Illinois to Join the United States

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

  • In a huge win for gun-rights groups, a federal appeals court in Chicago Tuesday tossed the state’s ban on carrying concealed weapons and gave Illinois’ Legislature 180 days to craft a law legalizing concealed carry.

    “The debate is over. We won. And there will be a statewide carry law in 2013,” said Todd Vandermyde, a lobbyist for the National Rifle Association.

    In a split opinion (see below), the 7th Circuit Court of Appeals reversed a lower court ruling in two cases downstate that upheld the state’s longstanding prohibition against carrying concealed weapons.

A long time coming:
  • Channel 2 - A federal appeals court in Chicago has struck down Illinois’ ban on carrying concealed weapons.

    The state now has six months to pass a law that would allow ordinary citizens to carry weapons.


  • Channel 7 (Thieves) - In a big victory for gun rights advocates, a federal appeals court on Tuesday struck down a ban on carrying concealed weapons in Illinois - the only state where it had remained entirely illegal.
Channel 5 takes a different tack, wondering if Illinois politicians are going to continue wasting taxpayer money while fighting a number of losing actions:
  • A federal appeals court decided to strike down Illinois' ban on carrying concealed weapons Tuesday, but Illinois leaders are deciding whether to continue the fight.

    Maura Possley, a spokesperson for Attorney General Lisa Madigan, told NBC 5 that the court allowed 180 days before the decision will be returned to the lower court to be implemented, so Madigan's office and the legislature will take that time to consider what action to take.
How about instead of worrying about American citizens exercising their Rights to defend themselves, their loved ones and their property and start worrying about how to stop the bleeding from the public coffers?

Someone ought to make a little mark on the crime charts McCompStat has in his office. Because in about 6 months, he might finally see an actual drop in crime stats - the real stats, not the cooked up bullshit he's been feeding Rahm and the media for the past year plus.

well i think that the crime in chicago will continue to stay the same. The reason being that downtown most people who are robbed are yuppies and hipsters and tourists. in the ghetto they will continue to shoot eachother and burglarize eachother.. but, for the rest of the state I think its awesome. Hopefully, a mob tries to rob the wrong person down on michigan ave and a few of them get tagged... that would be awesome. I still hate this state, but its a step in the right direction. hopefully the citizens of this state use this right and conceal carry for the right reasons.

I doubt it. Last year CCW failed by just a few votes. The state would have had a reasonable expectation to be able to regulate concealed carry rights. This path of absolute denial will leave them absolutely powerless when their next hastily drawn up law is overturned.

My name is Michael T. Sweig a proud supporter of the CPD and the CPMF. I believe in law and order. I also believe in the Second Amendment. In as much as I am blessed to have residences in other states, I have CCW permits in CA, NV, FL and UT. That means that I can legally carry a firearm to protect myself and my family in most states. And I do just that.
Guns don't kill people. People kill people. In Chicago, a law abiding trained civilian who is packing just might cut down on the senseless violence that plagues this city.
The liberals who oppose the right to bare arms are not getting this fact. That is, perhaps a thug might think twice before slashing someone's throat, as happened recently at the Westin, if that thug knew that a 45 ACP awaits them. God bless the police but law abiding citizens are finally getting a chance to fight back if necessary.
And to you dems who oppose common sense I welcome you to the USA before Chi is a lost city!
Finally, I will join the CPMF Op Santa this Sat and Sun so I can give back to Chicago's finest.

Now let's hope the powers that be will finally realize the futility of fighting against CCW in IL and submit to the inevitable conclusion.

But you never know what may happen next...there's a slight chance they'll appeal to the Supreme Court, which by the time they get it would have a chance for Obama to get another one or two justices appointed and wind up overturning the decision and therefore weakening the 2nd Amendment.

Yes you will be able to carry if you meet the most stringent criteria, annual training, testing and qualification. You will be able to carry after hundreds of dollars in fees to the State , County and City of Chicago.

Unlike most States all you need is a drivers license and background check to carry or get a permit.

In Illinois, you will need an FOID card, $10 dollars now, soon to be $250. Cook County soon to require registration $250. Chicago registration also to be raised to $250.

