Accomplice to Murder

Anita wasn't in charge when this all went down, but as the current head of the office, she's goign to shoulder some of the blame:
  • Accused serial killer Michael Gargiulo — charged last week in a north suburban girl’s cold-case murder — could be responsible for up to 10 murders, a California homicide detective told the Chicago Sun-Times.

  • While in Los Angeles County Jail, Gargiulo allegedly told authorities that just because 10 women in those homes were killed — and his DNA was present — doesn’t mean he murdered anyone .

Anita's office goes into denial mode:
  • “In our assessment, there were no admissions made that could be used to connect and prove his involvement in other murders,” said Alvarez spokeswoman Sally Daly,
Not "We are continuing the investigation." Not "We are reviewing our records." Nope. Just "there were no admissions," and close that door before something ugly gets out.

The trouble is, the ugly part is already out there:
  • Gargiulo was a longtime suspect in Pacaccio’s murder. In 2002, Cook County sheriff’s detectives obtained a DNA sample from Gargiulo, who was living in southern California. The next year, tests confirmed his DNA was on her fingernails, officials said.

    The Cook County state’s attorney’s office didn’t think the evidence was strong enough to charge Gargiulo in Pacaccio’s slaying. At the time, prosecutors thought the DNA could have been the result of “casual contact,” according to a statement released last week by the state’s attorney’s office. He was a friend of her younger brother and frequented the Pacaccio home — and was in a car with her the day before she was stabbed 12 times, prosecutors said.

    But Pacaccio’s parents have criticized Cook County prosecutors for not charging Gargiulo in their daughter’s murder after they learned of the 2003 DNA match.

A match eight years ago. At least one murder in California, along with a previous murder and a stabbing after the match was made. And maybe a bunch of additional murders in the intervening years. Serial killers don't just stop killing after one and their "cycles" between events usually get shorter over time.

The excuses coming out of Anita's office are complete fabrication and horse crap - you mean to tell us DNA isn't enough to charge anyone, but her office has released how many inmates over the past few years based on DNA evidence. Anita's predecessor Dick Devine needs to be asked some harsh questions, too. There is at least one and maybe as many as ten dead girls' families out there who deserve explanations.

I am too pissed off to even begin to type the stories I have of the ASAs at 26/cal. I have even more nightmares of the ones in the suburbs..including the ones asking a detective what a GSR was during a murder......WTF...

How about you try to actually TRY a frigging case......Not say..um..they could use this as a defense..Guess what moron..They can say anything...But we show they dont and we win..Are you going to lose your spot? NO!!!!!!!! You got your spot and are not going to lose it unless you hit the wrong hole with your tongue....Try and win a case and be a real attorney..May actually be a benefit to society instead of a shitty 60K a year leach who does nothing but endanger your families..Damn.....

Anita should not be blamed at all, way before her time. But that the SA is trying to deflect blame is a strike against her. Not sure her angle here, she should be screaming that the ones who proceeded her screwed up.

Dicky Devine f-ed this up good. Though he did a great job going after police officers for his publicity machine.

Well at least he's enjoying his healthy six figure salary in the private sector.

If there is a hell hopefully it has a space reserved for Dicky.

Think that ASAs have two major conflicts of interest:

1) wanting a high conviction rate, which means tried cases must have irrefutable evidence to be presented to juries biased towards "not-guilty/give him another chance" verdicts.

2) wanting to pander to the voting constiuency, which in many cases, has family members who have committed crimes, been arrested, and have been through court system.

Add fact that ASA is yet another warren of politically-connected ill-trained (and lackluster law student) hacks who otherwise probably couldn't get a non-paralegal job at a decent law firm. Isn't that a description of Alvarez herself?

Justice isn't served, it's bought in Cook County and in Illinois. I'm beginning to think that if the criminal isn't caught red-handed committing a felony, then that criminal is likely to be inconvenienced but unarrested, and certainly unconvicted.

No wonder crime rate is going down. Hardly anyone is getting arrested anymore.

I'm not defending AA, but isn't there always a first murder for every serial killer? Perhaps the glenview girl was his first - he was pretty young back then, too.

