Pension Board Meeting

Anyone have the info on Tuesday's meeting?

An entry in the comment section states that the retiree rep Hauser and the Lieutenant rep Maloney sided with the City appointees on a number of procedural motions:
  • Today at the Pension Board Meeting PO Mike Shields and Sgt. Mike Lazarro made 2 motions. 1 was for a vote of no confidence against John Gallagher, and the 2nd was to put a letter of admonishment in John Gallagher’s file for playing secret squirrel regarding Weis and Co. and our Pension Fund. All 4 of our ELECTED TRUSTEES were present, only 3 of mayors appointed trustees were present. Both motions were voted down because RETIRED PO KEN HOUSER AND LT. JIM MALONEY sided with Gallagher and the city’s trustees with a 2-5 vote denying the motions.
We also heard a rumor that the head of IPRA is in our pension somehow? Supposedly, Gallgher refuses to release any sort of list of who is actually paying into our pension and stunts like J-Fed and Co. sneaking in the backdoor demonstrate a definite need for absolute transparency regarding Pension Board dealings. These cockroaches have been operating in the dark for far too long and something needs to change in light of the sad state of our underfunded pension.

And evidently, Hauser and Maloney need to be removed by their respective voting blocs, too.

I'm sorry but I fail to understand why they shouldn't be in the Pension Fund. Secondly, I don't understand why anyone worries about it. None of them are likely to be around the 10 years required to vest so when they quit, get fired or die all they get back are their contributions anyway. Perhaps by having a stake in the pension, they will try and ensure that the fund remains strong, at least while it benefits them.

I'm sure I must be missing something, but I don't get it.

On Thursday morning, November 5th, I filed a complaint versus the Policemen's Annuity and Benefit Fund (PABF) with the Office of the Inspector General, City of Chicago, for allowing Jody WEIS, Michael MASTERS, Peter BRUST, Robert KLIMAS and Patrick DALY to contribute monies to the PABF. We are not dealing with five magnanimous philanthropists here. We are dealing with transparent weasels.

I then had a phone conversation with PABF Executive Director Gallagher. He stated that "an administrative misinterpretation (had) occurred" which has since been "resolved". All PABF contributions by WEISel and Co. "have been transferred to another (unspecified) City fund."

The day before, I had sent an eMail to each of the aforementioned five which reads as follows: "Get your filthy, fuckin', money grubbin' hands out of OUR pension fund, you imposters. Integrity, principle, honor, excellence and shame are foreign to your vocabulary." None responded.

To the other 217 unidentified recipients who received a blind (bcc) copy, I added "What y'all gonna do about Gallagher and Daley's four stooges on the PABF?".

In light of yesterday's PABF meeting and if the SCC account is accurate, I herein add the names of Kenneth A. HAUSER and James P. MALONEY to my previous paragraph. With prejudice, I call for the immediate resignations of Gallagher and Daley's SIX stooges.

Add to that PABF "counsel" David Kugler. (I will never forget you and Richard J.Brzeczek, you slimy rattlesnake.)

It's obvious that two of Daley's RATS have infiltrated two of the spots reserved for elected trustees that are supposed to be looking out for the best interests of the working copper.

Those of you who float blindly through your career, mindlessly paying into our pension fund better wake the fuck up, and quick. The millions given away to Daley's nephew with no results in our financial favor and the grim news about Pallohusky should be more than enough to open your eyes to what's possible concerning OUR money and subsequently our futures.

I don't know about the rest of you, but I expect a nice monthly check for many, many years after contributing to this cesspool of a job and city for what will amount to more than half of my life when my time to retire rolls around. And I've got a big problem with anyone who steals from me or threatens my family's well-being.

We ALL need to rally behind Mike Shields and demand sanctions for those who allow ineligible people to steal OUR money. It's high time the loopholes and those responsible for pimping those loopholes are exposed and punished accordingly.

As far as the Lt. goes, siding with Daley's group just put the nail in his coffin. He's a fucking dip shit for doing that.

Maloney was "appointed" by Daley a few years ago to sit on a board to study how to strengthen pension funds. He wrote this himself in the newsletter. Hopefully the Lts on this job will note this next election.

