Stories in both papers yesterday about how weed ANOV's just aren't taking off like politicians hoped they would and how Cannabis arrests are still more likely than a ticket being issued:
- Sun Times - Instead of giving out tickets, Chicago police more often than not arrest people for possession of a small amount of marijuana, according to a study released Monday by Roosevelt University’s Illinois Consortium on Drug Policy.
Researchers found that 93 percent of misdemeanor marijuana possession violations in 2013 resulted in arrest in Chicago.
That despite the city’s 2012 ordinance that allows for tickets to be issued for small amounts of marijuana possession.
- Tribune - Two years after marijuana possession became a ticketable offense, arresting people with a few grams of the drug remains a bad habit for law enforcement, drug policy researchers said Monday at a Roosevelt University symposium.
Cook County has the highest rate of marijuana arrests anywhere in the U.S., according to a study released Monday by Roosevelt’s Illinois Consortium on Drug Policy. In 2013, there were nearly 16,000 arrests in Chicago for possession of marijuana and only 1,100 tickets issued.
These reports preempt an upcoming article in The Reader that will show that will show Cannabis arrests disproportionally affect ...wait for it....black people! That's right - Cannabis arrests are racist. This also explains the orders from downtown that have turned entire Tactical Teams into ANOV generators in an effort to blunt (pun intended) the numbers by writing....wait for it again....MORE black people! This will even out the numbers of white folks (or people) who manage to get ANOV's instead of spending hours in the lockup.
The entire ANOV process is cumbersome and keeps you off the street longer than a regular weed arrest does, but McCompStat wants ANOV's, so that's what is being pushed.

They simply say that arrest are the norm and it's done out of habit. What they aren't saying is that numerous arrests occurred because the offenders don't have valid identification which is a basic requirement for citing with an anov. The likelihood it will continue is the BS box but when there is no I'D or the arrest is coupled with another offense-- which it usually is-- then an anov isn't allowed.. As per the order. The closing line to this is simply not true. ANOV's for cannabis are faster than arrests. Writing an ANOV, completing a chemical test, one inventory and a one sided document, is faster than a long form arrest, inventory of the narcotics, inventory of the arrestee's personal property, case report and complaint. The ANOV process DOES save time.
Not that I support it! I think all narcotic offenses should be long form arrests. But as one of the few officers who has actually written ANOV's for cannabis, I can say with certainty that it does save time over a long form arrest.
More African Americans violate the drug laws so that is the reason for the numbers. In our politically correct America that equals racism.

And how many of the "citizens" we encounter on a weed stop, where we could issue an ANOV, have an active warrant that requires us to bring them in?

ANOVs generate money (in the Mayor's world anyway) and arrests cost taxpayers. That part is easy enough for anyone to understand.
The second part is just too hard for them to admit. They are all smart enough to see it I hope. You send the police to "hot spots". What is a hot spot? It is where people are shooting each other plain and simple. Now if you send all the police in one area, that is where you will get all your enforcement. Parking tickets are another example. I will bet my life that a majority of tickets are issued in the downtown area.
Who is shooting each other? Now you have you answer. It really is that simple.
Why not just make Blacks exempt from ALL laws so every other race can Stop being racist.

When this first came out, several POs told a boss it would not work the way they said it would. The boss did the right thing and mentioned it to the Supt, who ignored him , as he does most good advice.

The problem was that they will automatically assume police corruption. They believe that if the police solely issues a citation they will keep the marijuana or something of the like. This leads to a inventory process which is time consuming where the liability far exceeds the reward (honorable, court, O.T., ext..).
All they have to do is allow the patrolman to write a citation and dispose the cannabis the same way small fireworks are disposed. Citation numbers would increase by 2000% and related vehicle i mpounds by 500% . Offcourse, that would make to much sense. Mmmmmmhhhhhmmmm
A valid ID is Required in order to receive an ANOV ticket.
No ID = Arrest.
Which demographic hasn't one or refuses to produce an ID?
Which demographic is likely to be smoking the marijuana and gets stopped?
Furthermore, why should race be an issue if only certain individuals or groups thereof, participate freely in the use of said controlled substance?

These pundits always make the false assumption that writing an ANOV for pot instead of a physical arrest saves a ton of time and frees up the officers.
That's simply not true. Due to the inventory procedures an ANOV for pot ties the officers up just as long, or longer, than a physical arrest for the same offense.
Someone, maybe the FOP, needs to enlighten these pundits on that fact.
Most people who are up to no good seldom carry identification .... a prerequisite for an ANOV.

