Former FOP Pres Suing FOP - Denied?

In Chancery Division of Cook County, Docket Number 2014 CH 2400, filed 10 February 2014.

The summary:
  • Michael K. Shields
    v.
    Fraternal Order of Police Chicago Lodge No. 7
    2/10/2014 2014 CH 2400

    Action for violation of the Illinois Whistleblower Act, breach of contract and declaratory judgment. Defendant - "an organization consisting of approximately 10,500 active Chicago Police Officers and Detectives and 7,000 retired Officers" - unfairly suspended plaintiff and removed him as President of Chicago Lodge No. 7 without due process after he complained to the City of Chicago Inspector General that arbitration between the City of Chicago and the Chicago Police Sergeant's Association "may have been rigged."
We don't have access (and neither does our tipster) to the on-line filing, but maybe someone out there does? We'd still like to see the specious reasoning behind it all.

According to a comment or two earlier yesterday, the motion was heard and denied already because - get this - Shields didn't get his letter in on time to contest the ballot issue! Talk about irony.

The motion was denied because Dougherty and the rest of the current members did what everyone quietly knows they do best: fight for what is best for every officer, current or retired, out there. Dougherty could have done nothing and let Shields derail the election for an indeterminate amount of time--and for those of us who've ever been involved in a lawsuit, we know these could mean months and even years. If they had done nothing the current members in office would have stayed in office during the lawsuit. But instead of riding it out and letting Shields take the blame, Dougherty, Aguilar, and Del Riveria did what is best for the rank and file like they've been trying to do the last three years: stop Shields. All the Angelo and McDonagh supporters who bash Dougherty and the rest of City Wide, keep it up. While you're busy talking smack, they'll be busy making sure your interests are being protected.

I want to know if Mike Shields is still receiving his FOP President Salary of 218k? I also want to know when is Shields hearing in Springfield in regards to his Suspension from the State FOP Lodge?
So now Mike SHields is suing the people whom elected him at one time? Now he is forcing us to defend ourselves and pay for legal fees? This guy needs to humble himself. Shields truly has lost his mind and thinks he is John Gotti of the FOP lodge 7.

Now we hear that Dougherty wants to pick his own election committee Thursday and has called another special board meeting.

Wasn't a big thing that the citywide team posted here was about Shields picking his own guys to hear charges against him?

Has any ticket talked about hiring a Cut throat PR firm to counter what the city brings against us? Or talk to big cities on who they use for labor issues, Im going to vote for the ticket who will admit that a Chicago Police Union elected official(A Police officer, no matter what rank) has 0 chance, ZERO chance Against what Rahm can bring against us.
Knowing you limitations would confirm to me that your not just in it for the $$$$$..............

Lots of PO's go to the Fitness center daily. Don't you think they see stuff?

Here's one for ya:
How can some officers at the academy have more than 12, 14, 16 BFd's at the end of a year and already into 2014?
How can they have 7 8 9 P days?
All of the range staff seem to have the most days to either sell or carry over but if you have 14 BFD's how can that be?
How come some of the gym staff have staggered start times by as much as 6 hours?
There aren't recruit classes after 1600hrs.
How do range and gym staff members have time (while working - carried on the A&A's) to do videos for krav maga and do concealed carry classes?
How can some civilians come and go as they please with their real estate business, their consulting businesses? Heck, there's a civilian that doesn't show up for work till 1100 hrs. on a daily basis yet, no one is there to be sure that this indiv. works and entire shift. Which he/she does not!
Staff come and go as they please with no supervision and no one ensuring that they are putting in the 8 hours a day.
The blatent theft from the city over there is unreal and unchecked!

To whom it may concern:

Recently we lost a very young, Detective to a heart attack while working.

The day it happened, a post here on SCC asked why we did not have defibrillators in the district's, and the areas.

I would like to form a committee to accomplish this by placing defibrillators in all the districts, areas and firehouses.

I do not know if we would have to raise the funds ourselves, or with the assistance of the Safety Committees of either of the unions pressure the City into providing them.

