How About Truth in Sentencing?

  • A man out of prison three months has been charged with shooting and stabbing to death a security guard while trying to rob a gas station on the West Side, police said.

    Kaz Link, 33 -- convicted five times on drug and theft charges since 1997 -- was charged today with one count of first-degree murder.

  • Link, of the 4300 block of West Jackson Boulevard, has a string of arrests dating back to 1997. In 2008, he was sentenced to six years in prison for the unlawful possession of a stolen vehicle. He was paroled in July.
Let's see - 2008 plus 6 years equals 2014, right? But he's out in three, even with five other convictions. And now he's a murderer.

"Truth in sentencing" would be a wonderful thing. As would a "three strikes" law.

Sounds like the parole board felt sorry for this jerk. Now someone is dead. Hope the next time he comes up for parole they might take a harder look at this murdering asshole.

Crook County's biggest problem is that its judges are WAY too soft on violent crime. What good does it do to arrest someone whey they're out on the street the next day and their only sentence is probation - knowing full well that the county does not have sufficient resources to monitor all probationers?

And c'mon- read the statutes. Anyone sentenced gets day for day "good time", plus credit for time served while awaiting trial,plea and sentencing. And they sue if they are kept any time over that.......tax payers money all the way around.

I was recently assigned to CBC and would hear the crimes and pasts of the felony arrests. One guy had "12 prior felony convictions". 12! He has struck out for 4 whole innings already!

There is not much in the way of parole at the federal level like there is in most states.

The feds can afford to lock up some one for a long time. the states see it as a drain.

Found one of these electronic monitoring devices on the ground at a west side gas station. Chains and bars are the only things these animals understand. They thrive in a prison setting, I say let them rot.

Im not the original SGT, but I think this needs to be addressed. Who the fuck does this piece of shit think he is calling himself "the real police"? The real Police dont need to be told anything. They know how to dress and how to do their own "paper". They dont go anonymous on blogs trash talking Supervisors picking apart comments and observations of someone whos job it is to over see entire Watches of Officers. I know not everyone is going to win the appearance award, but you "young jag-off", need not call yourself the "real Police". Go on and trash talk others, meanwhile, the "real Police" are being box 1 and 2 on their own "Pro-Active Police" arrest reports. Take your "paper jumping" ass and "little time on the job" and FaceBook or something else. You are in the way of working Police by the way.... You can't claim to be in a catagory of Officers when you don't even have what it takes..... STFU and GFU you wanna-be! God Bless the "Real Police". You are few and far between. There is no PAROLE BOARD that only happens for parole violators&those sentenced pre 1995 You get your time cut in half plus 6 months "good time" upon entry into the IDOC to ease overcrowding unless its a Class X felony Murder-Rape 85% of jail time is mandatory hence only 2/12 years served i year sentence- 61 days 2 years -6 months 3 years 1 year
ect!

The reason Crook County judges are so lenient on criminals is that there are way too many of them. Getting homicides and other henious crimes is a ho hum matter. Go to smaller towns, or go down South, and they get the book thrown at them.

When I was a rookie back in the 70's I was astounded at the length of the criminal histories that some of the mopes I arrested had. I couldn't believe they were out on the streets after being arrested so many times. Once the disbelief sunk in, I came to understand what the problem was, and that is the court system. It was all there on paper....the cops arrest the offenders and then the courts let them out. People should be outraged that this is the norm.

Many of you are knocking Cook County Judges, but in spite of the fact that the county judicial system is not the best in the country, I find a 6 year sentence for auto theft to be a little stiff, even with priors. I didn't think anyhone went to jail for auto theft any more, but then I have been gone a few years.

1856 Supreme Court Case of South v Maryland ruled that the police have a responsibility to protect the general public but not every individual unless there is a 'special relationship" which is a copper knowing that there is a likelihood that someone will be harmed or wronged if he or she does not take action. Another special relationship would be if you are guarding a witness-then you are bound to protect that individual.

This is called the "Duty of Care" doctrine. We cannot be held liable for things that happen out of our view or out of our control. We can't protect every individual. You would need a cop for every citizen.

If found guilty, and properly sentenced, expect to see this offender out again. Down the road some eyewitness will recant their testimony. Some Northwestern Law Class will reveal new facts to prove he was improperly convicted.

Arrests are arrests, and without convictions--they don't mean shit in bond court, nor are they taken into consideration in sentencing.

Convictions are, so even a sentence of Probation is building the conviction sheet for later crimes. Three stikes (natural life mandatory) requires three convictions for class X (serious) crimes, and they must be: "arrest-Conviction/sentence, arrest-conviction/sentence, then a third arrest / conviction, with no overlap.
Few of those long rap sheets everyone is talking about here fit those requirement.
