Once Again, Second Class Citizens

There is (or soon will be) not a single person in the State of Illinois who has to register a firearm anymore.

Unless you're a Chicago Police Officer.

Read the linked order here, right on page two:
  • H. Sworn members will register all duty and nonduty firearms with the Department.
Once again, we now have less rights than the other citizens of Chicago, Cook County, Illinois. We've been warning guys and gals for years now that something like this was on the horizon. That once Concealed Carry passed, without the support of the FOP, that we as officers would regret it for not supporting something that a majority of the citizens wanted and that the courts were going to grant. In fact, the disgraced ex-president of the FOP publicly berated the blog for daring to support citizen Rights.

Now what? Who speaks up for us? There is no purpose in this rule change aside from screwing with Officers. We'll guarantee Dick Mell isn't going to have to register any of his weapons, the weapons that Shortshanks changed city ordinance to allow for a loophole when Mell forgot to register his guns one year.

This is going to make an interesting Constitutional argument one day. And we predict it's going to cost Chicago taxpayers hundreds of thousands of dollars.

Can we, as dept members, argue that this isn't a lawful order?

Correct me if I am wrong, but a gun registry violates Federal Law.

No such rule or regulation prescribed after the date of the enactment of the Firearms Owners’ Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established. Nothing in this section expands or restricts the Secretary’s authority to inquire into the disposition of any firearm in the course of a criminal investigation.

Who is to say that those non-duty firearms are yours?

Also is there a charge for this, how did Rahm let that go?

I am sure that there will soon be universal gun registration just like Hitler wanted and got. As some historians noted, if every Jew in Europe had a Mauser rifle with 20 rounds of ammunition and the will to use it there would have been no Holocaust.

You have the Democrat/Commies like Pelosi saying that all military veterans are mentally unstable and should be forbidden to own firearms. I am sure they think the same of police officers.

Stay Safe. Guard your 2nd Amendment rights, government sponsored murder is not far away.

    "Once Again, Second Class Citizens"

"Condition Of Employment" will end up being the catch phrase in this...

"Ya wanna be/stay a Chicago Cop? Register ALL of your weapons."

Rahm must be figuring on wide open rebellion against his rule being spearheaded by The Police and supported by what's left of the oppressed upright citizen tax payer.

Rahm invested MUCH political and media capitol trying to drive a wedge between what's left of the oppressed upright citizen taxpayer and THEIR Police.

A discussion with one of our elder subject matter experts emeriti led us to the following:

You sign on to this stinking, shit-doo-doo job for a 20 to 40 year hitch... Each man his own time for his own reasons.

Everybody else either had the good sense to stay the fuck away or lacked the courage to step forward and sign up.

    Somebody. Has to...
Everybody doesn't have it in their make-up to just stand by.

Yet people want to be free and easy to heap criticism on the man that did sign up.

Both of these groups of people offer up plenty of not so expert commentary and Monday morning quarterbacking on how they think you should/shouldn't be doing your stinking, shit-doo-doo job that they couldn't/wouldn't sign up for.

You'll be condemned to second class citizenship in a city that burns Policemen at both ends and demand they show gratitude for it.

Yeah... Chicago Coppers aren't perfect. They cuss, yell and have a native tendency to play the Boots & Fists Symphony at the drop of a hat. Some people say CPD is chock full of too old, too wild and too ornery guys who are too steeped in martial/manly virtues and traditions.

The craven, non-native shit-asses have caused much ink to spill and many trees to be sacrificed to push their agenda that The Police are the problem.

    Not so...

So... Are Rahm and McLookAtMe going to sic the Police on The Police as part and parcel of this bad policy?

Heart warming... The notion of Police households having their doors busted off the hinges to enforce the illegal and un-enforcible under the capricious application of "condition of employment?"

Or will it be a nasty-gram via inter-departmental mail?

"We don't have a list of YOUR shit. Comply or get fired. Fuck you and your constitutional rights...

    Signed:
    Garry F. McCarthy
    (For Rahm Emanuel)

Or will that fall to Department of Homeland Security?

