Sergeant Contract Fails (UPDATE)

Not just fails, but crashes and burns.

Approximately 900 - to - 100.

In the old days, the leader of such a disaster would either cut their own stomach open, or shave their heads and become a monk, never to be seen again.

Hopefully, Rahm does both.

Back to the drawing board.

  • Chicago Police sergeants on Monday resoundingly rejected a proposed, four-year contract with the city tied to pension and health care reform, dealing a stunning blow to Mayor Rahm Emanuel’s efforts to solve the city’s pension crisis.

    Emanuel had praised Chicago Sergeants Association President Jim Ade for the “courage” he demonstrated in cutting a deal the mayor hoped would serve as a “road map” for other unions to follow.

    But the divide-and-conquer strategy that touched off a civil war among Chicago Police officers failed miserably with the rank-and-file.

A stunning blow to whom? The only three people pushing for this were Rahm, PBPA President Ade and Fran Spielman. Get a load of how she describes this "deal" in the article:
  • By an overwhelming vote of 876 to 134, sergeants rejected the groundbreaking deal that would have raised the retirement age for sergeants to 53; increased employee pension contributions from 9 percent to 12 percent by January 2015, raised health care contributions for new retirees to 2 percent of annuities, forfeited cost-of-living increases every other year and limited C.O.L.A. in intervening years to 2.5 percent with simple interest.

    The tentative agreement also included a 9 percent pay raise spread over four years while maintaining the $1,800-a-year uniform allowance and $3,220 in annual duty availability pay that supplements a sergeant’s income.
(1) Raised the retirement age; (2) Increased pension contributions by 3%; (3) raised health care costs for retirees; (4)forfeit cost-of-living every other year; (5) limited COLA.

Wow. The Sergeants sure negotiated a GREAT contract!!! Plus they held the line on Duty Availability AND Uniform Allowances, something that the FOP negotiated years ago in lieu of pay raises - remember?

We sergeants aren't as dumb as we look :-) and please stop bashing Jimmy Ade for trying to do what he felt was right. His instructions from us members was to retain what we had and he accomplished that. The offer never would have been made by the city without the pension attached.

Sergeants have always run the watches and have finally been recognized by GMAC . Now we must demand to be compensated for our new responsablity.
There will be new leadership in Sergeants PBPA , we will never sell out our current or future retirees .
Our current leadership attempted to sell out the entire Chicago Police Dept and retirees .

The FOOLS who voted yes should be "castrated" as Jessie would say. 2.25% pay raise per yr and pay 3% into pension. Give up or stay the same after all gained in previous contracts. But lose in retirement age, COLA-not compounded IDIOT FRAn SP-and pay more fore health ins when retired. City would have more leverage taking away the Quarterly big checks they get or do away with the three quarters of an hour OT they get every day for showin up to work. I was amazed that many Unions are still paying little or nothing. We have put in our end. No "forgiving" the City anything.

Rahm has to be furious, this was a big gamble by him to get a small union to set the pace for all the others. I would believe that no arbitrator will get tangled up in pension issues. That is far beyond the scope of labor contract talks, so it should be a quick arbitration, ha!
I have a feeling the legislature was waiting to see the outcome of this, I still fear what those idiots will do to us if they get a chance. Strike one Rahm, but he still has a bat! Watch out a dictator scorned...............

interesting story here on the state pensions, the numbers, and blame game too. They throw Blago under the bus and use him to blame it all on.

How the actuary table of 50 years were used instead of 30 years for example like everyone else.

the new NDAA laws that congress passed, (both parties) -- the president has the power of a king, a pre-Magna Carta King that can call you an enemy combatent with no proof, no trial and either hold you in dentention indefinetely or order your execution in a drone attack if necessary to take you out.

How many consitutional amendments does that action violate?

And posse comitatus?? Hell naw, that's the DHS setting up checkpoints in our cities, they're not federal troops. That's silly. It's for your saftey. Taking away your firearms is for your safety. Taking away free speech is for your safety. The NDAA is for your safety. Right?