I do know that within a week we could have petitions on all of our work places, expressing our desire that they be installed immediately.

I learned tonight that the City Colleges have them and the airports have them.

We should have them.

If we have to raise the money, we could do it.

I am sure a lot of businesses that make their livelihoods off Police and Fire like the Credit Unions, the uniform stores, etc. would love to help.

Lets give it a shot.

I hope he's successful. Anyone with more than a minute on this job knows our union isn't on the up and up. The remnants of "Citywide" allowed a naive kid to fall flat on his face so they could remain the "good old boys club" that they'd been for several terms.

Now don't get me wrong.....Shields is to blame to some extent, but can't be held 100% responsible.... Not when the other clowns have been to this rodeo many times in the past. Only now Dougherty gives an interview to the press on how he plans to make FOPs issues known to the masses? NOW they decide is a good time to ask black officers to join their ticket? Why no one of color on tickets past? Billy Boy is grasping at straws. The rats bailed ship and joined other tickets because they know the jig is up. I pray there is a REAL financial audit once the new regime takes office. Shields had poked the hornets nest. He's awakened the sleeping giant. And everyone that knows of or participated in nefarious deeds of FOP administrations past is getting really nervous and if shows. Shields tried to shine light on the roaches ruining our union a and they ran him out and want to destroy him before he does the same to them. Best wishes Mike. For those of you who didn't get to hear all the teams roll calls, here's a quick synopsis from a district guy.

Dean Angelo team spent half of their time explaining why dean is on disability and then talked about cutting a bunch of stuff

Citywide spent most of their time blaming other people for the problems of the current administration and then had to listen to my roll call yell at them about the letter

Clean slate had a few district guys, from 16 and 9 I think, talked about real issues like time due and equipment. Liked that they had solutions not blaming other people. Missed mcdonaghs speech since I got to roll call late.

As far as independents, liked day guy from 8, John I think. His story really hit home about being stripped.

Just another reminder guys, I don't know R. Aguilar at FOP nor do I have a personal opinion about him but something to keep in mind regarding how he thinks. When he was in the 009th Dist 1700 roll call he was asked a question regarding the raises (2%) we have received the last few years in our contracts which have been well below cost of living to live in Chicago. The question was, Do you believe the cost of living in Chicago is 2% to which he said "YES", he was then asked Do you believe 2% was a fair offer by the city to which he responded "YES". He was asked one more time Do you think the cost of living in the city has only been 2% and for a 3rd time he said "YES". I want to know where R. AGUILAR lives in the city. Do we want someone like this fighting for us. Is this how others on the team think? My water bill, real estate taxes and vehicle city sticker have all gone up from 25%-40%. I understand many of the principles behind the dismal raise the point is he believes it's fair.

Ummm.... Could it be that they carried over bfd and pd's from 2013? I much prefer time away from this job to selling the days back to the city, so I carried over the maximum and currently have 18 total bfd and pd's in my bank.

I doubt anyone has 14 bfd's total, maybe just a combination of the days in their bank.

You're damn right we should have them and we shouldn't go begging for them.

Consider this: That detective, I believe, died on duty. Heart attack is considered a hazard of doing this high stress job. John Thomas died of a heart attack, John Thomas was given full like of duty honors etc.

Assuming this detective gets the same, which I believe he very much deserves, that money spent on line of duty benefits, funeral, benefits for the family and kids, well that would easily pay for defib machines in every station. Just the line of duty money for one officer.

But also consider this, knowing the City of Chicago, these devices would no doubt be available for the public, not just police officers, so dude comes in grabbing his chest, well, when have you known the City to promptly replace equipment in a police station? I'd rather purchase and carry my own defib.

TRO Denied, but the case was not dismissed. The next trial date is in 28 days. Given that this case may have a massive financial and/or public relations impact on the FOP for years to come, I hope SCC can post the actual complaint. If Dougherty and Donahue win, then their deeds or misdeeds will be much more publicized if they get elected. If citywide loses than the new board can get in front of it, do an internal review take corrective steps and take the needed steps to restore everyone's confidence in FOP.