I'm in the same boat - I really don't understand what is going on here. What does the law say, are they allowe in the pension or not? What I do know is that Illinois Law requires cops to pay 9% (for fireman it's 9.25% I believe). Maybe Weis HAS to pay, and, if so, where the hell should he pay it? But maybe he can opt out of the pension, I don't know. It is not like the 9% is tax-deferred. I am sure it is not. So if he scoops up his 9% after 3-4 years, then why pay at all?

I don't get it.

I am retired and a member of the Retired Chicago Police Association. If the circumstances of the discussion and the vote are as stated in this blog, then I would want Hauser to immediately resign, not only as pension fund rep, but as President of the Retired Association. The retired association was a sleepy little group that was on the edge of folding due to lack of participation. Then, all of a sudden, new blood shows up, en mass, to run for the board. When I looked at the names, I knew something was up, as they were all retired officers who were active in the FOP. It was a way to influence votes, as retired officers can vote in FOP elections. But, truth be told, no one else has stepped up to help in the association, interest in running for office just is not there. And, for the person who commented that the retired officers do not care, you are really wrong!!. Communication with the retired officers is poor and many are just not in the loop. The retired newsletter is controlled by Hauser! I also wonder what FOP is doing regarding pensions? The names of the persons who are in the pension fund need to be revealed!!

Whateever happened to all those requests that Jesse Jackson sent to the 1st Districts Commanders office requesting special Police patrols at the nightclub? Everyone new it was a mini riot every time that bar closed numerous police shootings involving patrons of that night- club. Yet special interest groups do what they want and then scream its the police fault. The sentecing these individuals received was a very light sentence I wonder was the light sentence do to the defendants political ties.

I share this confusion. If they are not around long enough to vest, then the most they can get is their money back plus a small amount of simple interest. Of course, if they die, they would get the death benefit, and I don't recallwhat that is for active members. Anyway I said this in a previous post, I just wonder if being in this fund or another as stated by Mr. Northen is nothing more than a bit of a scam to avoid paying into Social Security. I am pretty sure that if I was already retired from the G, where I never paid SS, and am now employed at an exorbitant salary that I would not want to start paying into SS. It would be nice to get that 90,000 back at the end of the 3 year stint rather than letting it go into the SS and never really getting it back. At least that is what I would do.

Sleepy is a problemo for me too, and I tend to get gassy after Thanksgiving dinner. Uncle Kenny (ret.) reads me the riot act about my methane production every year. For family's sake, I may run for the bathroom a little faster this year.

Can't dump someone if nobody runs against him. Retirees who move(the sane ones)out of state better have mucho pesos to run. The retirees who stay in Chicago or subs must have one good person who can step up. I've got one name in particular who is very respected ( especially by this board) who would be a perfect candidate. I won't name him. You know who he is.

As a retiree, I would love to partner with Mike Shields and give integrity to the board and fight shortshanks at every turn. Nolan and his cabal virtually ensured Hauser's election, but now might be the right time to make a move on Kenny and eliminate a rubber stamp for shortshanks.

As I see it, John Northen has the right of first refusal, but if John cannot or chooses not to do it, I relish the thought of being a part of launching that shortshanks loving guy named Hauser. And fuck you Bill Nolan, you corrupt bastard.

He's not SUPPOSED to be in OUR pension, which is for vested officers... whatever he gets should come from somewhere else...most likely, hes gonna get one from the city and now hes trying to get a second pension from us (just like huberman did)....

The lawsuit between Block 37 developer Joseph Freed & Associates and lender Bank of America over a $128 million foreclosure is hard to follow, but a news report filed today on Crain's ChicagoRealEstateDaily.com may shed some light on the crucial question of which side the mayor favors.

The city originally appeared to favor Freed, threatening to punish Bank of America for taking Freed to court. David Roeder reported in the Sun-Times on October 23, "An influential alderman said he is considering whether to bar Bank of America from advising the city on bond issues. 'One might question the wisdom of using Bank of America on a future bond deal, given the circumstances,' said Ald. Edward Burke (14th), chairman of the City Council's Finance Committee. But the receiver, appointed by the court in response to a request by Bank of America, has an interesting new lawyer. According to Crain's, "John J. George of Daley & George Ltd., will have a billing rate of $350 per hour. Mr. George's other name partner in the firm is Michael Daley, brother of Mayor Richard Daley."

