Daley Clears Lieutenant

Kass has a column up about yesterday's "gang news conference:"
  • The conference of current and former gang leaders was under way when I walked up. The subject was supposed to be about the gang killings on the streets and ways to stop them, and to condemn Police Superintendent Jody Weis.

    It was somewhat disorganized, with conflicting messages, a lot of emotion, but no focus.

  • It went on like that for a while, everyone getting what they came for. The leaders got publicity. The reporters got to ask pointed questions to demonstrate that they're not pushovers.
And then this comment by the mayor:
  • Meanwhile, the politicians were busy playing their parts in the pageant, playing defense. Mayor Richard Daley defended Weis.

    "Unfortunately, everybody complains about police," Daley told reporters. "But again, it's America. You can complain about anything."
Amd there it is. "...it's America. You can complain about anything."

We expect a directed finding of "exonerated" by the IAD Special Investigations Section first thing this morning, a blanket apology issued to the Lieutenant and the resignations of all involved parties, from J-Fled to Masters Masters Masters to Brust.

UPDATE: Post corrected for the IAD investigative arm. Who knew that they had so many branches?

Why would Confidential Investigations be handling this case? Was surveillance required? Was the lieutenant tailed? Was a tracker put on his car? Was he videotaped? A confidential overhear, perhaps?

He put a post up on his personal blog. What on earth would Confidential have to do with a straightforward case like this?

technically it's special investigations that has the case....confidential deals with criminal matters, residency and medical roll stuff.

There have been coppers who complained about UNJUST discipline and they were made 30 Pending for voicing their 1st Amendment Rights.

Will they too be EXONERATED by Mayor Richard M. Daley???

I agree IT'S AMERICA!!!! Plus the Lt. was not only voicing his opinion to better the department and the safety of all its officers but it was the truth on top of it. Finally a man with balls that was willing to step up for all of us. Scc - good posting.

What about the Lt's mental pain and suffering of the thought of retaliation. This is america land of the free!!!!!!!!!!!!!!!! Freedom of Speech and expression. Also as a sworn officer had a duty to protect the public in which he did in his statements. Then they harassed him with the mental anguish of a CR# filed and possible termination as it was said in the media........

you guys are missing the difference between The Police Rules & Regulations and the 1st Amendment right to freedom of speech

Lt Andrews is not subject to criminal punishment, only Administrative sacntions

I know I know Pat Hill used to do it

Ive heard her dumb ass on the radio in years past and couldnt believe my ears

That said, While I agree with Lt Andrews 100%, he is going to be spanked and the Dept has the right to do it

Fredo Ypur my brother and I love you But dont ever take sides against the family again

No. This is the Kingdom of Daley. He may give you the illusion of free speech, but if it is something that embarrasses him you will be thrown under the bus.

If Lt Andrews receives a finding of anything except exoneration, Daley will mug for the camera and state that the issue is out of his hands, when in reality he had given the order to bury the Lt.

When I was "arrested", IAD Confidential Investigations under Raymond Risley, Jerry Robinson and Louis Velez did the superintendent's "black bag" dirty work also. I consider that unit to be the equivalent of Hitler's SS or the Soviet KGB.

The bullshit arrest was subsequently dismissed and expunged. The City had to $ettle for retaliating against me for exposing the truth about EXAMSCAM.

Daley never "apologized" to me for going public with the damning TRUTH.

He simply destroyed an outstanding career and left me to "twist slowly in the wind" with a massive cover-up.

I have passed on all my "lessons" about Daley's treachery and vindictiveness to John Andrews. The guy is sharp.

No, you're missing the point. He is an American citizen and therefore is protected by the First Amendment as long as he is commenting on matters in and about the public interest and in the public domain. Obviously, he can't divulge criminal records, details of ongoing investigations or things of that nature. He can however, criticize operations, voice his opinion about decisions made in error or contrary to the public good, etc, as long as he is speaking as a private citizen, off-duty, out of uniform and not as a representative of the Department.

In uniform, on-duty,he is obliged to follow orders so long as they are legal, but off duty? The Supreme Court has already in decided similar cases that you don't stop being a citizen off duty.

You're on the right track, but I think the Court language was limited to "matters of public concern," not anything about public domain or public policy. The Court also did not extend 1st Amendment privilege to a public employee airing personal gripes and unsubstantiated claims. I think Andrews will have a problem.

rules and regs. must follow legal guidelines, or they are null and void. In this case the Bill of Rights takes president, and any policy contrary to it are null, void, and illegal to enforce.

many of these rules were written ages ago by people who were quite dumb, and didn't consider that they are in direct conflict with real laws concerning our basic freedoms, which are God-Given Rights. The whole city really should try to get out of the Dictator Daley mentality, and join the United States of America.

I think we're both arguing shades of gray my friend. He's allowed to have opinions. Nothing Andrew's wrote is a personal gripe or unsubstantiated. Even the Carothers stuff ended up being vindicated by the Sun Times the next week when the feebs admitted he was on their radar.

We may be arguing shades of gray, but I suggest that you read his letter very carefully. The first 2paragraphs as well as part of the 3rd are pure speculation and opinion. All of his comments regarding public corruption are also pure speculation. I know, I know we all are aware of how things are done in Chicago, but he better have some evidence that he can use. Nothing about Carothers was verified by anybody. He is on the G radar, so what? He may be the worst boss in the world, but again Andrews better have better evidence than just the fact that his brother(s)is/are crooks.
Don't get me wrong, I admire his guts in what he did, but I think he will have a problem. His letter largely reads like most of the comments on this blog, that is a compilation of rumors, petty grievances, unsubstantiated innuendo and sour grapes.
I wish him luck.

J-Fled was on "Garrard McClendon Live" on CLTV last night. When asked about the IAD investigation of Lt Andrews, he said it was not a First Amendment or freedom of speech issue. He said the issue is about corruption.

He stated that when someone talks about corruption within his command staff, he "takes this very seriously."

Hmmm...

So Andrews brings information forward about corruption at CPD. What is the first thing J-Fled does? He charges Andrews with police misconduct for bringing this information to light.

It sounds like a corruption cover-up led by J-Fled himself.

Didn't Andrews say on WGN radio that he was directed not to discuss the content of his statement to IAD...that it is an ongoing investigation? Didn't Andrews state that he respected the investigative process and would not reveal what happened at his IAD meeting?

How can J-Fled talk about an ongoing internal investigation when Andrews can not?

How did the gears shift from "bringing discredit to the department" by writing on his blog...to corruption?

Now that corruption is the focus (per J-Fled) and Andrews has been ordered by IAD not to talk about specifics, what happens next?

Did J-Fled openly admit on television that he is going after another whistle blower?

Don't they have laws against that?

Didn't Andrews write something about J-Fled being in the "circle of corruption?"

We all know there is no corruption in Chicago.

Move along now... Nothing to see here.