What about the 99% of people who refuse to sign the ticket? They have more time then money, so they can sit in lockup for 5 hours and get a free juice and sandwich, then get an i-bond and the weed case will automatically be thrown out in court. I always thought this was true after spending my career in black and Hispanic areas. But, the facts are there and the above statement is not true. It seems that research by universities and by DOJ show that blacks and whites use illegal drugs on an equal footing. What does account for more arrest in black areas is the fact that drugs are sold and used differently between the races. Whites are not as open about selling or using. Check the information available for free at DOJ.

indeed. Studies through out the years show it's pretty even. The brickyard for instance on 5th ave near cicero isn't just a bunch of homeless white people. The.western suburbs also dispel that myth. Arrest numbers say differently because a black person is more likely to come in contact with police due to heavier police presence in their neighborhoods/more likely to be committing a crime when being caught with drugs, etc.

Have any of you actually used the new clear system on the pdt? It is awful, slow and times out. What about subsequent charge? Most of the time rap sheet doesn't even load on the pdt. 15 grams is too high. Subsequent charge was obviously not taken into consideration.

If the bag is small enough to do an ANOV, how is there court time for locking someone up for it? The state's attorneys just Nolli these cases. Here is how I save a ton of time on cannabis arrests: I sprinkle the shit in the wind and throw the bag away and break open the joints and scatter the shit all over. Then I leave. Takes hardly any time at all and is much more satisfying. Same thing with small amounts of white powder or tan powder, the kind of small amount that gets no PC always. I save the courts the trouble of finding no PC, I find no PC myself. Again, faster and satisfying.
How bout you ANOV em if you wanna kcuf em in the wallet, or lock em up if you wanna give them a CB? As long as you hit em. Only yttihs thing is we can't do both to the same offender haha...

How often are you going to have an opportunity to write an ANOV just for POC? Anytime you get someone with weed they're either smoking it or you find it during a custodial search, both of which makes them ineligible for an ANOV. Unless they want me to start searching people without PC, how else is the sernerio of writing an ANOV going to come about?
The order on ANOV's was changed to say if you can verify their identity via CLEAR to write them an ANOV, but CLEAR almost never works in the car and you can't bring them into the station to check.
I can't wait till they find a homicide victim or offender with an ANOV for weed in his pocket from 15 minutes before the murder. How are they going to explain that? "My baby would be alive today if poleece would've locked that man up!"

In a nutshell, here's the problem-
An ANOV is a waste of time because there's no physical arrest and you still have to deal with the waiting and hassle of getting an inventory approved. Why spend the time and not get a head and a court date? Two, with how lax it's getting, why lock someone up and ruin your credibility in court when you only get finding of no probable cause over and over again? Just a waste of time. It'll be legal soon and tact will have to go balls out on pissers, drinkers, and fly dumpers...and riding bikes on the sidewalk.

I absolutely agree with you office. It's not like we are locking up normal Joe's who occasionally smoke weed. If you want to do real reporting, find out what the weed arrestee's background looks like.
Maybe, If I lock up dude for some weed, he wont be on the corner this evening getting shot or being the shooter.
That saves the Mayors and Mccarthy's ass. It also saves the taxpayer for the cost of the medical bills.
I think the mayor, the supe, newspapers and the citizens all owe me a big thank you.

It was made illegal because of bullshit. Plus you can't ID it via Smell on a Traffic Stop if there is no "Purple Haze" smoke cloud or smell in the vehicle. Easy to cover with a Camel or a Newport
It is however less harmful than the cigars or cigarettes I see Cops smoking as they drive around in their Marked Squads.
Everybody complains they want more police, but yet complain when they, their family, or friends get arrested. All they want is more scarecrows.

The dumb idea is marijuana prohibition. Prohibition didn't work in the 1920s, it's not working today. But the Gangster Disciples, Latin Kings, etc thank all of you prohibitionists for your support. Without you they wouldn't have money for guns and bling and rap record labels to recruit new members.

Most illegal drug transactions occur with absolutely no law enforcement presence. That is to say, the drug market is essentially free from the interference of any rule of law.
It's a free market.
Most production, transport, delivery and distribution goes on unhindered by any prosecution.
You somehow believe that legalization makes your purchase a happy, friendly transaction where no violence takes place along the chain and suddenly the cartels are like your friendly, neighborhood corn, pork rind, or Popsicle vendor...
Competition among all contraband suppliers for their command of the market doesn't make a single distinction between what's inside of those bundles crossing the border.
In other words, you can stop with the flowery crap about how potsmokers are harmless.
People are getting their heads cut off in Mexico just the same to keep you and your friends baked, just the same as for the rock-smoking crackhead or the junkie with the needle in their arm.