They knew that this day was coming and have been planning for it for years. This is going to be a BIG money grab for the State, County and City.

This does not include the cost of the REQUIRED individual annual training and qualification courses that be required for you to exercise your rights.

Does not end there folks. You will also be required to carry a HUGE insurance policy in the event you get sued for protecting your self with your gun.

How many times does an Illinois jury award large amounts of money to the CRIMINALS shot by Police in justified shooting? Well, it is almost every time. You too will be paying hundreds of thousands of dollars to the shithead that just tried to rob you if you shoot him.

The City of Chicago does not even have a plan in place to allow it's retired Police Officers to carry a weapon once they retire. This is a Federal law and the City just refuses to comply. Retired Officers have to go to the state and qualify if they want to carry! And yes it is all paid for out of their own pocket.

Do you actually think that the City is going to make it easy for Joe Citizen to carry???

So it will cost upwards of a $1000 a year just to carry! And god help you if you have to shoot some crackhead.

They will also try to limit just what you can carry. I have been told that the City wants it to be a six shot revolver .38 with a 4 inch BBL. Just like the armed Security Guards all had to carry until recently.

Do not start celebrating yet. If I were a betting man I would say that it will be at least 5 years before the first Chicago citizen is allowed to carry! And I only say this because, City Hall believes it does not have to follow any State or Federal laws!

Illinois might have a concealed carry law in 180 days and it might not. I expect appeals and stall tactics by the state. And, if they put together a law that Quinn will sign ( so far he says he will never sign such a bill), look for so many restrictions put into place that it will be tied up in the courts for years. These liberal democrats do not go down easily when the money they spend is yours ! For many years our political class has, while denying you the right to bear arms, obtained phony badges from local police departments ( suburban park districts of two blocks that had 500 police officers and a city with 25 full time officers had over 500 part time youth officers) and the county sheriffs office with hundreds of weekend court deputies who only worked a few days every six months) and , in the case of Trotter, a no show job with a security agency. And, dont forget our alderman who carry badges and consider themselves keepers of the peace so they can carry weapons. And, of course the mayor, who travels around with an army of armed guards. Remember when Rosie O'Donnel blasted citizens carrying weapons? It turned out she traveled with two armed body guards. Hypocrites, all.

Channel 5 News tonight did the typical - an interview with an ordinary citizen (African-American woman) saying we don't need more guns on the street, and an interview with an NRA spokesman as a counterpoint. NOWHERE was there any real reporting about how conceal-carry laws REDUCE crime and SCARE the shit out of criminals.

SCC, you are absolutely correct to predict that once a concealed-carry law is passed in Illinois, the homicide rate in Chicago will go down.

A famous Chicago citizen said something to the effect, last year at St. Sabina Church, "The NRA doesn't like me, and I'm OK with that."

Interesting...that citizen spewed hatred for the NRA, the very organization that was triumphant in the courts, ORDERING the Communistic, People's Republic of Illinois to pass a law allowing ordinary citizens to protect themselves on the street, the very same right that the Founding Fathers intended when the Second Amendment was written.

The irony is that this famous citizen will take the credit when the homicide rate in Chicago declines next year, even though he is 100% against conceal-carry laws. Go figure...

The INJUNCTION is stayed for 2180 to allow the legislature time to implement a new law. At the end of the 180 days, the Unlawfukl Use of Weapon Statgue is ruled uncomnstitutional and anybody in Illinois with an FOID can carry any way they want and carry anything they want. And five decades of unconstitutionally convicted citizens will suddenly earn the right to sue the crapola out of Illinois, you know, we the taxpayers.

Who would think Lisa Madigan's office would get this wrong?

and, oh yeah, if she decides to take it the Supreme court and loses there? Then States like NY, NJ, MA, CA and Hawaii will suddenly be "shall issue" states also.

Seriously, though - how much of an effect do you think it will have on the city crime rate, overall? Because from what I read here, most of the shootings are among people who don't have FOIDs or firearms permits anyway, and have no intention of getting them, and don't exactly go through legal channels to buy their weapons.

Personally, I got my city permit some months ago, though I haven't actually tried to buy a handgun yet. Hope to be doing so before long, though.

