Did something change?
- Don't get yourself jammed up big time by doing movers anymore. The law changed yesterday and it states that we no longer take a persons license as bond. They sign the ticket and go on their way. But no one told us, not the law department, not the CO book in roll call. Take someone's license and you're fucked. Remember ignorance is not a defense when you get sued.
Senate bill 2583 went into effect 10Aug14 and it states "Amends the Illinois Vehicle Code. Repeals the Section concerning license as bail. Provides that residents of this State and residents of any other state which is a member of the Nonresident Violator Compact of 1977 who are cited by a police officer for violating a traffic law or ordinance shall have the option of (1) being taken without unnecessary delay before a court of jurisdiction or (2) executing a written promise to comply with the terms of the citation by signing at least one copy of a Uniform Traffic Ticket prepared by the police officer. Provides that the Secretary of State shall suspend the driving privileges of a resident who fails to comply with the executed written promise to comply with the original terms of the citation until the Secretary receives notification by the court of jurisdiction that the person has appeared or otherwise executed the written promise to comply with the terms of the original citation. Amends the Code of Criminal Procedure of 1963. Removes a provision allowing the Supreme Court to include deposit of a chauffeur's or operator's license in the bail schedule for traffic cases. Makes corresponding changes in other portions of the Code."
Is this some sort of joke to get everyone to stop writing movers? If so, well played. If true however, once again, a massive breakdown in keeping the troops informed of a major legislative shift.

Our e-mailer must have had the first printing of the story. So this is interesting - everyone rolls on a signature. We guess that will save them the trouble of actually having to go out and acquire a legal license in the first place.

They are working hard to dumb down the laws for two of their biggest voting blocs: criminals and illegals.

This was tried back in the early 1980's under the "PTC" program -Promise To Comply.
Problem was everyone promise but no one complied.
I hope the Department issued a Special Order, Department Notice or at least a teletype order.
Maybe it will work now with better inter-state communication.
Its pretty much the same as it is now. If they have a license they sign and leave, if they don't they get long formed or an i-bond.
For those who weren't around then, they tried this in the mid 80's. DL suspensions for non compliance went through the roof. Most of them from laziness and/or stupidity and some for pookey saying he was really mookey and no one giving a shit to make sure. I'd put my money that the same thing will happen.
I know it's difficult and most of you whiners have to be spoon fed everything but I read it on the home page of I-CLEAR, it says your not to take a DL for a petty offense, but things such as no insurance, speeding over 20, etc all still require a bond. If they refuse to sign for the petty offense, then you write refused in there. Satisfied?
Remember when they first started taking signatures rather than DL's. Ill residents stopped coming to court and they changed the law back to requiring a DL for IL residents. How soon they forget.. (+20 years?)

Sick, he just made criminals happy because they can hold onto their license. Working coppers know driving on a ticket w/ license forfeited for bond makes it easier to get a subject out of a car and into cuffs for many different things.
Also remember he's rarely challenged for office.

This is a complete breakdown in leadership. Your legal dept should be on the ball when it comes to shit like this so when this becomes law, every copper gets notified of the change. Not every CPD officer reads this blog, so I guarantee some officers will continue to take licenses in violation of this new law since they weren't notified (not acting maliciously, mind you.) That exposes them and the department to IPRA trouble and lawsuits.

Funny that this has gone into effect less than a year after giving illegals the right to obtain a drivers license.

It's about time. Most other civilized states do not require your DL as bond. Don't show up for court or pay the fine and the long arm of the court will nab you.
Haven't written a mover in a long time. I'm not a dog, I respond to all by jobs and clear up in a timely manner, and probably write a book of parkers a week. It's just that i got tired of seeing officers testifying in traffic court and the judges finding everyone not guilty. Sometimes even without hearing the defendant. So now I write them in parkers. If you open the parker book and see the list of codes, look at the first one: "unsafe driving". It's like a 19P, only they'll have hell of a time fighting it. Don't forget about the contact cards either boys and gals. The department wants us to hold on to any and all hard copies. Start the narrative with a location code. Remember! Reasonable suspicion has to be clearly stated! And the brains at 35th wonder why nobody is doing anything these days.
This is probably a ploy to get more tickets. The vast majority of officers don't like to do TVB's so this will get more tickets written as long as people can sign if verification of a valid license exists. Next, most miss court and get slapped with a large fine. Then, suspension of license and bigger fines and impound of vehicle next time. The ones that don't miss court get whacked for court costs even if innocent. This is just a money maker if the officers choose to be pawns in this game. Just my opinion and I hope I am wrong, but I could see it. Or they will use the "it's for the children" crap again.
Where is traffic court at again? I forgot. It was made loud & clear to me that we are not supported there, so unless it makes for great PC, forget it.

If you want to get your blood boiling, peruse some of the comments on these sites. 99% of them are anti-police. A lot of them allude to using our current disciplinary system to "get paid". Some of them even go so far as to advocate killing the police.
Will Commander Evans and his gaggle of incompetent supervisors that put the arm on these coppers to generate bullshit activity be around for her and her partners Civil Rights Violation lawsuit? Doubt it. Will these officers be allowed to retain their full police powers once the beef is taken and the investigation gets under way? Doubt it. The rules only apply to unclouted peons in blue shirts, not to those of exempt rank accused of pistol-to-palate hijinks.
This is what happens when well-intentioned officers, worried about keeping a partner/car/start time/spot on a team, feel the pressure to perform at the behest of clowns that shouldn't be running a hotdog cart, much less one of the most crime-ridden districts in the city.

