Sue the "Deep Pockets"

Hmmmmmm:
  • A woman who says she was attacked by a homeless man and woman while leaving a Jewel Food Store is suing the store and her attackers.

    Jennifer Hall says that while she and her fiance were leaving the Jewel store at 1224 S. Wabash Ave. on Aug. 25, 2008, her 36th birthday, she was approached by Derrick King and Joyce Burgess. The two requested a cigarette and when Hall denied them, she was physically attacked -- losing most of her teeth and ending up with 85 staples in her head.

    King pleaded guilty to the crime last october and was sentecned to three years in prision. But according to state records, he was paroled just 18 days after pleading guilty to two counts of robbery for the attack on Hall..
First of all, the editor over at Breaking News ought to be fined for the errors in this story.

The victim's choice of targets for her lawsuit is interesting though. How much liability should Jewel have for homeless people who wander onto their property and beg, cajole, threaten, harass and beat citizens in an effort to get money? And if Jewel is liable, shouldn't they be able to protect their property by more than the usual means? Should we expect to see Jewel managers armed with Tasers, nightsticks and guns to protect their property? It would be entertaining no doubt.

Yea, that's who I'd be suing and the CTA and the city. And if I was some multi-billion dollar corporation I would know if it was worth charging an extra buck a six pack to have a store with a parking lot near that CTA station. Jewel is not the victim here.

Jewel has surveillance cameras on the outside of their buildings monitoring their parking lots. Jewel knows there are liabilities in those lots. For at least this store, they should have armed guards with unmuzzled dogs patroling the parking lot.

This store is at a major transportation hub for the poor, urban pioneers, and shit heads. The situation there is not going to get any better. I'm sure Jewel first thing on Monday morning will consider whether to keep a store there or not.

The crime scene wasn't even on Jewel property. It happened on the public sidewalk along the side of the store.

Since when does Jewel Foods control who walks down the city's public sidewalks?

Jewel has "security personnel" at that lot. However, they are told that they will be fired if they interfere with anything going on around them. They are there strictly for show. So if your family shops at Jewel, let the shopper beware.

Normally I would say fuck her and this is why this country is the way it is because of these types of law suits BUT you know what? Not this time! This time I say pay the girl and pay her big!
The girl gets attacked by a fucking bum (who was attracted to this fucking state due to its left wing liberal policies) and sustains massive trauma to her face, head and teeth.
She then looks to the great justice system of this state to avenge this heinous attack on her and hand down a sentence befitting the devastation this asshole caused to her and her life.

A a least two occasions I observed different black females set-up a lawn chair and table and begin panhandling in front of the Walgreen store entrance at Touhy and Overhill. A simple call to the store manager got these mutts removed. Not in my backyard. And fuck Haiti, too.

Whenever I have brought it to their attention it seems they allow these bust outs to hound people. Jewel doesn't owe this broad a dime. She and her coward boyfriend were celebrating her 36th birthday at the Wabash Tap on the east side of Wabash just south of Roosevelt. She and her boyfriend left the Tap and crossed to the west side of Wabash to buy cigarettes at the Jewel. After leaving the Jewel on their way back to the bar, they were confronted by two homeless people, a M/1 and F/1. The F/1 said to the F/2, "how about a smoke." The F/2 said, "why don't you get a job." This happened on the sidewalk adjacent to the Jewel not in the Jewel lot. The M/1 grabbed the F/2 and hit her knocking her out into Wabash and sat on top of her pummeling her face. Boyfriend M/2 didn't do much of anything to help his girlfriend. CPD stopped the melee. Although it was the homeless POS who is at fault, it's not smart to trash talk with homeless beggars after having a snootful. But, the Jewel had noting to do with it. If Jewel is found liable, you will see a lot of merchants moving out of the city. She ought to sue her jag boyfriend for not killing the animal that attacked her.

Business ARE liable for crimes that occur on their property, but only under certain conditions. The company needs to be aware or should have been aware of incidents in the area or on their premises and failed to take any action to protect.

I agree that no one should have to "pay a cover charge" to shop at the Jewel or any other store in the city. The manager should not allow it. Selling candy, Streetwise and other assorted nonsense before you go into the Store is anoying. If I wanted to give a donation or buy any of the junk they allow to be sold or begged for at the entry I wouls find it myself. Corporation policy should not allow selling any chances, begging for money for any charitiesd etc. Its all a cover Charge to shop at that store just like the bums begging smokes and money, the manager needs to sign complaints and lock these ass wipes up.

