Offenders Sue Police...Again

  • In April 2012, Chicago Police responded to a burglary in progress at Mike’s Electronics store in the Little Village neighborhood on the west side.

    Three men were stealing stereos at 2:30 in the morning. Within 15 minutes of the police arriving, one person was shot dead and two others were seriously wounded as the men tried to escape in a stolen van. Security cameras and police dash cameras captured much of the shooting.
And get a load of what this lawyer is saying the basis for the lawsuit is:
  • The lawsuit cites Chicago’s deadly force policy which states ‘when the vehicle is the only force used…sworn members will move out of the vehicle’s path.”

    “The van cannot be a justification for deadly force,” Hegarty said. One officer who is standing in the path of the vehicle says he was hit by the van, injured by flying debris and treated at a hospital.

    Hegarty argues the tape shows the officer running down the sidewalk apparently unhurt and officers reloading and approaching the van. He also accuses them of continuing to fire after the vehicle crashed.
Well, we watched the video, and the officer did indeed move out of the way - after being hit by the van. As to him running away, adrenalin leads the way - we recall more than a few folks (or people) shot through the heart who managed to run quite long distances and unload numerous shots after the fact. It happens.

But the van itself is a 4,500 pound weapon, and thankfully, any number of experts will tell you that. At least one tells the reporter so. And criminals willing to drive through a closed steel door with cops on the other side are more than willing to drive over granny or anyone else who gets in their way. The NBC report is reasonably fair and the video is explicit in showing the complete disregard the criminals had for the safety of anyone in the vicinity.

This lawsuit is totally because of the I want to make a name for my self house mouse Lt.'s that write our stupid general orders. This department has written us into a corner with the ridiculous general orders that have been implemented in the last 10 years. They have written us into being sued for any thing and everytihing. This would apply to a PO getting struck by an offending vehicle.

The burglars are still in jail awaiting trial almost two years???

Sometimes the bond systems works. If they had pleaded guilty and were in prison Governor Quinn could have commuted their sentence and they would be out now.

But what would this Hagerty lawyer be saying if these mopes had smeared a few of these cops against the sidewalk as they crashed out and maybe killed them.

He would say, "The officers didn't follow their own department orders and move out of the way when the vehicle is the only force used against them."

This is so true. The general orders are a total joke and they breed frivolous nonsensical lawsuits like this one. "Officers will move out of the vehicle's path" - well no shit sherlock. Funny, it doesn't mention what to do when asshole comes back around for another try to run you down. If you follow these GOs you'd be running around like a decapitated chicken just to avoid being hit by a lunatic criminal. Rules made up by wanna-be lawyers and office barnacles who never saw the inside of a squad car. They make orders, rescind those orders, then create special orders to override the other orders etc. etc.. All symptomatic of an overly bureaucratic inefficient system.

The plaintiff’s’ attorney is taking great risks. This attorney’s image will forever be tarnished and his reputation sullied for seeking taxpayer money for criminals committing felonies on film. Law abiding tax paying working class types will let their conscience be their guide and forgo legal representation from this greedy questionable criminal- representing attorney. The legal profession will ostracize this attorney citing his lust for personal compensation and not choosing what is right, moral, ethical and just. Like a black eye impugning the esteemed reputation on the upstanding members of the bar. Crime doesn’t pay and associated criminals should not get paid. Let me get this right. The burglar and aggravated battery offenders put the lives of officers at risk of death and great bodily harm by attempting to defeat a lawful arrest by means of escape with the use of a deadly weapon in the form of a motor vehicle. They are beyond a reasonable doubt committing numerous felonies and putting officer's lives at risk all in violation of criminal law. Now we question the actions of officers who are protecting their lives and the lives of fellow officers with some non compliance type stuff of some general order. Officers your life, your safety and the other brave officers lives are somehow diminished by an order written by department lawyers in an office fantasizing what legal theory is applicable and how best avoid liability. When your life is on the line you react instinctively not debate in one’s mind the numerous applicable general orders, special orders, dept. notices, legal bulletins etc.

Officers. your life is cheapened by some law school graduate with a blue set of general orders in his hand dissecting the order and its application in his prestigious legal penthouse on LaSalle Street. Maybe this attorney should face the families of the involved officers and give them some bullshit legal theories that the lives and physical well being of their family members don’t matter and society’s bad boys, who made the conscientious decision to choose flight from prosecution, are somehow elevated over society’s peacekeepers.

But,it looks as if the officers were firing to prevent death or serious bodily harm to officers or citizens who couldn't get out of the way of that 4500 pound projectile if it kept moving.

They were now forcible felons when they showed blatant and reckless disregard for anyone's safety when the crashed blindly through that door.

Criminals should not profit from their crime. Why should any jury give THEIR money to these mopes as proceeds from their burglary.

If a trial does come I am sure that this Hagarty will try to exclude any evidence of the burglary itself and try to bury the criminal records of these mopes as deep as Obama's school records.

Apparently too many people looked at the case report involving the mayors kid and now the superintendent is all pissy over it. He wants to jackpot anyone that even looked at that report that was not directly involved in the case regardless if you disseminated it or not. Sounds like a losing proposition since the order does not state anything about just looking at a report, just disseminating it to non law enforcement or outside the dept. What if I worked in 019 and wanted to see the offenders description and wanted to look out for these guys? You are preventing people from doing their jobs. We are still the police right? Sounds like we're not. Gotta go my school counselor is calling me.

