Juvie Court ASA Resigns

  • A prosecutor with the Cook County state’s attorney’s juvenile division resigned last week because she says she was demoted and suspended without pay for dropping charges in a politically sensitive and flawed case. The case, which involved a downtown “wilding,” garnered negative media attention.

    The term “wilding” entered Chicago’s lexicon in recent years to generally describe groups of youths who harass, rob and terrorize people in the Loop and on the Magnificent Mile, two of the city’s biggest tourism draws.

    Sonia Antolec, 30, told the Chicago Sun-Times that one such case ended up on her desk in early April. She said police paperwork indicated that a woman who had been mugged while riding a CTA Red Line train with her mother near Lake Street had been able to identify the girls who attacked her shortly after the incident. Antolec approved charges against the girls, all minors.

    But the case fell apart when Antolec interviewed the victims, who told her something surprising that was not indicated in police reports about how the muggers were identified.

    Police had lined the girls up against a wall with their backs facing the victims. “The victims were asked to identify them from behind,” Antolec recalled.

Of course, none of this came out during the actual investigation by detectives. Only after she started prepping the victims/witnesses did any shadow of a doubt come into play.

Sorry, but we aren't buying it.

It certainly seems she got dinged for not following proper procedures. And the video has her blaming ::gasp!!:: the police, the detectives and trotting out the tired old meme that "...8 young black children were mistakenly arrested..." as if police cruise the Mag Mile looking for black people to arrest.  Blaming the "racist police" is an old liberal technique used and perfected by Jackson and his ilk to absolve the arrested criminals from actually having to face the consequences of their actions.

She claims she resigned because she got punished for dong the right thing. The question now becomes "which right thing?" Cook County States Attorney Anita Alvarez's "right thing" is keeping the Machine in power and the voting blocs happy.  And Cook County Board President Peckwinkle's "right thing" is keeping minorities out of jail at all costs, regardless of their guilt or actions.

We're betting she lands another County job shortly.

i'm not a leo, but i am a lawyer, and from listening to her it's apparent something's not right here. it's pretty clear that the problem wasn't the investigation conducted by the police. it appears that the problem is ms. antolec's case of liberal white guilt. i would have loved to be a fly on the wall when she interviewed the victims. probably sounded more like a cross-examination by a defense attorney.

between this headcase, and the one that got arrested at the porn store on belmont...if this is typical of the state's attorney office (and it appears that's exactly the case), we're fucked.

Sorry SCC, but I believe that you have this one wrong. The victim's told the dicks that they could only ID from behind, so what happens, they view a line-up looking at the arrestees from behind. Call me crazy, but as long and I have been in the "D", this just doesn't cut it. The video clearly shows severl shitheads taking the victims purse and making good with her property, police just grabbed the wrong ones based on a weak flask and a pink hoodie. I doubt the dick's pressued anyone into making an identification, but trying to do the "right thing" as far as the dick's are concerned will only make a helluva pay day for the chillins that had their case nolle'd by the ASA. And, she had her supervisor's approval to do so. So don't be so fast to judge the young lady. Seem's she got it right, and i doubt that she will be vying for any County job, if she wants it I am sure that there are several high profile criminal defense firms that would enjoy hiring her. But she doesn't seem the type to go to bat for the dark side. But seeing she is a single Mom, and needs to support herself and her son, I bet that the big guns are already knocking on her door to file suit against Anita et al.

WTF is this "Do the right thing" nonsense?

I thought that it was the Prosecutors JOB to Follow the law and put criminals in jail. and NOT play Public Defender for 'urban teens' -- or wear a Cape in court /s.

Granted it's alway hoped that in following the law the 'Right Thing' will be the results, and any exculpatory evidence will be turned over as SOP, but this is ridiculous.

Didn't the officer know who he IS?

