Koschman Report - No Clout

The lack of a cohesive take in the media shows everyone exactly how fucked up this case was from the word go.

First up, you have the Tribune with this headline and opening lede:
But then you have the Sun Times with this take:
  • Daley quickly knew of nephew’s involvement

  • Former Chicago Mayor Richard M. Daley knew “shortly after the incident” that his nephew Richard J. “R.J.” Vanecko had been involved in the drunken confrontation that led to David Koschman’s death, according to a report from Koschman special prosecutor Dan K. Webb Tuesday.

    Daley, higher-ups in his office and others in Daley’s Chicago Police Department were aware of Vanecko’s involvement even as Koschman lay dying in a hospital with a cracked skull and swelling brain, the Webb report revealed.
But no one could make the connection? Or no one wanted to see the connection? And no clout was involved, but everywhere you look, there are the Daley appointees making decisions, "adjusting" statements, imagining conclusions based on what was convenient rather than what was on paper.

The names of the coppers Webb considered indicting are bad enough. The footnotes and connections contained therein are downright shameful. Save for the convenience of the statute of limitations running out, there's plenty of crap contained in this report to paint a damning picture of the Department as incompetent, bungling, criminal and in the pockets of the connected.

Reminds me of when Vanecko's brother together with Allison Davis got that $68 million or so from City Pension funds to finance, with a guaranteed profit, their very FIRST real estate venture.

Our pension board rep stood up before the membership at an FOP General meeting and told us that he didn't know it was Daley's nephew plus Daley's pal asking for the money. But he voted for it anyway since it was such a great deal and they were darn lucky to be getting a piece of it.

And Daley got in front of the news media and declared he knew nothing of the deal, it just happened and no one knew it was his nephew looking for the money.

That is a variation of how my first wife got pregnant. Watch me pull a rabbit out of my hat, nothing up my sleeve...

This report is nothing but visual noise and media commentary on it is nothing but a finely minced word salad with donkey dung vinaigrette.

These misdirected children in the media know damn good and well that these motherless fucks in the inner sanctum of Daley Inc. have had decades to perfect the art of conversation while seemingly not saying much.

These tone deaf m/fers in the media have no point of reference regarding the nuances of inference...

This report is a white wash and at the same time is as dirty as a dead whore's panties for all that it strains really hard NOT to say.

Just remember that::

Terry H first made Dean the dream an exempt and sent right to commander of Intelligence (bypassed district command). Then Phil C made Dean the dream commander of area 5 and then Deputy Chief of Detectives.

Phil C made Joe S merit lieutenant and then gave him exempt position as Commander of area 5 (bypassed district command).

Phil C made Sam C merit sergeant and sent him to area 5 while Dean was there as commander.

Phil C saved merit lieutenant Denis W from being fired for the out of state sex charges. In fact, he hid Denis in 018 as temporary punishment.

Apparently Phil C thought all of these men were the best police and he sponsored them. So who else should be blamed here?

I was just discussing the differing headlines with my wife, such a crock of shit we've been force fed.

I distinctly remember a story about a file with a note on it that said something to the affect that the suspect was the mayor's nephew. However, we're expected to believe that notation didn't influence anything, much like the 60 day sentence has nothing to do with any familial relation? Absofuckinglutely shameful, I hope that karma catches up with all involved with this charade.

Second, it appears that the only thing the CPD is guilty of is assigning the first investigation to detectives who were going on furlo and blew it off in the first few days, not because of daley's influence, but out of laziness.

Third, the d-unit really needs to centralize homicide files. Personally, anything that could be scanned and stored electronically-such as gpr's should be mandated.

Fourth, people who thought this was a conspiracy and bashed their fellow officer-go so scc's archives, need to ask themselves why they are so quick to believe in conspiracy theories without any proof.

As much as I want Daley to go to prison, I firmly believe he had no influence

Scientists often say that in order to make an extraordinary claim, you must have extraordinary proof.

The claim: Daley and company influenced a CPD coverup to protect his nephew who murdered an innocent kid.

The extraordinary proof??? Nothing that can be proven, just a whole lot of speculation.

There is no doubt the Daley administration was corrupt, but bringing provable evidence has unfortunately not happened yet. I'm starting to lose hope that it ever will

Of course if clout or influence from the Mayor's Office were involved with this case getting all fucked up, quite naturally the detectives at old Area 3 would have filled out the proper Political Influence Case Fixing Report, CPD 193.21c and it would be available from Records Division under the original RD number and cross referenced by Event Number.

