"The Letter" = No Retro (UPDATES)

  • Fraternal Order of Police President Mike Shields may be riding high after working to torpedo a four-year contract tied to pension reform that Mayor Rahm Emanuel had hoped to use as a roadmap to solve the city’s pension crisis.

    But leave it to Emanuel to send the outspoken FOP president crashing back down to earth.

    Emanuel is playing hardball, thanks to an embarrassing oversight Shields made last year, flatly denied but now acknowledged by his own corrective action.

    The Chicago Sun-Times reported last year that rank-and-file police officers may have to wait a year to negotiate a new contract — and forgo a retroactive pay increase in 2012 — because Shields failed to notify the city between Feb. 1 and March 1 of last year that he intended to terminate the police contract and commence negotiations on a new agreement.

    If that notice is not given within the one-month window, the contract automatically rolls over for another year.

    At the time, Shields insisted that his letter to the city was “well within the timeline” required by state law.

    Two weeks ago, the FOP president essentially acknowledged his earlier mistake by sending the city the required notice to avoid having the old contract roll over for a second straight year.

    That gave Emanuel an opening to declare that, as a result of Shields’ earlier mistake, the FOP has forfeited the retroactive pay raise that has long been an automatic part of any union contract.

Oops. There it is. No retro for the last year. When Rahm said he was going to stick it in the FOP's ear, we thought maybe the reporter had misheard a word that rhymes with "ear." Looks like we were correct.

And everything we published at that point seems to have been 100%, completely accurate, despite all of the abuse we took in the comment sections about being a tool of Rahm and undercutting the FOP, along with all the slander and threats from Shield's people.

Good job Mike.

UPDATE: Here's the FOP response.  To the commentator who was whining about we only posted the Sun Times story, the Sun Times story was up at 0530. The FOP had nothing up.  Then we had to go to a little thing we call a "job."  And since we don't use Department resources or time that the city is paying us to actually be the police,  FOP's reply had to wait.  That's what they get for being reactive - late coverage.  The fact remains that if FOP had been upfront a year ago, this story is a non-issue.

UPDATE: Yes asshat, FOP had to wait.  We have a job.  A job you obviously don't have, kid.  One that lets us be up at 00-dark-hundred, and if we were caught blogging on city time instead of our time, guess where we'd be?  And your nonsense that 10,000 people's jobs are on the line - bullshit.  No one is losing a job.  But the statement that 10,000 people's welfare is at stake?  That is the job of the FOP Union, not SCC.  So go place your ignorant head back up whomever's orifice you recently vacated and sniff the fumes there.  If Mikey had been upfront in March 2012 instead of picking fights he didn't need to pick, this wouldn't be an issue - FACT.

Any copper with half a brain knew the truth. That is water under the bridge. Now we need to stick together or Rahm will try and shove a deal like tried to shove on the Sgts on to us.

Dealing with Rahm, maybe it would be a good idea to let the contract roll over in perpetuity and forgo the retro just so we can keep what we already have.

The Sun Times, meaning Fran Spielman, prints an article and that means it's true? Since when does SCC put any credence into anything published by what you consistently refer to as the Slum Times?

Is there a dispute? Apparently there is, but there is also a place for that dispute to be heard. It's called the Labor Relations Board.

Maybe you ought to wait for a decision from that body before you rush to any conclusions.

Seems like Rahm didn't get his way with the Sgts, in large part thanks to the FOP. Now, he is going to try to embarrass the FOP president. Does anyone really believe the timing of this thing is a coincidence? Looks more like political bullshit to me.

He tried the divide and conquer thing with the Sgts. Fortunately, they weren't bamboozled by him. Hopefully, we are at least as smart as the Sgts and won't be divided either. FOP needed to call Rahm's bluff when he tried to get to our pensions by using the Sgts. This is simply his shot at retribution. STAY STRONG BROTHERS AND SISTERS.

Just heard on news that CTA is voting on a new way to pay for fares, through some company (Vestra?). You have to pay with their card, and if you don't use it for awhile, they charge you $5/month.

If this passes and you pay with cash, instead of paying $2.25 (I think) for a fare, you'll pay $3.75.

