Long Week Ahead

Baring some unforeseen circumstances, the Abbate trial starts Monday. That means the media will be running the infamous footage of him throwing haymaker after haymaker and missing just about every single one.

And again, while we and 99% of our readers condemned the actions of this asshat, we roundly objected to the felony charges that were based on nothing but political considerations. Look at what this person who never should have been hired in the first place has wrought on the Department as a whole.

In any case, if you have blood pressure concerns, avoid the news for a bit.

I've watched that video a hundred times she approaches Fabbatte when he enters behind the bar and intentionally makes first contact.His only defense would be that he being in a drunken state, seeing double, thought that there were actually more than one aggressor and fought for his life or the next round of drinks which ever came first.

did the ASA offer a pre-trial plea? nobody condones this actions but....agg. battery? where is the great bodily harm? how many times have we been denied getting these charges unless the victim is almost dead? how many times did i hear '' make it a misdemeaner battery kid'' when a guys head was busted open? this is a case of drunkin stupidity not agg. battery.

Abbatte is a goof but this does NOT warrant felony charges. Political considerations. The only, and we mean the ONLY, reason the ASA charged the felonies was because the asshat was a Chicago Cop. No other reason. In 100 out of 100 other cases, this is misdemeanor battery.

Should he be fired for conduct unbecoming? Yup. He never should have been hired due to his background, but this Department isn't willing to expose the clout that got him a badge.

Should he be fired for any other a a half-dozen violations of the law and rules? Yup. You aren't going to find one iota of support here.

Should he get jail time, community service, maybe a fine? Sure. All appropriate punishments.

But years in prison? Sorry, we wouldn't advocate that for a regular drunk jackass in a bar.

Sorry your world view is so narrow that you don't see the big picture, but political prosecutions like this make a mockery of the law in general and diminish the chances of real victims getting a fair shake in the system.

You know why he disagrees with the felony charges is because everytime some shithead on the street uses one of us for a punching bag, we have to beg for felony charges and if they are approved by the ASA's, when it comes time to court, the charges get busted down to a misdemeanor or get a plea deal.

I was seriously injured on a call and the ASA had the balls to flippantly ask me if how far do you want this case to go. She really didn't seem to give two shits that I would be in pain for the rest of my life and this bartender really didn't get injuried at all.

In no way am I defending abbatte because I've always thought he was a stroke, even before this happened.

That's why.

You are probably right that very few bar fights would result in felony UUW charges, but the agg battery statute would appear to allow for it.

(720 ILCS 5/12‑4) (from Ch. 38, par. 12‑4)
Sec. 12‑4. Aggravated Battery.
...
(b) In committing a battery, a person commits aggravated battery if he or she:
...
(8) Is, or the person battered is, on or about a public way, public property or public place of accommodation or amusement;

A bar would appear to be a place of public accomodation.

Question...in the event if you as a police officer, in the bar at the same time this all was going down....would you have stopped this from happening? There were several guys there just looking on.
No this man, although a city finest, should not given a prison sentence. What is fair is fair and it should be carried out the same as a civilian.
I think the whole disgust with the public is that a Chicago police officer was beating up a girl. A girl. Much smaller in size then he. I think the public sees the big guy beating up the little guy. You know, I know, the public knows too that a police officer is to protect, not cause the problem. Yes, I too understand that this one was not be on the force. I understand that there are far fewer of these types. I am glad of that too. With this happening, it only makes your job that much tougher. More difficult. But as a citizen of Chicago, I am really glad that we have some very professional officers out there doing what they love to do. Help.

SCC, I enjoy your site even though I only agree with it about 50% of the time, but I felt compelled to comment on this post.

Either Abbate is an "asshat" "who never should have been hired in the first place" and is unworthy of any support from you & the rest of your fine brethren (and sisteren, if that's a word) in blue... or you're on his side because his "haymakers" missed and you don't think it's fair he should be facing felony charges for his actions because it's "political."

You can't have it both ways! This guy is scum, he's one of the reasons why people fear & loathe the police, he's not what good cops are about & stand for, and he should go to jail for years... that's the point you could have and should have made.

I'm for cops, the good ones, and you missed an opportunity to show that you are too.

We are for equal treatment under the law. Cops are not above the law, but they aren't below it either.

Lord forbid one day we have to appear before a judge or jury and this incident colors the entire experience of those sitting in judgment.

You can't have two standards. He was off duty, not in uniform, and not representing the City or the Department. The laws have no provisions for increased penalties for what your job happens to be.

There is no "separate but equal." Are you seriously advocating a return to those days?

Was he on duty when he used his position as a police officer to intimidate the victim and witnesses?

He didn't just attack a woman half his size, he attacked the entire basis for the criminal justice system.

If a gang member who tried to intimidate a victim and witnesses would be charged with a felony, why shouldn't he?

Now he's claiming that it was "self-defense" and that she "threw him around like a rag doll."

You have every right to defend this cur. You have NO right to be respected for it.

You can't claim off duty out one side of your mouth and then claim on duty 24/7 when it is convenient out the other side of your mouth.

To me the most troubling part of this whole thing is not that an idiot beat up a defenseless woman, but that a bunch of cops appear to have made serious efforts to help him avoid his just reward for his behavior.

Police did a line up next on yesterday for two witnesses. One witness picks out the driver, the second witness picks out the wrong person. States attorneys want police to substitute another person and give the witness a second chance to pick out the offender. Police refuse to go along. S/A's get mad and start to yell at police. Police continue to refuse to go along with the state. States attorneys are huddled in corner and overheard stating that they are not to trust the police and not to interview witnesses unless states attorney is with the police, because police notes are inaccurate and not to be trusted and say what the police want them to say. 2 incidents are as different as day and night. One is an out of control alcoholic on a rampage. I don't care if she is allegedly stealing his money. However the letter of the law wasn't followed in sentencing therefore this will be appealed so plan on seeing that awful video for many years to come. Second incident was a typical Chicago bar fight between consenting adults. The losers were just babies w/law degrees. And I'm proud to say, not related to me.