I don't think it's up to
Anita to scour the country looking for possible bodies. If there are agencies with cold cases dating back to when the POS left town and made his way to California, they should bring this to either CA or IL attention.

The main problem is the cook county states attorney is not on the side of good but the side of the criminal. They will go after police officers with felonies on misdimeanor crimes. But will let a guy out doing robberies who has been arrested 106 prior times. They are in their own agenda! They sponsor things on helping criminals expunge their records. It like having public defenders on both sides.
Warning...If you can, get out of cook county far away. This is ground zero for urban terror!

Tom Dart is a media favorite... after all, he's never seen a camera he doesn't like. He'd be a tough opponent for Alvarez if not too many jump in that race; thus, the media will continue to put heat on her. The press likes Dart. They already made her look terrible delaying charges in the Officer Bailey case because of that Hawaii conference.

98% of our ASA's are useless. Look at Det. Johnson's case, look at any case you go to court on 62 times. They keep continuing it so that the guy finally gives up and pleas. Cuz a plea is a win. The sentence from the plea is a joke. The guy is back on the street in 6 months.

When I started the job,it was the Dicks who decided if you had a felony charge and if so they wrote up the appopriate complaints and charged Homie accordingly.Never had an ASA refuse to prosecute.

Things changed for the worse when we had to get ASA approval prior to charges.Keep your chins up officers,it has to get better,because it can't get any worse.

Dick Devine is way too busy trying to get the O'Hare concession contract for his connected friends. Dick was nothing short of Daley's puppet all the time he was in the SA office. I am sure he will "memory loss" when it comes to any hard questions.

There is so much ignorance about felony review coming from patrol officers.

First, if you have a solid case and charges are rejected, you can ask your WC for an override in every case except murder. The reality is that felony review almost never rejects charges in a solid UUW or PSMV case. These cases need to meet certain standards. It's the reality of living under a Cook Co court system.

Murders are more complicated. A case must not only prove the offender committed the crime but the case must also defeat the likely defense. Had this case been brought to trial in 2003, it would have been a loser and he would have collected a nice amount from the Cook Co Sheriffs Police.

So many cops on this job get all of their job info from the TV. It's getting even worse. I would bet that at least 50% of all cops on this job have no clue what happens to an arrestee after they put him in lockup, yet they're all experts in prosecuting murderers because they watch CSI.

Anita, wants her judgeship. She cannot place blame on the annoited, Dick Devine. The irish "political" mafia has her doing damage control for his failures and cover ups. Just look at the vanecko case. The chosing of judges has to be taken anyway from Don's Burke and Daley. This would be the perfect time to strike and bring some professionalism and dignity back to the ASA's office. The citizens of Crook county and Shitcago would rally behind her, but we now she's been drinking the koolaid. Hope her selling her soul was worth it.

I hate that (ASA) attitude. When you get a shit case (as many of them are) Put it on--let the judge or jury decide. As a wise former first chair (now a judge) used to say, "Good things happen when you answer ready for trial."
More often than not, he's right.

The best friend a criminal ever had is the Cook County States Attorney's Office.

Let them try this shit downstate or even 50 miles west. And to think that at one time (1981) there were people in CCJ for traffic offenses and even parking tickets!

The same statement could also be applied to Robert Vanecko, in regard to the David Koschman homicide case. It's brilliant if you think about it. In fact, I'm sure public defenders will jump all over this. "My client made no admission that could connect or prove his involvement in (insert your alleged crime here), so the State must drop charges."

I hear that there are also 2 unknown DNA profiles in this case. That may be the reason he wasn't charged until the 3rd party admissions popped up.

I take it you have worked with 98% of them? Are you talking about Det. Pat Johnson's Att. Murder case? What's your complaint? That they got a Felony conviction out of a Cook COunty Jury on complete circumstantial evidence, supported only by the statement of an admitted lying co-defendant? Thoses ASAs did a fantastic job to get a conviction on that. No fault--of course--on the partof Det. Johnson or his partner, but the evidence was very thin.
You might want to come up with a different examploe if you're trying to show "98% odf ASAs are useless."
