J-Fed Changes the Law

Mope-rah must be back on her meds - she's making sense again. And reading the blog evidently:
  • Cuello should have known what was going on in her condo, just like all the other landlords in Chicago are expected to know what's going on in their rental apartments.

    They don't get to plead "I didn't know" when fed-up neighbors finally contact the alderman or complain about the problem at a CAPS meeting.

    These residents expect property owners to carefully screen their tenants and move quickly to evict problem renters.

    So how could Chicago's top cop, the guy who was supposed to clean up the police department, defend his top brass for doing less?

    "I just don't see where there is any culpability," Weis said.

Read that last line again:
  • "I just don't see where there is any culpability," Weis said.
Good job J-Fed! You just wiped out at least two entire chapters of municipal ordinances aimed at a landlord's responsibilities under the nuisance abatement laws AND gave any defense lawyer worth his retainer fee the grounds for releasing not only building property, but automobiles used by third parties to transport drugs, guns, fireworks, prostitutes, etc, from any fees, fines and attachments that might have been levied against them by Ordinance.

That budget hole Daley's been talking about? Do you think it's going to get a bit bigger if lawyers start using J-Fed's words in their defense arguments and appeals? We do, and it's all courtesy of J-Fed's embracing two different standards of accountability.

the entire Cuello incident is disgraceful...will lawyers be able to use some J-Fed statements as a defense?...maybe in an honest court system, but not in Cook County, where the judges are selected and retained by the Daley machine...justice is bought and sold (wholesale!, but you know, the economy is bad) by who you know, who the State's Attorney decides to prosecute, etc.....BAU! (business as usual), friends...

February 19, 2009 (CHICAGO) (WLS) -- Students at DePaul University held a pro- gun rights rally Thursday.

Their organization is called Depaul Students For Concealed Carry On Campus.

Organizers want to help students get a Firearm Owner's Identification Card. They say it's time Illinois passes legislation which allows citizens to protect themselves.

The organization claims there were 40 assaults and nearly 900 violent crimes in DePaul's police district last year.

This is just one of the many reasons why the morale is so low. It's the same old same old. Differnt rules for different folks. Business as usual BS! We all see this and just laugh. Any average joe working copper would have been hung out to dry by J-Fed and his clan. For the average Joe the press statement would have read more like this.

"We are very disappointed with the behavior of this officer not being in control of a property he owns. We hold a very high standard for our officers and he will be stripped of his police powers and assigned to desk duty during the investigation. The individual arrested has an extensive back ground and history with law enforcement and we will be looking into how much and exactly what the officer knew about the illegal activities taking place in and on his property. We are constantly fighting against gangs, guns, and drugs and anytime one of our officers is involved in a situation like this we take it very seriously. I have directed asset forfeiture to look into seizing the property that was used for selling the guns and narcotics. Rest assured no special treatment will be given to this officer because he is a Chicago Police Officer."

This is how the story would have read to the average Joe. How can we support and trust this gang of fools anymore? B Cuello is our boss? HAAAAAAAAAAAAAAAAAAAAA!!!!!!!

A/1 problem building officer should investigate this incident the same as any other. If this is an isolated incident, D/S should be formally notified that the crime occurred at property she owns. If it is or becomes a chronic problem, measures should be initiated to seize the property.
As far as the daughter. If there is no evidence, such as her fingerprints on the weapons or narcotic packaging, she should not be charged. The boyfriend admitted to the possession, stated his girlfriend had no knowledge, and she can't be connected to the contraband.
Ask anyone who has executed search warrants. All present do not go to jail. Only the person named in the affidavit and those at the scene where evidence can connect them to the illegal contraband.

Gotta give MM props on her latest column, she definitely nails it down on this subject.
Looks like the gloves are off with regard to the media and J-Fed now.
First Steinberg, now Mitchell calling on J-Fed to step down.
The J-Fed express bus "back to Philly or wherever" has definitely left the station. The bad thing about this is, if Cuello steps down, then her hubby Cmdr O'Donnell, a good man and a decent boss, will have no protection, and will likely wind up on J-Fed's chopping block at sometime in the future.
WEISel has already derailed the careers of several good exempts already. How long this bullshit continues is anyone's guess.

I'm not sure what the rule number is, but isn't bringing discredit to the department a rule violation? It was in every newspaper, TV station in chicago, and made it to national outlets. I think it may qualify for this.

Even if it doesn't qualify, I'm still pissed that an investigation was not even conducted. Just swept under the rug while everyone else would be rotting away at callback for years.