I know Doherty is not the best along with the citywide team, that being said sorry will not vote the Lego starter kit where the new guys learn the job making huge 6 figure salaries! It's to bad no woman obviously was not qualified enough to be at the top or near top of the ticket. Could you imagine if we had a woman like cps Karen Lewis? Eliminate the pension ability of the top 4 spots $170,000 a year big salary save the pension as you guys are telling us about exempts taking to much, take your civil service pension no more!

Why are no CPA accountants not at the top of the ticket?

Why no labor attorneys at the top?

Yep I'm a high school grad also, but can admit we need people with smarts at the top.

Employees come in when they want because the are on salary meaning if something like Taste of Chicago comes up they have to work Sundays.

A good supervisor will let you change your day of group so you don't need to use P days.

To retired Sergeants, Lieutenants, and Captains, who are voting members of the FOP: When Lieutenant Jim O'Neil was working to get supervisors collective bargaining, Bill Nolan promised Jim that the supervisors were going to have their own FOP lodge. As the date drew nearer to submit names of bargaining organizations to put on a ballot from which the supervisors would choose, O'Neil learned that Nolan lied to him, and the supervisors would NOT have had their own lodge, and worse yet, the FOP Lodge 7 bargaining team would have done the negotiating for the supervisors contract. No supervisor would have been allowed to sit on the FOP board, or any negotiating team. O'Neil appealed to then national FOP president Gil Gelagos, who told O'Neil, "Bill Nolan IS the FOP in Illinois. What he says goes." That's why the supervisors went with the PBPA. We wanted to be with the FOP, but not under the provisions Nolan imposed. Dean Angelo was a leading proponent of anything Bill Nolan wanted to do. His failure to denounce Bill Nolan for not doing everything he could to have the supervisors join the FOP, in my opinion, speaks volumes. Dean lacked integrity, when it mattered most. He could have been a part of something historic, something that would have made Chicago Police unionization much more powerful that it is today, but, instead, chose the path of a politician, which I believe he still is.

A few of the candidates I know personally and voted accordingly...yah or nay. .but for the most part I was flying blind. Sad for the union I belonged to for over 31 years . Its interesting the candidates and their teams are finally actively attending roll calls. A common theme is the bump in pay for the FOP leadership. All seem to agree that it is quite high, but those running agree there is not a single thing that could be done since it is written in stone in the by laws. How about all that extra pay over your current civil service pay go back to our non-profit fraternal organization, a recognized charity or a scholarship for the children of the membership. The mantra of their is nothing we can do, its written in the by laws, with regards the bloated pay does not fly with the rank and file. You can argue travel expenses and other related expenses to justify your higher salary. If that is the case put in expense vouchers for all to see. Fat cat money and power corrupts. Who is paying for the mailings, posters and handouts with all that expensive, glossy professional looking literature. Are the candidates putting forth their own money or is their some sort of "scholarship" by those who have an interest in the union's money collected from the membership. I suspect the monies collected through the sweat, sacrafice and hard work of the brothers and sisters of the lodge are to be distributed for services or some other scam at a later date to those paying the freight for all that promising glitzy campaign literature. Follow the money fraternal brothers and sisters of the lodge.

Its just a vicious cycle again and again. I didn't vot for Shields, but for citywide and I made a mistake. They did hang that kid out to falter, that isn't Fraternalism. Although I like reading SCC and sometimes commenting on cases, let me give my two cents on your union and its leadership before you make another mistake.

The FOP should be a strong union and its members should trust that it is doing its best for them.

Based on my observations that hasn't been the case. The "old guard" were taking care of themselves and doing what was best for them.

When Shields pointed that out, he got enough attention to get voted in, but somehow the position overcame him and he succumbed to the same trappings (and perks) that he questioned the previous group for exploiting.

Now, you have a chance to elect new people some with new ideas and some with old ideas. Be cautious.

Shields was a stepping stone to a better union, but he failed to take it all-the-way. He WAS right
in one respect and that was the Union needed to be better than what it was.

