Detective Indicted

It would seem that the heat from parolees committing crime and boot camp being a failure is getting to the County people, so they have Anita indict a cop for a highly questionable set of circumstances:
  • For the first time in more than 15 years, a Chicago police officer was criminally charged Monday in a fatal, off-duty shooting because Cook County prosecutors said he acted recklessly, opening fire over his left shoulder from inside his car into an alley occupied by at least four people. 
Part of the reasoning behind the indictment is that no gun was found.

Really? We can name a few dozen instances where guns were used in crimes, then got legs and walked away in the hands or pockets of passersby on the street. Usually, someone who is about to be apprehended ditches incriminating evidence. The chances of that evidence, be it dope, a gun, burglary proceeds, an iPhone, disappearing are better than average depending on the number of people in the immediate vicinity versus the number of cops being on scene.

By the same token, does anyone think it's odd that if the police are running around, planting guns on every minority on the west and south sides, that no gun "turned up" on scene? If we're so good at putting guns on people, why didn't one turn up here? Are we suddenly incompetent at something we've been so good at for thirty or forty or more years? All those guns in our squad car trunks and we couldn't spare a single one to save a cop?

Sounds like someone wants to have their cake and eat it too.

(we make no judgement on the circumstances of the night in question. that's out of any of our hands now and in the courts. posts accusing us of taking sides or other nonsense will be deleted as usual. we don't know the circumstances and neither does any one else. if you read the linked article, the detective seems genuinely remorseful and reached out to the deceased's family members, expressing regret and sympathy for the events. it's up to them to accept or decline his explanations.)

First off you do not need to see a weapon to utilize deadly force, I'm tired of the lame stream media slandering news. I have seen it first hand of a gun growing legs and running off into the night never to be seen again after a police involved shooting, or chasing someone who pitches his jab while running from you, only to have him give up after a lookout picks it up and takes off in another direction. Someone folded like a lawn chair to indict this officer just to appease some low life store front reverend. Things like this happening will greatly impact our officers and will probably get one seriously hurt or killed because they will second guess them self. What has our world come to?

I gotta be honest, when I first read this story earlier, I did think you guys would take the side of the detective. As a PO I'm not taking a side either, its a tragic situation for both sides and the detective does seem to have LOTS of remorse, and the brother still being upset is understandable but hopefully he and the family can understand one day the stress that that type of situation puts on a cop at the time of that type of hectic situation. I know there will be some coppers who object but for there to be almost 700 police shootings since the the late 90s the article said I believe and he's only the second to be charged in almost two decades, there obviously has to be some evidence that has come to light and we have to deal with that. I dont believe its because of pressure from the man who was killed in Englewood because of the cell phone. After all people ALWAYS want cops charged for shootings even when they are clearly justified and thankfully we never are. This obviously doesnt seem to be one of thos situations. Lets all just await the out come.

I read a couple comments in the other posts about us not showing up to defend or support our own. Reason being......we are told not to stop by. We can't sit in the galley with uniforms on because we are intimidating. Judges throw us out, Asa's tell us to cover our uniforms. Yet these shitheads can do whatever they want in court when the tables are turned. What about interviewing us when it's one of our own as the victim? What about te outrage we have for the offenders? What about our side?



Oh yea we don't get a voice we deserve to be shot, beaten, stabbed and whatever else comes our way because we chose our job. Absolutely appalling the way we are treated in court when we show our support.

I was one of many cops on that scene that night and here is some advice for anyone, cop or legally armed civilian involved in a shooting on duty or off.

SHUT THE FUCK UP!

Bite your tongue and say nothing except to identify yourself and ask to see a lawyer immediately. You are suffering from shock; you are feeling dizzy and want to go to the hospital.

Do not say anything at any time until that lawyer is sitting on you lap. Continue to say nothing, unless advised to say it by the attorney.

Even days, months or years later, never say you fired shots to "KILL". Get the word "kill" out of your vocabulary. You or someone were being attacked and in fear of losing your life and great bodily harm and fired to neutralize the attack.

Stay Safe. Good luck Detective. This will become McAsshole’s Cozzi case. He was probably told by Rahm that this cost us $4million so fuck him and see that this don't happen again.