Whoever the Corporation Council is that ok'd this seems to be gambling on some cock-eyed reading of immunity under the municipal corporation banner should this order disintegrate under the weight of it's own fuckery.

Utter financial and career ruin should be their reward.

From Rahm & McIdiot on down.

Really? So the city can just make up all sorts of employment rules? While you're a cop, you can't vote. While you're a cop, you cannot worship off duty?

A "work rule" that flies in the face of a Constitutionally guaranteed right is legal? Not to mention the fact that it is a government agency doing the collecting of information. Like SCC says, a very interesting constitutional

The difference is that by not registering you are not committing a crime, but not following a workplace policy. Your discipline would come from your workplace not the courts.

Just like when CCW Licenses start being issued; there will be companies that prohibit employees from having firearms on company property including employee parking lots. Even though there is a safe harbor law for parking lots, if you stored your gun in your car an employer can discipline an employee for not following company policy.

Correct it will be labeled under condition of employment, just like residency. You as an individual still have the right to live where ever you chose and the right not to have to register your weapons in Chicago. All you have to do is resign, move and go work for Walmart.

On the other hand if you think the the City's firearm registration is gone forever you are wrong. They simply could not maintain the current system. They are expecting a huge influx of new handgun owners with CCW. I believe Rahm estimated 400,000 on channel 7 a few weeks back. .

I say in less than a year all will one again be required to register their firearms in the city. The registration will be handled by a private contractor and yes you guessed it. The new registration fees will be hundreds of dollars.

Just imagine, at 100 bucks a pop all current registrations have to re-register. Then add the estimated 400,000 new registrations on top of that.

And no, the gun registration was never ruled unconstitutional by anyone.

Now with the CCW training at 3 to 5 hundred dollars. The state fee is what 150 bucks + FOID and the new city registration fee. it will cost any one from Chicago 700.00 to 1000.00 dollars to exorcise their right to carry in Chicago or Cook County, who is also considering charging a fee. The county wants their cut and may also create a registration for ALL Cook County residents.

The city and county are also considering mandatory minimum 1 million dollar insurance policy for anyone who chooses to exorcise their right to own or carry.

It is all about the money people, we all know that. Their philosophy is that if they can not have things their way, which is no guns at all. We will all have to pay dearly to them for something that is our right under the constitution.

It is expected and reasonable for the department to require registration of duty weapons. It is not reasonable and was unexpected for the department to require registration of you private weapons. I am not an attorney, but I would guess that this is a requirement of the job that would not be enforceable in any many. FOP should file a grievance on this matter and go to court for a temp injunction. If anyone attempts to register any weapon that is banned by Cook County ordinance that is currently in court, they might require you to dispose of the weapon. I don't see the logic here except as a matter of power and control.

Since when do conditions of employment trump constitutional rights? So by your logic your employer can change your religion, not give lunch breaks, work you 100 hours a week with no compensation, tell you that you can't be married..... see where this is going? So if your employer wants to trample on your constitutional rights, he just calls it a "condition of employment".... I don't fucking think so.

Those of you who boldly say you will not register any other guns than your duty guns should probably think twice. If you owned and registered guns in the past they certainly still have a record of you owning that gun. There are laws that must be followed regarding the lawful transfer or sale of guns to someone with a valid FOID card. Dont outsmart yourselves and leave yourselves open to disciplinary action or potentially the subject of an arrest for firearm regulation violations. THose havent been changed by the new law. These are potential federal violations. Be careful!!! You may win in the end but in the meantime they can make your life miserable.

On September 11, 2013, the Chicago City Council repealed the law requiring the registration of firearms and the law requiring a city issued firearm owners permit.

You can give them them to any family member who has an FOID and a clean record. Before the new law there was a small gray/pink transfered lost destroyed form that had to be filled out. I am not sure what had to be done now.

"Not sure about this one. For years you were never allowed to sell a handgun to anyone but another po or a gun shop, even though Illinois residents were allowed to own handguns. Sounds similar"

We now have the Heller and McDonald decision, the Moore decision. And a very strong State preemption law regarding handguns. Again Chicago is being two cute by half. Despite what the ordinance says I can complete a private sale of a handgun (provided I check FOID etc..) to anyone anywhere in this state. Bring it Corp Counsel.

