Two Deaths = 60 Day Suspensions

  • Two Cook County prosecutors have been suspended for failing to file charges against a man who had threatened to kill his family -- three months before he set them on fire, killing himself, his wife and one of his young children.

    The prosecutors had declined to file felony charges against Nathaniel Beller, 29, in September after he was accused of filling a bathtub with gasoline and threatening to kill his family, according to a Cicero police report.

    Cicero police officers said they forced their way into the apartment after negotiating with Beller to release his two children. At one point, Beller lit a cigarette while in the apartment, according to the police report.

    An assistant state’s attorney interviewed Beller at the hospital and later informed police that no charges would be filed, according to a Cicero police report. Another prosecutor, according to the report, cited a “lack of evidence” and the lack of cooperation from Beller's wife Taniya as reasons for not approving felony charges.
"Lack of evidence?" A tub full of gasoline, a kid soaked in gasoline, acts of furtherance with a lit cigarette.  Move along, nothing to see here. At least, not until 90 days later when three people are dead and another burned almost beyond recovery.

Since there won't be any prosecution, we doubt anyone from Anita's office had to actually see pictures of the aftermath or listen to the screams of a child. You know, the way the responding fire and police personnel did.

Sleep well counselors. Hopefully, someone acts to disbar these morons.

Unfortunarely you cant file ARDC complaints on states attorneys, they are exempt. Only body that can look into ASA misconduct is AG's office. Good luck on little Lisa doing anything.

A.S.A.'s can't approve felony retail theft without running it past one of the three Felony Review Trial Supervisors. These two are just lambs for the slaughter. Which sup rejected the charges? Canellis, Wood or Byrne? One of them is the culprit. Of course two of them have been promoted since the bathtub incident, so what does that tell you?

A law clerk for IPRA's Rosenzweig was charged today with 3 FELONY counts of "Threatening A Public Official" after he threatened to "go postal and kill" Rosenzweig and coworkers and then himself.

Oh yeah...prior to being hired to help in the grand scheme of fucking over coppers, this stud has been arrested for both domestic battery and VOOP.

While not an IPRA Investigator himself, keep in mind that this asshole represents the caliber of employees hired to investigate you when some ghetto Hoodrat says you motherfucked her over towing her Baby Daddy's car.

Let's see if whatever clout helped him land that job helps keep him out of the media spotlight (and jail) now.

"A 20-year-old man was shot and killed outside a Chicago Public Schools high school basketball game at Chicago State University Wednesday night after a melee broke out in a handshake line after the game.

"The man was taken in serious condition to Advocate Christ Medical Center, according to the Chicago Fire Department.

"The shooting happened about 9:20 p.m. outside the campus gymnasium near 95th Street and King Drive, said police News Affairs Officer Daniel O’Brien. He was pronounced dead [sic]at Christ hospital Wednesday night." (The shooting victim died, not the police news affairs officer.}

The prosecutors want the perfect case. However, in Chicago there are few perfect cases. The prosecutors office want the "win". Sometimes there are going to be losses. But at least there were enough to keep the @##holes behind bars for little. Resulting in the saving of others lives. Especially when you have a one on one case which often times the prosecutors do not want to approve.
Our felony review process has become such a joke.

According to Ilinois State Law, Probable Cause should be the necessary link to arrest an offender and bring that party to the next stage of the criminal justice system but according to the Law of the States Attorney Office and Anita Alverez the case has to be a slam dunk conviction on paper before felong charges are approved for prosecution. Their should be an open investigation by an outside authority into cases that have been rejected by the ASA Office for lack of evidence, continuing investigation, polograph required, the ASA gives so many stupid reasons for rejection of charges. Most of the time they work against you..
As SCC states, no probably cause or lack of evidence with gasoline on a child in a bathtub, but also IDCFS needs some accountability as well, were the children removed and taken into Protective Custody for the purpose of Interview by ASA in safe environment, the children examined at the hospital.

