Exceptionally Cleared Closed
For the first time, the Chicago Police said Friday they know who hit David Koschman and knocked him to the ground in a drunken confrontation in the Rush Street area, leading to his death from a brain injury 11 days later — but they’re not telling.
They said they are closing Koschman’s 2004 homicide case without asking the Cook County state’s attorney’s office to charge anyone because they concluded the punch was thrown in self-defense.
Police reports made public Friday black out the name of the man who detectives concluded threw the lone punch at Koschman. But the descriptions they provided and accounts given by witnesses and others to the Chicago Sun-Times make clear it was Richard J. “R.J.” Vanecko, a nephew of Mayor Daley and White House Chief of Staff Bill Daley.

Change the description to "off duty Chicago Police Officer" and the newsworthiness of this event is front page news for years. The States Attorney's Office would decide the flimsy evidence would suddenly be enough to indict for murder and the citizens would be screaming in the streets for justice.

Becker fled in a panic driven, alcohol induced stupor after a bustout Streetwise vendor attempted to disarm him in 018 and he was tried and sent to the penitentary for what was essentially self-defense. Vanecko beat to death a victim who independent witnesses state was not an aggressor. That is murder. It's amazing how many people here are still so quick to defend these Irish peices of shit.

I have NEVER seen a self defense case where the person claiming self defense...REFUSED to make a statement to the police.
The Dicks are making a mistake when they assume the punch was thrown in self defense.
Without a statement from the person throwing the punch, how do they have any idea what his intent was???
This is a tempest in a teapot. The police identified Vanecko as the offender and presented the case to the SAO. The SAO interviewed the witnesses who would talk and declined charges. The police then closed and cleared the case exceptionally. That means the offender is known but not charged because of some bar to prosecution. In this case it's a pretty big bar: the prosecutor won't prosecute. The problem is that some moronic police boss decided to redact the entire report from the FOIA request, thereby creating the aura of suspicion. After that the thing had a vitality of its own. Adding spice to the mix was reopening the case in light of the FOIA denial and sending it to another area. If the world is truly run by the C student, then the public sector is run by those who got gentleman's D's.

Permit me to give a small sample of what makes this a shit case; several of the victim's friends were unable to pick out the person we know to be the offender (hint for you greenhorns, this usually involves a line-up), all parties involved are two sheets to the wind, o never mind why am I even trying to make any of you understand.

Thats fine. Now, can the family file a wrongful death suit against the responsible party and subpoena the police records for the case? At the very least maybe they can bankrupt the scumbag. I know there is some sort of time limits on filing the suit, but considering the department stalled for ears on closing the case and withheld the name of the identified offender I would think the time limit can be overcome. Possibly they can even sue the city and the mayor for their concerted effort to obstruct justice and deny the right of the family to sue initially.
