More Koschman Fallout

There is now a timeline of the behind-the-scenes actions of the Department and who was calling/texting/e-mailing whom:
  • After the Chicago Sun-Times began the investigation that led to former Mayor Richard M. Daley’s nephew pleading guilty to involuntary manslaughter, Daley’s administration began scrambling to write a police report that falsely concluded Richard J. “R.J.” Vanecko was defending himself when he threw the punch that killed David Koschman.

    City Hall’s 59-day investigation involved 16 police officials — from top brass to detectives — as well as Daley’s law department and the mayor’s press office, including one of Daley’s closest confidantes, Jacquelyn Heard.

    Daley’s press office released the findings only after police officials met with Cook County State’s Attorney Anita Alvarez’s chief of staff, who apparently agreed Vanecko shouldn’t be charged.
So the mayor's people were kept in the loop pretty deeply. Webb says there's no evidence that Shortshanks participated in these exchanges, but when everyone involved was either hired by, worked for, or was promoted at the behest of one guy, one political Machine, well...let's not kid each other. This is still Chicago.

Also, the ASA who "threw away" the files from the case resigned - six weeks ago:
  • The prosecutor who declined to charge former Mayor Richard M. Daley’s nephew in the killing of David Koschman — and apparently “threw away” the case file — has left the Cook County state’s attorney’s office, the Chicago Sun-Times has learned.

    “Darren O’Brien no longer works in the [state’s attorney’s office]. The state’s attorney accepted his resignation letter approximately six weeks ago,” said Sally Daly, a spokeswoman for Cook County State’s Attorney Anita Alvarez.

    According to county records, O’Brien, 56, retired on Dec. 30, as Daley nephew Richard J. “R.J.” Vanecko was awaiting trial for causing Koschman’s death. O’Brien had worked in the state’s attorney’s office since 1984, when he was hired under Daley, who was state’s attorney before he became mayor.
For the naive, Daley used to be the State's Attorney for Cook County, and when he moved up, he put his deputy Dick Devine in charge and kept a tight hold of the leash. But remember, there's no evidence that Daley knew anything. Ever. At any time. But when you control all the levers of power, and everyone knows what's expected of them before they're even appointed to a spot (elections being a mere formality), well then, you have insulated yourself from ever having to actually having to engage in something as sundry as covering up a homicide.

Down the memory hole everything goes, with only the police taking any heat in the media. As predicted, this case is going to be the new Burge or Abbate hammer with which to beat the Department.

Doherty and Donahue are part of the Daley's democrat machine for mike Madigan. They pushed Fran Hurly to be state rep against a policeman running for the same office in the primary. They pushed Fran Hurley, the 19th ward secretary over the policeman, a lawyer. They also didnt back Lt. Garrido for Alderman so he lost by 60 - 65 votes. They are both playing politics at you expense to benefit themselves. DUMP THESE TWO.

WTF, Either Daley junior never used a phone or email or people really walked in step with his commands. The best book I ever read in school was Boss by Mike Royko. In essence, many people owed Daley Sr favors and no matter how illiterate the son seemed, he got paid. Literally.

Two people mentioned in this report, have close ties to the FOP. James McCarthy, who was recently promoted to Sgt, and assigned to the 009 district, was a field rep for the last several years. Terry Collins, who serves on the Board of Directors, is a trustee. Both men are attorneys who worked in Legal Affairs, for Deb Kirby. It's all legit.

These two Detectives are the most honest hardworking guys I know. They did not engage in any type of cover up. Do you think they, if given a chance wouldn't hang the mayor and his family out to dry, well I can tell you they would and they would not want to take the hit for him.

The real idiots here are Darren O'Brien, Sgt. Cirone, Andrews and Lt. Walsh. If you are going to slander someone slander them not the Detectives. The issing file probably is sitting in Devine's basment somewhere or went into a firepit in his yard.

The only one of these cities that has a few redeeming qualities is Austin. Houston is an absolute dump. They are big cities, with all the same big city problems. Why would I leave Chicago's traffic, exploding Mexican population, crime, corruption, smog and lousy schools to experience the same things, plus a house with no basement, (that's right, no basements in Texas because of the unstable subsurface), fire ants, no neighborhoods like we have here, minimum wage jobs, huge water problems, and where it's brown all year because nothing grows in Texas. No thanks.