Not to worry, Mell will just have a state law passed exonerating him from all culpability for any offense within the State of Illinois on that day. Sort of like when he blew his gun regiatration and the City Council opened gun registrations for one day for everyone in Chicago named Alderman Dick Mell from the 33rd Ward.

These things happen and can easily be fixed.

I don't know, SCC, we have goofs on this job silly enough to conduct a lineup with the suspects facing a wall. These same goofs will grab the first people they encounter who remotely resemble a description and put them on a wall. Apparently, that's exactly what happened.

If, and this is a big if, what she claims was even partially true, the cases had to be dropped because even a really bad judge would have tossed them out.

She may well have violated procedure, but it seems likely that the main reason for her punishment is the bad press.

It does not seem likely to me that she would make up a story like this that could be readily checked.

Come on, SCC, something isn't right with this case and it doesn't sound like the ASA is the culprit. She states that the victim expressed surprise at the backwards showup and the vic did not know why this was done. Seems to me she could ID facially so why a backwards ID? This sounds very screwy with either the coppers at the showup doing wrong or a lying victim. I suspect a lying vic myself but can't be sure. Sounds like the ASA had a losing hand dealt her and Anita is covering for someone.

There is no way dicks would run a lineup like that, but if the POs did a showup like this for some silly reason like not wanting the offenders to see the victims, then the POs better get ready to pay.

For future reference, whites usually make terrible victims and witnesses. Most would rather give up their property than go to court. Whites almost always shitcan a lineup.

If the kid was beaten because he told someone that the kid was selling drugs that takes away your racial factor. Just because two people don't share the same skin tone does not automatically mean it's a hate crime. You should refer to your ILCS.

who to believe? simple answer: case was nolle pros, so no jeopardy attaches. if the id was good all they have to do is refile charges and go to trial. the fact that they haven't recharged tells you all you need to know about how good that lineup was.

Does everyone know every detail of this story? The victims picked out someone with a pink hoodie at a police line up where everyone is facing the wall, the ASA did not know about that until she interviewed the victim, decided there is not enough concrete evidence to convict and dropped the charges. What is wrong with that? Only God knows the field day a PD could have with this case if it continued to trial. And to my knowledge, juvenile court trials are typically bench trials, if this ASA has a judge that will not even entertain a case like this without concrete evidence, it only makes sense for her to dismiss the charges.

Hell, I've been working on the west side for nearly 2 decades, and some people I could only identify from the back. Like Big-giant-lard filled-ass lady that I see all over. From the front she looks normal, but the views from the side or back are one of a kind. To young, white people from Lake Forest, it's hard to distinguish one from another without previous exposure. Identifying markings on hoodies, writing on the rear of shorts, etc. is an easy way to remember individuals during a very stressful situation. At least one more "victim" will start voting republican.

I believe she indicated that SHE initially approved the original charges.
That normally takes place after her investigation of all the evidence during that investigative and probable cause phase.
Then SHE decides that the evidence/investigation is not proper.
To use an old defense attorney's court room tactic/question...

Q: Miss Antolec, based upon your own conflicting testimony, tell the court, 'Were you lying then or are you lying now?'

Trying to do the right thing will only get you jammed up. When bids open up, if they ever do, bid to your respective neighborhood/district and watch your homes and those of fellow officers. I am not familiar with the facts of the case but I made a couple of obervations in her interview:
1. She keeps talking about the "lineup" until Carol has her clarify how the lineup was conducted, she then describes and explains a "show up identification". Why does she keep saying "lineup" instead of "show up"? She knows the difference and I do understand that she describes the offenders as being lined up on a wall for the show up but that is not a "lineup identification".
2. She says that she "Approved" charges although the offenders are juveniles and were charged as juveniles. We all know that juvenile charges are not reviewed prior to charging by the ASAs. Am I missing something there?
3. She only refers to vague police reports as the source of her police investigation information. A detective should have done a less vague police report with interviews. Was that completed?