Seriously? Who owns this company, inquiring minds want to know?

this isn't really that important, or significant. Past contracts have shown this. They can play with the raise amount/percent, and which year we get it, until the cows come home.
In the end, it's the total % increase that matters, over the course of the contract, not just a year or two of it.
In theory, no retro SHOULD result in a higher over-all wage increase over the life of the contract, since both (% of raise, and year of raise) will be tied to the city's budget at the time the arbitrator makes his decision.

Well the fop cost me 6 months of retro from 2012. We had a contract for first 6 months of the year. Our raise would have been 1 percent for those 6 months. So fop cost me $375 before taxes. After taxes $250 less in my pocket. This is for those with 5-10 years on the job. The math is right. Math is for 6 months not a year. More Disturbing than the money is that the FOP lied about it. Trust is gone.

I loved reading the email that the FOP sent out to members when this news hit the papers yesterday.

The email blames the City for a "letter" rising from the ashes because of the no vote on the sergeants contract. They try to tie the pension fight in the argument. Did the FOP just not justify the sergeants voting down their contract because of tying in the pension debate with contract issues?

The FOP is blaming the City for their failures and crying foul when the City tells them our current contract was extended to the end of June 2013 because of FOPs failure to submit the letter in the time stipulated in the contract.

The letter then goes on about how the City is betraying us. Hey Mikey, you are the one who is betraying us when you have lied to us for the last year in regards to the letter disaster. You are the one who has not been bargaining in good faith with your members. You fucked up in not sending the letter in during the time frame the contract stipulates and the City still held negotiation meetings with you over the last year even though they did not have too. Now when they break off meetings you are trying to put the blame on them. You fucked up.

Stop trying to twist your fuck up back on the City. Sounds like they extended an olive branch by bargaining over the past year when they never had to and could have just waited to 1 July 2013.

Members, this is why we do not vote in a person who has ZERO union experience. Never was on the board. Never was a unit rep. Was never even a watch rep. Hell he probable has never even filled out a grievance. He always talks about the lack of experience in the command structure of our department yet he has zero experience in union business before this past election. Oh and don't go on about the pension board, other then a couple of Youtube videos what did he actually do when he was on the pension board? For the couple of non scandals of Weis and Hubberman that he paraded around about there were dozens of bullshit duty disabilities that he voted for that should not have been approved.

Letter really doesn't matter. Never did. And once it goes to arbitration, which it will, we'll be awarded retro. Past FOP regimes have ALSO FAILED TO SEND THE "MAGIC LETTER" IN. The thing is, it's not a necessary part of the contract. A formality, yes? Necessary, no?

This is Tiny Dancers way of revenge plain & simple. Fact remains it means absolutely NOTHING in terms of retro pay. He's making hay out of it to divide the ranks and picked the perfect time to do so. That's what politicians do best, especially vindictive ones like Rahm.

THERE WILL BE RETRO. But everyone needs to focus on the larger issues at hand.

How in God's name could that happen? Rich Aguilar was re elected, Donahue was held on a "consultant" and Sid Davis got re elected (then left afterwards) and who else? Geez, just with Rich being there that should not have happened. Either way Mike had a duty to know his responsibilities. I know mistakes happen but that's why airline pilots make so much money because they have to be well educated or people die. Unreal Mike. Learn your job and shame on your re elected staff for not assisting you.

Mike is a good guy and the "Union" as a whole is a good thing.

However being a good guy doesn't mean he is a good President.

This was always a huge fuck up and now it is coming back to bite us hard.


You can't pick and choose when to use the contract, it is our guidelines for dealing with the Department and City. Whatever stupid point he was trying to prove may have cost us all a lot of money.


Don't forget though, there are plenty of senior Board members that should have known better and stepped up to make sure this issue was handled at the time.

