Danger Will Robinson! DANGER!!!

  • In a case some argue could throw open the long-standing secrecy behind police internal investigations, the 4th District Court of Appeals in Springfield has ruled internal affairs files are a public record regardless of the outcome of the probe.

    Attorneys specializing in Illinois public records law said Thursday it is the first such ruling of its kind in the state and therefore binding on trial courts statewide. It could also have repercussions for long-running complaints about Chicago police brutality.

Great. Compelled testimony rears its ugly head again. Remember, you have less rights in an administrative investigation than a criminal one. You are ordered to answer questions. You are ordered to testify give information against your own self interests. You are assumed to be in possession of facts and recollections of incidents merely by your presence on a scene.

And if a single error or omission can be attributed to anything you put on paper, you will be fired.

Not only that, the bottom-feeders are going to use this civilly to ruin cops across the board. Anything you own, anything you've worked for, anything you've accomplished by dint of hard work serving and protecting is going to have to be sold, pawned or given away to defend yourself in a Crook County courtroom with a juries who already give felons millions.
  • The Sangamon County Sheriff and the State Attorney’s Appellate Prosecutor—who argued the case—have 35 days to decide whether to appeal the ruling to the Illinois Supreme Court
The Local and State FOP better get on the ball here. The National Lodge might not be a bad idea either.

Contrary to what the article says, the 4th District Court of Appeals has little precedential value to Chicago.

You only have to worry if the IL Supreme Court Rules on it, then it affects the entire State.

I have found that without a contract, I have lost the incentive to be aggressive and pro-active and THAT, in turn, has gotten me ZERO CR's.

This ruling is sure to convince more in our profession, here in Illinois, to follow the same, sensible, "think of me and my family first" program.

The lawyers and judges will cause the destruction of our society as we know it. They make the rules and then make them unconstitutional.

Many years ago, I went to a IACP training where the instructor said that IAD records have been open records (after the investigation is over) in Florida for a long time. At that time, he didn't think that it had had too much impact but then again, things are more adversarial here than most places.

Anyone had a friend or contact in Florida who might know how this is impacting cops there?

The FOP lawyers need to start advising officers that any testimony given will be held against them in a court of law. We will have to have a test case where an fficer refuses to give a statement after being given administrative rights, I dont believe the city will be able to fire you for refusing based on the recent court rulings but I also dont want to be the guy to find out.

The process of policing a city includes the longstanding tradion of RIDICULOUS allegations placed against officers on a daily basis.
any allegation within the last two years should be reviewed and arrests made if they are found to be false. that'll close this problem quick

First, this is a three judge panel decision from the Illinois 4th District Court of Appeals (covers the middle part of the state near Urbana). Not the nucleus of legal thought in the state, let alone anywhere else. I'll bet more than 90% of all cases heard in that podunk appellate court are farming contracts.

Second, this decision has not been heard, maybe never will be heard, by the entire circuit (all 7 judges). Even despite that, the case is only law for other districts until any judge in any one of them says it ain't the law here.

Third, police are generally sued in federal court, something that almost always follows a complaint where the complaintant could give two shits how the internal investigation concluded. In these cases, the federal judge would control whether the investigation reports would be publicly released and no Illinois appellate court, not even the Illinois Supreme Court, would even have a say in the matter.

Rulings by judges capture too many headlines. Judges have power over you when you are standing in front of them. If you are not in front of them, they generally have no control over your life. That pleasure falls to the crooks that you elect to lead you. They are the ones in control.

For example, when your citizen friends ask you why they can't carry a concealed firearm, don't look to the US Supreme Court for help. Look no farther than City Hall and the Illinois governor. They're the ones standing in the way of your rights.

Today we are working in some very scary times! We do not have the support of our bosses, immediate and 35th brass. We have a Sup. that was not a police officer. We have an IAD boss who was not a police officer. We do not have the supoort of the public. We're dammed if we do dammed if we don't. We have a police hating, unprofessional, racisist president who makes terrible statements about something he has no facts about. He then throws more fuel on the race flames when he should be making no comment at all. Especially as the PRESIDENT! Obama has shown all of us how he feels about race and the police.

Now we have a liberal court system that makes special and unconstitutional rules for us. What's next?

Local and state FLOP are basically useless. they have so much membership to hold protests, picket, etc; but never really do shit on their own as far as organizing any kind of protest. First of all, this will be appealed. Secondly, these records are already subject to discovery, so they're available to plaintiff's counsel now (and have always been). Thye real implication is that these records are available to anyone filing a "Freedom of Information" request. Still potentially challengeable. This issue is far from settled.

Here's something to think about -- cops are almost always sued for civil rights violations in Federal NOT State court, amirite? You can't possibly think that Loevy and his ilk will all of a sudden start bringing their claims in State court just to get access to these newly "public" records, do you? Trust me, it'll never happen. These lawyers already get whatever they want in terms of disciplinary/CR files from the federal judges. The ruling, while troubling, does nothing to change the landscape. Cops are at no greater risk today of being bankrupted by a judgment than they were last week. Get real.

This is stupid beyond belief. An investigation based on accusations is a public record even if the investigation shows the accusations to be bogus, unfounded, or just plain damn' lies? The fact that an internal affairs investigation isn't something where the accused's rights are protected should make this a NO GO of the first order. If this decision stands, you guys may as well all quit before you lose everything you ever hoped to own.

I conducted several Article 32 investigations (the military version of a grand jury with only one member) before I retired from the Army, and the Privacy Act prevented information from being released to the public even if I found the charges to be supported enough to recommend that they go to Court-Martial.

I completely agree with this. 95% of your lawsuits are going to be federal lawsuits. ive been sued 12 times in my career and everyone of them has been federal. in federal court anything is discoverable and admissable including cr#s, the investigations and the outcomes. this really is nothing new at all. ive had almost all of the cr#s come up in federal court and they try to make a big deal about it. nothing new here. plus, just because an appellet court in springfield ruled it does not mean it applies to us. it does not apply to us... yet. if it goes to the illinois supreme court and they rule in favor of it then it will effect chicago. until then, nothing will happen. and dont worry, if this goes back to the illinois supreme court...again it will be shot down. this issue has gone infront of the supreme court many many times and its always gotten shot down. lets not start worrying yet boys and girls. its sounds worse than it is... try not to step in the bullshit too much, youll ruin your boots boys.

That case already happened - many years ago - and the firefighters who refused to give statements under admin rights on the advice of counsel were fired. The firings were upheld. No FOP lawyer in his right mind would ever advise an officer to refuse to give a statement under admin rights. Leave that crazy shit to the PBPA lawyers. After going thru what a certain PO went thru a few years back...I'd rather trust Obama than some of the P.O.'s on THIS department...half of the witnesses against him have been indicted or fired or resigned...Wanna guess WHY???

WRONG! out of everyone that was being sued the two retired dicks got hit with $66,000 each in punitive damages. The city got hit with another $150,000 plus legal fees of over $600,000.

People you are missing the point of this ruling! This info will now be available via Freedom of info. A clever defense attorney will be able to use this info as defense exhibits to help get his client off. They will be able to question you about other beefs (ie. "this is a public record your honor") in defense of joe gangbanger in criminal court and then use your statements against you in a Fed lawsuit. This is the Burge tactic, but it will be able to be used in every trial. This is scary!!!

Sorry, you're both wrong. The City was hit for over $100,000 in compensatory damages. Those are the ones paid for with your tax dollars. The two detectives were hit for a little More than $66,000 each. Still think all cases should go to trial?