Here's my intake. IPRA sucks and over reaches to make a case towards officers F-them and hope they chocke on their spit. To be a private investigator in the state of IL it take 2 1/2 days of training, so that's what you are dealing with. They are scummy, always embelishing things, pressure unnecessarily to make it stick against the officer, even when the officer was right. F-them. I utterly hate them. This guy should of never been hired, he might be related to the female IPRA lady after her son got arrested. If my son would acted disrespectfully, I would not need a cop to whip his ass...I would bend them over infront the officer and spank the shit out of them. That was her issue, she sucked as a mother, her kid turned bad and she tries to protect him with her J O B. If you ask me, since she used her J O B, she should be fired too. F- IAD/IPRA...they are against the officers.

A law clerk for IPRA's Rosenzweig was charged today with 3 FELONY counts of "Threatening A Public Official" after he threatened to "go postal and kill" Rosenzweig and coworkers and then himself.

Oh yeah...prior to being hired to help in the grand scheme of fucking over coppers, this stud has been arrested for both domestic battery and VOOP.

While not an IPRA Investigator himself, keep in mind that this asshole represents the caliber of employees hired to investigate you when some ghetto Hoodrat says you motherfucked her over towing her Baby Daddy's car.

Let's see if whatever clout helped him land that job helps keep him out of the media spotlight (and jail) now.

I agree with an earlier poster. Those two ASAs are fall guys for their superiors. To any ASAs ready this, welcome to our world. They will leave you to hang out to dry for political expediency. My suggestion for anybody in Felony review, is approve everything and let the branch courts deal with it. It is definately the path of least resistance.

Be promoted and paid on a tier level. It should be a Career Profession. It should not be a clout, political, job, that is underpaid, poor training, and no future.

I love that SCC is pushing accountability. I'll remember it when the press says the police didn't do something, therefore it's the police's fault someone was killed.

There was no evidence against mope because the mother wouldn't make the kids available to prosecutors! The prosecutors would have a hard time convincing a judge to COMPEL minor children to testify against their father. Without the children's statements how can you PROVE aggravated battery. This is the reason why so many child abusers go unpunished, because families back the abuser.

The children are dead BECAUSE their mother liked the animal more than she liked them. That is the bottom line. No one else is at fault.

This bullshit is the same crap the press throws at the police. These people's lives are miserable and horrible because they are miserable and horrible people. Only they can stop it. Any belief otherwise is just your liberal fantasy of utopia. I would hope a police blog would be less likely to join a liberal witch hunt, but I guess I was wrong.

Listen, the person should have been charged in the first incident. But do not blame the trial sup. Their hands are tied and are not allowed to make a call on their own. Everything has to go through the top three on the 14th floor. They have the same micro-managers we do. These two had to fall on the sword for their office. You know it and I know it.

Also, not every ASA is great, but there are plenty who are good to us. I also see a bunch of us act like idiots at court when they ask us to do something. Just remember, there are a lot of tools in this department also.

If you think Anita has seen the light or she is "holding people accountable" then I want to sell you some ocean front property in Arizona.

Anita has received negative publicity. So she is simply covering her ass in response. A typical politician.

Any police officer will tell you that even with overwhelming evidence, ASA's will routinely deny felony charges. It's just standard operating procedure in Cook County.

I quit the office because of garbage like this. It's horrible and I believe Cook County's felony review process is the biggest coverup and miscarriage of justice in the entire country. However, don't be so quick to place the blame on these two ASAs, because not all are bad. After fighting to get cases upgraded and charges approved, I continued to be shut down by supervisors and office politics. It made me sick to my stomach and kept me up at night, and after awhile I realized I was fighting a losing battle and had to bail. These two ASAs could've been a couple of good ones who were fighting a similar losing battle and lost big time.

Obviously 60 days suspension is nothing but something is something. It took 20 minutes to write...we are still citizens, voice your digust whenever possible.

While not an IPRA Investigator himself, keep in mind that this asshole represents the caliber of employees hired to investigate you when some ghetto Hoodrat says you motherfucked her over towing her Baby Daddy's car.