Mayors Job Creation vs Latest Food Stamp Caseload Data

The latest food stamp (SNAP program) caseload data came out Dec 7.

As a nation we are at 47.7 million people on the program.

Illinois caseloads were up about another 16,000!!

Numbers are up by 8% in Illinois on a year vs last year comparison.

Tell us again about how Chicago and the state of Illinois are leading surrounding state in job creation hahaha.. Then have the corporate controlled media and political apparatus answer the question: "what kind of jobs are we creating if there are any being created at all?"

There are now 1,973,243 people in Illinois on food stamps as of the latest report. If you compare that to Chicago's population of about 2.7 million people it's like we have 66% of the city on food stamps.

Of course that's just an illustration. Some will argue that the report is for the entire state with a population of around 13 million which is true. But I'm just sayin'. 1,973,243 people, look around you today. That's like two out of every three people you see in Chicago.

Half of them ARE working in WalMart-like jobs, the working poor. Some are students, some are children, some are retired seniors and some are just plain deadbeats working the system like a Chicago or Illinois clouted politician or one of their crony's.

First put on a star and a gun in '79. Wasn't a fan of concealed carry. A little tricky for the Police. 'Course then a Chiacgo Police Officer could walk down the street, people smiled. Oh baby, this one is far from over. I'm not a LEO, just a lawyer but here's my two cents:

Will the Illinois legislature implement the law, as required by today's decision? Yes, but the devil is in the details. Restrictions on "who" (felons, mental patients) and "where" (schools, churches, courthouses, taverns) are just the beginning. Expect more wrangling and delays than we are currently seeing in the whole Fiscal Cliff debacle.

Will Lisa Madigan appeal to the US Supreme Court? You can count on it. She is a gun-hater, as is her father, Governor Potato-head, and President O-BLAME-A. No real downside if she does appeal, and besides what lawyer would not want to argue a case - any kind of case - before the US Sup Ct.

Will the US Sup Court hear the case? A bigger question. An appeal to the Fed Appellate Court level (such as today's decision) is a matter of right. An appeal to US Sup Court is at the Sup Ct's discretion. Statistically, I think something like less that 1 in 4 cases are accepted by the Supremes. But what about this case? Oh, I'd say a greater than average chance, so that the Supremes themselves can put their own impression on things.

And where the heck are we while all of this is shaking out? From a legal standpoint, I would not start packing until Springfield passes their law. From a practical standpoint, "better to be judged by 12 than carried by 6".

Stay tuned. It's gonna be a wild ride.

This decision was authored by Judge Richard A. Posner. The written opinions of 7th Circuit Judge Posner are those of the foremost legal scholar in the judiciary and are cited in more decisions than any other judge in the published opinions of SCOTUS. Formerly the Chief Judge of the Seventh Circuit, he may well be the most respected federal jurist in the nation.

This man should have been nominated to serve on SCOTUS a long time ago. While he is a legal genius, his down-to-earth opinions are easily understood by both attorneys and laymen alike.

Judge Posner may well be the most prolific author among the entire judiciary.

Every other state in the union has some form of concealed carry.

Chicago has the highest murder rate with a huge number of unsolved killings and shootings.

Police are underfunded and are tens of minutes away when seconds matter.

Citizens have a constitional right to protect themselves.

Concealed carry saves lives & reduces crime.

Bob Costas admitted on national television citizens should resist aggression on there knees, stating if he were in the Colorado theater Batman attack, he,d be on the ground groveling and tha concealed carry should be illegal.

It's Costas, right to fight on his knees if he choses. But, that does not give him or his ilk the right to keep me from having the tools that can make the difference between me having a chance against an agressor more powerful or equiped with deadly force.

If all the people on the plane that went down in Shanksville, PA on 09/11/01 were wired like Bob Costas, that plane would have hit it's target.

I was at NON-POLICE company Christmas party tonight.

Normal hardworking people, the kind that earn and pay taxes and take their kids to school and care for their elderly and most probably attend church of some kind.

Well someone, not me, raise a toast to the Federal Court for striking down that law especially because the Chicago Police Department has been decimated. There were some clinks of glasses and overall agreement.