Pay no attention to the HUNDREDS OF MILLIONS being spent on pet projects that we don't need while your pension hovers around 30% funded.

No doubt the city will institute some kind of special employment that all you suckers and sellouts can work for time-and-a-half. You can help disarm other officers under Obamao's National DISARMy when the time comes.

There is an educational standard... a uniform standard... an attendance standard... AND registration of duty related firearms! This is easy ladies and gents! You've got a '1911' .45 that's not authorized? It doesn't have to be registered! DUTY RELATED BECAUSE WE SIGN YOUR CHECK!

It's a condition of employment and has nothing to do with constitutionality.

Like SCC says, a very interesting constitutional question.

    12/30/2013 07:28:00 AM

Yes. They can and they do it all the time.

Residency requirements have been found unconstitutional. But guess what? We still have to live in the city.

don't you realize by now that the city can do whatever it wants with no real threat of any penalties to be paid later.

this can be readily fought in court. preemption is pretty strong for handguns. they just plain cannot require a registration of handguns. that is specifically preempted.

you are going to have to go to court to beat it though.

I think you will still have to register long guns though if they push it.

take up a collection and hire a lawyer like everyone else has to do when government goes outside its bounds.

This Is the sentiment of many people, they hate her, but would like her fighting for them...she fights for "her" workers rights and the reason you cant stand her is because of the bs dribble that circulates about teachers and the cps. Rahm is doing what nazi party starting in the 1930's... pick a few points of argument and use them as slogans. I'm right here.

You got the spelling right except there is no capitol D in the middle.

I didn't go deer hunting this morning, to cold, so I didn't get to read this after sun up. Got busy with some other work so here is my answer.

As I see this there are a couple of issues. 1 they can not require you as a FOID card holder to register any handguns. this preemption was passed in the carry law. It Says:

    (b) Notwithstanding subsection (a) of this Section, the
regulation, licensing, possession, and registration of
handguns and ammunition for a handgun, and the transportation
of any firearm and ammunition by a holder of a valid Firearm
Owner's Identification Card issued by the Department of State
Police under this Act are exclusive powers and functions of
this State. Any ordinance or regulation, or portion of that
ordinance or regulation, enacted on or before the effective
date of this amendatory Act of the 98th General Assembly that
purports to impose regulations or restrictions on a holder of a
valid Firearm Owner's Identification Card issued by the
Department of State Police under this Act in a manner that is
inconsistent with this Act, on the effective date of this
amendatory Act of the 98th General Assembly, shall be invalid
in its application to a holder of a valid Firearm Owner's
Identification Card issued by the Department of State Police
    under this Act.

this is clearly a regulation and it applies to FOID card holders as the general order requires CPD officers to possess FOID cards.

I would also think that it could be grieved as it was not agreed to in contract talks.

question is, who wants to tell McStreetlights?

Yeah, speaking of foid cards, when is someone gonna challenge them? Why is Illinois the only state that has foid cards?

    12/30/2013 11:37:00 AM

Can't speak for any other state besides here and Michigan..

When I bought my first .380 and .45 in the 90's back in Michigan I had to get a Purchase permit from my Local PD and do the whole FBI background check and etc...

The Purchase permit was valid for up to 3 handguns and only usable for 7 days from date of issue.
I didn't need anyone's permission to buy hydroshocks for the handguns or Carbine (didn't need a permit to buy the 9mm Hi Point carbine either).

Illinois FOID Card.. you can buy how many handguns legally every month with it? I'll tell you....121 a year with the 72 hour wait. And you can get 365 Rifles/Shotguns with the 24 hour wait.

There is of course the point that the FOID card is illegal Constitutionally since the McD vs Chicago Decision.

