Someone is Lying

  • She’s one of Chicago’s top cops — so highly rated that she was one of three finalists to replace former Supt. Jody Weis.

    But Debra Kirby’s account of her actions in the aftermath of disgraced officer Anthony Abbate’s notorious videotaped attack on a bartender was directly contradicted in sworn testimony Tuesday in federal court by another officer and an assistant Cook County State’s attorney.


    Lawyers for the beaten bartender, Karolina Obrycka, hope the three wildly differing accounts from Kirby, Sgt. Joseph Stehlik and prosecutor Tom Bilyk about a phone call Kirby testified she made three days after the attack will convince a jury that Kirby is a liar who tried to hush up Abbate’s attack.
Just knowing what we know, and some of our number having been through the wringer, we speculate as follows:
  1. The prosecutor has no dog in the fight.  Anita has been looking to hang coppers for years and her predecessor didn't do us many favors either.  To think the States Attorney wouldn't have hung a copper out to dry in a heartbeat is nuts;
  2. If this was in fact, a heater case as is being portrayed, there is no way a sergeant takes it upon himself to get misdemeanor complaints signed under unless he's part and parcel of any conspiracy.  We don't mind sergeants for the most part, but let's not kid anyone - they aren't allowed to make decisions of this sort of import. 
  3. Kirby is throwing everyone she can under the bus in hope that the wheels jam up and save her the brunt of this one.
There is a reason that IAD reports directly to the Superintendent outside of any other chain of command.  It's the same reason the Superintendent reports directly to the mayor - political insulation.  And if there's a fire, insulation protects the "valuables."

  • Why isn't anyone asking about how IAD tried to farm out the SOS investigation to the States Attorney and the feds for over almost two years while the crew ran amok?  Kirby was in charge then and sat on it.

Stop with the conspiracy theory. If you think these were kirbys choices alone you are crazy. She kept her job this long by following orders and being a good soldier. And as far as the sos nonsense. No one wanted it because it was a shit case with little or no evidence other than dope dealers accusations. You cant play both sides. Being one day you are on IADS side the next your claiming they are screwing over cops.

OT: Saw the new cmdr of 003 on the news tonight. I think he did a good job being under the scrutiny of Goudy's 'investigative unit' report. But I hope those officers sitting in the tahoe on Drexel have enough
sense to leave the newspapers at home, and at least
appear to be doing something proactive during their
tours of duty on that hot spot. Several shots were taken of the beat car and the officers sitting inside of it from the channel 7 copter, so clearly people are paying attention to what the cops assigned to directed patrol there are doing. Don't embarrass yourselves, and you really don't want to embarrass your new boss, because he doesn't suffer fools for long.

If Sgt Stehlik were smart he would do so and protect himself.

I've always found Kirby intelligent and fair, Stehlik, a little limited in his abilities.

A decent lawyer can get any two people to sound like they are lying and any three people to sound like they are conspiring.

A 'hungry' lawyer could make your mother and father sound like Russian spies. Any copper that has gone through these nonsense civil suits knows the game they are running.

Shouldn't the Corp Council seen this coming, didn't they talk to their witnesses before they hit the stand? If they would have then the stories would have been better.

The city can argue this was not a cover up because they were looking at charging him with something...they just did not know whether to go after a felony or misdeamenor.

A cover up is if they tried to hide the fact that this incident happened, which they didn't.

When you watch the tape it is a misdeamenor, Kirby just should have said based on what she saw she believed it was not a felony.

And you see how the states attorneys office tried to distance themselves, A.S.A. Bilyk saying he never received a call even when both Kirby and Stehlik said they talked to him. NEVER TRUST THEM!!!

What little team spirit between the Police and S.A. is fried for at least the next generaltion!The next phase will be when attorneys get people released from prison simply because they were sent there by SOS. Will the CPD seek CALEA accreditation? Any plans to hire and promote "the best and the brightest" rather than kill morale with "clout babies"?

Some police maintain that Kirby has been given a sinecure job just to keep her mouth shut about the skeletons buried away. Is she an officer of honor and integrity or just another money-grubbing well-connected psychopathic bully?

Tom Bylik was either the head of felony review or one of the three deputies at the time. The video was brought to him by IAD dics and he viewed it. Bylik has always been a pimp, but he saw what everyone who viewed it saw: NO FELONY. He told the dics he did not see the basis for a felony because the punches didn't seem to land, she did not appear to have been hurt, she did not seek immediate medical attention, and suffered not serious injury or great bodily harm. When the shit hit the fan the state moved Bylik to juvenile court quickly. The IAD dics afterwards admitted to me they screwed up by not getting a formal rejection from felony review, but nobody at 35th street thought it was a felony either. Just to be sure they asked felony review for advice. Happens all the time.

The State's Attorneys always ask about the vicitms injuries. In the Abbate case there where none. I have witnessed the ASA refusing charges on a case where the victim was "Just shot in the leg" and also how many have told the felony requesting detective "Broken noses don't count as broken bones" Coppers included, till the "Mearaday" incident in 025 The bartender didn't even have a bloody nose or a black eye.

Perjury??? Official Misconduct?? hahaha, do you have any clue how hard that is to even prove. The feds would laugh if someone said can you look at this for perjury. No, she wont be charged with anything. Her testimony is only at odds with another officer and does not make sense... which my friend is not perjury or anything close to it

(don't know what they call it now)....then wait (sometimes, a long time) for a decision as to whether they would take a case or not....they did this case on a phone call?....eh?....

1. The powers to be control it.

2.If IAD wanted to be a functional unit-- tell me how?
a. How many of the IAD people know how to write a search warrant-- say for a bag a police officer has and will not open? count on one hand I bet.
b. How many IAD people know how to write a COH and how to run it through the system ( wire someone up)?
2. How many IAD people could write an order for a Pen Register? The numbers coming in and out of a phone.
3. How many IAD people would even attempt to write a Title III for a subject? Wire tap
4. How many of the IAD people would work nights and midnights on the wiretap?

I think this was a slap to Kirby and her IAD goofs. Obviously they didn't document their phone calls to Felony Review, which is why they are blubbering liars on trial right now. Nothing was documented.

Why IAD does not do their job?

1. The powers to be control it.

2.If IAD wanted to be a functional unit-- tell me how?
a. How many of the IAD people know how to write a search warrant-- say for a bag a police officer has and will not open? count on one hand I bet.
b. How many IAD people know how to write a COH and how to run it through the system ( wire someone up)?
2. How many IAD people could write an order for a Pen Register? The numbers coming in and out of a phone.
3. How many IAD people would even attempt to write a Title III for a subject? Wire tap
4. How many of the IAD people would work nights and midnights on the wiretap?

Now put your drink down and go write a warrant or Title III, so we're all impressed that you got that class in your clout unit. I hope you put more attention to detail in that paper than you did in your comment.

If felony review was called and did in fact denied felony charges, they have to do paper on the call and should give you a rejection number. That information should be included in your narrative.

Does anyone remember that IAD Sgt that reported all the corruption crap that was going on in IAD before retiring and everyone gave her a hard time on Second City? This seems like it was some of the things she was talking about. The clout, the ineptitude of the bosses, the selective investigative process. Maybe next time we'll think alittle longer before we jump on the bandwagon.