Anybody want to bet on who's going to win now?

Of course, the most important question for taxpayers may be: How much is this going to wind up costing us?

As long as there's a free meal involved he'll always vote the city line. At the Regular Board meeting of the Policemen’s Annuity and Benefit Fund of Chicago held on November 24, 2009, the trustees, in a unanimous vote, approved a transfer of salary deductions erroneously sent to the Policemen’s Annuity and Benefit Fund of Chicago on behalf of five Chicago Police employees who do not meet the total requirements to be members of this system, as noted below. The contributions will be sent to the Municipal Fund for the City of Chicago.
The Retirement Board of the Policemen’s Annuity and Benefit Fund will be holding a board meeting next Tuesday, at which time the Board is expected to approve a transfer of salary deductions erroneously received by the Retirement Board of the Policemen’s Annuity and Benefit Fund of Chicago (P.A.B.F.) to the Municipal Employees Annuity and Benefit Fund of Chicago for Chicago police officers serving in exempt ranks who do not have a civil service title of patrolman, sergeant, or lieutenant. To be a member of the PABF retirement system, an exempt employee of the Chicago Police department must have been, at one time in their career as a Chicago Police officer, in a civil service title. Though these officers were statutorily granted peace officer status here in the State of Illinois, they are still precluded from being members of the PABF because of this provision in Fund statutes, Chapter 40, Act 5, and Article 5-109.

Comment on previous post: Yes the Festival of Lights candles have a sticker over the Chicago 2016 logo. I was there and have several of these candles. When you turn them on and look at the sticker the 2016 logo is clearly visable.

I am in the last 3rd of my career and have earned my stripes and bars. I have lived my whole life in Chicago and hate to see what 2 decades of corruption, theft and mismanagement have done to the greatest police department in the country as well as this once great City.

Thank you SCC for being the only reliable source of local news and helping us connect the dots of corruption.

If the circumstances of the discussion and the vote are as stated in this blog, then I would want Hauser to immediately resign, not only as pension fund rep, but as President of the Retired Association. The retired association was a sleepy little group that was on the edge of folding due to lack of participation. Then, all of a sudden, new blood shows up, en mass, to run for the board. When I looked at the names, I knew something was up, as they were all retired officers who were active in the FOP. It was a way to influence votes, as retired officers can vote in FOP elections. But, truth be told, no one else has stepped up to help in the association, interest in running for office just is not there. And, for the person who commented that the retired officers do not care, you are really wrong!!. Communication with the retired officers is poor and many are just not in the loop. The retired newsletter is controlled by Hauser! I also wonder what FOP is doing regarding pensions? The names of the persons who are in the pension fund need to be revealed!!

what you don't get is that they do not need 10 years to vest, they are exempts, they get vested as gold braid in three years, then, if they go on to some other job that can be somehow tied to law enforcement they can pay into the fund and steal a pension at the their pay rate.

I'm in the same boat - I really don't understand what is going on here. What does the law say, are they allowe in the pension or not? What I do know is that Illinois Law requires cops to pay 9% (for fireman it's 9.25% I believe). Maybe Weis HAS to pay, and, if so, where the hell should he pay it? But maybe he can opt out of the pension, I don't know. It is not like the 9% is tax-deferred. I am sure it is not. So if he scoops up his 9% after 3-4 years, then why pay at all?

I don't get it.

Heres what youre missing

In order for an exempt member to be in the pension, he must have been in BEFORE he became an exempt member

So if Im a Lieutenant and I make Commander I can be in the pension because I was in it as a Lieutenant ( and presumably a Sergeant and a PO before that)

If I was with the FBI or the University of Kansas and then Im made an exempt member like Mr Weis and Mr O W Wilson then I CANNOT be a member of the pension fund


I didnt know this either until it was exp[lained to me by Mike Shields

This whole thing was a tax move...it IS that simple. On principle, I agree that they do not belong in the fund. In practice, their money would have just been more deposits into our fund. The likelihood of it helping the fund (more deposits) was and still is great than the likelihood that their actions would hurt the fund (one of them died in office = death benefit).
Simply put: Their contributions would have earned the fund a greater return, dollar for dollar, than the simple interest they would get whenever it was that they ended their contributions prior to being vested.
Knowing that they will never obtain the ten years of time to vest in the pension would have made it more tolerable.