I, however, do not feel that Jewel food store is anymore responsible than the man in the moon. the attorney who wants to bring a law suit againt Jewel is nothing more than an ambulance chaser. I, think she has a better chance against the state and Quinn for his irresponsibe act letting these scum bags out. The panhandling mutts are a problem at the Six Corners Jewel and the one on Lawrence/Central Ave. I'm sick of being approached by these vagrants for money. We even had a group that was setting up shop at Wilson Park.

Some police departments let their off duty employees work in uniform at secondary employment.

Here's an idea.

Create a new public agency that hires off duty cops. Call it the Chicago Cop District.

Let businesses in the city contract with said agency to provide security at their locations.

Let's say the businesses are charged $50 per hour per off duty officer. That's probably a high number, but that factors in salary, and administrative costs plus a kickback to the city. If 200 business citywide utilized this agency 24/365 the agency budget would be around 88 million dollars a year.

You could limit the types of businesses that could hire this service. Grocers, Home Depot, Drugstores, strip clubs etc. Only high class businesses.

That would provide 4200 Chicago Cops with one shift a week. Said cops could carry police radios and would be in uniform.

That would be an extra $12000+ in each officers pocket yearly if they received $35 an hour.

Everyone wins. Except the bad guys.

You ever heard of criminal trespass to land? You can tell anyone to get the fuck off your property, whether it's a store or not, any time you want. A business does have some responsibility for the safety of its customers. I was under the impression that the piss bum approached the victim as she walked out of Jewel and followed/harassed her onto the sidewalk.

Jewel just does not care. I observed a theft at the Jewel on Lawrence&Central. Probplty reported it to the head cashier ( no mgr on duty ) and she just stood there looking lost, nothing was done, except raise the price so all us honest folk can pay for it.

Chicago simply stopped hiring well over a year ago. Instead of laying off, they let attrition reduce our ranks by over 1,000. Not as painful as layoffs but the result is deeper cuts.

You are right.. and unfortunately wrong as well. The city does not want the liability incurred when a PO makes what may be interpreted as a quesitonable arrest. The city believes that no police/citizen (criminal)interaction is better than making an arrest.

I went to Home depot lot to hire 2 guys to help me with a roofing job and I offered $10.00 per hour for a four hour job and these miserable unemployed ingrates had the nerve to tell me will only work an $80 minimum. Who the fuck do they think they are making a demand like that. Screw them.

I am a business owner and can tell you first hand that these parasites are a huge burden to any business. I post signs regarding trespassing and pan handling, however these parasites have no respect for any laws! Call the police and as soon as the patrol car pulls up, the parasites walk away ( It usually takes about an hour for police service because you guys are so short handed). But just like a disease, if the problem is not dealt with in the proper way, it returns. These f'n people know exactly what they are doing in regards to the police. Worst case, i sign a complaint and they are out of my hair for the day, but the very next day, they are back! These f'n animals cost my business and other business' in this liberal city hundreds of thousands if not millions of dollars every year. Who wants to patronize a business when you see these pieces of shit hanging around and aggressivley begging for money? I follow all the rules by maintaining my property, passing every inspection, putting up fencing, proper lighting and cameras all to comply with this city's ordinance codes. What do we get as business owners in return???? Higher taxes!!! Less Police Protection/service! Business' (including mine) will have to step back and take a look to see if it makes sense to continue doing business in this city! Officers, please be safe and thank you for all you do. I wish an ordinance would pass allowing a business owner to protect his property from loss due to negligence of city services! By ANY means necessary! God Bless The CPD!!!

I live in IL.SOUTH part. I have an CCW Good in other states, BUT NOT IL. It saved my ass in IN. and did not have to pull it out. Gave up when I pulled my shirt back and had my hand on my 45 ACP 1911. I guess it depends on a couple factors not real obvious. If Jewel knew the thug was there and chose not to take any action, the choice to do nothing can be looked at by a court. If all they had to do to mitigate a potential mess like this was to dial 911, and they did not do so, they ought to have some explaining to do, especially if this kind of problem has occurred in the past.

Jewel cannot be blamed for what the criminal did, but they can be blamed for what they did, or did not do.

Business ARE liable for crimes that occur on their property, but only under certain conditions. The company needs to be aware or should have been aware of incidents in the area or on their premises and failed to take any action to protect.

If anyone goes to Menards or Home Depot or anywhere else to hire "handymen" hanging around for a day job, I believe that you are making a very serious mistake, especially for a roofing job. If one of these folks happens to get hurt you will be responsible for their medical treatment and compensation. The damages would go far beyond your homeowner's insurance. You, my friend, would be in deep hock. Take out a one million umbrella policy for liability. It will cost you about 200 per year and well worth it. The old saying, Penny wise and pound foolish" still applies.
