Finally, Consequences?
Someone finally noticed that if there is no enforcement, then there is no reason to fear a non-existent consequence:
- Chicago offenders caught drinking, gambling and urinating on the public way will no longer be free to ignore their citations with impunity and blow off their administrative hearings — at least not without risking jail time.
Ignoring concern about the impact on overcrowded Cook County Jail, the City Council agreed Wednesday to throw the book at those offenders, up to 70 percent of whom are currently in default because they don’t fear the consequences.
Aldermen approved Mayor Rahm Emanuel’s plan to add six months of jail time and double the maximum fine — to $1,000 for drinking and urinating on the public way and $400 for gambling — for violators who fail to pay their initial fines and are no-shows at administrative hearings.
Of course, nothing says that Sheriff Dart has to accept the prisoners that show up at "the bridge" at Cook County Jail. We said last week that Dart and Preckwinkle are going to demand some sort of monetary compensation before they even think of reopening the Division that Dart closed a year or two ago.

"the right people." So we guess the homeless are free to continue to piss on lawns and be drunk in public. They're untouchable. And we're pretty sure Preckwinkle will be objecting to the racial makeup of those already in default to the city.

Maybe they will issue warrants but they will never make it to county... They will get brought infant of the judge after the warrant is executed and they will plea to time served or it will be sol. If they are found guilty they won't be going to jail or sentenced to time... More than likely supervision, swap or time served with a small fine. Much todo about nothing
My Cook County Board Commissioner posted this regarding this story:
"So if the city arrests you + you can't pay the $1000 fine, you can be jailed for 6 months…costing the county $25,000"
Well the homeless going to jail is seventh heaven for them. Three hots and cot and shower. The people fingers wants to get is the working person they will spend $ to show up for work monday morning.
They want social justice, not equal justice.
So if they don't pay.... Didn't we already try this in traffic court? How about the lab fee for the state on narcotics cases? No cook county judge in their right mind dare to put a strain on the "people".

A person can not be jailed for violating a city ordinance because it is not an offense. An offense is the violation of a state law. City ordinances are not criminal laws and they do not heard by real judges.
The first court of jurisdiction is the Circuit Court. The city administrative courts are not criminal courts and use the Illinois Code of Civil Procedure because it is like the city is suing you when they charge you with an ordinance violation. Even when ordinance violations are heard in the Circuit Court the civil procedures are used there too.
Jail time is considered “jeopardy” and a person facing jeopardy is entitled to certain rights, such as a finding of guilt beyond a reasonable doubt. In the city administrative courts they only need to prove guilt by the civil standard which is “a preponderance of the evidence”.
Now I’m an old flat foot and even I know this. What kind of an idiot is advising them to do this nonsense or is this just a show and they never intend for the City Administrative Court Judges to ever sentence anyone to jail?
The Circuit Courts and the Code of Criminal Procedure are there for a purpose and there is no way to get around it. The City probably likes their administrative courts better then the Circuit Court because they have a higher conviction rate – and that is because of the lesser standard of guilt.
There will be a lot more ghetto millionaires after this fiasco.

What the great alderman is saying is, enforce this ordinance around the Universities and ballparks.That way the city has someone to force to pay.The shitbags will continue their obnoxious behavior with no consequences.
In over 30 years on CPD,in multiple Districts,I never heard of anyone doing jail time for a city ordinance.I doubt that any judge will jail someone for a Quasi-criminal city ordinance. Like one poster said,Dart won't let them in the jail doors. I have to agree with him on this one.
Pawer is rahms guy. He needs to make sure the Wrigley crowds and his ward types are not arrested for all the drunken behavior. He does nothing without rahm giving him the ok.He has done nothing since he took over from Schulter.
I work at 26th Cal. A few sergeants are refusing to accept them and doesn't care if CPD gets mad and insists. The reason, the original "crime" is not a state statute and punishable by jail time. Sergeants say they aren't about to be sued over violating someone's rights.

Preckwinkle has gone on record saying Ronald Reagan has a 'special place in hell' or words to that effect - for his war on drugs.
Someone should tell the Mensan Preckwinkle that not one of the savages locked up in Cook County jail is there due to anything Reagan ever did. Not one. As you all know, the Illinois drugs laws were passed by the Illinois legislature, not Reagan. Goof Preckwinkle.

We have all these websites showing the names and salaries of government workers and contractors. How about a website listing all the others receiving government checks such as welfare, Medicaid, food stamps, SSI.

It's not my fault nor yours that the majority of law breakers and the majority getting locked up are black. They love trying to make something it's not. It's not racial, it's fact. I am not from here, I am a Southern boy but we do not allow malcontents to stand in front of every business, shake a cup, chase people and get sunburnt on the sidewalk. I would love to go back but right now I am stuck here.
I am often faced with the choice of how to escape from the latest aggressive panhandler when I go to an El stop, the officers in the neighborhood are sympathetic but people always cry discrimination no matter what color the offender is.
Who do I have to vote for so that Chicagoans can enjoy a more hobo-shenanigans free existence?
I thought we took an oath to enforce the laws impartially? Who are "the right People"? Please explain it all to me.

Isn't a State Law that being intoxicated on a public way is a "Illness" and the poor person has to be offered a ride home, taken to a hospital or rehab center? The ERs didn't want this type of person at their hospitals but did get stuck with them.

Even if this was a conservative place you can't use federally awarded dollars to pay for municipal offenses. Like duh-uh.