One of theses attorneys is the same ASA who refused to approve charges for an officer this past August who was head-butted by the Cricket Phone Store robber who ultimately was charged with over a dozen armed robberies. The officer had to have $3000 worth of dental work done to his teeth after the head-butt, but ASA Raven refused to approve charges giving some lame excuse that she had to interview a civilian witness. When challenged by the detectives and invited to go to Englewood at 2 in the morn to interview the all important witness, the ASA backed down and said she was CI-ing the case. Thankfully the Det. was able to have a more sensitive ASA at the Grand Jury just add the charge of Agg Batt to a PO when shit-bird was indicted. ASA Raven clearly had no intention of approving the Agg Batt charge despite the officer having his front teeth knocked out. What kind of sanctions will she face for this fuck-up? None of course, the victim was the police, they don't count. And for all those skeptics out there thinking that her decision making had to have something to do with Police wrongdoing, there was none. The officers were by the book 100%, not a mark on the offender.

I think it becomes very obvious whats wrong with Cook County when the SA aren't held to the same standard as Officers. Put these SA's on trial for negligent homicide it's the only responsible thing to do.

Anita Alvarez did not invent felony review. CI's and mutual combat and charges rejected were going on when I came on the job in '82. Those practices continued under numerous state's attorneys, both democratic and republican. None of this is new in Chicago; it is just a continuation of business as usual. Charges have been rejected even when the victims are cooperative. Hell, I recall and ASA rejecting charges against a male CNA who sexually assaulted a severly mentally retarded woman who resided in a state facility. The 21 year old victim was blind, could not talk and had been institutionalized most of her life. Staff members in the facility caught the CNA and detained him for police. The ASA who reviewed the case declined charges because, in his opinion, the sex could have been consentual. Fortunately, a street deputy approved an over ride. Felony review has devolved into a way of sending only sure winners or plea bargins to court.

in over 20 years of law enforcement my experiences with asa's at the trial level have been positive--- we have all got into pissing matches with the asa's at felony review--- some of that is our fault because coppers try to ram a horseshit case thru for that all important activity--- others are dead bang winners with good vic's, witnesses, etc... and they deny charges--- these two were given 60 days because of the political fall out and intense media coverage--- alvarez had to do something because she is still wiping the egg off her face from the koschman indictment--- the ccsao has their own code of silence....

I'm not really big on lawsuits, but I really hope the little boy survives and his guardians sue the living crap out of Anita and her office for their failure to act. The article that I read has Anita already admitting that they made a mistake by not seeking felony charges on this guy.
Wouldn't this be somewhat they same as the CPD leaving that girl out of jail by area 1 and her getting attack. Because of their failure to protect this family.

The CCSAO removed the kids from the care of the mother and father and the kids were placed with dCFS and a DCFS foster parent got tired of watching the kids and dropped them off with grandma where dad was staying and the same place where the fatal fire was ultimately set. So the CCSAO did act in the best interests of the children. In fact a juvenile court judge ordered that visits had to be supervised so let's also lay some blame on DCFS and the Foster Parent. ASAs on felony review can only review the case presented by the police and in this case Cicero wanted a rejection and said case was going nowhere. Remember it was Cicero who didn't ask for a deputy override or file misdemeanor charges also. There may have been wrong decisions by the CCSAO but there's a whole lotta blame to go around. This blog is full of haters who have no clue the actual facts of the case or the way things transpired. Some of you must be the same coppers who want 4 defendants charged with possessing a single gun in a car in a locked center console. Get a grip.

Why did Cicero PD call it in as a rejection? Why didn't Cicero PD ask for override? Or file misdemeanor charges? Why weren't kids being monitored more closely by DCFS? Why was father allowed even supervised visitation?

Father was in mental health facility since original event in September and when he got out, then he went after the family; wouldn't he have been in the same place had Cicero PD asked for felony charges and they were granted by the ASA?

I try not to Monday morning quarterback, but this seems like an awful lot of blame being heaped on just two people who were in one very specific position.