He thinks he is talking to 8 year old children and needs to threaten everyone in the room with no partner requests and how his little girls upstairs might have to move a car while doing partner requests and put people on the list. I have always returned the car where it is supposed to go. I have always brought in activity. I have never fallen asleep during vri. Im sure people dont do anything, they fall asleep and they park the car where ever.. we all know who they are but He thinks he needs to talk to everyone like they are children. GFY! Im tired of your speech. Start talking to people like they are adults and stop making your own rules because your girls upstairs dont like it. I work 011 all the time, most of the time im in 011 because im a north sider and there is never a threatening speech, no rules on how to park cars and no talking down to the officers out there... LT Kane is just a POS who is gonna show everyone who is boss now. Ive worked with him when he was a blue shirt and worked in the same district as him as a sgt.. trust me, it goes much deeper with this guy. He has a past of screwing with coppers all the time. He gets off on showing everyone HE is boss and YOU WILL listen to him or else. He hasnt changed a bit in 15 years. when he worked a beat car he always tried to play the hard guy role to the public and to other coppers on the watch.

Actually I am a real nice guy. I'm as laid back as they come. Why am I not nice? Because I'm calling the knob job coppers on this job out?? Who cares about them. I am nice to my co workers and treat them with respect.. But after working hours it ends there. I have a much better life outside this dept. this job is not life, it's not a way of life or something that makes me different than any other citizen out there. Too many cops think they are do self important because they are the police. No, we're not. Get over yourselves. I'm a very friendly person. Don't mistake my words for my actions towards people. At work you must be cordial and respectful but outside of work is another story... Like here for example is a great place to vent.

Not to mention fuck up everything about our police department. One bad decision with Cozzi that Kirby advised him on. Martin, Rodriguez, Hillard, and Cline big fat zeros who did Daley's bidding. Weis was the best thing that happened to us. What's right is right!!!! 94 million dollars in VRI!!!!! Not one extra dime in raises for us. At least Weis published all the Meritorious Names. Guys like Wiberg and Cline couldn't hide behind their Daddy. Both tried to make Lt under Weis but he didn't bow down to them. I’ve always have been amazed at how few of us are true gun nuts. For most of us it’s a tool.

But if there were more ranges that were easy to get to I think we would see a lot more shooting competitions going on. I’ve always felt that in the City’s eye we were second class citizens but in the eyes of the Department we were 3rd class citizens to them.

But it might be nice to have a quality collection of classic pieces.

I heard that Mark Donahue gave all of his City Wide guys brand new Lugers after his last election as President of FOP.

Incoming Boston mayor, police clash over AR-15 proposal
    Published December 30, 2013

Boston police are clashing with the city's incoming mayor over a proposal to arm some officers with AR-15 rifles.

Mayor-elect Martin Walsh came out against the plan over the weekend. The Boston Police Department had been pushing for a limited number of officers to carry the high-powered rifles, in light of recent mass shootings as well as the Boston Marathon bombing earlier this year.

But after the incoming mayor initially stayed mum on the idea, a spokeswoman for Walsh said he's not on board -- not yet, anyway.

"Mayor-elect Walsh is opposed to the AR-15 rifles," spokeswoman Kathryn Norton told FoxNews.com in an email. "Unless otherwise convinced by the Boston Police Department, he does not think they are necessary."

Police officials had pushed for the rifle purchases in response to mass shootings like the one in Newtown, Conn. The Boston Marathon bombing happened after the plan was already in the works but nevertheless fueled the proposal.

One unnamed officer told the Boston Herald, which first reported Walsh's stance on the issue, that "it gives you at least a fighting chance if you go into something where suspects have more firepower than you."

Under the plan, according to MyFoxBoston.com, the city would buy 33 AR-15 rifles, at $2,500 apiece. They would go to two trained officers in all 11 districts of Boston.

But the plan needs the mayor's sign-off, and a number of critics had spoken out against the idea, questioning whether giving officers such rifles would increase the chances of innocent people getting shot.

"I don't believe arming them with assault weapons is going to make them any safer," City Councilor Charles Yancey said, according to MyFoxBoston.com.

Unless you just woke up from a long sleep, the south and west sides are shooting galleries. It is about time the honest citizen gets a break and can defend himself. As far as the rest of your comment, you must be a liberal college professor who lives in Evanston or Winnetka and really does not have a clue of what happens when a police officer uses deadly force. You judge by what you read in the media which was written by liberal reporters .

