The Clouted Survive Again

Remember the drunken nutjob ASA on video repeatedly calling a CPD Officer a "fucking whore" after being arrested after biting a shop owner on the north side?; The video went viral, three witnesses backed the store owner and the cops on the scene displayed amazing restraint with this entitled and clouted asshole.

Cleared of all charges late on a Friday (in hope of burying the story):
  • A judge acquitted a Cook County prosecutor and her boyfriend of all counts against them Friday involving a scuffle in which she was accused of sinking her teeth into a man’s leg.

    Associate Judge Anthony John Calabrese made the ruling after testimony that painted a less-than-pretty picture of Sarah Naughton and Bradley Gould’s Sept. 22 night out.

    Defense attorneys Jeffrey Aprati and Rick Bueke said Naughton and Gould, both 31 at the time, were battered in an overly zealous eviction from a lingerie store.

    At least three witnesses Friday suggested Naughton and her boyfriend, Gould, appeared drunk and out-of-control outside Taboo Tabou, 854 W. Belmont. David Boone said Naughton bit his leg during the scuffle, requiring him to get a tetanus shot.

    And Naughton kept telling people she was an assistant state’s attorney, according to testimony presented by prosecutor Daniel Nikolic, a member of the Illinois attorney general’s office.

An overnight comment says Judge Calabrese is a former ASA, so it's no surprise this went the way it did. Remember taxpayers - this is/was representing you, the people, at court. Money well spent.

Should anyone be surprised, look at our own Department. Female copper with less than 15 years,leaves a do nothing district most of it inside, transfers to 016and gets straight days/weekends off, in her District of residence. Think about that next time you pay for child care because you have to work at the other end of the world. Chicago is not legit!

What they found was enhanced officer safety kept floating to the top of the list. Improving or creating a culture of safety within departments needed more attention.

At this point if ANY COPPERS didnt know this here is an FYI. Its safe to assume Many judges, defense lawyers "for criminals too" were ASA's sometime in their careers, at least from what I've seen in Chicago. Basically lawyers are NOT out to get each other or make each other look bad at a trial and they use "professional courtesy" like many cops do for each other. They play politics and VICT's "even a PO" are never given a real chance, its all about deals and conviction rates. CLOUT rarely loose in court. If a PO finds himself at a crossroads in court as a victim, try to make a "deal" and get Money if possible from the offender because the SYSTEM will not protect YOU> FUCK the principle of the case, get PAYED.

Remember as I predicted. Sarah Naughton is Gino Naughtons daughter. Gino Naughton was a former states atty at 26th street and then a 10 year lawyer in Vrydolaks law firm on Commercial.

Sounds like Gino got the case sufficiently shopped in front of the judges at 26th street. That’s the same Gino Naughton that has the habit of not showing up in court to represent his clients…

The 3 day bench trial of Sarah Naughton, the drunk leg-biting A.S.A., and her attorney ex-boyfriend ended on 05 April. Naughty Sarah was found not guilty of 9 charges and the ex was found not guilty of 4 charges. Judge Calabrese, a one-time A.S.A. who once worked with Sarah's daddy, another former A.S.A, ruled that the victim was really the aggressor. Thus Sarah and her ex were the victims. The four witness lied. The 3 P.O.s were wrong. A newly obtained video was shown in court. The in-car camera had recorded Sarah getting out of handcuffs, removing the seatbelt, kicking the rear window, slapping at a P.O., and trying to force herself to vommit. Judge Calabrese stated that at no time did she try to resist arrest. The problem was that the faulty handcuffs came off of her. Amazing.

But we know that the whole intention of keeping it in the CROOK County Courts was to protect this evidently clouted piece of drunken shit. If that was a copper involved in the same situation, he/she would have already been prosecuted by these ASA assholes, found guilty and FIRED!

This drunkard was charged with a felony if I remember correctly. Calabrese is in branch 29 which is misdemeanor court. Branch 42 is felony court so how did Calabrese just happen to preside over this case? Is it because he knows this girl's father really well and the fix was in? Something seems fishy to me. This is a shame too because I used to think that Calabrese was a decent judge. Decent not good because decent is all you can hope for in Crook County.

By the way I resent the slurs that just because this judge has an Italian name he made this decision.

I could easily see a judge named Murphy, Daley, Burke, Jackson, Hernandez, Lipinski, or Horowitz also making a fine decision like this.

Just remember this is Cook County. Our judges come in all ethnic flavors, but surprisingly the taste is almost always the same. What taste is that?

PS I can recall a few cases in the last few years where clouted cops were in the trickbag for stupid off duty behavior and miraculously were found not guilty. In two cases the judge was the same guy.

I don't recall many complaints here about that. In fact some of you hurt my feelings by suggesting that my not celebrating those occurrences made me more mouse than man. I lose sleep over it.

Ultimately the same standard should apply to everyone. Unfortunately the truth is that there are multiple standards.

For those who are truly clouted files disappear, detectives retire and are hired by the CCSAO and special prosecutors have to be named.

For the moderately clouted trials are held quickly and favorable judgements are rendered quickly.

For the unclouted bend over and prepare to be boarded by prosecutors and also possibly expect a phone call from your helpful friendly neighborhood alderthug.