Sad news. The officer everyone has been looking for city and countywide from 016 who left his home with only his car and gun yesterday morning has been found deceased this afternoon in Niles by suicide. Please people, reach out to friends, family, eap, or anybody you are comfortable with... They will never turn you down, think less of you or make fun of you because you are experiencing problems. Suicide is a long term solution for short time problems. Rest in peace and my sincere condolences to his family.

The lawyer in this case messed up big time. He only named the city as plantiff in the lawsuit. He attempted to refuel and name the officers individually but the statute of limitations had passed and it's too late. That is why he is trying to tarnish the officers involved.

Lets say the burglars got a settlement. How about Lisa Madigan’s office seek a re-payment for all the taxpayer supported child care from birth to date from these proud daddies like the hospital childbirth expenses, the LINK, the healthcare etc. After all, if you owe for a water bill, parking tickets, unpaid income taxes etc., wouldn’t the sate city do their best to collect leaving no stone unturned taking their portion giving back to the state or rightful owners? How about past victims in their previous résumé of crimes? Would past victims be eligible for compensation for their emotional distress? What about those hit it and run baby mamas who haven’t collected from the non-productive thug daddy? Shouldn’t they get a bite of the baby author’s money? What about a bill for the housing and meals at Cook County Jail and I.D.O.C., the public defenders costs and any and all costs associated for past criminal behavior to be paid helping bring down those massive deficits in local and sate government?

There is a distinct between a vehicle coming at you and a vehicle being used in furtherance of a commission of a crime as a deadly weapon. The former is what the G.O. ,IMO, was meant to address; whereas the later has to do with Use of Force and protection of life.

Thought the order said something about move out of the way if possible but if the vehicle is being used as a weapon you can shoot the driver. Am I wrong on this?

Sad news. The officer everyone has been looking for city and countywide from 016 who left his home with only his car and gun yesterday morning has been found deceased this afternoon in Niles by suicide. Please people, reach out to friends, family, eap, or anybody you are comfortable with... They will never turn you down, think less of you or make fun of you because you are experiencing problems. Suicide is a long term solution for short time problems. Rest in peace and my sincere condolences to his family.

POLICE HARASSMENT
Chula Vista, California PD e-mail forum with the local community. A civilian posed the following question:

"I would like to know how it is possible for police officers to continually harass people and get away with it?"
From the "other side" (LE side) Sgt. Bennett, obviously a cop with a sense of humor replied:
"First of all, let me tell you this... it's not easy. In Chula Vista, we average one cop for every 600 people.
Only about 60% of those cops are on general duty (or what you might refer to as "patrol") where we do most of our harassing. The rest are in non-harassing departments that do not allow them contact with the day to day innocents. At any given moment, only one-fifth of the 60% patrollers are on duty and available for harassing people while the rest are off duty.
So roughly, one cop is responsible for harassing about 5,000 residents. When you toss in the commercial business, and tourist locations that attract people from other areas, sometimes you have a situation where a single cop is responsible for harassing 10,000 or more people a day. Now, your average ten-hour shift runs 36,000 seconds long. This gives a cop one second to harass a person, and then only three-fourths of a second to eat a donut AND then find a new person to harass. bThis is not an easy task. To be honest, most cops are not up to this challenge day in and day out. It is just too tiring.
What we do is utilize some tools to help us narrow down those people which we can realistically harass.
The tools available to us are as follow:
PHONE: People will call us up and point out things that cause us to focus on a person for special harassment.
"My neighbor is beating his wife" is a code phrase used often. This means we'll come out and give somebody some special harassment.
Another popular one: "There's a guy breaking into a house." The harassment team is then put into action.
CARS: We have special cops assigned to harass people who drive. They like to harass the drivers of fast cars, cars with no insurance or no driver's licenses and the like. It's lots of fun when you pick them out of traffic for nothing more obvious than running a red light. Sometimes you get to really heap the harassment on when you find they have drugs in the car, they are drunk, or have an outstanding warrant on file.
RUNNERS: Some people take off running just at the sight of a police officer. Nothing is quite as satisfying as running after them like a beagle on the scent of a bunny. When you catch them you can harass them for hours to determine why they didn't want to talk to us.
STATUTES: When we don't have PHONES or CARS and have nothing better to do, there are actually books that give us ideas for reasons to harass folks. They are called "Statutes"; Criminal Codes, Motor Vehicle Codes, etc...They all spell out all sorts of things for which you can really mess with people.
After you read the statute, you can just drive around for awhile until you find someone violating one of these listed offenses and harass them. Just last week I saw a guy trying to steal a car. Well, there's this book we have that says that's not allowed. That meant I got permission to harass this guy. It's a really cool system that we've set up, and it works pretty well.
We seem to have a never-ending supply of folks to harass. And we get away with it. Why? Because for the good citizens who pay the tab, we try to keep the streets safe for them, and they pay us to "harass" some people. Next time you are in my town, give me the old "single finger wave." That's another one of those codes. It means, "You can't harass me." It's one of our favorites.
Hopefully sir, this has clarified to you a little bit better how we harass the good citizens of Chula Vista.

I can't believe you. Don't you have a heart? Whatever issues he may have had or whatever "long term" issues he may have had, an officer killed himself. For the love of humanity can all of us cops just feel sorry for this cop? He was still a fellow officer fellow worker and a family member. Even if you hated this officer is it really necessary to insult him in public like this? Shame on you.