But there was not such a report filled out, hence, incontestable proof that no such outside influence was used, attempted, considered, thought of or wished for. It is the Chicago Police Department version of a miracle.

We have no media. According to the report the department is a bunch of keystone cops, especially the bosses. Loosing official files, finding official files, making up official files, WTF! Ive got in trouble for loosing a case report of a shoplifting case and we have bosses loosing homicide reports with no repercussions. Anyone on the department that has been around, reads this report and laughs. Don't get me started on the States Attonery's office who said they expected CPD to charge. In all the years and all the victims, I wish I had a dime for all the times I presented to the State for charging and they refused! Now they state in this report that it was the responsibility of the detectives for charging, in a homicide! This was a white wash by Webb. Why didn't we get someone outside of crook county for this investigation. And why wasn't this presented to a Special grand jury for the decision in charging, and not king Webb. Eat it up folks cause there is nothing the non connected can do in this city. Our last hope is the media and they are completely in the tank or incompetent themselves.

Remember when Weis came in and cleaned house of all Clines merit dirt supervisors? If you noticed D.A. Was not removed from his exempt position, even though he was put there by Cline. Reason being is D.A. Parents are wealthy contributors to the Daley political family. In fact, the only reason they played Chicago politics is because their son D.A. was not following his Greek heritage and became a cop instead. So D.A. Parents had to ensure their son didn't embarrass the family, and they made sure he became a boss. Another payback connection to think about.

Webb's report sucked. There were a lot of questions to ask that weren't and a lot of people that should have been interviewed that weren't. His whole report was basically a chronology of the investigation in stead of who knew what when? Who talked to who when? Who made what decisions when?

Who knows how many Police and/or ASA bosses, Supervisors, Detectives/ Investigators etc might be willing to step out, on their own, to assist the Daley clan in the hopes of being rewarded sometime down the line?

Besides, all of the people who have been promoted into positions of authority by the Daley Crime Family already KNOW that they MUST protect the 'family' at all costs. This is why they were promoted to begin with. They do not need a call from the Mayor to know what they need to do.

It's called 'plausible deniability' and Daley has been insulated by it his whole life.

According to the report, Daley knew his nephew was involved before the Detectives knew. If that is true he had an obligation as an officer of the Court, which he is as a licensed attorney, to notify the State's Attorney. The whole thing stinks and the cops that were involved need to be sued and they will be. In my career, I have seen coppers fired for less than covering up a manslaughter. Screw the Patronage Hacks, especially the Lt. at A/3.

One item I do remember when reading one of the detective's supplementary reports, it can not be determined who punched the victim, but it was in self defense.
I thought it was odd that a detective would supply an affirmative defense.

Of course the Sun Times will put their best spin on it. They got punked. This Nowak by the way was quite the inarticulate dope on his 15 minutes of radio fame interview before the report came out.
Maybe everybody should take a deep breath. This was all a bunch of the speculation depending on your viewpoint and nothing solid beyond that.
And cheering these police haters on? Next time there is an in custody death or a difficult shooting, you can bet they will be screaming about Koschman and calling for an officer to be indicted.

So you really believe that Shortshanks avoided prison by picking up a phone and directly telling people what he wanted done? Use your head. If you read the report and noticed that CPD documents were missing or had stuff scratched off, and that the SA files, both hard copy and electronic, were missing and there was no pressure put on, you are just naive.

This town is such a farce. There are people that will still fall on a sword for that corrupt ass just to get a spot.

All they do is call the mayors chief of staff on their personal phone and leak any clouted info.

It was verified by a chief of staff of an alderman who had a case. Suddenly his boss knew after the notification was made.

But of course Danny webb the plea bargain lawyer who hates trials does not think clout was involved.

Webb went through great pains to investigate the police who actually do police work.

He searched personal emails from a Sergeant and even went so far as to check cell phone records to try and prove that another Sergeant was actually in the office when the Koschman file was found. He dug into unfinished, draft copies of supp reports.

Interestingly, there is no mention of the mayor's cell phone records, or even any of the records from the mayor's staff, or Masters' cell phone calls, or Biggane's personal emails.

Webb must have run out of money before he could get this information.

Why were the mayor's cell phone records not examined, particularly when the mayor testified that he knew about Vanecho's involvement before the police?

Why were the mayor's cell phone records and his staff's cell phone records never examined to determine if any calls were made to Vanecho, Vanecho's friends, or high level police officials?

Why weren't the mayor's personal emails examined? Why weren't his staff's emails examined? Why weren't Jodi's cell calls and emails examined?

Why didn't Webb get any security video from the mayor's office at City Hall when the case was re-examined in 2011? Why didn't Webb get security video from police headquarters or the SAO when all those meetings were being held?

