County Rifle Sting Goes Wrong

A lawful gun owner, attempting to follow the rules and conduct a private sale, is detained without cause because some politician wants a headline:
  • BEWARE OF THE COOK COUNTY SHERIFF

    I had a rifle on armslist that I was looking to dump, nothing important. When I received a email from a buyer telling me they wanted to purchase the rifle. We exchanged phone numbers. I received a text last friday asking me to meet the buyer. I was working, but wasn't busy.

    They wanted to meet in Oak Park, I said NO WAY.

    They recommended a different spot. I agreed, the Portillos on Roosevelt and DesPlanes. There is a gun range a couple of blocks from there that I thought would be a better place but, it was Friday and I was more afraid of rush hour then I was of the location.

    Long story short, it smelled and looked wrong. the car was a pick up with black windows. I'm thinking gangbanger. When I pull up two guys get out of the car, but they are both older white guys. They didn't match the car. They look over the rifle, but when it comes time to sign the paper work, the guy doesn't have a FOID card. He tells me he has a domestic arrest.

    I tell him I can't sell him the rifle, he offers more money, I reject his offer. He keeps try. I keep saying NO.

    Next thing I know, there are 50 cops surrounding me, they are searching my car, and handcuffing me and toss me in the back of a car.

    Within 15 minutes I'm in the Maywood sheriff station. They are asking where I live, how many guns do I own, how many I've sold. The experience was rough and distressing. I didn't want to answer any questions.

    All I can think is that I'm in handcuffs for some reason, did I break a law I wasn't aware of. If I answer a question wrong I end up in a jump suit.

    Turns out, I didn't break any laws. They want me to give them information that I didn't have. I almost had a heart attack. I walked out an hour later with my rifle.

    What the bloody hell was that. Is this how we threat citizens when political fortunes are on the line. It took me a week before I had the nerve to post on this site. I use be mad at people who refused to sell to cook county residents. Now I understand, its not worth it.

    How native was I, be-careful. FTF is hard enough without having to worry about bogus stings. 
We aren't lawyers, but we know a few, and this stinks to high heaven. Almost entrapment by "suggesting" the transfer take place in Oak Park. After numerous refusals to sell the weapon to a known Domestic Battery offender, insisting and raising the offer?  This badgering wouldn't stand up in any real courtroom - of course, they took him to Maywood, so who knows what would have been lied about over there.

Doesn't Dart have some puppies to rescue rather than putting millions of taxpayer dollars at risk on a "sting" that doesn't even pass the smell test?

    Oak Park's gun ban was declared unconstitutional along with Chicago's. Oak Park got stuck paying the NRA for legal fees.

    Oak Park asked Chicago for help paying those legal fees since Chicago asked for Oak Park to join Chicago in the suit. Chicago declined. Way to go Rahm. Ask a small town to join you and then refuse their request of financial help when they do join you. What Oak Park had to pay was their entire budget for street repair for one year. Bet they won't join Chicago in any more gun lawsuits. But the sergeants union got indemnification for illegally trying to steal our pensions.

Why has Lynch applied to become chief of UC/Berkeley? Has the U of C given our chief is walking papers because of this BS liberal outrage over the recent protests at U of C hospital?     First of all, you WERE arrested. When you are handcuffed and taken from the scene on the street to the police station involuntarily, you are under arrest.

    There had better be an Arrest Report.

    You did not mention whether they gave you Miranda Rights.

    If what you say is correct, the "officers'" conduct is not only contrary to police practice, but violates a whole bunch of state and Federal Laws.

    Get yourself a lawyer and cash in. And those nitwits are a disgrace to law enforcement. They deserve to get a new hole tore in them.

    Only the Cook County Sheriff's Office would hire anyone so stupid.

    If the head of that operation was smart he would have bought that rifle out of his own pocket and avoid your lawsuit.

    Have your lawyer preserve video/audio evidence before it gets erased.

    Some years ago Daley attempted to do that by sending undercovers CPD into legit gun stores. In one case a retired cop was the clerk and recognizes one of undercovers as a cop refuses the sale but does not blow the cover of the cop because he thinks it is a legit undercover operation.

    Stay Safe, look out for undercover cars at gun shops and gun shows.

