Fantasy Lawsuit

  • The estate of a convicted felon fatally shot by police in March filed suit Friday against the city and the individual police officers.
Whoa whoa whoa...the estate? Of a convicted felon? Red flags all over the place to begin with. It gets more unbelievable as you read on:
  • The lawsuit claims officers [#1] and [#88] entered the home of Matthias Mayhorn without permission on March 10, threatened him with injury and/or death by hanging him by his legs out of a second-floor window, fired a weapon at him while he was hanging out of the window, dropped him onto the pavement below and delayed in summoning medical assistance.
Uh, yeah, right, sure. It happened exactly like that. The other side of the story:
  • According to a police news release, Mayhorn, 28, a convicted felon wanted on an investigative alert, was attempting to escape via the window when he aimed a gun at the officers, who then fired multiple shots. The shots knocked Mayhorn to the pavement below his window.

    A gun was recovered from the scene, and the incident is under investigation...
Call us slightly biased, but we kind of believe the second version there. Hanging people out of windows? Shot at him while he was hanging out the window? In a Hollywood script maybe.

The trouble is, of course, Cook County juries.

Get another petition going. If a lawyer brings a b.s. case forward, and the case is easily proven to be b.s., the lawyer is liable for civil penalties both in cash and their law license. The ballistics alone should prove the case based on angles of entry/exit.

Are you kidding me?

You must be a hair gel if you've never hung someone out a window before. Of course, I know it is now against the rules. But back in the day, what a tool for law enforcement!

Today you warn people that police intervention is imminent by yelling "TASER!, TASER!, TASER!". Back in the day, though, before those newfangled 50,000 volt "Taser beams" existed, we used "WINDOW, WINDOW, WINDOW!" as a warning.

My favorite was always glass block windows, but picture windows are good also. Once we forgot where we were and tried to hang a guy out a basement window. Boy, did we feel silly after that one!

The best one was hanging a guy over a railing above the Chicago river. He almost went "swimming with the fishes" when we nearly dropped his wiggly, slimy ass! (Note to future window hangers: DO NOT STRUGGLE WHILE DANGLING. Accidents DO happen!)

Then there were the five gang bangers spray painting the train while riding on the 'el'. We had them hanging out the train windows while we sped along at the speed of light, (or however fast those things go).

That's the ONLY time we actually dropped anyone from a window! In fairness, though, we didn't so much drop them as they were "taken from us" by a train traveling in the other direction. Funny, we used the same story on our reports that time, too! The offenders were trying to "make good their escape by fleeing out the windows of the train" when we announced "Stop, sir! We are Chicago Police Officers. Do not jump from those windows in an attempt to escape truth, justice and the American way", but they did not heed our lawful order to stop and exited the train via the windows anyway.

That was also the only time we ever called in the MiB (Men in Black), to use their "Flashy Thing" as we had a whole train full of witnesses whose memories needed to be "erased". What? You thought that was only a movie?

Anyway, I get all misty eyed when I reminisce about the 'good old days' and realize how all of you young kids missed out on things like the window dangle, and the black boxes, and Police Call Boxes, and beat cars with big 'bubble' Mars lights and no air conditioning.

Some day you will feel these same pangs of nostalgia remembering the joys of carrying a long or short stem radio instead of that Communications chip (C-chip) embedded in your skull. Or remembering those great old classic beat cars instead of going to jobs through a Star Trek-like Transporter Room. Or carrying that trusty old revolver or Glock instead of setting your Phasers to 'stun'.

Of course, one day, police officers will not be necessary as proven in the movie "The Day The Earth Stood Still", (rent the 1951 original. It's absolute classic vintage sci-fi, And talk about dialogue! "Gort! Klaatu barada nikto!")

The FOP needs to use some of that
5 Million Bucks in the Legal Defense Fund and start taking legal action against these BS Lawsuits..and also how about action against these Lawyers who file these lawsuits...I say take our Legal Defense Fund and sue EVERY LAWYER that makes a false claim...

I believe that the courts can sanction plantiffs and their attorneys for bringing frivolous lawsuits.

This would be a case to demand monetary damages and should also be brought to the attention of the disciplinary committee.

Don't laugh I did a traffic accident report for a "Sock" guy who got hit buy and killed by a car. Several years later I gave a deposition when his "estate" sued the other driver. I said "What estate, the corner of roosevelt and union"

30 years ago while working tact on the south side we tried to get into an dope flat.Could not get past the burgler grates. The two occupants climbed out of the third floor window to escape. One fell hard and broke his leg and was last seen crawling away. We just went out the back, got into our car, went to the station and then went home. Never heard another word about it.

Some greedy lowlife lawyer with absolutely no conscience hopes that some clueless Cook County jury will give him some kind of settlement.

There is a good chance he will get some insane judge like Lefkow, who will facilitate this rape of the justice system.

The Public cannot fathom how messed up things are in the civil litigation system and the politicians have no desire to fix things. I don't really wonder why. ($$$$$$)

The lawyers that attempt these thinly veiled blackmail attempts ("give us a quick settlement, we'll go away and you'll save the taxpayers in the long run") will get away unscathed. No suborning perjury charges, nothing.

Until these scumbags bringing forth this garbage are charged, fined or SENTENCED, they will keep stealing the taxpayers money.

I have talked to some cook county personal injury lawyers and it seems that there have been a lot of not guilties over the past year in the Daley Center. Juries have given reduced damages on solid cases.

Maybe the citizens of Crook County are seeing through the B.S....

I agree with you that lawyers are shitbags and only do what they do so that they can get paid. However, you're last comment "keep getting them numbers boys!" better not be a shot at the officers who were involved in the shooting. If it is, how fucking dare you criticize two officers who were put into that situation. I don't care how bad this dept. gets or how long we don't have a contract; if a shitbag points a gun at you, you light that motherfucker up.

The corp counsel can settle any case for under $100.000.00 without any other approval. If its over $100.00.00 it has to go through the city council. The lawyers know this so that is why you see a lot of lawsuits around $100.00.00. They lawyers settle, take their 3rd, then take "fees" leaving their client with pennies. The only ones who win in these cases are the lawyers.

Actually Einstein, the complaint is asking for damages "in excess of" (that means more than) $50,000. Almost like there is something important about that number. Wait, there is something important about that number - that is the exact amount of damages you need to plead to get into the law division in Cook County.
