Old McDonald Had a Gun

Old Otis McDonald that is.

He's the lead plaintiff in the McDonald v Chicago lawsuit that just might bring down Shortshank's draconian and unconstitutional gun laws:
  • "I know every day that I come out in the streets, the youngsters will shoot me as quick as they will a policeman," says McDonald, a trim man with a neat mustache and closely cropped gray hair. "They'll shoot a policeman as quick as they will any of their young gangbangers."

    To defend himself, McDonald says, he needs a handgun. So, in April of 2008, the retired maintenance engineer agreed to serve as the lead plaintiff in a lawsuit challenging Chicago's 28-year-old handgun ban. Soon after, he walked into the Chicago Police Department and, as his attorneys had directed, applied for a .22-caliber Beretta pistol, setting the lawsuit into motion. When that case is argued before the U.S. Supreme Court on March 2, McDonald will become the public face of one of the most important Second Amendment cases in the nation's history.

And our two favorite comments following the story:
  • Nationally, the murder numbers/rate dropped from 16928/5.6 to 16272/5.4 from '07 to '08.

    Illinois had a population of 12.85 million w/ a increased murder rate of 6.1/100K (790) in comparison to 5.9/100K last year.

    Chicago had 22% of the population of Illinois yet accounted for 64.5% of murders w/ a per capita rate of 18/100K. an increase in murders both raw and per capita.

    Cook County had 41% of the population of Illinois yet accounted for 73.9% of murders(584) w/ a per capita rate of 11.1/100K. It had a population drop yet an increase in murders due exclusively to Chicago.

    The Cook County murders in raw number/per capita increased 11.9 and 11/1% respectively while arrest numbers and rates decreased compared to '07.

    If Chicago were to fall into Lake Michigan, the Illinois murder rate would drop to 2.8 .

    Were the rest of Cook County to follow suit, the rate would drop to 2.72 .

    Yet instead we saw that increase. Now it's appearing that, in order to artificially reduce the murder rate from the disaster they saw in '08, they're increasingly classifying deaths as 'suicides'. All to continue to justify their ineffective gun ban.

    Then there's the % of murders by types of weapons used, 2008:

    Nationally: 66.9

    Chicago: 80.8

    Now tell me. Where are most guns restricted and/or banned? Where are they more common?

  • For those who think that overturning Chicago's gun ban is going to increase violence in the city, it might be informative for you to look at what happened last year in Washington, DC after their similar ban was overturned. We all heard their police chief and other politicians, as well as the Brady bunch fear mongers and their blind followers all predicting the same old lame "wild west" BS they've been trotting out every time a gun control law is overturned or even challenged. Well, just like every other single time, they were wrong. In 2009, the first full year without the ban, DC had the lowest murder rate the city has seen since 1964.

I'm all for lifting the ban, but i have to admit i am a little scared of a gun now legally being introduced into all these highly volitale and violent situations we are thrown into every day.

It also appears that "death investigations" are on the rise. After the final numbers are released at the end of the year, who will notice if they "reclassify" 60 death investigations from the previous year into homicides?? They should release the numbers as "homicides and pending death investigatiions", and see where that takes it!

I'm no hockey loving, Second Amendment freak like SCC, but there is a reason it is the SECOND amendment. Right after freedom of speech.

The more I see of what is going on in Iran the happier I am for the number of guns in this country.

As for Mr McDonald I prefer a shotgun for home defense, but he has a right to defend his house with a handgun if he prefers.

I never worked that District, but I wouldn't mind responding to a call where this old gentleman aerated a few bangers who were breaking into his house.

Hell, I'd even come back after my shift with some rubber gloves to help the old guy clean up the mess.

That says it all doesn’t it.

I think we’ve got a pretty good Supreme Court right now, they have been making some good sound decisions. This case is more then just about gun rights, it is also about how the Fourteenth Amendment to the Constitution applies the Bill of Rights to the States. I think the majority of the court is going to vote for our rights. This certainly will set back Obama and his fascist agenda.