Now I'm going to go to work and watch the, "We've got your back video" and bring in the numbers for you boss. Yea, that's what I'm gonna do.

If she had any integrity or self respect, she would have at least retired by now.

I am willing to bet even with the strictest penalty - which is probably a fine??? - that there is not a judge or a educated professional in their right mind that truly believes it is appropriate that Ms. Cuello should be placed in jeopardy of losing her career over this incident. i am more concerned at this point as should any concerned parent and the Chicago Police Department that her daughter, being part of the "police family" is properly counseled to make the choices that keeps her out of harms way before something more serious occurs. It could be one of your kids some day and it could be a lot worse. Why don't you take aaaaaaaall the energy focused on reasons why morale is so low and come together with some grand effort to make me and a lot of other people believe there is a sign of life out there. I want to hear more positive talk. I want to see more positive PR. When I read some of this stuff, I swear many have really given up. My father once told me quitters never win and winners never quit. Don't ever give up on what you believe in which is the reason I hope many took this job in the first place. Now have a good day dammit.

Every single policeman I talked to these days is more than unhappy with the way things are going. I not talking about the usual complainers who will always hate their jobs, I'm talking about good policemen, beat guys, tact guys, people in nice units, supervisors. It seems like all of them can't stand this new superintendent and have a "its not worth it" attitude these days. I completely agree with them, unitl the City gets rid of this idiot and starts treating the CPD with a little respect. I am done doing anything.

At a time when it seems that almost every city employee is running around with a parker book and the city is crying broke he should have been made to pay up. The reprecussions already flying in 014. Of course the daily stand up roll calls and coming in late will solve everything. How low has this Dept. sunk? Dragging a whole desk crew down to IAD to find the mystery faxer on the 19th. The scandal is that the police department publicly closed an investigation into an on-going criminal conspiracy to sell guns and drugs in the city because one of the accomplices and/or witnesses is the daughter of the Assistant Superintendent.

A conspiracy involves the seller (arrested), the buyers, the original suppliers, the transporters, the safehouse protectors (daughter) and owners (Aunt Bea).

Here is one of the most serious crimes that local law enforcement is sworn to prevent, the transportation and sale of drugs and weapons within its boundaries, and the Chicago Police Department will not even question two people involved because one is a high ranking police supervisor.

Absolutely not true.

It is most likely that these two shared a bedroom and it is very likely that some contraband was located in that room. If that is the case, then there was certainly probable cause to arrest Bea's daughter.

That Probable Cause would only dissapate if the subjects were BOTH interviewed and after those interviews the officer could determine that the daughter did not know about the contraband. Then, she could be RWOC at the WC's discretion.

However, on-scene prior to those custodial interviews there was very likely probable cause to arrest the daughter.

Whether or not there is enough for a conviction is not a judgement for the police. Police make arrests when there is probable cause.

Here is one of the most serious crimes that local law enforcement is sworn to prevent, the transportation and sale of drugs and weapons within its boundaries, and the Chicago Police Department will not even question two people involved because one is a high ranking police supervisor.

His biggest problem occurs when he has to be spontaneous. The FBI does not do things quickly. As a result, their people don't seem to be able to think quickly. Dumb things are said, under pressure, when he does not have the time to think through the ramifications of a short flippant statement.

According to WMAQ, the feds are letting CPD conduct the investigation and will respond accordingly once it is done. They stated there were NO threats against the President, however derogatory comments were made.

I'm sure they'll slam somebody for 'conduct unbecoming' and misuse of department time or some such nonsense, but really this doesn't sound like as big a deal as people want to make it.

Shocking, but the right to free speech does still exist in this country.

Wow, am I right to believe that most posters here are cops? Most of you seem clueless as to the laws you are hired to uphold, and not compassionate enough to protect (another of your duties)the citizens.

The law do NOT call for immediate siezure of someone's property unless they had knowledge of the illegal activities going on. Anyone that knows Bea should know that she had no knowledge of these activities, unless she is the CI.

If the person named in the search warrant admits that illegal contraband is his/hers, all other parties present are released, unless contraband is found on their person, if no outstanding warrants exist in their name.

Damn, doesn't the public rip on you enough? Do you have to trash each other too. I personally think that is far more damaging to morale than anything a boss can do to you.

I hope those of you trashers that have kids don't end up eating your words someday. No matter what we do, they don't always grow into the adult we invision when they are young.