Finally, after all these years, this POS Darren O'Brien, has met his Waterloo.

I've been retired a long time, but I can still remember calling Felony Review and this moron responding. It was like maybe I dialed wrong and they sent a Public Defender.

We once had a witness to a homicide who was reluctant to cooperate, but finally, after hours of interviews, he finally came around. We called for an ASA and O'Brien responded. All of our hours of investigation went up in smoke as it took O'Brien all of 5 minutes to talk the witness out of testifying. O'Brien was threatened with arrest and the charges were subsequently approved.

The only one that should be charged with obstruction of justice and official misconduct is none other than Darren O' Brien. He had the final word on charges and since it was a homicide the detectives can not get an override on the states attorney. And why would he destroy the case file? Even the FBI should be able to figure that one out.

He never had to say anything. Why did you think they let his office and CPD know who was involved. He doesnt have to say anything. Its implied. If your a boss and say it comes to your attention that Daley's nephew wants a transfer or a promotion, do you really think Daley has to call you and ask for it. My guess if you dont do it, his people call you if they can find where you were dumped to

Those guys have done a tremendous amount of good for working policeman out there and are true friends to real policeman and anyone that knows them is aware of that fact. Any personal beefs can always be addressed to them in person. They are easy men to find and I'm sure they'd welcome the input. I have read Webb’s report three (THREE!) times, cover to cover. And, in regards to the 2004 investigation I believe Webb does a great disservice to the CPD officers involved and to the public. All the actions by CPD personnel (in 2004) that he outlines is non-criminal behavior. Yes mistakes were made. Very stupid mistakes, but none he lists are criminal. (We all know you can’t take assumptions and beliefs unsupported by real evidence to court).
Webb states in his report that “Prosecution is Barred by the Applicable Statute of Limitations” yet he never details any criminal behavior committed in 2004. By stating that the statute of limitations applies he implies criminal behavior yet he never outlines any. So, if there was criminal behavior wherein prosecution was barred by the statute of limitations why does he not outline it? And if there was no criminal behavior why not just say so? To make the CPD look bad and to justify his fee?

Why would I leave Chicago's traffic, exploding Mexican population, crime, corruption, smog and lousy schools to experience the same things, plus a house with no basement, (that's right, no basements in Texas because of the unstable subsurface), fire ants, no neighborhoods like we have here, minimum wage jobs, huge water problems, and where it's brown all year because nothing grows in Texas. Election Ballots Go Out as Planned
Yesterday, suspended Lodge President Mike Shields file a lawsuit against the FOP demanding damages because Shields claims he is a whistle-blower. Shields also filed an emergency motion for injunctive relief, seeking to stop the FOP elections so he could be placed on the ballot. The Lodge was first notified of the court action late yesterday afternoon. The judge hearing Shields' "emergency" ordered that FOP file its response by 10:00 a.m. today, with a hearing set for 10:30 a.m. Our attorneys worked late into the night formulating our response and preparing affidavits for witnesses.

The case was heard late this morning and Shields' motion was denied. The FOP argued that the "emergency" was one that Shields himself created and the judge agreed, ruling that Shields filed his motion too late and had squandered his opportunity to be heard by the court. Ballots were mailed today.

I couldn't agree more. Many in the news room don't seem write about the truth any more, but rather a perception that fits an intriguing narrative.

Look at the media and Homicide reporting. They seem to be intrigued with the low homicide rate and yet a public perception of crime being out of control.
Somewhere in there they refuse to look at the answer that's in front of their noses.
Instead of reporting on blatant anti-social behaviors and gangs, they focus on the police crime numbers.
The Homicide Watch is a daily article that follows the shootings, of which almost every single one is gang related, yet the narratives are heart-tugging, and sad; as if the gang and anti-social behavior component doesn't have any role.
Perhaps the media should get back on the street and REALLY investigate these crimes- you know find out WHY they happened - not how.
We have a gang war in full throttle throughout the city, yet the papers are filled with a perception of police misconduct and incompetence.
By the way Mr. Webb, Sun and Trib, those cops you suggested as incompetent (Walsh, Andrews, and Cirone) would blow any of you out of the water when it comes to a complete investigation, hands down.
Only in Chicago can a cop be a criminal and a criminal be a victim.