After being robbed 5times my son decided enough was enough...protected himself and was promptly arrested for carrying a concealed weapon. The bad guys still have their guns so my question is where is the justice in that???? im voting for McDonald tomorrow.

Either you are being sardonic or you cannot possibly be a police officer. Hint: the bad guys already have the guns. The good guys will be able to have them too if they lift the ban. That is the point. It is a state's rights 14th Amendment Case. Daley and the antigun people are presenting an argument that supports the idea that the states could have had the right to disobey the Emancipation Proclamation and remained slave-holding states in 1864. Same logic.

What the DC people SAY has been important is that they've got a lot more tips coming in from the community. Notably, there's been a huge decline in Prince George's County, too, though Prince George's saw no change in their gun law.

And here, we've seen a huge change in public attitudes towards "snitching". Even Mary Mitchell, who you used to revile on a weekly basis, has written several columns in the last six months saying ending the culture of silence is critical. The department needs to get away from the "they're all potential murderers in that neighborhood" attitude expressed so often by commenters here, and start developing the trust that would help you get your job done.

I'm not a gun hater. I'd be fine with more limits on purchase, but I'd also be fine with overturning Chicago's ban. I just don't believe you that it helps much. There is a lot of evidence about what DOES help, but it mostly gets ignored in Chicago.

SCC, can you please make a thread out of this? On Friday, I attended my regular traffic room. There was a off duty PO who was there as a complainant on a ticket because he was struck by a vehicle on the way to work and was injured. The civilian who struck the officer's car was represented by OUR FOP ATTORNEY Tom Needham. He knew all along the officer was CPD and continually tried to badger the officer to no avail. Is this not a conflict of interest? Does FOP know or care who they let represent us and then stab us in the back later on?? Has this happened to anyone else in the past??

Well,situationally,I was working at a retail outlet when a couple from Missouri(where there IS a CONCEALED CARRY LAW) came in the store and the husband approached me. After the usual banter about the gun and the now famous Blue Grip(thanks SCC :) ) he produced his "carry permit". I asked if the man was carrying a weapon and he replied no and EVEN VOLUNTARILY OPENED HIS COAT FOR INSPECTION. We continued on with the conversation and what he said didnt surprise me at all. He stated that Gang crime and shootings HAVE GONE WAY DOWN since "they" "allowed" us to carry. The point here is that NO w wouldnt have locked the man up and yes given the proper training and concealment practices,this is a VERY GOOD THING. In response to the "im a little scared" comment,sure you have a right to be its your safety but remember not all people carrying guns are bad guys. Im sure the State will find a way of incorporating into the PDT system a way for you to determine if the person you have stopped is a CC permit owener. Good horse and street sense will also come into play as well. Most of us that arent the police and CARRY are more than willing to be compliant and keep YOUR safety in mind as well as ours.

Off the topic but there was a devastating fire last night in the Edgebrook neighborhood on the northwest side where a Lutheran church was destroyed. Is the state and city going to step in and give that church 1MILLION dollars to rebuild like they did for a church in the Bronzeville neighborhood a few years ago. My guess is NOT! Why not should be the question by citizens from the upper class Edgebrook neighborhood.

Otis McDonald's public face sure looks good to the gun lobby. Is this true just because he's an articulate and responsible Chicago resident from Morgan Park and not another babbling gun nut from Mt. Greenwood? Close but not quite.

McDonald's race is critical to the lawsuit -- the 14th Amendment, adopted on July 9, 1868, prohibits any law that attempts to "abridge the privileges or immunities" of freedmen. Since he's the offspring of a black freedman, McDonald can only lend legitimacy to the Plaintiff's arguments.

I do believe the reason for the Beretta is it is a cheap small gun that is banned by the unconstitutional law. I do suspect that the reason being is that it is not a "scarier" handgun and it makes the ban look even more silly.

Hopefully after this is finished we shall see a Concealed Carry Law passed in this state. I have already got my Glocks ready for carry. Unfortunatly I cannot carry here in my home state and do when I go out of state.