My guess is it will all fall into the hands of an arbitrator, including the retro issue. If fire, teachers etc. receive retro, I cannot see a fair arbitrator denying it, with or without a letter.
I did not vote for shields, but right now Rahm is going after him like he did Karen Lewis because he dared to stand up to him.
I was one of the people that came down on shields but you can't have it both ways. We wanted him to stand up to this pension grabbing mayor and he did.
Granted he should have filed the letter, he screwed up, period but people are putting far too much emphasis on retro, Rahm will simply use it as a bargaining chip, so be it. We asked the Sgts not to sell us out for $9000, so I'm not signing on to give up pension guarantees during contract negotiations for retro. We need to join ranks with the remaining unions and fight this little man to the very end. He is a spiteful little dictator, a man child, now we know why they wanted him out of Washington.

Once upon a time there was a mean man who came to town and scared away all the other mayor candidates so he could win the election. This Mean mayor rahm was very skilled at tricking people into thinking their own civil servants (police and fire) and their modest pensions were the bad guys. Well he wanted to make all the good policeman accept a bad contract. First he went to the sergeants union leaders who were also tricked by mean man. Then there was the policeman. The mean mayor rahm thought he could make the fop union leader accept the bad contract that hurt many policeman for years to come in exchange for retro paychecks. So when the FOP union leader said NO I will not trade a bad contract for retro checks, the mean mayor got meaner. The mean mayor told all his reporters how their would be no retro. This made the good policeman very sad when the read the morning paper the Called the Moontimes. So sad they couldn't write all the tickets and impound all the bad guys cars. So the policeman were very sad for awhile like a good month or two but they always answered their calls. Some days the sad policeman tried to write tickets through their tears but they kept reading all the numbers wrong on the license plates. One day the bad mayor who loved revenue more than anything else realized that having sad policeman was not a good idea and decided it was cheaper to bring back retro than have sad policeman. THE END

Geiger is the same person that has pissed away our dues money on lawsuit settlements from him sexually harrasing secretaries. How much money has this guy cost us! So when we get the retro pay, what are you gonna blame Shields for?

The City cannot withhold it regardless of what their PR newspaper machine says. Even if the letter was sent a day late or two days late or a week late, state law trumps some inconsistent contract provision in our CBA. Illinois law gives the FOP 60 days to serve the City with notice--which it apparently did within that time frame.

While this blog may not know this, Rahm does. But he doesn't care.

What he cares about is taking away our pensions. This is what the rank and file should be worried about. We're gonna get our retro pay. But if Rahm has his way we might lose a whole lot more than that.

This letter flap is just another attempt by him to create division amongst us. See it for what it is people. While we're bitching about whether Shields slept on this, Rahm is wide awake reloading for another attack our our futures. Our past is safe--we're gonna get our retro one way or another. Start looking ahead people. We have a real fight on the horizon.

Oops! I made a significant math mistake in earlier postings. It's 110 days before Rahm the cucksocker takes away all medical benefits for the retiree's who are not part of the 55 yoa and out group. Given the fact that he has declared that he does not have to even begin bargaining the active police contract until 01 Jul 2013, I think it's safe to say that he won't strike a deal for us prior to that date. I know that the union does not represent us per se, but seeing as you all will be retired someday too, the cucksoker will definitely try to use it as a bargaining chip. So, I guess I have to give a Fock You to Shields for holding up the process for a full calendar year which effectively negated any chance of a timely agreement.

Guys, this is negotiated during the contract. It is not a given.
I'm retired now, but I was on some of the committees long ago.
The city does not give us anything, we have to go after it during the talks.
Nothing is "carried over". We have to bring everything up, point by point. Many things are kept the same, but its not automatic.

I like to see that the blame is going to fall on the shoulders of Mike Shields and deservingly so. I looked at the contract books from 2003,2007 and the 2013 fop book all the names listed from president to past president are the same. There are a couple changes but the majority is the same. So once again I say the old regime Dougherty,DiMaria,Aguilar,Davis,Cappareli,Burns,Moriarty and Donahue all failed the membership because its their THIRD if not more Contract negotiation and they should have known better. They let it happen so that Shields could fail. So place the blame on the entire group not just the one.