Why didn't Webb get a log of visitors who came to see the mayor in 2004 and 2011?

Why didn't Webb get the log of visitors who came to see Koschman while he was in the hospital for two weeks?

Why didn't Webb get GPS records from the vehicles used by the mayor and his staff in 2004 and 2011?

I think it's time for another investigation to get to the bottom of this.

Lets take a look at some of the major players in this investigation: Andrews been clouted since his parents were feeding all the exempts for free at their restaurant on Ohio Street. Never investigated a case in his life and it showed in his testimony. Cirone's father was the former head of the old CID. Took good care of lil Sammy til his passing. Walsh's father was Deputy Chief of Area 3 until his retirement. Yawger left the CPD on a Friday and went to work for the State Attorney General on the following Monday.

Webb puts out the impression he considered indicting officers yet in the same report he states that there was NO evidence to indicate criminal actions on the part of any of the police officers. Apparently this is how he justifies the seven figures he made on this.

I distinctly remember a story about a file with a note on it that said something to the affect that the suspect was the mayor's nephew. However, we're expected to believe that notation didn't influence anything, much like the 60 day sentence has nothing to do with any familial relation? It seems awful coincidental that the former mayor was hospitalized at the same time that his nephew copped a plea and this report was scheduled to be released. It really reminded me of the scene in "The St. Valentine's Day Massacre" in which Bugs Moran has himself admitted to a hospital for "a bad cold" after seven members of his gang were murdered in a Clark Street garage. The gangster was avoiding police investigators. One suspects that the mayor is dodging the media.

I don't know what the detectives did or did not do in this investigation, but I can speak with experience that there are many cases presented to Felony Review that should be charged but are not. Par for the course that Flint Taylor, Dan Webb, and the Sun Times are blaming the police department. Flint is greasing the way for his next civil suit. Webb proclaims the integrity of convicted former governor Ryan and used the testimony of convicted drug dealers against police officers to make a name for himself. What a stand up person Webb is. The CPD is once again a punching bag. Consider the sources. Stand tall out there. You are the last line of defense for the defenseless. God bless all you working POs and the work you do.

First, the sun times completely exploited this story-and ms. Koschman for their own gain. Their never was a cover up, no matter ho hard they tried.

Second, it appears that the only thing the CPD is guilty of is assigning the first investigation to detectives who were going on furlo and blew it off in the first few days, not because of daley's influence, but out of laziness.

Third, the d-unit really needs to centralize homicide files. Personally, anything that could be scanned and stored electronically-such as gpr's should be mandated.

Fourth, people who thought this was a conspiracy and bashed their fellow officer-go so scc's archives, need to ask themselves why they are so quick to believe in conspiracy theories without any proof.

As much as I want Daley to go to prison, I firmly believe he had no influence

Wow Detective I hope no one I know ever gets you assigned to their case. You know why there is no "proof"? The same reasons it took alot of arm pulling and protesting to get it looked at again. I do not credit the rag suntimes in bringing this to light, cause they did it for themselves not the victims mother. They chose a juicy story over Daleys thumb. But that aside, this case was attempted to be covered from day one. I don't even really blame the Det's 100% cause in the end they did what they were told. Was it wrong of them? Yes.. Should they have stood up? Probably. But as we all know (not you obviously) this dept is corrupt from the top and a tool for the political crime family known as the Daleys. It would be suicide for any of the dets involved to push something that no one wanted pushed, from the state on down. So because the report doesn't show the daleys corrupt doings you eat it up and believe it? You are either in their pocket or just naive... Or both

Daley did not have to "influence" the investigation per se, as those in charge knew the consequences of not protecting King Daley: being dumped, midnights in some ghetto district, or worse, as those who have screwed with the family have found out.

The plea deal was done to avoid any further publicity, and to avoid shining the light of truth in halls of corruption.

With 25 yrs on this job there is NOTHInG that is coincidental. Daley didn't have to make a call it was understood. Go after his nephew and your done on this job BUT take car of him, give him an out, just gotta make a jury member think "hey maybe the little guy asked or it", just like the added statement on the file by those 2 detectives. BTW, if I were a defense attorney and those 2 detectives were the lead witnesses in any of my clients cases I would be filing an appeal immediately. They are done as far as being credible in any criminal case from here on out. Its like this "if you can sell this bill of goods, make it right, it will be good for you in the future" but no one expected the kid to
die or we're waiting it out. The fix was in, no call need be made. Look at the the Lt. Who was tied to missing files, the sgt. Whom comes from a VERY connected family (outfit) and the two other merit promotes who owe their positions and livelihood to Daley and Phil Cline (who destroyed this job once and for all). Enough said. Ask yourself, what if this was your son, your nephew, your brother,.........would you be so quick to defend the indefensible? Terry H first made Dean the dream an exempt and sent right to commander of Intelligence (bypassed district command). Then Phil C made Dean the dream commander of area 5 and then Deputy Chief of Detectives.