On a different post some discussed Hamilton and his boys, and the popes. I remember back then another pope, a cop's kid, gangbanging and accidently killing two young girls. Don't know if this site existed then, but I certainly hope you weren't calling for his home to be siezed (the kid lived in Dad's home) or his job to e taken. Where is the love?

It is not important what you or I believe. It's where the evidence leads. As neither of us were there, I defer to the officers who executed the warrant. At this point their investigation did not establish probable cause the daughter had knowledge of the illegal contraband. Should further investigation prove different, her fingerprints on the weapons or narcotic packaging or pictures of her with the recovered items, then an arrest warrant should be obtained and she should be charged accordingly. Until then, there is no reason to question the integrity or professionalism of the officers involved.

That is not true AT ALL. She called all the political people she knew first and a few ministers. On top of that, the Hispanic clergy refused to get involved in any way. They blatantly informed her, since you are one of us and one of few Hispanic Exempt members, we will not hurt you, but we are not helping you. I also know she contacted at least 1 would be political supporter. I personally got a call not long afterwards with details of the circumstances prior to anyone from the department saying anything.

The resignation PR ploy was told to an Exempt close to her a few days later in an effort to help Jfed recover from this embarrassment. What was told to him was, allow Asst. Supt. Cuello to publicly say she offered her resignation and then Jfed was to come back and say in summary "he would not be accepting her resignation at this time. He would allow the investigation to proceed and all facts to be documented. Once the investigation is over, we will see what direction the department needs to go regarding the Asst. Superintendent." He was then to comment on some level of her responsibility changing to fall within the CPD guidelines and historical response to situations like this. The reality is if it were anyone else, they would have faced departmental sanctioning until the investigation was over. Some people stay in call back for years for far less!!!

Since Jfed's stupidity and incompetence as a representative of the greatest police department in history, he came immediately out and said he supported her and she had no culpability in this incident. It was too late to do what was suggested. He put his own foot in his mouth. He could not save his ass or the department due to his arrogance and inexperience as it relates to dealing with the police. He WILL go down in history as the worst Superintendent of CPD!

Maybe if you surrounded yourself with people that were actually knowledgeable of police procedure and our historical response, you, the Mayor and this Department would not be looking so stupid right now. We will NEVER get anywhere with you here, no matter how stubborn the Mayor is and no matter how much you promise to take care of Carother's people so he would lay off you and not really hold your feet to the fire. He is doing just enough to say he responded and took action. Lets look to see his brother, Sorry Lt. Anthony "Tony" Carothers of the 2nd District Tactical Unit get promoted real soon!

Regardless of how you feel about her, she was 100% on the money.
I'll even say that most of the time when she takes a swipe at us, we actually deserve it, because we've left our dirty laundry hanging out on the clothes line for all to see for quite a while now...
As for the warrant....while I can't say I have always taken "all residents/occupants to jail" when serving a warrant, if the actual lesse/renter/owner is on the premises, and contraband is found in areas of common access, whereby the lesse/renter/owner would have had to see it or have knowledge of the illegal contraband or criminal activities due to the amount/size/quantity, then I would be obligated to arrest him/her also. It's not my job to try the case, if a judge feels different, he can absolve them of any guilt.
It's common knowledge that while Aunt B is claiming "no knowledge" about the contraband, there was no way for the daughter to make this claim, based upon what was recovered and where it was. That and the fact that (again, from what's common knowledge at this time) the daughter "showed her ass" (acting out, hostile, etc.), she DEFINITELY would have had to make that trip to County Jail. She was cut a BIG BREAK, one she clearly didn't deserve, regardless of who "mommy" is.

I am not second guessing the officers. They are the ones who make the call in the very gray area of probable cause. Certainly, the daughter is on the fringe.

I'm just disagreeing with some of these limitations people are throwing up regarding search warrants.

No, not everyone should or even can go to jail.

But, a person doesn't have to be on the warrant to be arrested.

The target always goes because the warrant connects him to the home and the contraband. Even if there is no mail with his name on it and even if he has no clothes or other property in the home.

For others who are present, a big part of determining probable cause is WHERE the contraband is found. If its found in someone's bedroom with all their clothes and other property, then that person can be arrested even if he wasn't named in the warrant. If its found on a kitchen table that four people are sitting at, then they all can go.

The big Cook County lie is that two people can't possess one thing. That rule only exists in the felony review unit of this backwards crooked county.

If Bea's daughter lived in DuPage, she probably would have been arrested and convicted.