Rahm was gonna slam us regardless, now he just turned up the heat a whole bunch because of some letter that the majority of us know nothing about or if it actually means what Rahm wants us to believe (no retro). I believe this is smoke and mirrors by Rahm to try and divide us especially after FOP punked his ass out with the Sgts NO vote. When all is said and done and this contract like every other one that I can remember is done with arbitration, we will get retro pay. Just cuz Rahm won't want to pay us doesn't mean the arbitrator will be more dipolomatic about it. Cooler heads will see that you really don't want a pissed off police force and if you want to keep this city from totally blowing up you'll have to be fair to your police. So take a deep breath and step back and look at the bigger picture here. You may not be happy with this latest rumor, but nothing is set in concrete yet. Support your union now when it's needed the most and don't let the asshole mayor divide you cuz that's what he wants the most.

What the article does not tell you is Paul Geiger, who is tight with Shields and and the 1st VP, fired the labor law firm that Donahue used so he could handle it himself....and bill the FOP in the process. He is the one that missed the deadline.

I'm so disappointed with the FOP that I cant even see straight. Thanks Mike for forgetting something so important as a window that if missed would cost us not only money but bargaining power. I called the FOP a week ago needing help and the advice given actually caused my situation to be made wore with my Commander. When I told them what had happened. All they could offer me was advise on how to apologize to the Commander. Thanks FOP...... Take care of the men and woman on the job. A 15 year vet.

Knowing a strike is prohibited by State Law Blue Flu and not generating ANY revenue for the Chief Snake charmer may send a clearer message to this ANTI-LABOR scumbag Mayor of ours. This is a hardball move in retaliation to the 876-134 vote that the PBPA were smart enough to vote down. An Unfair Labor suit will make this letter a non-issue and the City will have to negotiate or go to arbitration. Thousands of men and women of the CPD put their lives on the line for the City everyday and this is how we are treated. Rahm big business is not backing you for your re-election nor is Union labor. What qualifications or experience did Shields even have prior to running? Oh thats right he was a rep on the pension board. And we all know how bad they have been screwing us for the last 20 years. With handing out free money to any politically connected person that asked. This guy is nothing more than a blowhard. Ask yourself what has he actually accomplished? Don't let the city divide us, folks. It's clear under the ILRA that retro will be worked into our new contract. Anyone knowing anything about labor law knows that statutory law as it applies to labor relations trumps language in the cba. The ILRA gives the bargaining unit 60 days to terminate the contract from the expiration of the contract. Yes, Shields could have avoided this problem by sending in the letter a few weeks earlier, but it won't change the outcome. The Tiny Dancer is pissed he got his pension "reform" thrown back into his face, and he's using this issue to hide his defeat and divide the membership. Don't let him.

Everyone relax. Here's the language in the Illinois Public Labor relations Act:

The duty "to bargain collectively" shall also mean that no party to a collective bargaining contract shall terminate or modify such contract, unless the party desiring
such termination or modification:

(1) serves a written notice upon the other party to the contract of the proposed termination or modification 60 days prior to the expiration date thereof, or in the
event such contract contains no expiration date, 60 days prior to the time it is proposed to make such termination or modification;

The FOP sent in a letter well before the ACTUAL expiration date of around 30 Apr 12 (or 60 days before the contact expired on June 30, 2012). Even though the contract says otherwise, statutory law will trump contract language each and every time. Yes, this headache probably could have been avoided, but please remember that Shields is the only person right now who is standing up to Rahm as every other labor leader willfully agrees to to fuck over his members or stands on the sidelines and says nothing at all.

This is typical rahm bullshit. Let's worry about our pensions and benefits and don't let rahm divide us by throwing out this boogieman argument after he got his ass handed to him through the sgts' rejection of his so-called pension reform.

It's time for a forensic audit of Chicago's budget. It's time for legislation to cut city Alderman rolls to 22. It's time for term limits for all elected officials. Why are the Alderman the only parcel of Chicago government to not sustain meaningful personnel cuts. We could easily, at no cost to taxpayers, cut the Alderman to 22 and configure their districts to the police districts. They can place their offices in the police districts. Get them closer to the people. No court battles over redistricting and they should be able to serve any of their constituents no matter race.

First things first...forensic audit of all bank accounts in the name of, or operated by, the City. Let's really see TRUTH.