Now, you have a choice of re-instituting the clouted few and going back to status quo or you can push further in making it a union for YOU, not a dues-paying organization where a few get a lot of perks, and a lot get few, if any, perks.

It should be a balance of old vets and new people and have a focus on taking care of everyone and not just "friends". If you fail to get the right people elected, FOP will continue to be FLOP, not only in this blog, but more importantly, in the eyes of those who have to deal with you on a contractual basis.

If I was on the other end of the table, I would want you to be disorganized, segmented and having multiple factions because it is so much easier in dealing with a union like that, than one that is strong (and united).

If I was on your side of the table, I would be yelling at you to wake up, grow up, and elect an effective team to lead you and get what you deserve.

Now you have the opportunity to rebuild FOP. Don't blow it.

If you do, you might as well have no union at all because what leadership you will elect, will only take care of itself, and not the rank-and-file.

Brock Merk of all people for 2nd Vice President--this membership should be afraid of te damage this goof is capable of is elected by our membership and I am not saying this to derail the guy but after a few minutes of speaking to this guy you get the sense that he really is not in touch with the real world let alone the police world. He does not have the police officers best interest in mind and if he could he would move to eliminate many of the benefits we worked so hard to secure over the years. Unfortunately, when it comes to what is reasonable in terms of what is best for our union he really misses the mark. For example, if asked he will tell you he believes the medical should be drastically reduced by the number of days allowed on the medical roll to perminantly eliminating all paid medical time. He believes there should be no IOD or Convelecdnt duty for medical or on duty incidents. So if you hurt yourself and if an officer can perform the job he or she was hired to do then oh well that is your problem. He will back that up by saying he has never had a need to use the medical for person injury/sickness or IOD. He is very lucky in this area but for many of us we have kids and bills to meet and without our medical benefits would be seriously impacted by an medical related incident, Brock is also against members suffering from post tramatic stress syndrome either as a result from child birth, military service, or tramatic life event. He believes that if you have personal problems oh well, that is your problem better get another job. brock is out of touch with reality and could be a detriment to our union in fighting for our medical benefits, etc. I am not sure how much you know about this officer but he has never wanted for anything. His parents left him a family art business which he runs during the day and at night like a part time job which he refers to CPD as his "fun time" comes to CPD to work. He also does not have that many years on the job is around 78 in seniority on third watch in 014 and God knows the last thing we need in this union is another goof taking over or treating our Union. I ask you this -- How can we have someone like Brock as our president when he clearly isn't his number one priority nor does he relate to the average copper? Many of us have not had the luxury of not wanting for anything and must depend on our benefits to support us when tragedy occurres. Brock is in my opinion only is an ego maniac he is only interested in name recognition and and fancy title of some sort he really has a need to feel like he is important by running for some type of office, etc., trust me I am not making this up they guy will share everything I have just mention spending only a few minutes with him-- that is only after he has completely mind blanked you because he has a very bad habit of playing annoying mind games with anyone he comes Into contact with. Not to mention he treats most officers and people he comes into contact with on the sheet as though they are beneath him. Not good when representing a group of people you are supposed to protect. I really hope SCC posts this because unless you really know what this guy is about and decide to vote for him simply because he has not worked for fop before, he really could get elected and then what? We don't want another spoon fed clueless brat that has had it easy his entire life leading our union. If you don't believe me or think I am trying to derail this guy for no reason please do your homework and ask anyone that has worked with this goof on third watch in 014 for longer then a day. It is to be a two-part crossover episode with Law & Order Special Victims which is another show I never watched. The reason I never watched that show is a lead actor is none other the infamous gang rapper "Ice-T".

"Ice-T", for those of you new to the job, the police family and culture and for that matter polite society, was the rap artist who published a song titled "Cop Killer". Who else remembers that?

It really soured me to see him playing a cop as much as the talk of Jane Fonda playing Nancy Reagan.

Turn off this turkey and let's get a real Chicago Cop show into production.