Again, I agree that the principle is important and that they do not belong there...and that Hubermann is different because HE WOULD be able to get the 10 years in AND NEEDED to be prevented from vesting. The current crew would have gained a tax advantage...nothing more. Keeping them out did not hurt them at all.

If you are really interested in making a difference, figure out what the hell you are talking about before posting your two cents here. I support Mike Shields, but sometimes we have to choose our battles. This was not one that needed to be fought....and if our only goal is to send messages, well then, we accomplished that...but it was a message that they already were aware of and doesn't matter to them.

Hey Mike SHIELDS...want to make a difference? How about moving to allow ANY VESTED member paying into/receiving funds from the pension to be able to review a list of all receiving payouts. It could be an on-site review. But this would allow anyone vested to defend their interests through you, our representative.

Just an idea for accountability...but it has to start somewhere, right?

That isn't the issue so don't confuse it. The issue is not voting to bring transparency to who is contributing to our pension fund and a no vote of confidence on Gallagher. The pension board is running scared bc Mike Shields is uncovering all their bad investments and back door dealings and the rest of them don't like it.

There are plenty of smart people on this job, to include lawyers and accountants who are tried of the bad pension investments. I can manage my money much better then they could. So to all the Daley supporters and gallagher supporters, go fuck yourselves, so time is running out.

Our Pension problems are more than just J-Fed and his band of men in pink tights. Daley has set up a commission to study pension costs. They have never talked at their meetings about a two-tiered pension (new hires in a 401k) but several have done so in a newspaper.

We also have Mayor Chuckie’s nephew getting loans from the plan too. Last year our investments tanked just like everyone’s deferred comp did. This year if you stood pat you did ok and so did our plan. But we also have the city treasurer sitting on the Board and she is approving investment money for people who make campaign contributions to her re-election fund. That would be a huge conflict of interest in any city other than Chicago.

While these problems are not a good thing in of themselves, they will make it impossible for Mayor Chuckie to go to Springfield and change our pension to a 401k with so many dark clouds hanging over what he, his family, and his friends and appointees have been doing to our plan for years.

With the patrolmen making up so much of the money that goes into our plan should our vote be weighted more? Mike let see if you can get that done. I know that you have brought many things to the lime light but now we need to see some accomplishments. You are just one vote, it is OUR own responsibility to keep their feet to the fire. And if we need to file Federal subpoenas to get answers Mike that is your next step.

I do not know if this has passed or not, I thought that it did, but in any event you should probably read the entire bill. It definitely does NOT apply to prior federal service, but only to various state and local entities that perform a police function. It seems that the buy in is pretty steep too.

what you don't get is that they do not need 10 years to vest, they are exempts, they get vested as gold braid in three years, then, if they go on to some other job that can be somehow tied to law enforcement they can pay into the fund and steal a pension at the their pay rate.

This too is incorrect. Exempt vest in the pension like anyone else, time on the job and age. I believe it is presently 23 and 53, the memory starts to go, at that point you get the basic percentage based on the best 4 years out of the last 10 years. It is an average of the best 4 years that the percentage, which mases out at 75 percent is based on. There is no exception for Exempt ranks. Thre is also no provision for later service, only prior service, but not with the Federal Govt. ILCS Article 40. You should all read it some time before you retire. This whole thing is a phony issue and is a tax Social Security thing.

Jim Maloney is a standup guy. Hauser is a hack left over from the Nolan years, but he voted right also. The press release from the board states they voted unanimously to remove the feds from the pension after gallagher let them in in error. SCC you and Northside owe Maloney and Hauser a huge apology for jumping on a rumor without fact checking.

The post was about Gallagher playing secret squirrel with our pension fund money and Hauser and Maloney voting that Gallagher did no wrong hiding the fact that Weis and & Co were in our fund.

There were only 2 trustees that Gallagher discussed this with, LUX and ROSCHE (?), and that fact comes from Gallagher himself! Both were appointed by the mayor. The big error was that they got caught!

The post is correct. Another point, Gallagher mentioned he had only 18 months left before he's maxed out. So I guess he's making his bones now for his next cushy position.

