The Lawsuit Train - CTA Style

Typical "deep-pockets" lawsuit, this time with the CTA as the defendant:
  • A lawsuit filed Wednesday alleges that the CTA and one of its employees are liable for the death of a Frankfort man with an open bottle of alcohol who fell last year from a Blue Line platform. Jeffery W. Knoll II died Aug. 7, 2012, when he fell onto the tracks at the Forest Park station and came into contact with the electrified third rail.

    According to the wrongful-death lawsuit filed by Knoll’s estate and mother in Cook County Circuit Court, a CTA employee asked Knoll and his companion to dispose of the alcohol but did not ask them to leave the station.

    Knoll, 28, didn’t respond to the worker’s instructions, the suit says, because he was “obviously confused, incapacitated or intoxicated.“ That employee, the lawsuit alleges, then left the pair on the platform after calling police and asking them to come remove Knoll. He fell before officers arrived.

    The lawsuit contends that both the transit agency and the employee were negligent in the minutes leading up to Knoll’s death and that they should have known that the electrified rail posed a danger to him.
The third rail poses a danger to everyone - if they stumble around and jump on it. And the estate of this dead drunken asshole might actually get paid, too.

Another case of, it's somebody else's fault.
Hey mom, why didn't you keep your drunk son home and get him counseling? The CTA should counter sue to collect for the money spent on the clean-up

Or, he was just an obstinate drunk.
Last I heard, CTA employees aren't required to be social workers, nor do they have police powers.

The family of an illegal Mexican got about $1.8 million when he pissed on the third rail at the Kedzie Ravenswood station a few years ago and got fried. No doubt the lawyers for this recent victim's family is "connected" and will get paid. The Chicago Way.

There's no personal responsibility anymore. I'll bet the family of the guy who "fell" on the 3rd rail at the Howard stop last month after the Pride Parade (and yes alcohol & tom-foolery played a major factor in this death) will do the same.

I hope the judge tosses this out. Or even better, finds CTA negligent, awards the family oh say $2,000,000. Then finds that the dead guy was 99% at fault and reduces the award by that much. Then you take their attorney's fees of 33%. They could walk away with a cool $6600! Shame on this woman for blaming others for her GROWN son's stupidity!!

The CTA will give them go-away money, about 10 grand.

It will cost way to much to even defend this--sad as it seems.

My wife's brother got caught in a closing door and ended up with a broken neck when the train pulled out of the station and dragged him 200 feet--the operator didn't look before starting even though people were yelling. He was sober, the CTA fought it tooth and nail, spend hundreds of thousands on lawyers and still paid over a million in the end. The operator was never disciplined

Continue to blame somebody else for your own actions. If the CTA employee attempted to escort the drunk from the platform, the CTA employee may ave been pushed onto the tracks? The employee did the right thing by calling the police. Nothing else required!

The law of the land should be, "You are responsible for your own actions." This guy got drunk on his own, decided to take the train on his own, decided to ignore the orders of an authority, and decided where he was going to walk once he got there. He subsequently fell on his own too!

After testimony from the CTA agent the judge will immediately award the Knoll estate a large sum of some throw down money.
In citing the reason for his quick ruling vs. the CTA, the civil court judge will simply mention Judge Gallagher's ruling in the Ald. Maldinado case.

The employee should sue the mother for raising such an idiot. He could say that he has forever been emotionally damaged for having to witness that death. He can't sleep, he gets nervous around crowds. He can no longer have sex with his wife because of the trauma. And it's all that idiot's mothers fault for raising such an idiot.

Do as they do in Japan. Shame and blame the thoughtless person who committed suicide on the tracks, causing others to have to needlessly wait, then make the dead guy's family pay for the cleanup.
