Was sitting in a Markham court room one day when Let 'Em Go Leo gave probation to a skirt who blew Ol' Boy's brains out while he was sleeping (she said she had been abused). As she passed the rail on the way out, New Boy tried to give her a hug, but she gave him a subtle wave off. Sure looked like misdemeanor murder to me.

SCC,

You do a fine job in analyzing legal scenarios. Your explanations are not bad. Felony murder does not require too much brain power to understand. I hope that the retarded person is not a police officer. This job needs an IQ test.

Hey idiot, when an offender knowingly commits a felony and because of said actions, this offender causes the untimely death of a citizen intentionally or unintentionally, the charge of felony murder is presented

"Felony Murder" is a generic term for a state criminal statute that makes it a crime of 1st degree murder when a person dies intentionally or unintentionally during the commission of a forcible felony.

Illinois' "felony murder" statute is 720 ILCS 5/9-1(a)(3) which states as follows:

"(a) A person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death:

(3) he is attempting or committing a forcible felony other than second degree murder."

Illinois courts have even held that accidental deaths are chargeable as 1st degree felony murder.

Example: Thug #1 and Thug #2 break into your house wielding guns. Homeowner shoots Thug #2 and kills him but Thug #1 gets away but is later arrested. Thug #1 gets charged with 1st degree felony murder for the death of his accomplice.

Example: Thug robs bank at gunpoint and flees in his car. Thug is pursued by cops and runs over a kid in the street killing said kid. Thug is charged for 1st degree felony murder even though he had no intent to kill the kid.

Example: Thug robs bank and the bank manager dies after accidentally falling down the stairs while going to the vault to get the loot. Accidental death = Felony Murder!

Are you catching on yet?

For the uneducated, try doing a little research before exposing your ignorance for everyone to see.

"Felony murder" is a synonym for murder that isn't first degree.

Interesting you bring up the phrase "misdemeanor murder." When I was at a mini class reunion in Lake Geneva, Wisconsin several years ago, (one of our teachers retired up there), I was listening to Chicago radio and landed on what was a really weak signal on 1690 AM on a Saturday afternoon. A black caller was telling the black host that because so many black men convicted of murder have a hard time finding jobs when they get out of prison, that the state ought to make murder only a misdemeanor if blacks commit it.

http://definitions.uslegal.com/f/felony-murder-doctrine/

The felony murder doctrine states that unintended deaths that occur during the course of committing another felony are murders. The doctrine does not require an intent to kill. In some cases the conviction for murder is sustained when a codefendant did the actual killing. Even if the death were accidental, all of the participants can be found guilty of felony murder, including those who did no harm, had no gun, and/or did not intend to hurt anyone.

Some states have by statute elevated felony murder cases to murder in the first degree. Such statutes typically define the felony murder as where the homicide or death of a victim occurs accidentally or otherwise as a result of injuries received in the commission or the attempt to commit a specified felony, such as arson, kidnapping, sexual assault, robbery, burglary, breaking and entering, escape from lawful custody, and manufacturing or delivering of a controlled substance, where the defendant participated in such commission or attempt to commit one or more of these enumerated felonies.

http://definitions.uslegal.com/m/misdemeanor-manslaughter-rule/

Misdemeanor manslaughter rule is a principle that death occurring during the commission of a misdemeanor or sometimes a non dangerous felony is involuntary manslaughter. This rule has been abolished by some states and by the Model Penal Code.

Under California's "misdemeanor-manslaughter" rule a killing without malice committed during an unlawful act not amounting to a felony which is dangerous to human life is manslaughter. [Saa v. Yates, 2010 U.S. Dist. LEXIS 94412, 10-11 (C.D. Cal. June 15, 2010)].

Sure there is misdemeanor murder. Just look at the reduced charges and nonsense the states attorneys office puts forth in court. I have no idea what law they try and prosecute, it's certanly not in any of the law books we read.

All misd homicide cases that are not 1st, 2nd, or 3rd degree murder and that are not committed with a weapon which could result in armed violence charges (such as a long gun) must now be assigned to Branch 23. However due to a shortage of Deputies they will only be assigned on the first and third Tuesday of each month. However is the call becomes too large due to the busy summer months the presiding judge can also authorize any other day of the week which he/she chooses as long as the additional cases will not interfere with the impounded vehicle cases.

Out of state cop here, when I went to a class given by Vernon Geberth, former NYPD homicide detective, twenty some years ago, he said they used the term 'misdemeanor murder' when he was there. Crimes like beaten kids that died, home invasions where an 88 year old lady was killed, those were MURDERS and they busted their butt to solve it. Stuff like homeboy #1 disrespects homeboy #2, or Juan owes Chavo dope money and won't pay, what happens then is a misdemeanor murder and it got the appropriate amount of follow up. I'm surprised your superintendent hasn't picked up on that as a way to throw the numbers....'yeah, murders are up, but a higher percentage of people being killed are actually criminals, so they're just misdemeanors, the FELONY murders of good citizens are down'. I hope if he reads it here I get credit for the idea.