Phil C made Joe S merit lieutenant and then gave him exempt position as Commander of area 5 (bypassed district command).

Phil C made Sam C merit sergeant and sent him to area 5 while Dean was there as commander.

Phil C saved merit lieutenant Denis W from being fired for the out of state sex charges. In fact, he hid Denis in 018 as temporary punishment.

Apparently Phil C thought all of these men were the best police and he sponsored them. So who else should be blamed here?

Off topic. I am really looking at the members that are running for office this year and cant believe that Dean Angelos team and 2 father son teams running. As for myself i am done with stacked boards. Mike and Dan Shields did a number on all of us. As much as i respect Dean, i dont want guaranteed votes in one direction. Clean Slate has some pretty good diversity, however i think Gorman is a piece of Shields shit. Nothing about the Doherty team impresses me in the least bit. As it stand right now i am voting clean slate (-) Gorman. As much as i think Dean has some good ideas, the stacked deck is something i am not willing to risk. Clean Slate will fight for the actives and the team has some solid experience on the retiree side.

If Koschman had thrown a punch that resulted in Vanecko's death, he'd be languishing in prison right now under a long sentence. They probably would have pushed for murder charges.

Otherwise we will continue to have Donahue and Dougherty tools of their machine. We could have had Garrido as an Alderman and Bird as a State Rep. Phil C made Joe S merit lieutenant and then gave him exempt position as Commander of area 5 (bypassed district command).

Phil C saved merit lieutenant Denis W from being fired for the out of state sex charges. In fact, he hid Denis in 018 as temporary punishment.

This mother lost her son and had to endure a coverup that denied her any sense of closure (if that was at all possible).What if this was your relative and the case was handled this way, how would you feel? I am disgusted by the facts contained in the Webb report and embarrassed.

This report is a fascinating account of these Detectives molding the evidence to their theory of events as given to them by the bosses. These brilliant Detectives claim no crime and the offender eventually pleas without a single motion heard. These Detectives should be accountable for this huge "mistake" and reassigned to anything but violent crimes. You can't make this type of error and live it down. They should be fired for false reports as stated in the report. Even Gilger admits he "omitted" interviews that would make this a crime. Shameful

These 3 arrogant pricks have generated falsehoods about good cops who don't conform to their way of policing. It is satisfying to see them exposed to the world.

I also like Sammy's excuse that he used his personal email account to send a message to Dean because that account was probably up on his screen. I thought we couldn't use department computers for personal use?

I also like how Sammy always bypassed his lieutenant and commander and consulted with his deputy chief directly. Here's one time the lt and cmdr got to be thankful Sam didn't follow chain of command.

Again this is about assembling the "right guys " for this investigation. Two Det.s going on furlough the next day? Hmmmmmm? Assign it to them but if this gets worse we can put OUR guys on it, and guess what , it did. The poor young man died after being punched for mouthing off to a guy 10 inches taller than him and 110lbs heavier. Then when you conduct the "re-investigation of the investigation" you have everyone lined up who's "on board" with the outcome. You get 2 Det.s without any real police experience as PO's but are clouted and tell them " hey this could be very good for you two in the future". Then these 2 brilliant Det.s commit a rule 14 by adding a statement that usually a 2-5 yr copper puts in on a dope pinch just to "play" with the judge I.e. " the the sub. Said f**k the judge"....only they put in the other line "I'll kick you ass" like when we lockup some a**hole for fighting with us ......to sweeten the paper. Then the Sgt. Who is very connected to a notorious crime family, but is in now with the Daley political family, oversees the 2 Det.s to keep them on the right path. Of course the lt. Who should have been fired but was rescued by Phil will do ANYTHING to repay that act like loosing the file and or parts of it 4-6 different times. Then of course the competent Commander and deputy chief , it's all the same story. Of course there has to be a fallout plan in case this gets exposed. And now this is where we are at. Two not very bright detectives, but team players, one lt. hack who should have been fired long ago and a commander and deputy chief who can probably survive since s**t rolls down hill. The kicker is they all have to be willing to sign off on it and STAND by their decision to do so, hence the granting of immunity. But alas Vanecko gets 60 days, and moves on to some big paying politically connected job somewhere, Daley recovers from his "sudden illness" out of state for an extended period of time and a mothers sone still lies in a casket, dead forever. While the 2 dets.s , Sgt, Lt, and Deputy Chief and Chief await the IG Report to see if any "discipline" will me meted out. This re investigation is an amateur act, conducted by a bunch of clowns......your tax dollars at work.