Off topic, but a good post idea. Hearing a lot of radio calls (ie burglar alarm) where the dispatcher asks the officer if they need an assist and the response is no. Shouldn't we be asking for back ups on all calls to show them that more hiring is necessary?

I have had the horrible experience of being "prepped" by this softy a couple of different times. I felt as if i was being crossed on the stand each time. "Are you sure" and "he's never been arrested for drugs before" were statements often used during these so-called prep-sessions. Those statements led to little arguments and her walking out in disgust with the insensitive mean police. I have always felt this sheep was on the wrong side.

Cute yet so ugly.

When it comes to all things CPD, I generally tend to defer to your insight, given that you are/were on the job. But, you are not, and have never been, an Assistant State's Attorney. So when you opine on the efficacy of an ASA getting fired whilst ignoring the fact that the evidence clearly demonstrated that that annoying little part of the criminal justice system, affectionately referred to as "reasonable doubt," was beginning to rear its ugly head, you should probably think again. As novel of a concept as it may be for you since you never went to law school, don't have a law license and don't practice law on regular basis, a prosecutor's job is not to get as many convictions as possible, or to approve every charge that comes through FRU. A prosecutor's job, the oath they swear to, is to seek and do justice. In doing so, they must evaluate the strength of the evidence that is given to them at every juncture of the prosecution. So when the time came to interview the victims/witnesses, she learned there were problems with the identifications, a critical piece of evidence when no other evidence exists to prove the doer did the deed. At this point, she didn't have much of a choice. Bear in mind, also, that she had approval from her immediate supervisor to nolle the charges, so that whole thing about not following proper procedure is, well, bullshit. Moreover, she didn't "blame the racist police," as you ascribe she did. She simply stated that evidence necessary to convict beyond a reasonable doubt did not exist, and the just result, whether you like it or not, is to dismiss the charges.

The attorney probably wasn't willing to toss her law license down the drain on a case that in her opinion was not solid. Also, she covered her ass and followed the chain as directed or she be in the media soot light. You have bullies in all government jobs and I for one am glad she stood her ground. For those that think she is wrong wake up -- Chicago has the most corrupt government and city workers too. I wish more people would stand their ground. Perhaps we would see a change in both racism and work ethic.

As a former ASA, I can tell you, the picture she paints of the office is incredibly accurate. Low level ASAs have no discretion whatsoever. Supervisors are all shitting themselves that a political firing wave will sweep them out, and no one NO ONE knows exactly who is watching your every move. Chief of Staff Dan Kirk runs his kingdom like a dictatorship, and he loves that people fear him. Friends are promoted, and life long skilled prosecutors go by the wayside. You have absolutely no incentive to "do the right thing." All you care about is covering your ass. And to all who say $63K is a load of cash, try raising kids, paying a mortgage, and paying down $100K in law school loans (because we're all not kids of rich folks - some of us grew up in blue collar families, remember). God forbid you are a single mom like this ASA. Why do you think so many people leave that hellhole?

The bigger problem in this country is that the court system, especially in Crook County, employs a rubber stamp approach to meting out justice.

I have had the horrible experience of being "prepped" by this softy a couple of different times. I felt as if i was being crossed on the stand each time. "Are you sure" and "he's never been arrested for drugs before" were statements often used during these so-called prep-sessions. Those statements led to little arguments and her walking out in disgust with the insensitive mean police. I have always felt this sheep was on the wrong side.

What this boils down to is HAIRGEL.

As in too much hairgel on the job makes handling arrests, doing show ups and writing proper paper almost impossible. Over half of what's left of this fucked up department are Generation Y leftovers who couldn't cut it in the corporate world.

When you have time, talk to a few of the 20-something's that work in your district. Ask them about ANY newsworthy current event, politics, finanances/investments, mortgages, health care, state of our pension ....ANYTHING PERTINENT TO EVERYDAY EXISTENCE... And you'll get the blank stare. Most (not all) of these kids are totally clueless and just drift thru life blissfully unaware. Pathetic.

