Vanecko Jail Time

  • A nephew of former Chicago Mayor Richard Daley today began serving his 60 day sentence after pleading guilty to one count of involuntary manslaughter, officials said.

    Richard Vanecko, 39, turned himself into McHenry County officials where he began serving his sentence at the McHenry County Jail, according to McHenry County Sheriff's officials.

    A spokeswoman could not say if Vanecko would be in protected custody.
  • The BGA supported the appointment of a special prosecutor in the Koschman/Vanecko case, and filed an amicus brief on the matter back in 2012.

    We now support continued scrutiny – this time, by your office – to determine whether federal crimes were committed by police, prosecutors or other government figures in regards to the Koschman/Vanecko case.

    In many ways, we regarded Mr. Webb's report not as the end of the story, but just the beginning.
But they couldn't do any of this while Shortshanks was running the show.

Why is he in the Mc Henry Co. lock-up and not Cook Co. where the crime occured? He could have been send to Kankakee Co. for safe keeping. Does everybody get to choose where they serve now or only the less lucky.

Wow, a whole lot of hate going on here. I think it’s blinding you to the facts. Webb never said anyone involved in the 2004 investigation committed any crimes. (Read the report – it’s obvious you haven’t) He only said that the Statute of Limitations would prevent any prosecution IF there were crimes committed. Further, the detective in that investigation ASKED FOR CHARGES. Even going so far as to request help from Thomas Epach to convince the State Attorney to charge. Too bad none of the witnesses could ID Vanecko. To this day they say the same thing and admit they could not ID him.
No criminal activity in 2004 was ever outlined by Webb. Mistakes…gross mistakes, yes. But NO criminal activity.
Put your hate aside for a few minutes and look objectively at the case.

No, you are the soft one. Apparently you can’t comprehend what you read. I never addressed the 2011 re-investigation wherein, as you say, “the fucking dicks gave Vanecko a defense without ever getting him on the record” (by the way, in case you are unaware, you can’t get anyone on the record when their attorney says he’s not going to talk to you). Nor did I mention, again as you said, “the convicted lieutenant, the clouted Andrews, and so on” who were part of the 2011 investigation.
Further your complaint about the line-up is ridiculous. They should have taught you in the Academy that the point is to make the line-up participants similar enough so that the witnesses identify the subject by facial recognition (please refer to Case Law and the Rules of Evidence). An identification made because “it was the big guy” won’t fly. Every witness must be 100% positive the person they identify is the offender because they recognize him. Not because he is bigger, fatter, thinner, wore a red hat, or a pink tu-tu.

The detective did what he did. Did he do everything he could? I don’t know. Nor do you. But he asked for charges, even without getting an ID and without a statement from the suspect because his lawyer told him not to talk. You say he did “so little that O'Brien could justifiably then say no charges”. I find it suspicious that you are so quick to defend the State’s Attorney. Are you really a copper or a spy lurking here?

Were mistakes made? Sure. I already said that. But certainly no provable evidence was found of any criminal activity. That was my point.

I believe you are only so agitated and indignant about this case because Vanecko, a Daley relative, was involved. And that, sir or madam, is what is pathetic.

Ok, lets see if we can get people to understand this fiasco. He was NOT tried in McHenry County. He was tried in Cook County, Rolling Meadows court by a McHenry County Judge. County Jails are NOT controlled by IDOC. The county jails are holding facilities from which prisoners are distributed into the IDOC system. A judge can assign a convicted criminal to any county jail that he/she wants. He could have been sent to IDOC, but I'd guess that since he is only going to serve 30-45 days, it's not worth the time and effort to ship him around, evaluate him and assign him. Plus he's connected, plus IDOC doesn't want his ass. Too much media nosing around. Plus he's connected and the Judge gave him a break.

Actually 1:05, the detective who ended up with the original investigation provided that testimony to a grand jury. That intentional flubbing of the investigation is more than enough to warrant a civil rights charge at the DOJ.

Then there is the leaving the investigation open for 6+ years, though every level of supervisor above the detective was aware of it? Same.

The lineup? Providing the worst context for what the witnesses described? That's not in Rules of Evidence or "Case Law", lol. Care to cite any particular case at the state or Federal level that would support this nonsense?

Can't help but think you were involved in the original investigation. Nobody without an interest would provide the distortions and misinformation we only read in rare comments here. Hope it was worth it for you in the end.

Again, you seem to fail to understand what you read. That is, if you read Webb’s report at all. You state the detective testified he intentionally flubbed the investigation (“That intentional flubbing of the investigation”. Read the report. He Admitted to no criminal behavior nor that he intentionally flubbed it. Webb further cites in his report it was ”intent” that he could not prove in nearly all aspects of the case.
The line up? Again you don’t seem to comprehend that the correct procedure is to make each subject as similar as possible, not so different as to make any single one stand out…no matter what the witnesses said. I have provided you with a few sources to help you understand.

One more thing 8:43, there are hundreds of open homicide investigations sitting out there. Many with named offenders. Sitting for years and years, just in this city. And all the supervisors, the DOJ and everyone else knows about it. It's not against the law. Where do you think CCX's come from? Just because an offender is named does not mean there is enough to charge him/her thus the investigation remains open until CCX'd. Many times years and years later.
Now, I'm tired of trying to educate you in the basics of law enforcement. Pick up a book sometime.

What you just did was bactktrack. He did admit to flubbing it by passing it to states attorney ASAP with so little that the states attorney could pass. Not criminal intent, but it's 100% a civil rights violation. He/you hung himself/yourself.

In fact, WADE was overruled long ago.

So which is it, are you one of the original fucked-up detectives or someone in the chain, O'Brien or one of the other incompetent State's Attorneys, or one of the city lawyers on the hook for this?

Explain how asking the ASA for charges is “100% a civil rights violation”. You claim he did almost no investigation before handing it over for charges. Nowhere is that stated. He never said that. He did his investigation and asked for charges. Further, brainiac, civil rights violations also require intent. Where is the intent? Do you know anything about the law?

Do your homework and read Webb’s report and stop embarrassing yourself with your ignorance of the facts.

And no, I’m not worried. I was not a part of the investigation. But those who were don’t need to worry either. As you should know, if you bothered to look up the federal statute of limitations, it applies to civil rights violations (if there ever were any) from 2004.

SOS officers did their time in a suburban county jail. Maybe they should have done their time in Cook County
