- A Far South Side teenager was ordered held in lieu of $1 million bail Thursday on murder and robbery charges tied to a botched hold up that left his alleged gun-toting accomplice dead.
Devante Graham was charged with his cohort’s death based on the theory of accountability after an off-duty Cook County sheriff’s sergeant killed a teen when he was robbed by the younger men Monday night at a Citgo gas station in the 700 block of East 103rd, authorities said.
His lawyer is protesting the lack of evidence:
- Outside of court, Rotunno said prosecutors are relying mostly on circumstantial evidence against her client.
“All they have is the video we have all seen,” she said.

When he worked in 025 he was a smart ass) from sending out the letter. When I asked Rich Aguilar what stopped him from sending the letter his reply was "I don't owe you or anyone else an explanation, have a nice day". He and the others are about as arrogant as they come. They feel that they don't owe us the members any explanations. So vote their ass out!

She has a point. In general, video alone is often not enough for a conviction. But there are two eye witnesses, the victim and the other perp. And he likely left fingerprints behind. And he identified himself as the person on the video when he turned himself in. Good luck to him in PMITA prison.
Billy Dougherty has said they if any of his guys do not get elected from the top of the ticket he will use the six field rep positions to bring them up stairs anyway.
So if you think splitting your ticket to put the best team up stairs at FOP will work Dougherty will negate your vote to just bring up his crew of useless goofs.
If you vote for Dougherty but not Aguliar Billy will just bring him up anyway. That's a D2A pension on top of 160k a year plus $600.00 a month just to show up.
Do not be surprised if he (Dougherty) brings up Mark Donahue when DiMaria retires just after the April general meeting.
P/S. Did you know that these goofs are paying each other supervisor's quarterly on top of 45 minutes a day which the sell back every year just like a captain of police. That's how they are getting the extra 30k a year.

A video of the crime does not always end up in a conviction. There are identification problems with any video. The accused will say it is not him and the prosecution has to prove that it is him with independent evidence. Not as easy as it looks.

I would be trying to plea bargain down to the lowest the ASA would go.

So throw him a break. ("he's basically a good kid" - well, you have to say that if you are trying to get him a break. I would be saying it if you were up for a bad charge.)
Tell the client, take the year or two and be glad you didn't get 10-25. (I doubt someone of my caliber will be taking his case - try to remember the scene in Trading Places when Billy Ray asked if there was a lawyer in the private Club, no takers.)

A lot of people construed OJ's running away as an admission of guilt, and a ton of other evidence as pointing to guilt, but evidence means little with the right jury. But there's just one problem - I get the impression the man they tried to rob isn't white, and so I don't think a jury would be manipulatable.

The video does establish that he was, in fact, there. The statute goes on to say:
"Mere presence at the scene of a crime does not render a person accountable for an offense; a person's presence at the scene of a crime, however, may be considered with other circumstances by the trier of fact when determining accountability."
Unfortunately the resolution of the video (any video at that distance)is not good enough to positively ID an offender. An eye witness id as good as it gets. They don't need the video.
OT Can someone please chime in about the lack of working marked vehicles. I have been on for 25 years now and this is absolutely the worst it has ever been. How can you possibly explain why every district is down 10-15 cars?? NO POOL CARS AVAILABLE!! How do you explain that the third or fourth largest city has a police officers driving around in vehicles with 140,000 miles??

I recall one cop, deployed in Afghanistan in the Air Force, and the district got word he was coming home. A district supervisor went to O'Hare to pick him up and when he got home we had his whole street lined with blue & whites with blue lights flashing, coppers at attention. He was in the informal AF uniform. That was a good morning for those who served.

Unfortunately the resolution of the video (any video at that distance)is not good enough to positively ID an offender. An eye witness id as good as it gets. They don't need the video.
Who told you an eye witness is as good as it gets. They are unreliable and many witnesses recant later. Thats why the ASA wants physical evidence.
Have you seen the special employment cars? There is so much paint and decals missing from them that pretty soon you will just have to take the key from car to car until you find one that fits. The hoods roofs and trunks are almost all gray from the paint peeled off and to keep the car going straight you have to keep the wheel turned hard to port.

The goof turned himself in after seeing himself on the video. What, now he's going to say "oh that's not me. I just hired this attorney and got charged with murder for fun?

OT. I saw 2 of the FOP Presidents to be come to my unit. I was the only boss on duty. Angelo and his people came up to me and were pleasant and asking questions about how they can proceed. The Clean Slate people came in another, did not introduce themselves, rudely asked me why no one is there to see them. Take it for what its worth.

Hey Ray, you are full of shit. I have introduced myself to everyone I have come in contact with at every district and unit. That's the first thing I have done everywhere. Take that for what it's worth goof.