WASHINGTON, March 11 (Reuters) - Illinois, which has the worst-funded state pension system in the United States, agreed on Monday to settle federal civil securities fraud charges alleging it repeatedly misled municipal bond investors about the underfunding of its pensions, the U.S. Securities and Exchange Commission said on Monday.

Illinois neither admitted or denied the charges and was not ordered to pay a penalty. It agreed to change its practices to more fully disclose risks to bond investors.

The settlement of charges that Illinois failed from 2005 to early 2009 to fully tell investors the risks of buying $2.2 billion worth of its municipal bonds is the latest blow to the state's reputation as fiscally troubled and crippled by a pension shortfall of $98.6 billion.

In official statements accompanying bond offerings Illinois explained that factors such as market performance had contributed to the increase in its unfunded pension liability, but it "misleadingly omitted to disclose the primary driver of the increase - the insufficient contributions," the SEC said.

In order to keep its contributions low, Illinois had developed a complicated system that included "ramp-ups" and "pension holidays," the SEC said.

Instead of paying to pension funds what actuaries had determined to be the annual contributions, Illinois followed a funding plan approved by the legislature that deferred the payment of pension obligations, compounding its pension burden.

The legislature phased in the state's contribution over a fifteen-year "ramp" period, where the amount Illinois put in gradually grew until in 2011 it made the full amount. It then had to put in a level amount so the pension system was funded by 2045.

The state went further, amortizing pension costs over 50 years, instead of the typical 30, which gave it a longer window to pay off the liability. Then, it lowered the contributions in 2006 by 56 percent and in 2007 by 45 percent in "pension holidays."



INSTITUTIONAL FAILURES

There were also institutional failures, according to the regulator. The Illinois government relied on bond underwriters, consultants and lawyers to advise them what to disclose but those same groups were relying on the state for the advice, SEC said.

"The result was a process in which no one person fully accepted responsibility for identifying and analyzing potential pension disclosures," the settlement document said.

Beginning in 2009, the state took steps to address the commission's concerns, the SEC said. Over the last four years, Illinois has improved disclosures in the pension section of its bond offering documents, retained disclosure counsel, and instituted written policies on disclosure.

In 2010, the state also enacted a law that employees hired after Jan. 1, 2011 would have a higher retirement age and lower pension.

Governor Pat Quinn said the commission had acknowledged the "proactive steps" Illinois took improve its pension disclosures, and that "the state began these enhancements prior to being contacted by the SEC."

Many states had long short-changed their pension funds, and when their revenues collapsed during the 2007-09 recession, they pulled even further back on contributions. At the same time the leading source of revenues for pensions, investments, plummeted in the financial crisis. According to Pew Center on the States, the pension gap for all states is currently $757 billion.

Illinois Comptroller Judy Baar Topinka, a Republican who was not in office when the alleged abuses took place, said the state has done "the right thing."

"Unfortunately we will all be paying for the mishandling of the pension funds for many years to come. At the time I warned that raiding our pension funds and borrowing to make our payments was a 'ticking financial time bomb' and sadly, that has come to pass," Topinka said.

The pension fund and health care for retirees will end up even worse than the deal. Please no comments about it is the law and city has to comply and that it would take a constitutional amendment to change certain aspects.
For a hundred years bond holders were always at the head of the line before anyone else in bankruptcy-- what happened to GM and Chrysler bondholders-- that was the law. HAHA
The Pols in springfield will get around any so called Law that is on the books.