Like drunkies State Attorneys that cause criminal damage, DUIs, domestics and so forth. I mean they keep using the excuse, "it was a mistake." Even when found with drugs like cocaine. What makes you think any of this is personal? This is a blog, where people discuss their own opinion on a variety of subjects. It's not about any one individual, for most of us anyway. it's about right and wrong, it's about a mother who lost her son and has has endure insult to injury, it's about political clout, it's about a terribly handled investigation, not once but twice, it's about the equality of a disciplinary system and a justice system, it's about merit promotions, it's about public trust, it's about questioning what on its face looks bad and is another black eye on CPD as a whole. Your entitled to your opinion, as are all the people you take issue with. Just because something is written on this blog doesn't make it true or valid, it's just a debate. I know one of the people involved and have always thought they were a nice person and still do but that alone doesn't excuse this mess. Sweeping it under the rug or minimizing it by saying much to do about nothing, is a option I guess, but I try to put myself in Mrs Koschmans shoes. Someone wrote "Mrs Koschman isn't complaining about the verdict", really? This woman has fought for years to have an investigation into her sons death. I don't think the 60 day sentence was any great victory in her mind but she never gave up her quest for the facts relating to her sons death and I commend her for that.
For me, this is about taking responsibility for the decisions you make, about being held accountable when you make bad decisions and that should apply to everyone including the politically connected like Vanecko.

Bashing coppers? Maybe, but anyone who has read the grand jury report must admit that the investigation was pretty shoddy. I am retired so I really do not know the background of the supervisors in this matter, but I do know that before I left the politicians made the department a patronage haven , especially the detective division. Supervisors and commanding officers with no real detective experience and no one supervising complex homicide cases. No cops were indicted in this matter because of statute of limitations and too many people granted immunity. But, I firmly feel that every police officer that is still on the job that is named in this case should be the subject of a CR number and an internal investigation.Some of the comments that I have read here are just plain crass and lacking empathy. God forbid it was not your kid. I would never put my name on a report ( and have refused in the past) where a supervisor interjected a statement that was not true or based on fact. your GPRs are and should be everything . I hope the superintendent makes major changes within the detective division for accountability, report writing and securing and indexing investigative files. I hope this never happens again .

C'mon men. Anybody out there actually believe that we could get any 5 policeman on this job to piss on Daley if he was on fire? Put themselves at risk to help out a family member? Forget it. He is persona non grata among us and we all know it. Phil Cline told him to get fucked and quit. How is it plausible then that he conspires to help that little p.o.s. Silly. Literally, this is a complete distortion of reality by the Sun Times, etc., to try and make a something out of absolutely nothing instead of doing their real job of investigating the embarrassing and widespread corruption among nearly every elected official in this county. The real scandal is the collusion between the media and these officials. Based on his history, Dan Webb hates the police as much as anyone and he concluded that there was no evidence to charge anyone with any crime in regards to a cover up in the Koschman case. His statements that he "considered charges" against certain people is clearly a bullshit nod to the media that he dearly wanted to. Had there been any shred of proof you can bet he would have tried. The truth is that Koschman kid was drunk, being aggressive and looking for the ass kicking that he got. Did Vanecko overreact or fail to walk away when he could have? Maybe. Those facts were presented and the State refused charges. As in many, many cases. To Andrews, Walsh and Cirone. Those guys are the direct line up the chain of command and it is their job to review and correct reports. The fact that they approved, rejected or requested changes of any report is proof of nothing except they were doing what they are paid to do. Whatever personal beef someone may have with those guys, that is the truth. Those guys have done a tremendous amount of good for working policeman out there and are true friends to real policeman and anyone that knows them is aware of that fact. Any personal beefs can always be addressed to them in person. They are easy men to find and I'm sure they'd welcome the input. I doubt that anyone who hides behind a computer would have the courage to do so but that is what a real man/woman would do. Any here?

