Three Years

  • The Arbitration process has begun.

    Below is a list of the actions that will take place in preparation for the process.

    August 28, 2009

    City and Lodge agree to Arbitrator Edwin Benn as impartial member and Chairman of Dispute Resolution Board. The Lodge appointee to the Board is FOP President Mark Donahue. The City appointee to the Board is David Johnson.

    Scheduling & Process

    We will meet with the City and the Arbitrator.

    1. A list of Disputed Issues will be filed.

    2. Meet for oral discussion of Disputed Issues. (Background and Education for Arbitrator on the Issues)

    3. Based upon feedback given by Arbitrator and any change in City position, the Lodge will submits its final offer on the Disputed Issues. [The Lodge will propose 4-6 weeks for all of above to occur.]

    4. Parties will submit briefs in support of their final offers. [Lodge will propose 30 days for briefs to be filed.]

    5. Parties will file response briefs to the other party’s brief. [Lodge will propose 2 weeks for response briefs.]

    6. Mediation sessions will be scheduled with the Arbitrator. [If the foregoing schedule is followed, Mediation should occur in December. The number of mediation dates will depend on the number of Disputed Issues.]

    7. At the end of Mediation, the Arbitrator will determine whether he requires further evidence on any Disputed Issue. Parties will also advise Arbitrator if they want a full hearing on issues of Wages, Health Care, Discipline or other issues.

    8. If the Arbitrator does not need any additional evidence and neither party requests a hearing, the Arbitrator will take the matter under advisement.

    If additional evidence is necessary and/or a full hearing is required, dates will be set. [It is expected this would occur in January 2010. If additional hearings are conducted, post hearing briefs will be prepared.]

    9. We would expect an Award to issue in March or April 2010.
So when the Contract is finally presented to the City Council and voted on, we'll either be one year out or (on an outside chance of a five-year deal) two years from expiration. It sure would be nice if the FOP could point out the City's inability to negotiate in good faith from the get-go based solely on the recent "negotiations." This is ridiculous.

If Chicago wins the city will settle and attempt to obtain a five year contract.

If Chicago loses the bid, expect the city/Mayor to rake us over the coals as hard as possible.

Mark Donahue better not use Gary, Indiana or any other Indiana department as a comparison.

Indiana is a "Right To Work" state and they pay ridicuously low wages/salaries.

All exempt rank officers in Indiana retire at their last patrolmans salary, regardless of time in rank.

There is nothing like your own union selling you out.

A little tid-bit...

When the smoke clears in March or April and the retro checks are on the way, it would be nice if we would be paid the interest accrued on OUR money for nearly 3 years.

We recall being in consultation with someone from IRS at the conclusion of similar goofiness a few years back. The question was raised as to why retro was taxed as a windfall when taxes were paid on the money anyway i.e. what ever the difference is between the old pay rate and the new one.

Any experts want to weigh in on this?

It is a sin and a shame the Police have to go through this. We reckon being the peace makers in this city isn't such a blessed thing after all.

do you think the teachers would have waited three years--- hell no, it would have been a strike vote... we unfortunately do not have the option to strike so we do other things, ticket slow down, quit killing crime, hit the medical more often, lay down on jobs, bitch on this blog.... at the end of the day the city will give what it wants to give, nothing will change that.....

I certainly idealize the FOP is going to present a lot of "evidence" of the city crying poor mouth; Whereby they'd saved tons of money not hiring 200 new hires they'd promised before the millions of federal grant monies for the new "30" officers.

That they're buying land for the "olympic village" at a time "reportedly" the Olympic location had yet to be determined.

That they'd laid off so many city workers, then awarded a $3 million contract to the Teamsters, to do what the laid off employees were doing .

If we belong to the FOP why don't we ask them to send us some top notch people to negotiate this for us. Would it not be in their best interest to show other departments around the nation that they can get a good contract for a city as large as chicago? Like the union that represents NYPD did. If we lose out on this one why would any department want FLOP to represent them? Why even pay dues and have a union? we only get what the city offered in the end. Tell me that's not true, look at the last 2 contracts. And we should use New York and LA as examples not Gary which is only as large as one district. What union represents New York? I say we switch to them look at the contract they got. FLOP does not care because they know we are suckers and would not ever push them out. We are pussys, I say fuck them if they do not get us a good deal this time and switch to the union that represents New York, thats good business.

Two weeks ago I was at the retirement info meeting and even the city pension guy said they are prepared to cut retro checks to the people who leave in the next year. He said that your health care is good to go to medicare age. FOP, city benefits office and pension board all say you have health care past 2013 but listen to the rubs instead! Buy out checks, retro checks and widows pension - I’m rolling in dough. If you can retire at 75% go for it. You’ll live a lot longer if your don’t have listen to Wayne, Sean and Jagnuts and the rest of the rocket scientists you see posting here. Maybe get off your ass and go to a meeting and afterwards if you don’t want to make a ass of your self at the mic ask some questions one - on - one. Either way this is not the same group of peple I came on the job with 31 years ago. Now all we have is muscle heads and pea brains.

I don't know what difference any of this would make, even if it were true, but Indiana may pay low wages, but it is definitely NOT a right to work state. I didn't know they had exempt ranks in Indiana.

They both have me too clauses. If FOP gets any money, so will they. They just won't pay out of their pockets to reap the rewards, they ride for free on our shirttails. It's the cheap way out. Why fight for a raise, when you can get it for free with FOP?

I am all for ending the exempts dipping into our pension fund for their gold braid pension bump.

Sorry, there is a 50 percent chance to be correct on this, and you are wrong. Illinois and Indiana and most other heavily industrial states are NOT right to work states. See this link: http://www.nrtw.org/rtws.htm. Just like everyone else Exempt rank personnel pay in at their current pay grade, and collect in the same manner. By the time you figure out the City's double contribution on the part of everyone, the Exempt pay-in helps keep the pensio afloat.

I agree, the tactic of drawing out the inevitable arbitration process looks like another joke. I say inevitable because FLOP was content from day one of negotiations to play footsie with King Dick the Two's agenda. It's a good thing for the City that the FLOP made such an unpersuasive argument about the City's lack of good faith negotiation during the last contract cycle. You remember, the contract that resulted from binding arbitration? Just like this one will?

Do you think they can force the city to negotiate in good faith? You want to strike? Then you should not be a cop.

Thanks for the excuse filled pep talk. You know how to tow the company line. You're right, I shouldn't be a cop, I should be a FLOP hack. It pays better and is less stressful.

Be careful with the FOP and arbitration. I previously worked for a dept. that had the FOP and we got our ass handed to us twice at arbitration. After the second time we got rid of the FOP. We were in a similiar situation with crap benefits and below average pay. They took away our comp time the first time and the raises we got were nothing to write about. The second time they jacked up our health insurance 140%. Hopefully your lodge has their stuff together or prepare to get screwed.

It's time to think about changing the makeup of the FOP. We need to sell the building, put the money in the membership fund, limit board members to 7, and only have one vice president. The salaries paid to Donahue, et al, is what keeps them from securing a contract for us. Why bite the hand that feeds them? Get rid of all the baggage for the good of the membership..

2 years and 9 months without a pay increase while the teachers and most city union workers received a 4 % raise each year for 5 years
also receive 80 % pension

city takes care of cpd that are rewarded pay raise by merit promotions

FYI: The Lt.'s have not approved their contract at this time. The password protected information is only for members to view the proposed portions of the pending contract. The ballots have been sent out and should be counted by the end of Sept. Believe it or not, when it comes to dealing with the city, all the non-exempt ranks are pretty much in the same boat: Screwed.
