Officers Sue Slum Times

  • Five Chicago police officers have sued the Chicago Sun-Times over publishing photo lineups that included names and faces of the officers standing next to Richard J. Vanecko, former Mayor Richard Daley's nephew.

    The federal lawsuit alleges that the newspaper violated the officers' privacy by disclosing personal information on their drivers' licenses, such as height and weight. The Sun-Times obtained the information from the Illinois Secretary of State's motor vehicle records, the complaint said.

    [...] Police officers are commonly used in lineups, according to the suit. But the complaint alleges that the publication of the personal information violated the Drivers Privacy Protection Act and that the officers are entitled to monetary damages.

So if we're understanding this, the lawsuit isn't based on the fact that the officers were identified in the paper, it's the way the Slum Times obtained the info via government sources and then publicized it?

We'd dearly love to see Vanecko in jail, and so would the Sun Times. But they don't seem to care about collateral damage.

Couple of important questions. How did they get this photo was it through foia? Who was responsible for saying that the others in the line up were po's? And who identified them by their names? Hope its not other department members.

I hate to say it but these guys should have never been in any line up. Police can't be made to be in a line up. They went along with this crap. The Daley crew should have had an on scene show up. They did all this to get the Daley relative off.

Daley and Family never served the city, they served them selves.

Nice to see SA Anita Alverez clean up the mess for the Daley Crime Family by refusing to appoint a special prosecutor into the death of David Koshman. Murderer Richard Vanecko is still a free man living in California. What a POS. Anita owes her job to Richie Daley & Co.

This will be interesting. The sun-times did not have to publish the personal information of police officers, but they did, and for what I can see, no real good reason. However, driver's information , I believe, is a public record and can be obtained by filing a freedom of information act, by anyone.

This is a real question so please dont jump on me: How are the lineup photos that appeared in the Sun Times different from, say, photos of officers at award ceremonies, press conferences or graduations? In those pictures, officers are identified for all the world to see. While I understand that there is perhaps some consent given for photos like that and there doesnt seem to have been consent for the lineup photos to be published, a question I would ask is... how does the publishing of these photos (unless they are of officers in UC roles) compromise officer safety? Officers names are all over the place..on paper all over the place, on thier uniform tags, on lists of award winners and stuff.

I only ask because to me and to others, i bet, this suit seems less about officer safety and more about jabbing the media and whoever the bosses are who allowed this photo to see the light of day. And iam fine with fucking with the media and with 35th. They should be just as accountable as anyone but to wrap this in the shroud of "officer safety" just doesnt pass the bullshit test. What do others think?

Another Alderbrainless sold his soul to the powers of the burke/madigan combine! I live around 52nd and Major in the 23rd ward, now with the new ward remap (SCC you and the readers have to see this mess), eddie burke has taken the 14th ward all the way to Normandy park and from 51st to 53rd street making it look like a Peninsula, and then madigan and his crew has taken his huge cut on the other side of Archer. Which makes the 23rd ward mostly black and hispanic by a wide margin,and looks like Zalewski is going to as usual roll over and not file a lawsuit!

Hey Mike what is in it for you?? Now you and the combine have pushed a great candidate for rep over the side in favor of a young no experience hispanic girl? Very disappointing Mike all the work done for you!

Now the important point here is Chuck Madia an active Chicago police officer ran against "roll over" zalewski and he did not have the support he needed! Would Chuck have rolled over? Definitely not! Whatever happened to being represented properly? These guys doing all this really need the feds on an indictment type probe! Another reason when barry obama loses hopefully Patrick Fitzgerald can get the bus in high gear full speed ahead!

30 years ago, some dics wanted to hold a line-up, but our lockup didn't have enough white guys that fit the offenders profile, so they asked for some coppers to "fill in". A guy getting ready for roll call agreed to stand in with the WC's OK. It went straight downhill from there.

The witness picked the copper out of the line-up. Another witness "wasn't sure". The incident that prompted the lineup had occurred a couple hours earlier while the officer was home (ALONE) preparing to come to work. He had no alibi regarding his location during the actual incident and had a CR launched on him (just to clear him, he was told!). Initially, he was told not to worry about it but the CR was left open for quite awhile and was never "exonerated", only "not sustained".

When the REAL bad guy went to trial, the copper was subpoenaed and the defense attorney tried to turn the copper into the offender, citing his being ID'd in the line-up and having the means and opportunity to commit the crime and tried to plant some BS ideas about motive for the jury (though it didn't work).

All in all, a good lesson in why you should NEVER, EVER VOLUNTEER!

I am surprised they could find an attorney to take the case. When the SOS officers tried to sue over being forced to take physicals over allegations of excessive force, physicals that included fingers inserted in their asses;No Competent Counsel could be found. Even Loevy & Loevy declined the case. It seems that the attorneys who handle suits against the City are a tight knit group that have a strong relationship with the City, and they do not want to endanger that relationship. Apparently even they have been corrupted!