The problem with the pension board members is the freebeeies that they are given by the various investment advisors. Free junkets to different places as the advisors try to get their hands on pension money. Once you are hooked, you are no longer free.

PRESS RELEASE UPDATE
At the Regular Board meeting of the Policemen’s Annuity and Benefit Fund of Chicago held on November 24, 2009, the trustees, in a unanimous vote, approved a transfer of salary deductions erroneously sent to the Policemen’s Annuity and Benefit Fund of Chicago on behalf of five Chicago Police employees who do not meet the total requirements to be members of this system, as noted below. The contributions will be sent to the Municipal Fund for the City of Chicago.

The Retirement Board of the Policemen’s Annuity and Benefit Fund will be holding a board meeting next Tuesday, at which time the Board is expected to approve a transfer of salary deductions erroneously received by the Retirement Board of the Policemen’s Annuity and Benefit Fund of Chicago (P.A.B.F.) to the Municipal Employees Annuity and Benefit Fund of Chicago for Chicago police officers serving in exempt ranks who do not have a civil service title of patrolman, sergeant, or lieutenant. To be a member of the PABF retirement system, an exempt employee of the Chicago Police department must have been, at one time in their career as a Chicago Police officer, in a civil service title. Though these officers were statutorily granted peace officer status here in the State of Illinois, they are still precluded from being members of the PABF because of this provision in Fund statutes, Chapter 40, Act 5, and Article 5-109.

Looks like they aren't in the pension plan anymore....

I was at the meeting and have known Jim Maloney since the 24th district back in the day. He is as sharp as they come and is as straight as an arrow. I am sure that he had a good reason for voting against the reprimand for Gallagher. Maloney knows sometimes a little diplomancy goes a long way,. Hauser is another story entirely. He is as phony as his wig.

I learned she was in but is now in the Municipal pension fund, like the others.

Gallagher needs to be forced in court to produce the documents showing who is paying into our fund, that is, which civilian fucks he let in without our knowledge in year's past. The only reason he won't produce this info is because he has so much to hide.

Gallagher is a daley appointee and therefore not to be trusted.

Lawsuit.

Why did he vote for paying the law school tuition of Gallagher's dolly secretary, the relative of a former commander?

Stand up? I am sick of stand up guys like that. I like the new stand up guy, Mike Shields, who never sided with the enemy.

Personally, I like it that Shields has some media person he can talk to to get stuff out in public. If he didn't have Yellin I would personally help him get the ear of someone else.

What outrage has Maloney or Hauser ever made public? How many grand thefts of pension funds have Hauser and Maloney quietly let slide by?

Why did Hauser and Maloney not sound the alarm at the law school tuition? Why did they not vote it down? Why did they not vote with Shields on the issues of this thread?

They are NOT stand-up, they are lousy hacks and they need to be former pension board reps. They can do their stand up routine at the retiree breakfasts and relive old glories and swindles.

We need to preserve what is left of our pension fund!

There are federal laws regarding what kind of information can be released for privacy reasons. Its entirely possible it is against the law to release a list of potential beneficiaries.

And technically it is not your money at all. You have a claim on benefits paid out of the fund but no ownership in the assets of the fund at all, even if you are vested.

In any case, being a defined benefit plan, unless the city goes bankrupt, your benefits are safe. If the city goes bankrupt, who knows what the deal might be. Thats why you should be screaming bloody murder about the dubious investments the fund holds, and not about a few people being in the plan that might not belong there.

You ought to be demanding an open audit be performed on what assets the fund holds and what they are really worth today, as opposed to what the fund is claiming they are worth. The results of such an audit would probably make you violently ill.

Instead of demanding an audit of the fund and its assets, you allow yourselves to be diverted to some unimportant issue like a few people in the fund that might not belong there.

Even if they kick a few people from one fund to another one, it won't change the underlying assets in the fund one iota.

Christ, anybody who knows Mike Shields knows he's the real police. The guy actually gives a shit about our money and people like the above jump on him. Typical Chicago bullshit.

I knew Mike when we were in 011. He was a year ahead of me out of the academy and he more than anybody helped teach me how to be the real police. Who gives a fuck if he's brash, it's about fucking time someone stand up for the PO's of this city. He's the real deal.