Its a curious new legal situation in Illinois.Remember this is Illinois and its all about making money for the lawyers.

If a business posts a sign saying no guns, applies to you too.

I can see this for duty weapons only. If you have four or five cops shooting at one bad guy you better be able to sort out who fired what gun and be ale to do it right away. Imagine what the lawyers would do with this if we don't.

There also have be instances where one cop picks up another cops identical firearm from a gun locker or desk or somewhere.

We had a case like that in 010 and the officer didn't know it until he was involved in a shooting.

I don't like it, but it may be necessary for weapons we carry on the job.

Am retired, check deposited today. My wife and my healthcase went up $64.00 a month, brother is single retired, his went up $37.00 a month. This is not because of Obamacare(I'm not a fan of him) but it only has to do with the city cutting their share of the retirement healthcare cost. They cut it from 55% to like 38 to40% this year, another cut next and in the last year the final cut and after that no subsidy for the retirees healthcare. Thats the reason

Think this one COMPLETELY through. Anytime you use your weapon on or off duty you are acting as a police officer. In like fashion you need to quaify with those weapons. If you qualify with an approved and registered and get into a shooting you will be acting as the police you are in good shape. You get into a shoot with an unregistered, unqualified weapon the pd can say that you were not acting as a PO because you did not use a sanctioned weapon. Try defending yourself as a private citizen when the city wont indemnify. Just play the game and follow the rule.....not everything is a part of the conspiracy.

Like here for example is a great place to vent

If what you say is true and you are a happy man, then what is there to vent?
    &&&&&&&&&&&&&&&&&&&&

Obviously something set me off in order for me to vent. If you read above in my original posting I was commenting on the moron who is a dog and is trying to convince everyone to not work VRI because he is worried about the dept and the contract blah blah blah.. This shows me he has only this dept and job in his life.. Don't try to convince others to be scared and miserable like you. I don't care about the dept or others.. I care about my family and I work VRI for them to provide them with great things.. The miserable fool above doesn't get that's what this job is REALLY about.. Making it work for you. That's why I vent, because I despise many of my miserable, bitter and arrogant coworkers who think they are special because they are the police.. We are no different than anyone else

To they guy who keeps arguing about posted signs that say no guns off duty, gfy buddy! If im off duty and carrying concealed, I will bring my gun wherever the fuck I want, you will never know! If some shit hits the fan and I stop a shooting or and armed robbery of your establishment you will give me gift card to come patronize your establishment or store as a thank you. Take your stupid bleeding heart argument and cram it up your ass. I have a sign for you... I'm not the other comment either about if there is a sign while on duty, but I believe what he wrote. If I pull up on duty and read your sign, fu, your on your own. Your sign applys to concealed carry civilians, not off duty LE. If you want it to apply to off duty LE, we will oblige you and take it a step further to on duty as well. Guns are so scary. Rant off. Sorry for the long post scc.

Hi. Just wanted to let you guys know that they screwed over the officers that retired and opted to pay for their medical insurance. It went up 40% thanks to Obamacare. Please let officers that are thinking of retiring before they are eligible for free healthcare DON'T. If I knew this would happen I would have waited until I was eligible.

    12/30/2013 07:42:00 PM

Can you please elaborate? Are you referring to officers who retired between 55 -59 years of age and were promised free healthcare?

    12/31/2013 02:02:00 AM

Re-read the post. They are obviously referring to "the officers that retired and opted to pay for their medical insurance". Pay attention to the 'opted to pay for their medical' part.

It's called reading comprehension. No, the poster is not referring to you.

Holy moly, mister or missus angry. The original post was not written very well (improper grammar) therefore, the run on sentence was not clearly comprehensible.

Furthermore, we have all known for a long time now that Rahm is not going to pay the city's portion of retiree health insurance and that retirees will begin to pay more in 2014. Which is also why the original post confused me even more as to what he/she was talking about.

    Also about those "No firearms"
signs, my firearm is concealed. Unless I have to go through a metal detector or a search it stays with me and no one ever knows.

My gun will have saved my life and the lives of those around me.

Even the life of the idiot who posted the sign.

And it is better to be judged by twelve than carried by six.