Department General Order requires that a line-up supp be submitted after a line-up is conducted (whether or not there is an ID). The fillers in the line-up are to be identified, for PO fillers it's usually name, star, unit of assignment. If you get a copy of the report, you have the info.

So would I. But the evidence is not there. Even if this was some westside nonsense, the offender could say "he started it" and poof ... no charges.


Everyone knows this. I understand the feeling that 'he is getting away with soemthing' because he is related to Daley. But the truth is, any offender would be treated this way. You are allowed to punch someone if he comes at you. Ya, the victim died. That's a tragedy. But who here hasn't punched somebody who came at them? You have almost a duty to punch him.

If there anyone who says the guy who died didn't start the whole thing? And I do feel bad for the kid, don't get me wrong. And I hate seeing his mom on TV. I'd go fucking nuts if I was her. But the sad truth is, there's not enough to charge, and in fact, Vanecko did nothing wrong. And I am just a regular cop. I don't know anyone involved and I have no love for Daley or the privileged class. But it is what it is.

Several years ago the supreme court ruled Police Officer's have the right to sue offenders for injuries as well as for duress of libaless statements! Officer SUE SUE SUE everybody, newspaper and protestor!

I happened to be at a holiday party of a family friend where one of the ST editors was present. When I asked him about a possible lawsuit by the coppers for IDing them, he laughed in my face and basically said, "Bring it on." Wonder if he's laughing now. Those big law firms can rack up some huge legal bills.

Your a public employee, you have no expectation of privacy, especially with this new technology. All those phone calls in that line up should have known better. Protecting the guilty did not serve you well or will it. Time will tell. The daley camp knew you were the police and its quite clear that info was let out, via, FOIA, to get you in and vanecko out of the spot light, at least for alittle while. Just like that officer in oakland got slammed by a federal judge for covering up his name tag even with the fear that po had of his family being targeted by the protesters. Po's have to protect themselves, the political structure is very much geared towards throwing the enforcers, not the politicians and their spawn, of the status quo, under the proverbial bus. That said, if your are willing to take a metaphorical bullet for a thieving piece of shit, like vanecko, then you should expect that karma will be on the side of the family that just wants JUSTICE. The same justice you would want if the koschman's were your family.

What is the actual basis for the suit? Were the photos through foia? When the photos were released does it become public info? Can't the the Times printing the photos without having their legal department check it out. Hoping the po's prevail, get some money and make the Times change how they report things

They are already here, more are coming every day and will do this come the May Disaster.

Don't make it easy for them.

GOOGLE yourself and you may be amazed at how many times you show up and on websites you may not have thought of.

When signing up for something, unless you absolutely have to do not list your employer as the Chicago Police Department.

Better than a non-published landline home phone number ($1.50 a month fee) is to list it in a phony name and without an address.

Get a Post Office Box, and send everything you can to it, magazine subscriptions, vehicle registrations, cell phone bills.

When you get those "Privacy Policy" notices from your banks or credit card companies respond and tell them you want your information withheld for all inquiries.

The City of Chicago, the CPD, the Credit Union, the FOP and PB&PA right now should be doing an information lockdown so hackers can't get our information. It would also be a great benefit if all banks that we have direct deposit with were notified to do the same.

Stay Safe, there are a lot more things you can do. Don't make it easy for the bad guys.

Dude you mustve went to one of those "north side" doctors. All I had to do was take a blood test, a vison test and a hearing test. You should sue the Dr that put his finger up your butt!

Its a shame and im not trying to say that the officers are not due compensation because what the sun times did was wrong... but it wont go anywhere unfortunatly. They had a case like this in minnesota in federal court where it got thrown out in a motion. Same exact thing as what happened here. Its hard to fight case law especially when its already been established in a identical case. sorry officers, you should be getting paid!

Civilians did not know until recently, and some still don't know that all po's have uniforms and sometimes all po's have to wear them. One sex offender was on the news claiming to have been beaten by two plainsclothes police and the CPD responded, impossible, all cops were required to wear uniforms that day.

How do you know this? Where you there? Did you investigate any of this? Tell us the details? Sorry, but there is no credibility in this issue at this point for anyone. An independent prosecutor is needed to clear the air.

Lawyers who take cases on contigency only do so if they think there is a good chance of prevailing and that the time and resources they expend on it will pay off.

If they are being paid by the hour, they just don't care.

My guess would be that they are going to give it a shot but not spend all that much time on it, given how weak their chances of getting anything for it is.

And well she shouldn't. The case was investigated. The witnesses were all over the place. Being related to Daley didn't make him guilty of anything. The Scum-Times tried to blow this up and create controversy to sell papers, but there was just no there, there. They relied on false infromation without verifying. Very sad for the Koschman family, but you can't prosecute without solid, reliable evidence.