The motion was denied because Dougherty and the rest of the current members did what everyone quietly knows they do best: fight for what is best for every officer, current or retired, out there. Dougherty could have done nothing and let Shields derail the election for an indeterminate amount of time--and for those of us who've ever been involved in a lawsuit, we know these could mean months and even years. If they had done nothing the current members in office would have stayed in office during the lawsuit. But instead of riding it out and letting Shields take the blame, Dougherty, Aguilar, and Del Riveria did what is best for the rank and file like they've been trying to do the last three years: stop Shields. All the Angelo and McDonagh supporters who bash Dougherty and the rest of City Wide, keep it up. While you're busy talking smack, they'll be busy making sure your interests are being protected.

To whom it may concern:

Recently we lost a very young, Detective to a heart attack while working.

The day it happened, a post here on SCC asked why we did not have defibrillators in the district's, and the areas.

I would like to form a committee to accomplish this by placing defibrillators in all the districts, areas and firehouses.

I do not know if we would have to raise the funds ourselves, or with the assistance of the Safety Committees of either of the unions pressure the City into providing them.

I do know that within a week we could have petitions on all of our work places, expressing our desire that they be installed immediately.

I learned tonight that the City Colleges have them and the airports have them.

We should have them.

If we have to raise the money, we could do it.

I am sure a lot of businesses that make their livelihoods off Police and Fire like the Credit Unions, the uniform stores, etc. would love to help.

Lets give it a shot.

How can they have 7 8 9 P days?
All of the range staff seem to have the most days to either sell or carry over but if you have 14 BFD's how can that be?

Ummm.... Could it be that they carried over bfd and pd's from 2013? I much prefer time away from this job to selling the days back to the city, so I carried over the maximum and currently have 18 total bfd and pd's in my bank.

I doubt anyone has 14 bfd's total, maybe just a combination of the days in their bank.

Umm no one can have 14 bfd's what kinda stuff is that? You only receive 4-6 a year and can only carry over 4 a year and must use those previously carried over that calendar year. The most you can have is 10. I skipped the guys ranting but now I'm gonna side with him. You guys are on some bs.

A CPD Chief gets about $175,000 per year or E8 formerly D8.

Back in 2005 the by-laws were changed. Instead of saying the president gets D8, they modified it to include union raises dating back to 1987. EVERY TIME THE MEMBERSHIP GETS A RAISE, SO DOES THE BOARD AND THE PRESIDENT.

The reason his salary is over $200,000 is because of the "...and shall be increased.." part of the sentence. Every time the membership gets a raise, so does the president.

Next, when you retire your insurance package is totally screwed up, they change group numbers on you, and if you retire they then make you pay a second deductible for that year if you need any healthcare. I say try to push for better beenfits now and make your union work for your dues money, put these board members to work , or get rid of them, put them on notice at meetings, don't let them intimidate you , by saying you are out of line and that you are an idiot, remember, you, the members voted these guys in. In case you have not noticed the FOP has been moving in a more professional manner, all things aside Bill has done so much for this organization that you harboring such a hate shows this. As far as the emergency board meeting called today again it shows the same Shields supporters again railroaded the whole meeting, Ron Shoegran made the motion to dismiss the meeting and Dan Shields seconded the motion the Shields minions voted their normal way, and nothing got accomplished, other than the election committee is a tad bit tainted but not according to the Shields group. Business as usual. Bill again tried to upright the train and failed only because of the minions of the past president. These are the same people who are telling you that they will change things, perhaps just seats.

Hey joker. I also voted for all legit guys from districts that are not associated with tickets. I've heard many ask pointed questions at FOP meeting for the last 6 years toward Donahue, Shields, and Dorety from these same guys. Some are District Reps.
We need new blood that isn't egotistical like Shields. All the guys from a district not running on slates fit that bill.

As far as the emergency board meeting called today again it shows the same Shields supporters again railroaded the whole meeting, Ron Shoegran made the motion to dismiss the meeting and Dan Shields seconded the motion the Shields minions voted their normal way, and nothing got accomplished, other than the election committee is a tad bit tainted but not according to the Shields group. Business as usual. Bill again tried to upright the train and failed only because of the minions of the past president. These are the same people who are telling you that they will change things, perhaps just seats.