Most of the violent people wouldn't be able to legally obtain a gun anyway, yet they do obtain guns and use them. I've run up on many a "legal" gun possessor while responding to calls of burglary in progress, suspicious persons in yards/alleys.
In all cases of 'legal' gun possessors, it was a homeowner who had come out of their residence to check on the disturbance; some had the firearm directly in their hands, others had (attempted, at least) to discreetly conceal them under sweatshirts, robes, etc.
In each instance, after checking them out (name checks are a must), I've always allowed them to return inside of their home with their protection of choice, sometimes to the consternation of other officers eager for a quick UUW pinch. These 'legal gun possessors have been people of the entire racial spectrum that resides in our once great City.
I always caution the youngbloods who were ready to pounce on the 'easy pinch' that that person could be THEIR mother, father, brother, uncle, etc. Then what?
I do beleive that once Shortshanks's law is repealed, that some sort of mandatory firearms education course become MANDATORY for the hordes who will rush to the gun shops and clean out the existing stock. Hopefully, what will be included in such a MANDATORY firearms education course (which the state could charge a $10/$15 fee, and rake in millions, which could go to our beleagered education system) will be a mandated affrimative response to law enforcement whereby should the police respond to a call and 'armed, concealed carry permit citizens' are present, they state that they are in fact armed, and produce these permits, in order to avoid becoming victims of gun violence themselves. Yes, we'll be on pins and needles for a while boys & girls in the LE community, but law enforcement agents do ok with citizens exercising concealed carry in other states, and with proper training on both sides, so can we. In any event, it's coming, and nothing Shortshanks can do will put this cow back in the barn now.

It would happen eventually, but word is the type of applicants remaining from 2006 has only increased the resolve of the department. They're bad. BI's have been told to let certain discretions pass that ordinarily would be grounds for disqualification.

If there was concealed carry permitting in Chicago shootings would PLUNGE in the city.

Immediately, the odds versus citizen and shitbird would be 50/50 or better in favor of the citizen and you know shitbird knows it.

I had a consealed carry permit in PA for protection because my living required I visit some really, really shitty places.

I had to be interviewed by the Sheriff face-to-face. Seated on the other side of his desk he had me field strip my 1911. Then took me too the range and watched me shoot.

He asked me, "Son, when do you show that 45?" I replied, "Only under one circumstance -- when I'm prepared to use it."

I never had to expose it but there was more then one time when the predator, sometimes predators, bugged off sensing I was not defenseless prey.

I've had conversations with cops who feel they are in harms way enough as it is no matter what the circumstance and they don't get a warm fuzzy feeling having to worry about dialing-in the likelyhood of gunfire comming from some where other then where there attention is fixated -- on the shitbird.

I know I don't know what it's like to stand in a Blueshirts shoes but I truly believe, vetted, permitted citizens are an asset more then a detriment.

As has been already, mentioned the criminal element is already fully loaded.

There was a off duty PO who was there as a complainant on a ticket because he was struck by a vehicle on the way to work and was injured. The civilian who struck the officer's car was represented by OUR FOP ATTORNEY Tom Needham. He knew all along the officer was CPD and continually tried to badger the officer to no avail. Is this not a conflict of interest? Does FOP know or care who they let represent us and then stab us in the back later on?? Has this happened to anyone else in the past??

Hours later, the 55-year-old Carothers submitted a letter resigning his post on the council, where he was the longtime chairman of the police and fire committee.

Boy were they PISSED.I ran into the same CTA "tact team" the next day going to work (armed of course) looked at them dead in the eyes and laughed my ass off.Boy were they PISSED. A few months later when a rather highly intoxicated subject was fighting with the same Office on the Red Line in the tunnel,I jumped in and held the bad guy so he could be cuffed. When the hair gel recognized me Boy was he THANKFUL.We talk often and have become social. Point here is ARMED and NOT the police are not ALWAYS the bad guys.

If you own a car, and have a CCW it is put on the system that you are a CCW carrier. HENCE.......When an Officer is running your plate, your plate will POP for a CCW holder. The Officer automatically knows that the occupant "could" be armed. KY has it and many other states do as well.

