A Law Already On The Books

  • One measure to curb gun violence in the wake of the Sandy Hook Elementary School massacre took a major step forward in the Senate Monday when a bipartisan group of senators agreed to push a bill designed to crack down on gun trafficking.

    The measure, the Stop Illegal Trafficking of Firearms Act of 2013, merges a Democratic effort by Sens. Pat Leahy (Vt.) and Dick Durbin (Ill.) with a similar effort by Sens. Kirsten Gillibrand (D-N.Y.) and Mark Kirk (R-Ill). It also adds another Republican as a supporter, Maine's Susan Collins.

    The bill would make it a crime -- with stiff penalties -- to purchase weapons on behalf of someone else who is barred from possessing weapons. Such "straw purchases" are believed to be the leading source of guns trafficked to criminals.
Thank goodness the legislature is doing something, right?

Uh, no:
We're going to say it's a little bit from column A and a little bit from column B.

Once again, a failure to enforce existing law and then passing a law that merely reaffirms what is already on the books without adding any sort of penalty so everyone can feel good about "doing something."

They're desperately trying to justify their existence. Really, at some point, pretty much all the laws that you can write are going to be written. THEN what do you do to justify your existence? Why, you RENAME them and pass them AGAIN!
(Or, you become the food police and ban foie gras, big gulps and energy drinks.)

New York City Police Pension Fund to keep gun and ammo stocks

New York City Police Pension Fund will retain its $9.97 million investment in five gun and ammunition companies, according to Patrick Lynch, president of the New York City Patrolmen's Benefit Association and a member of the police pension fund board.

“We oppose criminals having guns, not law enforcement and law-abiding citizens,” Mr. Lynch said in a statement provided by Al O'Leary, a spokesman for the Patrolmen's Benefit Association. “While the social impact of pension investments can be a consideration, there is no evidence that the manufacturers of these weapons that are the tools of the trade for law enforcement have done anything improper. The pension board's primary responsibility is to make sound, financial investments.”

Mr. O'Leary, in an interview, said the pension fund board didn't take a formal vote. He said board members had been briefed by New York City Comptroller John Liu on the gun- and ammunition-related investments. Mr. Liu is the investment adviser, custodian and trustee of the five city pension funds within the $127.5 billion New York City Retirement Systems.

The $9.97 million investment in gun and ammunition companies represents a tiny portion of the $26.8 billion police pension fund, according to data provided by Connor Osetek, a spokesman for the comptroller.

Alliant Techsystems Inc. accounts for more than half of the total police pension fund's weapons investment with $5.45 million. Other pension fund investments are in Olin Corp.; Sturm, Ruger & Co. Inc.; Smith & Wesson Holding Corp.; and Forjas Taurus SA.

The $46.6 billion New York City Teachers' Retirement System voted last month to divest its $13.5 million in shares of the same five gun and ammunition companies.

Who is going to enforce this? FBI?ATF? who .. the answer is NO ONE.

How many gun crimes were prosecuted by the USA out of the Northern District last year? 2011? 2010? thats what you really need to look at.

Lying on ATF form 4473 (the background check when you purchase a gun) is already a felony, and that form requires you to affirm that you are the buyer of the gun and are not a straw purchaser.

I agree. Stay away from Fox River Grove, IL. Assholes with red light scamera system at IL route 22 & US 14. You can't win. They say it's for "safety", but if it was really a safety issue, why not just install NO TURN ON RED signs; that way nobody can make a right turn on red. OOPS! If they did that, they wouldn't be able to give out $00 tickets by mail, that you can't fight. And no, it doesn't matter if you come to a complete stop. WHAT A SCAM!

And therein lies the rub.

The Cook County ASA would rather hang this over an offender's head to force them to plead to a lesser offense than go to trial on something she might have to actually fight. That, plus judges would rather a plea agreement be offered than have to sit on the bench all day, "listening", "litigating" and well, JUDGING.

As far as federal involvement goes, good luck. As an earlier poster said, Biden says we don't have the personnel to enforce those laws.

Apparently passing more laws is somehow the answer.

It's all an effort to make it appear that they're "doing something" about the problem.

The fact that that it will have no long-term effect means nothing.

As another previous poster said, you can't regulate the actions of savages. You know it. The elected know it. The savages? They're unaware of ANY of this.