Then let them change the law or add an amendment to the constitution. That can be challenged in the courts, but dont just give it away

HB3538 solved the police and fire pensions. It was passed and enacted on January 1, 2011. If nothing is ever done or nothing would be said about our pensions, starting in 2015, the city would have to put in their proper share yearly so that in 25 years in 2040 our pension would be funded to 90%. HB3538 mandates that the city puts in the money or the state cannot give them their share of the state city revenue sharing. Thats the problem, the city doesn't want to do that so instead they are trying to get out of their mandated obligations by trying to scare the employees into raising their contributions Dont let that happen. When HB 3538 was passed there was no mention of increased contributions or freezing or reducing COLAS. Why pass a law and honor it if all the city has to do is say I dont want to raise property taxes so let the employees raise their contributions. Our pension is already regulated by HB3538

Only a person in Tennessee could think of this.
From the county where drunk driving is considered a sport, comes this true story.

Recently a routine police patrol parked outside a bar in Bristol, TN . After last call, the officer noticed a man leaving the bar apparently so intoxicated that he could barely walk. The man stumbled around the parking lot for a few minutes, with the officer quietly observing.

After what seemed an eternity in which he tried his keys on five different vehicles, the man managed to find his car and fall into it. He sat there for a few minutes as a number of other patrons left the bar and drove off. Finally he started the car, switched the wipers on and off--it was a fine, dry summer night--, flicked the blinkers on and off a couple of times, honked the horn and then switched on the lights. He moved the vehicle forward a few inches, reversed a little and then remained still for a few more minutes as some more of the other patrons' vehicles left.

At last, when his was the only car left in the parking lot, he pulled out and drove slowly down the road. The police officer, having waited patiently all this time, now started up his patrol car, put on the flashing lights, promptly pulled the man over and administered a breathalyzer test. To his amazement, the breathalyzer indicated no evidence that the man had consumed any alcohol at all! Dumbfounded, the officer said,"I'll have to ask you to accompany me to the police station. Me too. Make sure you talk to your brothers and sisters. No matter which way they vote when it does come up, make sure they vote. I think a good rule would be to fill it out and mail it the same day you get it.

I'm ashamed to say, I've put a ballot or two in my bag, meaning to get to it, only to have the deadline pass. I won't make that mistake again. Maybe we can make that a motto--"Get it, vote it, mail it--same day!"

I'm not a sgt., but I agree. Sgt's have to supervise everything from dead wood to overzealous coppers. You not only have to protect yourself, you've got to look after the troops, some of which are less than grateful. You've got to discipline people while motivating them at the same time. I don't envy beat sgt's at all.

It's got to be the worst job in the dept., especially for those sgt's who have to get up there at compstat.

The last sgt's test I took, I didn't even go to the second part, because I could not see any benefit to leaving the D-unit to become a sgt. in a district.

It is against labor law for any police union to dare try to negotiate for retirees. Retirees are not part of the bargaining unit. Some years ago the FOP tried to get some wording in the contract regarding some retirees rights. The City's chief labor lawyer Franczek said they would walk out if FOP tried to bring that to the table. Retirees are not covered by the contract. They are no longer City employees.

The pension board represents retirees as does any law firm hired by retirees. For instance, Krislov and Associates represents retirees on the Korshak thing.

Mike Shields re election is not until October. I recently heard he got the negotiation paper work late on purpose so we do not have a new contract at all during his first term. This way he has a better chance of being re elected for a second term. He knows he is up for a tough re election and he has little confidence in being re elected if we get a horrible contract.

Uhuh. Yeah, in 011 we have time to spare between our backgammon and chess tournaments to get this accomplished....arresting people for ignoring tickets. Is that even a legit law on the books? I've heard of collection agencies, but to lock somebody up and clog up the court system for not paying a ticket? That should make the lockup real happy.

Doesn't this mope realize that 99% of the people locked up for DOPW, gambling, etc., and are given tickets, etc., don't have 2 nickels to rub together? He wants us to lock up the homeless, penniless now? So penniless the most they could afford is a slingshot?

People too illiterate to commit any offense above a dice game or scrapping or being a homeless alcoholic?

Does he really think this strategy will lead to catching masked armed robbers, home invaders, murderers and so on?

Seriously? This guy is too stupid for words. I keep a huge bottle of Excedrin with me at all times.