    We are the government agents of a corrupt and unjust system here in Chicago. We complain about the corrupt politicians, but how many will sign up for VRI and unjustly stop people for contact cards, let alone that "gun pinch?"     Sir, what happened to you is definitely a violation of your civil rights. The 4 th amendment prohibits unreasonable searches and seizures. You were arrested for no reason. Please consult with an experienced civil rights lawyer. Torreya Hamilton knows what she is doing and gets results. You should be compensated for what happened to you. Good luck.

    You said the undercover sheriff's deputy revealed a domestic violence conviction. However, the armed citizen you quote was only told by the buyer that he had a domestic violence arrest. This difference is huge. the federal law prohibits sale or ownership of firearms to those convicted of a misdemeanor DV charge or who have an order of protection. A DV arrest itself does not automatically create an order of protection. Despite what liberals want to believe, if this imaginary buyer had a FOID, he was well within his legal right to buy a firearm.

    I am NOT a big fan of the ACLU. But in a case like this they do have a downloadable booklet on what to so if you are stopped/detained.

    It is unfortunate that we are starting to see a divide between "good" law enforcement and "bad" law enforcement.

    A well armed citizen thinks: You my friend were the victim of a crime by the government. You may consider contacting a civil rights attorney who specializes in criminal civil rights litigation, review the matter with him or her and decide your options. By attorney I do not mean Loevy and Loevy or those types. I believe the problem begins when they took you into custody. Up until then, I would not agree any of your civil rights were violated. By the way, you should rethink the internet gun selling idea. Meeting people in parking lots does not really solve the safety issue. The rest of your actions are indicative of a responsible gun owner. We have a duty to follow the laws to the letter.

    As a Retired CPD Officer I feel what happened to disgraceful. I worked many stings in a undercover capacity and never attempted to entrap anyone. Once the found out you were acting in a legitamite manner the action should have stopped. You were correct not to answer any questions. You have that right. These type of actions are what gives Law Enforcement a bad name. I am glad it worked out for you. I would persue legal action. This was not right.

    I feel bad that a law abiding citizen had to go through such a horrible situation like this but as a brother in blue I would never recommend a lawsuit against my fellow police officers. They only were trying a scare tactic to see if this could have led to some illegal sales of guns. Just like we do out there in the ghetto on a daily basis to get a good arrest. Once it was determined that the citizen refused to sell the uc the weapon he should have been thanked and sent on his way.     Citizen said "domestic arrest."

    We said "known Domestic Battery offender."

    It's amazing that cops are still willing to work in that grey area, bend the law or whatever you want to call it, just to stay in their spots. The bosses won't be able to protect you when you are a defendant in federal court charged with a civil rights violation. Your willing to go to prison, get sued, lose your job and lose your pension for some boss and to stay in your unit. You're nuts!!!!!!!! By the way civil rights violation does not have a statue of limitations.

Ask a small town to join you and then refuse their request of financial help when they do join you. What Oak Park had to pay was their entire budget for street repair for one year.     It was only when the media started asking questions that Kelly posted an entry about the purchase on his Facebook page:

    I just had a background check a few days ago when I went to my local gun store to buy a .45. As I was leaving, I noticed a used AR-15. Bought that too. Even to buy an assault weapon, the background check only takes a matter of minutes. I don’t have possession of it yet but I’ll be turning it over to the Tucson PD when I do.

    As a Retired CPD Officer I feel what happened to disgraceful. I worked many stings in a undercover capacity and never attempted to entrap anyone. Once the found out you were acting in a legitamite manner the action should have stopped. You were correct not to answer any questions. You have that right. These type of actions are what gives Law Enforcement a bad name. I am glad it worked out for you. I would persue legal action. This was not right.

    Yes it was. Sgt. Bob O'Neil, on leave from CPD and Ald. Burke's kid, were the Uc's. The whole thing was thought up by O'Neil, and brought in CCSPD at the very end, two hrs before the deal took place.

    There are a lot of CCSPD guys that are good cops... This investigation was initiated by a former CPD sergeant, now working directly for the moron Dart. The other UC was none other than Alderman arrogant's son, EB Jr..

    The SP guys refused to take the case, but were ordered by our inexperienced and police hater Sheriff. The SP guys have there share on goofs, but this was the actions of a guy who wanted another press release!!

    Sir, what happened to you is definitely a violation of your civil rights. The 4 th amendment prohibits unreasonable searches and seizures. You were arrested for no reason.