We should also demand a full copy of the contracts associated to the sales of public assets including skyway and meters...but not just the contracts...all of the negotiation materials including notes, emails, any and all money transfers related to the contracts or negotiations. This could be very powerful information.

Soooo let's say for arguments sake each officer should be owed an average of 2000 dollars retroactively for the past year. And let's say there are 10,000 of us. that means mr. Shields just potentially put 20 million dollars of our money back in the citys pockets because he failed to mail the letter. Like many of you have stated, there are many more important contractual issues to deal with aside from a "retro check" ; however if our bargaining unit just in essence gave the city millions of our dollars how can we trust them to solve the bigger issues?

The city gets temporary boost in manpower and when the homicide numbers go down they stop VRI. The city saves because they dont hire new police officers.

SCC... pick a date or several dates. See if police officers will boycot VRI. That will be the test of whether or not we can stick together. It's not a work stopage because it is VOLUNTARY!!!

The Sergeants showed tremendous unity. And there is no need to pick on the 134... it is what it is. Dont believe Sergeants needed Shields to sway them to the no vote. Most Sergeants have been around the block once or twice.

By the way this boycot should include everyone that is eligible to work it. Everyone needs skin in the game. P.O.s, Detectives, Sergeants, Lt.s. We are all in the same fight...

I think the arbitrator will have the final say in whether Mike was wrong in not submitting the paperwork on time, remember there is a state law that contradicts what the city is arguing, even the media is careful to use the word "may".

As far as retro is concerned, I wouldn't hold my breath on getting much or any pay raise. The VRI money is our pay raise.

First point - the FOP has always got the letter in on time. As a matter of fact, it is usually hand carried to the City on Feb 1st and signed for by the Ciry so there is no arguing if it was sent in time.

I might not agree with Jim Ade from the Sgts. association but he hand delivered the letter b/c the consequences are you are agreeing to another year of contract with no raise.

I sure am flab Shuelds brought his friend Jim McCarthy down with him to help with the legal stuff. McCarthy and Geiger must be pretty shitty lawyers!!

On the question of the ILPRA, it has no effect. The clause in question is a sunrise provision. Basically, get the letter in by March 1st, if you don't than the expiration date changes from 30 Jun 2012 to 30 Jun 2013. So the ILPRA has no effect until 90 days before expiration date which hasn't happened yet due to Shield's fuck up

Sid Davis was re-elected as Recording Secretary and still is Recording Secretary. Shields did not retain Sid as a Field Rep and the Field Raps work in the office at HQ and make the Captain's pay.

Caparelli also is not a Field Rap... McCarthy lost the election but was appointed as Field Rep. Saul DelRivero lost his election and was also appointed as Field Rep.

Yes, someone should have clued Mike in to important deadlines. Donahue was around. Recall Mike cleaned house when he got in, he fired Pleines and fired almost all of the inside office civilians so who was around that knew that letter was due?

I knew it but I lost my election so I wasn't around to offer advice that, hey, that letter needs to get sent.

Shields fired the secretary who typed it last time and would have known to do it. Shields fired the attorney who made sure it was done in a timely manner for several contracts. Shields couldn't be bothered to simply pull up the previous letter by Donahue and tell a secretary, "Change Donahue's name to mine and change the date, and we're good."

The City cannot withhold it regardless of what their PR newspaper machine says. Even if the letter was sent a day late or two days late or a week late, state law trumps some inconsistent contract provision in our CBA. Illinois law gives the FOP 60 days to serve the City with notice--which it apparently did within that time frame.

While this blog may not know this, Rahm does. But he doesn't care.

What he cares about is taking away our pensions. This is what the rank and file should be worried about. We're gonna get our retro pay. But if Rahm has his way we might lose a whole lot more than that.

This letter flap is just another attempt by him to create division amongst us. See it for what it is people. While we're bitching about whether Shields slept on this, Rahm is wide awake reloading for another attack our our futures. Our past is safe--we're gonna get our retro one way or another. Start looking ahead people. We have a real fight on the horizon.