This case was a loser the minute 8 of the 10 "police" on the scene stood around with their hands in their pockets/vests or blabbing away on their cell phones. This job gets collectively dumber every fucking day. RIP CPD.

I do. Check their papers and if everything is in order then let them go about their business. Marijuana is not the devil weed that most have been indoctrinated to believe. It is a harmless plant that actually has medicinal benefits and may one day provide a cure for multiple ailments. Coppers who arrest marijuana users are not making society any safer, unless you are talking about someone stoned who is driving a vehicle. If that's the case, then lock them up for DUI just as you would a drunk.

The duty of the prosecutor is to seek justice, not merely convict. She didn't have the evidence she needed. She is ASA and her opinion is exceedingly more credible than yours in this regard. Just looking at her credentials I'm inclined to believe her (those Jesuits aren't known for graduating dummies). We are a nation of laws, not passions. Everything else you posted is just presumptive race-baiting.

To put it another way, the ASA got it right for the same reason the Zimmerman jury got it right. Ponder that for a bit, I'm going to make a sandwich.

A felony in any other Illinois county and couldn't get the ccsa to do anything else but offer "court diversion" even after I went to court twice and made it clear I would continue to go. As a former ASA, I can tell you, the picture she paints of the office is incredibly accurate. Low level ASAs have no discretion whatsoever. Supervisors are all shitting themselves that a political firing wave will sweep them out, and no one NO ONE knows exactly who is watching your every move. Chief of Staff Dan Kirk runs his kingdom like a dictatorship, and he loves that people fear him. Friends are promoted, and life long skilled prosecutors go by the wayside. You have absolutely no incentive to "do the right thing." All you care about is covering your ass. And to all who say $63K is a load of cash, try raising kids, paying a mortgage, and paying down $100K in law school loans (because we're all not kids of rich folks - some of us grew up in blue collar families, remember). God forbid you are a single mom like this ASA. Why do you think so many people leave that hellhole?

When it comes to all things CPD, I generally tend to defer to your insight, given that you are/were on the job. But, you are not, and have never been, an Assistant State's Attorney. So when you opine on the efficacy of an ASA getting fired whilst ignoring the fact that the evidence clearly demonstrated that that annoying little part of the criminal justice system, affectionately referred to as "reasonable doubt," was beginning to rear its ugly head, you should probably think again. As novel of a concept as it may be for you since you never went to law school, don't have a law license and don't practice law on regular basis, a prosecutor's job is not to get as many convictions as possible, or to approve every charge that comes through FRU. A prosecutor's job, the oath they swear to, is to seek and do justice. In doing so, they must evaluate the strength of the evidence that is given to them at every juncture of the prosecution. So when the time came to interview the victims/witnesses, she learned there were problems with the identifications, a critical piece of evidence when no other evidence exists to prove the doer did the deed. At this point, she didn't have much of a choice. Bear in mind, also, that she had approval from her immediate supervisor to nolle the charges, so that whole thing about not following proper procedure is, well, bullshit. Moreover, she didn't "blame the racist police," as you ascribe she did. She simply stated that evidence necessary to convict beyond a reasonable doubt did not exist, and the just result, whether you like it or not, is to dismiss the charges.

The bad is that she let emotion be put into her job . She articulated she approved charges then dismissed them in court my dear lady you forget once submitted and approved you are swearing under oath of office that what everything was done with best clearly and video CTA and media coverage puts the offenders on scene also proved that. At the min any 12 year old playing batman can see that anyone on scene can be justifiable arrested for mob action. The theft/robbery you could have thrown out.You recanted said notion by liberal or malice prosecution which is against you and your oath . If the kid was beaten because he told someone that the kid was selling drugs that takes away your racial factor. Just because two people don't share the same skin tone does not automatically mean it's a hate crime. You should refer to your ILCS.