I feel very sorry for the detective. I have been in 3 shooting on this job!!! Having said that, it is impossible to arm chair quarter back. There is noway anyone can tell you how it went down, after it went down !! Unless it is premeditated murder or drunken discharge of a firearm you cannot charge this guy. The PO was in fear of his life and stayed on seen to cooperate with the investigation. We need to step and support this officer now and not convict before any trial has been put on. I wish to all my fellow officers a very happy thangsgivng.

It seems to me that if the courts and the city are willing to pay 4.5 million of tax dollars to the family, then this shooting is clearly on duty and no charges should be filed. The question is why isn't the face of the police out there either questioning the settlement or arguing that this officer should be afforded the same process as an on duty officer.

As a civilian, I have no problem with CPD using deadly force IF it's required. If one of you on here put down a scumbag who pointed a weapon at you, then I'll buy you a beer. However, in this case, someone else got hit with a round and is now dead. And when the city has to settle yet another multi-million dollar lawsuit for a fatal shooting, attorneys want someone to be responsible.

If this happened to a CCW holder, they'd be charged too - and odds are, not for involuntary manslaughter, but something more serious.

And "fully automatic Glock" - I know the Tribune is lazy, but can they at least use the correct terminology with firearms?

Full Auto Glock Handgun was used.

My wife was reading the story online yesterday night and used the above words.

Also were the words : Unregistered Firearm

Regardless of the circumstances...

No one in this Country unless they are a Tac Officer with written permission is allowed to Own a post-1986 Automatic Handgun.


He's done just for the above reasons.

Maybe the detective felt he did nothing wrong and wanted to get his story or his side out. Usually not a good idea, especially when everything he said in that French documentary can be used against him.
Dont think his lawyer did him any favors.

I am probably a lot older than you with a lot longer career than you and during that time I have saved a lot of cop's asses and maybe even a few lives. Some of it by reading into the future; if you do this than down the line this will be the result, same with what you write or say.

Only time will tell for sure and you may be right. If the Detective were found Not Guilty on All Counts, then McDufass, if left to his own devices might be inclined to let the matter fade and let the Detective shuffle Supplementary Reports until he maxes out his pension.

But I doubt that would happen. If found Not Guilty, every West Side Rev-run with a church the size of a phone booth or more will be calling on Rahm demanding that justice be done.

Rahm will then call McFill-in-blank and what do you think he will do.

So you could be right in that this may be more dependent on what Rahm wants than anything else.

Stay Safe. Based on what "Mr. McCarthy" has done in the past, would you trust him with anything involved in running the Chicago Police Department? Would you trust Rahm with your pension?

I know this PO. He is top-notch. His life was in danger that night; he took immediate, appropriate and proportionate police action. He did exactly what he was trained to do and what he swore an oath to do. Now he's being punished for it. What a damned shame.

I am probably a lot older than you with a lot longer career than you and during that time I have saved a lot of cop's asses and maybe even a few lives. Some of it by reading into the future; if you do this than down the line this will be the result, same with what you write or say.

Only time will tell for sure and you may be right. If the Detective were found Not Guilty on All Counts, then McDufass, if left to his own devices might be inclined to let the matter fade and let the Detective shuffle Supplementary Reports until he maxes out his pension.

But I doubt that would happen. If found Not Guilty, every West Side Rev-run with a church the size of a phone booth or more will be calling on Rahm demanding that justice be done.

Rahm will then call McFill-in-blank and what do you think he will do.

First of all, you are not older than me or have more time on the job, which really makes no difference.
All I was saying was dont condemn someone for something he has yet to do. When you said "do you really think he will rush to get the detective reinstated" I unlike you do not know what he will do, but it is possible.
Read page 7 of the October 2013 FOP newsletter written by Jim McCarthy.
There were two 015 pos involved in a street stop and there was a video of it. They were stripped and IPRA recommended separation and forwarded it to McCarthy. He wrote them a letter of a non concurrence opinion and restored the po's police powers and no separation. In the FOP article it was stated that this was not the first case he has written a non concurrence letter and that he has written several regtarding discipline and that the FOP has taken notice of that fact.
I have a feeling those 015 po's might not agree with you assessment of the supt.
