Another Opportunistic Lawsuit

  • The family of a motorist who was shot and killed by police during a West Side traffic stop last month filed a $3 million wrongful death lawsuit Thursday against the officer and the city.

    Xavier Ferguson, 22, of the 1600 block of N. Melvina Ave., was fatally shot by police Nov. 24 in the 5200 block of West Kamerling Avenue, officials said.

    [...] The incident began when two uniformed officers from the Mobile Strike Force Unit saw a vehicle about 1:20 a.m. with numerous occupants discarding items from the window, according to a police News Affairs release following the shooting.

    The officers activated emergency equipment in an attempt to curb the vehicle, a van, police said.

    The vehicle initially refused to stop, but then stopped and several of the occupants exited and fled on foot, the release said.

    A Grand Central District police lieutenant said several of the occupants “jumped out and charged at the officers.”

    As officers approached and announced their office, a male suspect lunged at an officer and attempted to disarm him, the release said. A struggle ensued, at which time the officer’s weapon discharged, fatally striking the suspect.

Remember, the only thing that makes your gun effective is distance. Once distance is lost, so is every other safety factor (time, shielding, etc) and it's pretty much a fight to maintain control of the weapon. If these assholes stop and obey the police or run away instead of toward, they live to deal dope another day along with curing cancer and becoming upstanding citizens.

We immediately have our weapon drawn upon traffic stops, especially if they refuse to stop--and if knuckleheads decide to lunge at us before we can even put our weapon away well then whatever happens next is in the hands of GOD! You can be certain though before I let knucklehead disarm me I will be firing my weapon!

Please tell me there was an in-car camera rolling during this incident.

If not, why not? The price of one BS payout would equip every car in the city, marked and unmarked.

I met with the MSF guys, immediately after the incident. They did EXACTLY what they were supposed to do. That was a bad situation for them, they reacted professionally. Good job for them. I'm sure their kids appreciate seeing them every single morning too.

Im glad the coppers involved went home safe and got to be with their families/dog/ whatever and got to live another day. these scumbags are getting more and more out of control, fight with the police and get what you deserve. the city shouldnt pay out a dime to any of them and should give the coppers involved a raise for a job well done.

We'd certainly like to see you operate on the streets seeing as how you can conduct a traffic stop at a distance of two full blocks.

Maybe we weren't specific enough - street work means close contact with subjects. Close contact means leaving cover/shielding and interacting with subjects. Unfortunately, that means leaving distance by the wayside.

Even your supposed disagreement follows our line of thinking saying that an offender can cover 20 feet before a decent shot is lined up. Distance is your friend in police work.

The personal attacks on our ability is what gets you flushed.

Jfled says that until the political winds dictate otherwise he will stand behind this officer 100%. However, a federal indictment for civil rights violations sits in Jfleds drawer should the scum of the earth who VOTE big time in this city demand it! Only fools work for a back stabber!!!!

People simply do not obey the law, they do not obey police commands, they get shot and then the moron family members sue. Hopefully, the next mayor, whoever that may be, will put an end to these lawsuits. Our current nutcase mayor has done nothing or the minimal to put an end to this ghetto mentality.

That is why it is so important to have an attorney at each officer's
disposal.

with 1400O Police officers in Chicago, the chance of a shooting is everyday. Fop, Benevolent at $1.00 a month to have an attorney for the Officers is cheep. 2,3 dollars a month and you have a full time attorney.

Does anybody know if the officer can sue the family or next of kin because the offender initiated a chain of events which caused the officer to shoot and kill him which in turn caused the officer undue stress and anguish in knowing that he took a life?

Glad they are OK.

But the officers used bad tactics plain and simple. Had the offenders been armed the police may have been killed.

On felony stops make the offender's walk back to you and do not leave your partner with a van full of shitheads by chasing the one that flees.

These are old tactics and every cop should know them.

To the officers named in the wrongful death lawsuit i suggest you get a lawyer and counter sue the shithead plaintiffs. Get a deficiency judgment against them so when they win the ghetto lottery you will have to get paid first. I tell you this because i was involved in a police shooting over 5 years and i never thought about suing and the FOP & Corporation Counsel never advised me to. Just recently the gangbanging plaintiffs family won a million dollars upon appeal for wrongful death and another gang banger who shot at me received $425,000.00 for being assaulted when i returned fire upon being fired upon.Trust me no one has your back but yourself.

The suit will be an old House of Branch "home going special" ...Just the front and no back. An elder subject matter expert relates some fools breaking in back in the 60's and stealing some of these "suits." Some ass was sho' nuff beat on Madison St. behind that... Your statement is the only thIng that makes a gun EFFECTIVE is distance. This is a faulty argument for two reasons 1) a gun is an effective weapon and successful kills at the point of contact range, 2) according to the FBI stats on police shootings - more then 80% are inside 20ft and half of those are inside 12ft the average human can tranverse 12ft with one bounding step inside of a second about the same time it takes to pull the trigger. I would refer to Caliber Press videos Surviving Edge Weapons where Dan Inosanto demenstrates such at 50 years old. Since all police stops are dealing with people well within 12ft the distance the argument is faulty and is simply a reaction time having mental acuity to recognizing attacts based on precursor cues not distance. This is a whole realm of training completely lacking in CPD and the police in general. We are not afforded distance especially not the type of distance where you observe more then a milsec to realize what you better already have muscle memory to perform.

Police Departments (and sadly, Police Officers) get fucked-up really bad when "customer service" becomes the mission. We're surprised the "How's my driving?" stickers weren't put on our vehicles.

We say fight fire with fire as the shitbirds have no rules they're compelled to abide by other than living to be shitbirds for another day.

It would take 40k coppers of grim intent, full immunity, absolute and ruthless adherence to ILCS, (not Chicago style fuckery of "We're home rule so we get to cherry pick how state law is enforced/interpreted") the complete and total destruction and reconstitution of the crook county court system and 20 years of putting a mean hurtin' on the criminal class to make Chicago livable again.

The CPD legends of years gone by had a particularly ferocious perspective that we heartily endorse...

If you're a shithead, either conform/adapt to the ways of polite society, leave Chicago if you can't conform/adapt or stay and get dealt with by The Police. And if you do the fool playing with firearms or other weapons in the presence of The Police, you will die. If you blink, you'll just die in the dark...

Won't happen because Daley Inc. is afraid the Police would justifiably come after them and their alderfool, runnin' dog rev'run and diseased & dying crack whore media associates.
