Sergeants' Out-of-Grade

We guess the PBPA won one:
  • Sergeant's WIN DSS Arbitration

    Late yesterday afternoon, we received a favorable award in the DSS grievance.

    Arbitrator Roumell ruled that sergeants assigned as the DSS are in fact performing substantially all of the duties of a lieutenant and should be paid out of grade for the time worked as the DSS.

    There are a couple issues that need clarification, though, and Tom Pleines has already notified Arbitrator Roumell.

    Unfortunately, he is not available until next week.
    I’ll have more information and will inform you when we receive clarification from Arbitrator Roumell.

    This grievance award is a big win for our members and further protects the collective bargaining agreement from the Department in their attempts to circumvent the contract.

    The award in the interest arbitration for our successor collective bargaining agreement should be out pretty soon as well.
    Arbitrator Bierig related that he would have the award out sometime after Labor Day. Hopefully we’ll have it within a couple of weeks. Again, I will update everyone when we receive the award.

The labor attorney with so much experience and knowledge that the Sergeants association hired him right after the FOP fired him.

The same guy that sued the FOP for discrimination when he was fired. And Shields had to pay him off with our money.

And he actually did an excellent job winning the this grievance?

So please tell me why did Shields and the FOP fire him?

He seems like he knows what he is doing. I want him representing us!!!

This is also good news for officers grieving the out of grade for desk sergeant. Although a different arbitrator, this decision should help establish a precedent.

Just because the department "eliminated the position of desk sergeant" doesn't mean the guys and gals filling in aren't doing the same tasks and duties the desk sergeant used to. An arbitrator with a lick of sense will readily see that the department changed the rules in the middle of the game for their own benefit. Why was it OK to pay out-of-grade forever only to say "not anymore" in January 2012?

Approving inventories. Approving PC on arrests. Responsible for prisoners movement in and out of a holding facility for sick arrestees, lineups and detective interviews. Responsible for the money/transmittals for cash bonds. Responsible for the shift change audit of all prisoner USC and jewelry. If someone fucks up and loses a prisoner or cash turns up missing, you know the department will hammer them. So it's only fair they be compensated for taking on the additional responsibilities.

Then there's doing a lot of the DSS's work: court transmittals/paperwork on 1/W and 2/W (betcha didn't know the DSS is supposed to be stapling all those arrest/court packets together to send to court with the bodies, did ya?). Calling in court absentees. Calling Central Warrants to verify warrants. Writing bonds for those eligible. Yep, all are the DSS's responsibilities. Not to ENSURE these tasks get done, but these and other tasks performed by the desk people on an everyday basis are supposed to be the bosses' babies. The list goes on and on and on.

I hope these folks get paid what's rightfully theirs along with a substantial award to boot. What'll be interesting to see is how the department handles who works these assignments once all the smoke clears. Will desk sergeants return? Will XOs go back to running watches with a field lieutenant? So many questions that the city failed to see before they implemented these cockamamie practices.

Congratulations sergeants and fingers crossed for you desk folks who should be a shoe-in for a successful arbitration decision. Stay safe out (and in!) there folks,

Now what about the blue shirts acting as desk sgts 24/7 in the districts? At least in 010 a blue shirt is doing the tasks of a desk sgt all 3 shifts. Are they entitled to out of grade? They're approving arrests and putting two cents in on narratives when they mostly don't know shit about doing arrests. Whose accountable when they refuse to approve an arrest until you add whatever bullshit line they suggest. We will get jammed up in court not them.

You must not have been paying attention the last 20 or so months. POs have been dropping grievances one per day for the OOG pay. Aguilar at FOP wrote his article about it with an update a couple months ago. Someone mentioned theres been somewhere btwn 8000-10000 individual grievances dropped by people. Theres a guy downstairs (in 011) that claims 300 +/- grievances that JUST HE has already filed with copies of every last document/inventory/etc. neatly filed away for if/when he needs proof of all the work done as sgt. Seems the dick who is the Cmdr or MLAS wouldn't allow the officers to file a class action grievance nor would he accept them on a period by period basis. He wants ONE PER DAY. THE ONLY REASON FOR THIS IS TO WEAR DOWN POs FILING GRIEVANCES. I hope your arbitrator sees this move by MLAS. Good luck to you guys and girls. Especially in places like 002,010,011,007 etc. you desk people bust your asses and need a sergeant to run desks that f*^%ing busy.

Not sure it really has anything to do with the po's arbitration. Hate to say it but two arbitrators can really rule completely different. Not like a court where a previous ruling can set precedent.
Hopefully our arbitrator will read this opinion and take it into consideration

The po grievance for desk Sgt is a loser according to someone familiar with the case. Logic is a sgt has never been a watch commander/DSS prior to this. A Po has been a desk Sgt when there wasn't one available. So its not beyond the scope of duty for a Po to be a desk Sgt in the past.

You'll find out soon enough. Some of the old FOP regime is sweating right now regarding a certain attorney let go for overbilling etc etc. Some believe they were in cahoots. Some say this is why they sabotaged the Prez, for sniffing around the $$$$ issues at the lodge and wanting to get to the bottom of things. Questions on how the money was spent and on who and what seems to have rattled the old regime. What are they trying to hide?? And did they torpedo Mikey for checking into things when they all should've been on the same team? Questions questions.

You guys act like this extra pay is big. It is not such a big deal. Take a look at how many more exempts as X/O What do they do? take more money from the pension from doing nothing. All sgts will get back pay now do a grievance that it should be on your pension.
Do the math more exempts since we cut capt. Gotta love it the exempts are more and we pay more. wanna get promoted get a guy!

Hey moron did you actually see the contract portion for the Sgts. We had to give up nothing. Gained several huge changes to bids. And has a nice consistent raise. It was a good contract. The only reason it didn't pass is because Tiny Dancer and Ade attached a seperate pension package and made it an all or nothing deal. So go back to you beat car and answer that domestic because you will obviously never get promoted. Enjoy that no retro asshat. Probably voted for Shields too.

I was under the impression that the individual po files a grievance with the union and they decide what to do and how far that will take an individual grievance. The FOP has a grievance committee that decides what action the FOP will take on a grievance. The FOP does not file a grievance on every case

SCC is the place we can come to share information, have some laughs, mourn our fallen, pray for our injured, and most of connect with brothers and sisters of CPD!

People have many thoughts on the human face of SCC some say its a guy at midway airport, still others say SCC is retired, others still believe he/she/them are a boss! Bottom line SCC is for us and as a veteran copper 28 years, retiring next year all I want to say is thank you to the human face, thanks for all you dedication, and time, may God bless you and whoever does this for us,

Oh so what you are saying was that in the past Before the elimination of the desk Sgt a po was the desk Sgt sometimes. So that means it was not beyond the scope of duties for a Po to be he desk Sgt. Therefore there should be no compensation if its in your scope of duties. However a Sgt was never a watch commander therefore that was beyond there scope of duties. That is why their grievance won and the Pos will lose.