That whole "surrender your license for a simple moving violation" is a uniquely Illinois invention - I've been awarded citations in about half the states in the USA and couldn't believe it when I moved here and heard about the license-or-bond-card nonsense. Welcome to the modern era, Illinois.... kicking and screaming as you go.
When the PTC law went into effect originally the law applied to Illinois residents also. They were allowed to sign for certain tickets like residents from other states. That only lasted a few months until they realized everyone promised to comply, but very few did comply. Everyone was getting suspended, so they went back to the old way. Lets see what happens this time. What's old is new again.
Uh, I would assume that one would need to possess a valid DL to be eligible to sign the PTC... so your last statement makes no sense.
This was the same law about 35-40 years ago. You could sign the citation without posting your license. The old-timers said since no one felt the need to go to court to get their license back, nobody showed up. Suspended drivers and traffic warrants skyrocketed.

Curious. This coming right on the heels of the state allowing illegal immigrants drivers licenses. I guess some one pointed out to our fearless leaders down in Springfield that those D.L.'s could not be accepted as bond, since the S.O.S. stamps on it Not Valid For Identification.

Actually it makes life easier. Write the citation, have them sign, move along. This was an initiative of the circuit clerks as now they don't have to handle the licenses, lose them or mail them back. When we always took licenses as bail, you were screwed if you had to rent a car or fly.

This is another attempt by Quinn and Company to mobilize their constituents. Do not be discouraged, this will create more outstanding warrants from people who fail to appear. And never forget, that more cops are injured in car crashes than gunfights. Keep writing those Movers. Get dangerous drivers off the street, impound their vehicles/weapons. Too many cops are working and retiring with their bodies broken by irresponsible drivers.
About time they changed this policy. Taking the DL is outdated and ineffective anyway. Back in the 80s they didn't have online traffic safety school and payment options, so this might actually be beneficial. Practically every other state requires only a signature on minor traffic tix. We only require signatures for ANOVs so what's the difference? If you are a responsible driver, you will handle accordingly, if not then you were never going to pay or go to court in the first place. A piece of plastic with your pic is not a bond. Besides, you can still get an IL I.D. if you need one. The SS doesn't want people in lockup for traffic so most will get an I-bond as long as they are clear; this will save officers the hassle of dragging some clown into the station for the "I left my wallet at home" bs too.
Back in the day, before I bonds, the a holes hit the lockup, spent the night and went to court the next morning (maybe). It was a beautiful thing.
I heard on WBBM that it was Quinn's doing. A last minute desperate attempt to do something for voters... it is a horrible, horrible practice.
If Quinn is re-elected, expect this to be rescinded quietly without a press release, however...

You shoulda heard the Lts. at rollcall blabbering how many cars were gonna be held down 'clearing out the park', 'commander says zero tolerance, yada, yada, yada'. Shit like this is def gonna backfire on guys, especially these newer kids that don't know any better. Cops are gonna get hurt when shit blows up. Obvious this was another XO Buscemi mission cuz if they would have just asked they would have discovered that we have been clearing out that park for years without incident 99.9% of the time. There's a method to doing it without causing chaos or having shit like this happen. You still need to carry a license. You still have to produce a license. Your license still must be valid. The only change is that you will not take the DL and have them sign the ticket. If someone cannot produce a license they still get charged with failure to produce.

The 011th dist 3rd watch POs in the video TA and MR got half of their own 65 team dumped by ratting to the commanders driver that 4 POs on the team were supposedly critical of the Cmdr and were the ones blogging about him on SCC. He launched them all, one of which was on furlo and not even around to "talk shit." The POs in this clip will do anything to keep their own spots on the 65 team so beware they are taking notes and reporting straight to the Cmdr and his driver who also can't be trusted. it used to be like this before in the early 80's. but too many were getting suspended for non payment of fines then they would pay them and have to be reinstated. SOS says it was too much work.

The thing is, that most of the time neither pookey or mookey have DL's any way so off to the pokey they go.
The governor said immediately, but the bill says 1/1/15 is the effective date.

Looks to be a very subtle change. If the rules say to take the license the license will still be taken. It appears that a fair amount of discretion by the cop is all that has been lessened. A cop could always just have someone sign. I believe I just signed the time a cop didn't take my license or bond card.

yep, many more of them are popping up especially on the southside of chicago and in 025. Ive fought with some of them, locked up several of them and enjoyed watching them interact with judges at court dates. Its pure comedy. Infront of the judges they will go on and on about how they are immune from laws etc. The judges flip out of course and end up holding them in contempt 9 times out of 10.. its classic. As for the 1983 (civil suits) dont worry. Ive had two of those also from the sovereigns. Them or a friend file those suits themselves. They
WILL get dismissed by the judge in the first few months because they are absolutely crazy and state laws that are not united states laws.. thus the suit holds zero water in court... that too is also hilarious to see. The only pictures in my squad car come from my iPad and the cellular modem Internet service that I pay for. Naturally there is no city related business conducted on my computer devices. I am still getting accustomed to not having my tried and true Windows 98 around any more on my City of Chicago computer. What obsolete Microsoft OS is the base OS now? Windows XP?

Are you new here? They do not serve arrest warrants on traffic offenses. Not unless they are also misdemeanors or higher, DUI, driving on suspended/revoked etc. That comes from another lawsuit against the city in the 80's.
People used to go to CCJ for warrants because of parking tickets. Now, you cannot house anyone on an offense that does not carry jail time.
Traffic ticket, they don't show up, they get convicted by default and eventually get a suspended DL. That is it.

My partner used to say he was a man of the 90's, the 1890's.
CPD has high tech gps in every cruiser , but the merit xo's cannot find the ten cruisers at bourbon street for two hour lunches .
Not effective til Jan 1, 2015.