The general consensus from everyone I've spoken with or overheard comments by is as follows: There are basically 4 tickets running in this election. Three are full tickets including a President nomination and one that is primarily Trustees. From everyone's perspective that I have encountered, people are having a challenging time deciding. If we stick with Bill, it may be the same board that we've encountered time and time again that may or may not be responsible for the current state we are in. Tom Mcdonagh is a Detective and people fear that we will be left with another board that is primarily detectives that we've experienced numerous times in the past. Dean has been on disability and people are concerned primarily over this fact plus there are talks about how he was on Nolan's team and people were not happy with his past performance. From what everyone can gather the Watchdog ticket promises to oversee everything going on no matter what President or ticket is voted in. I personally have not heard any significant negativity about any of the independents running. My recommendation is that everyone do their own research and form an educated opinion and vote accordingly. Listening to people bash the candidates and offer one sided opinions does not help any of us.

Gentlemen after you retire not one fraternal organization cares about you, the police dept. must start a system of checking with the retired members to see how life is going, many retired guys have spent their entire adult lives on this job and the only friends they have are coppers

The above reired Sgt spoke words that are so-so true. Us retired guys, lived for the job and then the job and all your friends are GONE.
It is a sad state to be in.
Our bodies are shot from the years otj, but our hearts will always be with the CPD. I would go back in a New York second if I could.
You young guys think that being a retired copper is grand, but you will see how sad it is when your time comes. Once a coppper, always a copper. Amen !

Not always true. I loved the job, will always be CPD, spent 40 years on, but I cant say enough about how great retirement is. I have many friends outside the department and never relied on just CPD for friends. A sgt told me when I came on "Do not give up outside interests and friends" and that was a true statement. Between pension, deferred and most importantly good health I'm enjoying the hell out of retirement.

Umm no one can have 14 bfd's what kinda stuff is that? You only receive 4-6 a year and can only carry over 4 a year and must use those previously carried over that calendar year. The most you can have is 10. I skipped the guys ranting but now I'm gonna side with him. You guys are on some bs.

You are 100% right No way can you have more than 10. Thats a fact. Anything carried over has to be used the following year.

I have never seen as much back stabbing as this FOP election, yes being a FOP official is a cushy job, but regardless of what union you belong with, they are all the same, they promise you the world, just like a regular politician, and deliver only a little bit, they are all self centered and really don't give 2 FUCKS about us, I'm a retired Sgt. and still belong to FOP, why, because I want to support the police, but I must say this, Gentlemen after you retire not one fraternal organization cares about you, the police dept. must start a system of checking with the retired members to see how life is going, many retired guys have spent their entire adult lives on this job and the only friends they have are coppers. Next, when you retire your insurance package is totally screwed up, they change group numbers on you, and if you retire they then make you pay a second deductible for that year if you need any healthcare. I say try to push for better beenfits now and make your union work for your dues money, put these board members to work , or get rid of them, put them on notice at meetings, don't let them intimidate you , by saying you are out of line and that you are an idiot, remember, you, the members voted these guys in. And as always. STAY SAFE AND GOD BLESS YOU ALL

It would be nice if you continued with the same insurance,but you don't. Why if you went from active po to retired, would you believe the policy number wouldn't change and the deductible apply? Its a different insurance policy with different benefits.

I hope that we do not make the same mistakes again. Vote for the following:

1. Candidates that you personally know and have confidence in.
2. Candidates that will bring to the Board of Directors both previous Board experience AND candidates who have no Board experience but new ideas.
3. Candidates from all of the tickets so that it not one slate who is elected.

Only with this mixture will the FOP go forward with a Board of Directors diverse in experience and new ideas as well as members who were no slated together but going forward will provide the check and balance needed.

The above jerkoffs can all go pound sand. I didn't vote for any of the above bums, there are no solutions in this bunch, only more problems.

Finally, after many years, the only ones who are making sense at long last are Kevin C Jans and Brock Merck. For President I went with Peblanski. If there were down there previously, I did not vote for them. That left some positions blank on my ballot. So be it. Too many bums.