On THIS particular case, Judge Calabrese ruled in favor of the ASA defendant, despite evidence that could have unequivocally convicted her and withstood most (legitimate) appeals.
My only point is that having appeared before him on many occasions, I've considered him overall as definitely pro-prosecution and pro-police. He has made it perfectly clear to the ASA's regarding HIS minimum sentencing guidelines.
He has shown a no-nonsense, often comical approach on handling the mutts that are late without a documented excuse for their tardiness.
I've seen many taken into custody for a BFW from earlier in the day without a release later that afternoon and held until the next court date, IN CUSTODY.
My favorite is when a regular (repeat) criminal, in custody, fails to take HIS offer for a longer than average incarceration time and asks for a continuance to mess with the state/witnesses.
(Calabrese does not want ASA's to offer TCS, just to flip the case) When the judge finds that the defendant refused the offer of 60 days H of C he'll continue that case 90 days just to send a message.
It is quite refreshing to see a judge control the defendants in this manner in his courtroom.
Most coppers that appear before him on a regular basis would probably agree about his 'overall' courtroom is handled in a professional and conservative manner.
While this case appears to 'stank' from what I've seen, I still consider him one of the better judges overall. I'll put this latest episode 'into the playbook' but will refrain, for now, to overly criticize him based on the other 95% positive that is attributed to him on a daily basis.
Just my 2 cents.

How did it get to Br 29? Are you new here? Felony gets tossed, No PC, returns to Br 29 for misdemeanor charges, lower court tosses it and probably no fix was necessary. The complaining witnesses got reached and did not come to court or declined to prosecute. Someone dropped off a bag of money or promises of favors or something similar. Judge didn't have to listen to a Motion to Fix, it got fixed before it got to Calabrese.

This judge throws every case out and punishes no one! He looks for every reason to launch a case. This guy is the worst judge ever in the misd. courts! He is friends with nearly every lawyer before him and spends more time laughing with defense lawyers and talking about the old days than actually looking at a case. I've even seen him yucking it up with Sam Adams Jr. and guess what happened to the case later? He is so politically tied to nearly everyone that he can't be fair. This judge will continue a case over and over for a full blown shit bag charged with delivery of cannabis and then toss the case because the lab tech. on the cannabis case didn't show. It's not even worth sending a case to this court room. It's a waste of paper, time and safety. This county is a laughing stock!

He is an Associate Judge, which means that he is appointed by the full Circuit Judges. He was not elected by the public. Some Associates hold office for years by virtue of appointments (either from the Circuit Courts or the Illinois Supreme Court).

Great prosecutor and a decent person. He is not corrupt. He prosecuted Roman Chavez. Chavez disarmed and murdered PO Ray Kilroy and PO Greg Hauser (025).
It's fine to vent about the ruling in this case, but the personal attacks on Tony Calabrese implying he's always been a crook, or was paid off, or is mobbed-up, are really uncalled for.

Really? She's an ATTORNEY you idiot. If you needed legal representation and you saw this video (which will be on the internet for the rest of eternity by the way) would you want her to represent you? A courtroom is supposed to be a place where justice is served. If the people metering it out do not have appropriate personal standards of living or respectability how can they preside over others?

Between people like Judge Brim and this young woman (who appears to be heading down the slippery slope of alcoholism), which, Heaven help us, may be just a small sampling, I would be afraid to have to go into a courtroom as a defendant. Fortunately, I behave in a manner that would not result in having to go to court for anything. But if you did, would you want Judge McGinnis presiding over your DUI case? Would you want Judge Brim deciding your fate? For years, they moved Brim around because her court calls were a fucking disaster, but nobody knew about her schizophrenia and periodic non-compliance with her medications, so she had the APPEARANCE of stability and intellect by virtue of being a Judge. Did Tim Evans know about her mental health issues? And you know Geno's kid will be back in a courtroom after this blows over. Would YOU want her to be the State's Attorney who's building a case against you? People in the legal profession need to be ABOVE reproach in their reputation. That is what the ARDC is for. So, where is the ARDC in all of this?

The outcome of this case was a slap in the face to every law enforcement officer and or respectable citizen who lives in a law abiding manner. It says, in no uncertain terms, that we (courts) will do whatever we want and protect whoever we have to because we owe 'someone' or they are related to 'someone' or the person that broke these particular laws doesn't deserve to have a felony conviction because they are special.

If the corruption in the Cook County Court system is that pervasive and deep, then every honest citizen is completely fucked because the problem is that the people like Brim and McGinnis and this girl don't give a shit about their reputations. They will have the audacity to, collect their pensions, continue to practice, accept a promotion, or go on to do whatever it is they desire to do in life because someone will always be there to grease their way or smooth things over while the average citizen reads about them in the paper or watches them walk by and wonders why.

Tom Tunney's phone call to the store owner was the tip of the proverbial iceberg and a rare glimpse into the process of how things really get done in Cook County.

When it went to trial the state had to let the shithead plea out because one officer was indicted federally, one at the state level and two others were under investigation. Lil Jack was convicted of a misdemeanor by the way. He's been at callback since. I'm sure he'll be back detectiving soon enough.

I am a officer who has testified before Judge Calabrese in the past couple of years. I honestly believe he is one of the better judges that we deal with. He has always taken his time and made defendable decisions. I did not always agree with him but I can not remember a single occasin when he was not fair and impartial. I lost a case that I thought should have been a a winner and he took the time to explain why he made his decision in open court. He is better than most that we see and well versed in case law.