They fully believe that McBox is going in the right direction. They even refer to him formally, as in Superintendent McCarthy, while talking with others.

It's like they were kidnapped and given IV's of the Kool-aid. No joke.

I can only surmise that the personalities of these sgt's are made up of traits that would have made them willingly drink the kool-aid at Jonestown....and served it to their children as well.

Look, they force us to retire at 63. They throw us out of a job, and then threaten to let the pension go bust? No court in the land would let that happen. That's why towns in California have had to close libraries and curtail other services to meet pension obligations. Changes have to be made, but Rahm is trying to scare us, and he found a willing participant in Ade. From prior contact, I believe Ade to be a good man, but he must now resign, as , going forward, his motives will always be called into question. His lack of disclosure regarding this mess was inexcusable. We must remain calm, and get new leadership ASAP. We also need to hire a good lawyer versed in pension law.

Here's a thought about how the city could live up to their obligation to catch up with funding the pension that they have neglected. New Casino in which 25% of city revenues would go to shore up their end of the pension obligation until they catch up then they can do what they want with the funds. All parkers, movers, Anovs would have a percentage designated towards our pension until the city got caught up with their end of their obligation and all funds from said tickets and violations would go towards same until the city catches up with their obligation to our pension. I know I would be writing as many tickets as possible knowing that this would go to our pensions, or else the only other alternative would be big tax increases or big cuts in benefits. This can be done but the city has to be willing to do it. As far as an agreement with the city, if they won't honor the state constitution then how the hell would they honor a contract agreement? The provisions written into the constitution were wetting to protect us, from the very people in office right now. Never give up our constitutional rights for a bullshit contract. The state liedto the SEIU and what happened? Not a fucking thing, what's makes anyone think that they would not lie to us?

Just a note here, the Lt's & Capt's union board had voted to approve a the very same package that was given to the Sgt's Assoc. They heard the backlash that was being sent over e-mails being sent out with the Majority against it and a few for it. So they held it up and not presnet to their membgership. This I got from one Lt on that board. So FYI beware of the other unions.

Great guy !!!! He just gave an opportunity for Rahm to circumvent our pension that the State Constitution protects us from. Wow ! what a great guy. From the FOP Current Update. March 12, 2013

Yesterday, the Sergeant's Union sent City Hall a message when it rejected Rahm Emanuel's contract proposal. The FOP fought for the "No" vote and publicly opposed this terrible deal. Today, the City wants to take its revenge. So, City Hall dredges up the long dead issue about the "letter" it claims is required to terminate the Agreement. FOP has been negotiating with the City since last Summer.

Now, with its feelings hurt by the Sergeants' rejection, you see the issue of the "letter" rise from the ashes. We called the City's lawyer immediately and asked how this story could be in the news given that we have been negotiating since last year. The lawyer blamed City Hall, saying that they were bent on revenge against FOP because President Shields did everything but "dance in the end zone" when the Sergeants' contract failed.

Brothers and Sisters, the FOP will stand and fight against the City when it breaks pension promises. It will stand and fight against any deal that only calls for sacrifice from one side - the workers.

The FOP will not compromise. We have the Public Employees Labor Relation Act and the facts on our side. Chicago Police Officers made our City proud and made the Mayor look great during the NATO Summit. We have a dangerous job in a violent City. During Rahm Emanuel's term, we have been asked to do much more with far less manpower. Now our Mayor would deny raises to those same people that work so hard for the success of this City? It is a terrible betrayal.

Last March, the City told the FOP that it would negotiate with this bargaining unit out of its "deep respect" for the men and women of the Chicago Police Department. If the Mayor really respects us, he would sit down and negotiate with us. Because of the City's failure to bargain in good faith, the FOP will file an unfair labor practice charge immediately.

the sgts voted down this deal because it stunk--- you don't go buy a car with four flat tires--- this deal was doomed the moment it was inked--- it is hard to believe that over 100 voted in favor of it--- looks like another lenghty impasse and a retro check in another couple of years as usual...