Officers here are use to running plates and approaching a vehicle with possible weapons in it. I know several. 99.9% of Officers agree there is never a problem......... I am sure it isn't pleasant to stop a car with a potential gun, but remember that gun may save your life from the average citizen on the street..

I think they did a great job with the tagging of the license and the license plate. Gives better Officer safety as well as a heads up while making a stop.

We will not see concealed carry in Illinois, in our lifetime given the current politics here. Shortshanks having to eat the ban is one thing, concealed carry is a whole different animal. The police will continue to carry and unarmed citizens will continue to be killed and eaten by the beast. A few will risk the UUW charge to be safe, most will not. Most will tough it out with the most potent OC they can find, very sharp folding knives and an ASP baton here and there.

This doesn't bode well for me, a non-cop law-abiding gun owner. I don't like the idea of a database listing that I may be armed. While this makes sense for the police, and I'd be in favor of it for just that purpose only, I don't trust the state to maintain the security of those records. I don't even like the fact that the gun I keep in the city is registered.

In many states it's a felony if you have a CCW and fail to disclose a weapon in the presence of an officer. Law-abiding citizens know this, and comply willingly without the need of databases.

I was stopped last april on 90 for a tinted plate cover (I was actually speeding but I think the ISP gave me a break). I got a warning but my car wouldn't start back up. I had a jump box in the trunk since I was on my way to WI, and he saw my gun case(s). I went back to thank him for turning his lights on while I got my ride started (to keep traffic from being so close to me as I was pulled over on the shoulder), and he asked me what was in the cases. I told him "My guns! Wanna see my FOID card?"

"No, that won't be necessary."

Why? Because I'm not a shitbird. Even though IL law doesn't require disclosure of what's in my trunk..he happened to see it, and I told him honestly. I have nothing to hide. Had he been a semi-asshole about it and insisted on inspecting them for being unloaded, properly cased, and me having a FOID card..I don't think I would have been that pissed about it either other than losing a few more minutes of daylight to make my journey. He's doing his job, and I think skeptical people will find that law-abiding and armed citizens are always willing to accommodate the police.

Carrying a gun is a big responsibility...for you and us. We know that (I have my PA license for out-of-state carry). It's both a very important right, as well as a dangerous one if not treated with respect. I'm looking forward to being able to be armed to protect myself and others - including you - should the situation arise (although I hope it never does).

I don't know about Chicago, but a LOT of people farther south in Illinois are carrying regardless of the law, and I'm not talking about criminals (other than violating an unconstitutional law). Mostly the cops leave them alone. In some communities where the police are known to be less than honorable, the police leave gun carriers alone because they know they will shoot back. (Don't deny it; the police department in my home town had a large number of officers busted for running a cocaine ring back in the 80s.)

Changing the laws or invalidating the Chicago ordinance won't change any of that. The people down there will not allow their liberties to be violated even now. They will not apply for permits or pay for training. I encourage Chicagoans to do the same.

id love for this ban to lift just to have one myself.but its kinda scarry knowing EVERYONE got one. and there alot more stupid people out there that will be shooting at others for no reasons.

I say, let Mr. McDonald carrying his gun, then when Pooky goes to stick the old guy up, Bam, Pooky will be on his way to the BURR OAKS CEMETARY and Mr. McDonald can be on his way, I don't have a problem woth Carry Concealed Law, Because every State with it has a lower crime rate then we do. I'd suggest either or both firearms for concealed carry:

A Glock 27 subcompact in .40 S&W caliber and a trusty S&W .38 snub.

I've added laser aimers to both. See www.CrimsonTrace.com

Also, you can easily palm a Seecamp .32 or .380 caliber pistol for deep, deep cover. You could easily conceal one behind the size of this post.

After being robbed 5times my son decided enough was enough...protected himself and was promptly arrested for carrying a concealed weapon. The bad guys still have their guns so my question is where is the justice in that???? im voting for McDonald tomorrow.

all these gun guys are way into knowing HOW to shoot ... I certainly hope they spend half as much time knowing WHEN to shoot ...

Don't get me wrong. I know how to read the 2nd Amendment. I just hope good people don't go shooting someone for stealing a bike ...