I followed the toast with, "I'll see you on the range."

Chicago will simply copy the New York City CCW requirements so that almost no one can carry. 6 million people in NYC, less than a thousand permits. $400 to apply for one. Your app is "reviewed" and a permit is only issued if you are deemed worth or in need of protection, like Stern, Imus, Trump, or a politico.

I hate thinking that this is what will happen in Chicago, but similar restrictions exist in Boston, San Fran, and many other cities. Let's hope that the NRA and others are equally able to fight these unreasonable restrictions on our 2nd amendment rights.

First off, thank you for your service. I hope you are enjoying retirement by now. Second, there have been 49 other states who can be seen as the "experiment" in CCW and Illinois can use their history in crafting the laws necessary. All of those states have police and have been able to establish laws and procedure to deal with lawfull CCW holders. I am CPD and like many today support concealed carry for LAWFULL, LEGAL citizens. With the criminal as eboldened and brazen as he is, the average citizen needs to be able to have the leagal means to protect his life. It's not just a snatch and grab anymore. It's three to six thugs sucker punching the person to the ground and then stomping on them BEFORE taking their valuables. Dems always talk about "leveling the playing field", well here you go. They just leveled the Apple picking field.

I've been a NYC police officer for three years now and A gunsmith for over eight. I can tell you right now living in NYC all the politicians are going to do is created a complicated weapons permit system that will make is difficult to get a pistol permit. The court ruling says they have to allow CCW but they don't say how. Not to mention they could just ban certain types of guns or place taxes on guns and ammunition to make it more difficult. They could even ban types of guns. For example here in NYC it is illegal to have certain types of rifles. Don't think for a second the fight is over brothers its just beginning and lets not forget the supreme court....

As a Life member of ISRA & NRA and a continuing fighter for CCW laws, we have very well equipped people in Springfield, who will make a bill that every law-abiding citizen will enjoy the fact we will carry. These people have been in the fight, for a while now.

Please take a vacation day and join us for the celebration known as IGOLD in Springfield March 6. Last year we had over 6000 gun owners there and no one was killed.

Based on a conflict between this 7th Circuit decision with a November 27, 2012 decision by the U.S. Court of Appeals for the 2nd Circuit (New York), I predict that Illinois Democrats will file for a writ of certiorari on appeal to the U.S. Supreme Court.

In the alternative and not unlike New York City, Illinois will craft a draconian law within the 180 day period which will make it extremely difficult for responsible, law-abiding citizens to carry concealed outside the home (unless they are covered by HR 218 or have CLOUT, "Chicago-style"). Yet the shameless hypocritical politicians all carry concealed and/or have bodyguards.

Unless you spend all day at a desk or in a car, I don't favor either method. I do use a shoulder holster occasionally when driving long distances or for a backup gun.

There's nothing wrong with a good LEATHER inside-the-waistband or outside-the-waistband holster, e.g. DeSantis Cozy Partner or Sof-Tuck (Your shirt can tuck-in over this one!), Don Hume J.I.T, or any number of pancake holsters (with or without thumbbreak). Off duty I generally carry a 3 inch S&W Model 13 in an old Bucheimer "Concealer" strong-side with a S&W Model 37 Chiefs Special Airweight in a Tex Shoemaker pancake holster. (Yes, I'm a revolver dinosaur.) The most important things are that your holster FITS your gun(s) and that you PRACTICE accessing them so it becomes automatic.

Good luck! Maybe open carry is next on the Illinois horizon; we just got it here in Oklahoma.

I read the news articles very carefully.

Why was there no mention of this city and state(Chicago, State of Illinois), with the highest murder rate, the only holdout aside from the D.ofC ?

All of the news blurbs showed maps shading Illinois and D.of C in regard to being non compliants but the texted asides all failed to mention our highest crimes with handguns as a relevant factor.
Specifically homicides.

It seems to me that this is relevant to the argument that handgun restrictions have failed badly and the State of Illinois and the City of Chicago are obvious proof of this poor past legislation effort to disarm the city residents and their ability to protect themselves.

Now lets see if the gun crimes drop.