Vanecko is guilty. Vanecko, like most human beings, tried to not be found responsible for his actions. He is not a murderer, this is an involuntary manslaughter case. It could have happened to anyone, nothing good ever happens at that time of the morning after a night of drinking. Look at all the people that have survived beatings, shootings, stabbings, years of abusing their own bodies and they continue to survive. This was one punch that ruined two lives, one punch. We've had people on this forum that have defended a drunk cop killing two kids on the expressway by saying they were tagging.

As much as we don't like the Daley family, Vanecko isn't a villain, he's just an asshole related to the former mayor. 60 days in McHenry is fitting, they tried him there then he should serve there.

Bosses like Denis are good for coppers willing to sell their souls to cover up for the clouted. I worked with Denis years ago and thought he was a great guy. After reading the report, they should have all been indicted, but they were smart enough to invoke the 5th. I say all involved in covering this should be lose their jobs. There is enough evidence to support administrative action. It will never happen. So glad I was lucky enough to leave this job for one that demands I tell the truth.

Vanecko and Daley really made patsies out of the police officers, detectives, sergeant, lieutenant and exempts. They tried a cover up for the last ten years and in the end Vanecko pleads guilty and gets sixty days in jail while they almost were charged criminally, lost their pension and still may face discipline as Emmanuel has the inspector general looking at the case. Hope it was worth it.

I just hope RJD is out of ICU and is ok. What a coincidence he getting sick at the same time RJV cops a guilty plea. That poor family. It's almost as bad as the Little Rascals curse. A shame their suffering.

It has been said here time and time again that the current political merit system lends itself to corruption. When people win the merit lottery again and again, they of course may become beholden to those who put them there. I have no ill will towards any one individual, it is the process I take exception with. Every police officer has to live with the decisions they make and judgement day will come for each of us. I may never atain a higher rank but there is a lot to be said for being able to sleep well at night, and to look at my not so pretty face in the mirror.

Worked in Near North when DW was there. EVERY1 liked him. For awhile a PO couldn't go wrong cuz the Captain was Tom S(a true gentleman)who not only took the time to learn 150 personalities but treated people like adults. He'd take the shirt off of his back for a PO. DPW was the same way. Ur problem was his problem and his goal was to solve it. It drives me crazy how people forget DW's generosity and empathy.
Both Denis & Tom made such an awesome 1 2 punch the working environment fostered activity. Activity was produced for TS and DPW simply cuz they were great Bosses.

No, they didn't try him there. He was arraigned, and eventually entered his guilty plea, at the 3rd district court house in Rolling Meadows.

The judge who presided over the case was from McHenry county, but Vanecko will do his time in Cook County jail.

Involuntary manslaughter, a punch thrown from one drunk at another drunk and fate has it that it was fatal. It was an accident. As far as the 60 days are concerned, is that enough I don't know. But I stand by my point if you are going to move the venue of the court to keep him from getting an unfair advantage then why shouldn't he serve his time there. As far as the if it was your son etc., well what if the offender was your son etc.? Would you bury him?

Really? Where is that evidence. i read the report also...the entire report. What about the part that says there is NO evidence that any of these individuals violated state law and that they gave non-criminal explanations for their actions. Did you just ignore that or did that not fit what you want to think. Douchebag.

You must be a merit promotee yourself. The evidence of collusion and falsified reports to absolve Vanecko is on nearly every page. Webb says that the only reason the goofs at 630 won't be drinking and eating from tin cups and plates is the expired statute of limitations.

Mrs. Koschmann hasn't complained about the sentence, why are you?

As far as it being my son, 60 days or 60 months or 60 years isn't going to bring him back. He has a felony conviction forever and 60 days is going to feel like 60 months to him. If Vanecko had murdered him with intent or continued to hit him when he was down then I'd want to kill him myself. That's what kind of man I am.

Now "Mr defending the indefensible" Are you going to answer the question of what your sentences would be or are you going to continue your riddles? Let me guess, 60 days if he was the offender, 60 years if he was the victim.

No, the statute of limitations is for the 2004 investigation. The part referenced about no evidence of violation of state law is from the report that talks about the 2011 investigation. But I understand that might not fit what's going on in that little brain of yours.