Did these guys try to pretty this up? Yes, they did. But all in all, the were not covering for Vanecko. If they had a good case against Vanecko they would have slammed him into the ground. Ask any detective in the city if they know of a case similar to this that has been charged. None that I know of have. If a cop came to me with a 30 second narrative of the facts I'd answer immediately - "there's no way the state will charge this." That's what's being lost here. Was JG wrong for not including a witness statement that Vancecko was the aggressor in his closer? YES. He was embarrassingly wrong. Wow. He failed to include a witness statement. I still can't wrap my head around that. That being said, JG is a good guy and a great Det. Some call him a company guy. I don't know. Maybe. Cirone's E-Mail about Koschman saying "I'll kick your ass" to pretty it all up was also embarrassing. I know they were trying to make inconsistent witness statements sound consistent. I get it. But you can't do that. You have to include everything. But were they doing it to cover for Vanecko? I doubt it, because the statement was still in JG's GPRs. Stupid and embarrassing ya, but no way a cover up.

You can't cover something up when there are 5 witnesses. You cover shit up when there are no witnesses.

Cover-up my ass.

Throwing the file out afterwards? - ya, I'll give you that one. That was a cover up, not so much for Vanecko but maybe just so the work would not be scrutinized.

These last two big paragraphs have a problem with the term 'cover up'. Yet they accept the term 'pretty up', which I don't get. Whatever. So Lets drop the terms, heck, even Webb never used such terms.

Webb laid out the facts of the case in chronological order. Part of his job was to see if there was any criminality conducted during the investigating and prosecuting phase. Webb said he could not prove criminal intent.

Without reading between the lines like we all are doing, the facts of the case definitely show how incompetent and lax the CPD and ASA can be. Everyone involved said this was a heater case and only the best CPD and ASA were assigned. So if this is what the best do on a heater case, what the hell do the dog ass moron CPD and ASA do on a nobody case?

Based on these proven and self admitted facts disclosed to Webb, CPD and ASA did allow a man to get away with "murder" (yes, involuntary manslaughter, agg batt, I know). Shouldn't those involved be punished by the CPD and ASA for being grossly incompetent and lax and negligent in doing their job? (Yes, some are retired, I know)

This is what Dan Webbs investigation was about. Was there enough to charge Vanecko? And did any CPD or ASA do anything wrong? I think Webb answered both. Now what - who's hands is this in now, if any?

So, counselor, in your "defense" you admit your clients 'prettied up' Vanecko's story and threw away material evidence?

I wish you were their lawyer. I'd like to see some people get what they deserve. A mom just asked for the truth. It's our star they tarnished. How about we just expect them to do what they are paid for .....to do what's right. Not to do what's right for them.

Steve Peterson was in charge of this mess and Tom Byrne his hand picked Chief of Detectives, as we see both were asleep at the wheel and Andrews was allowed to really fuck things up. When questioned about what happened Peterson threw the detectives under the bus and Byrne didn't know what the fuck was going on. C'mon skull these were your guys, way to have their back you merit hack, and Hilliard lackey. Go have breakfast with Weiss and talk about how you could have been an FBI agent if you only had a brain.

Read in today's Sun Times that the B.G.A. sent a letter to the new head of the F.B.I. in Chicago to look into charging the police with civil rights violations and/or corruption charges. This like the
Chicago version of the Rodney King case. I think the police should stick together and strike let's see what would happen to the City then. No police in Chicago there would be a thousand murders a week. We have to take stand and stop being shit on by the politicians, newspapers, and the public. Strike, strike, strike!

I am still stunned that anyone would defend the actions of the detectives and the prosecutors office in this matter. The crass comments that this little skinny kid was drunk and the aggressor and got what he was looking for are outrageous. This was poor and sloppy detective work. If the dicks did their job and made their case, which they did not, then let the ASA reject the matter. What crap. Someone comments " spot on" really? Can supervisors correct reports or ask for a correction? Certainly, but only if what they want is based on some fact or interview/ Everything should be in the report both good and bad and let the courts settle it out. If a supervisor wants to add things to a report or make corrections that have no basis, let them do a supp. You just can't defend this investigation. Police detectives around the country are now laughing at the detectives in the CPD, for this investigation and a lower homicide clearance rate then Harvey.