I know a little about the law. And the minute the time period to send the letter expired, by operation of the contract, the contract was extended for one year. This means that when Mikey boy sent his letter in 60 days before as required under statute, the contract had already been extended and was therefore moot. If him and Geiger took a break from eating steak dinners and chasing tail every night on the member's dime, they may have known how the law operates.

You think retro doesn't matter? Look at it this way. Even without retro, FOP has forfeited one year of raises, which we say is conservatively, 2%. Every raise after is a percentage of the previous year salary. FOP has shorted itself the benefit of that raise for every year for the rest of your career and into your pension. It has been given away. You will not get it back. Free money that should have been yours goes back to the city.

I cannot understand why no one from FOP doesn't do anything about the leadership's incompetency. Has anyone called the state lodge to complain about the breach of fiduciary duty? Has anyone asked how much was paid to settle with Pleines when he was fired? How much to settle with the victims of sexual harassment when it ocurred at the hands of FOP executives? Its the members' money that is being used to foot these bills yet nobody cares. And now, when money was clearly left on the table by the ignorance of a few, I still see the "he's a great guy" posts. This cost the members money and will keep costing! Meanwhile, the FOP decision members continue to make captain's and commander's pay and sit on the glass at every Hawk's home game in seats paid for by the poor schlep working the beat car in the ghetto on midnites.

Well the fop cost me 6 months of retro from 2012. We had a contract for first 6 months of the year. Our raise would have been 1 percent for those 6 months. So fop cost me $375 before taxes. I loved reading the email that the FOP sent out to members when this news hit the papers yesterday.

The email blames the City for a "letter" rising from the ashes because of the no vote on the sergeants contract. They try to tie the pension fight in the argument. Did the FOP just not justify the sergeants voting down their contract because of tying in the pension debate with contract issues?

The FOP is blaming the City for their failures and crying foul when the City tells them our current contract was extended to the end of June 2013 because of FOPs failure to submit the letter in the time stipulated in the contract.

The letter then goes on about how the City is betraying us. Hey Mikey, you are the one who is betraying us when you have lied to us for the last year in regards to the letter disaster. You are the one who has not been bargaining in good faith with your members. You fucked up in not sending the letter in during the time frame the contract stipulates and the City still held negotiation meetings with you over the last year even though they did not have too. Now when they break off meetings you are trying to put the blame on them. You fucked up.

Stop trying to twist your fuck up back on the City. Sounds like they extended an olive branch by bargaining over the past year when they never had to and could have just waited to 1 July 2013.

Members, this is why we do not vote in a person who has ZERO union experience. Never was on the board. Never was a unit rep. Was never even a watch rep. Hell he probable has never even filled out a grievance. He always talks about the lack of experience in the command structure of our department yet he has zero experience in union business before this past election. Donahue and all the rest who've headed FOP have made backdoor deals and sold their souls to the devil.

They've all lied to us, they've all profited from us and from the position they've held as FOP president.

We were screwed by an old veteran, and we're getting screwed by a youngster.

Same shit, different day.

We better learn to stick together, because this is war my friends, and it's going to get mighty ugly.

When I came on the job we stuck together. If a WC stuck it to the troops, it was swiftly dealt with by whatever means necessary, until he got the message. We had the power then and we would still have it now if we stick together.

When I came on the job there were guys nearing retirement who started in the 60's. They'd cut smart-asses to ribbons with one well-placed remark, bosses included.

Coppers who came before us fought hard for the benefits we now enjoy. Don't give them up.

I just finished reading all the comments about how one of the veterans should have told him to send letter. How do you know that one or more of them didn't tell him? Maybe he just made the decision not to send it.

..so glad I'm gone next month. Best time to leave. Free health care . My deferred in dow market is at record level. Summer gonna be horrendous but I dont have to deal with it ever again. I've got about a year and a half to go, plan to leave at 55, especially if the free health care is still available.

Can someone advise if the city can pull that after you retire with that as a benefit?

You're absolutely right. Pension and medical are the cupcake and the frosting. The rest, like retro, uniform allowance, shift differential, etc, even if we had to give up a holiday, those are just the sprinkles.
