Sergeants to Sue City

  • The Chicago Police Sergeants Association intends to file a lawsuit this week seeking to compel Mayor Rahm Emanuel to hold a lieutenants exam that they suspect he is delaying because the sergeants endorsed Ald. Bob Fioretti (2nd) for mayor.

    The lawsuit will accuse Emanuel of violating a 2012 agreement to schedule the lieutenant’s exam as soon as possible.

    The agreement to hold Chicago’s first promotional exam to the rank of lieutenant since 2007 was not written into the sergeants’ contract.

    Sources said that’s because City Hall did not want the Fraternal Order of Police or the Chicago Firefighters Union Local to know that it had bargained with the sergeants over the issue of promotions for fear of setting a precedent for those other unions.
And the reasons are exactly what was speculated here:
  • In the politically charged atmosphere of a mayoral campaign, there also has been speculation that Police Supt. Garry McCarthy may be working behind the scenes to persuade Emanuel to eliminate the requirement that candidates have two years on the job as sergeants to qualify for the lieutenants exam.

    Sources said McCarthy told the last group of sergeants promoted that they would be able to take the lieutenants exam, but City Hall overruled him.
Hey, the City takes your money, that's a binding contract of a sort. But if a timetable isn't written down, well...."buyer beware" and all that. Rahm plays the game in such a way as to demoralize. No surprise there.

Guys have planed, prepared, spent money and put their families on hold for this test. All this will do is bring morale even lower and make more bitter cops. Typical chicago BS.

Now legit Sgts are being clouted out by Gary to put his clouted merits in as exempts.

Yet still no action by anyone like in NY.

Sounds good to me, the ole' side letter. You see, the city agreed to many side letters with Fire, FOP, Lt Pbpa and Sgt Pbpa over the years and held their part. The Sergeants Association is calling them to court on this one. Should be easy for the judge. The city has a long history of meeting their side letter agreements! Even a Cook County Circuit Judge handle this one. And with all the Rahm commercials airing during all newscasts there is not one about police and fire morale or promotions. Look for a test date very soon, Rahm does not like to be played. He needs to show the Superintendent he is in charge and won't be embarrassed by a police union.

OT I know I may be late but several things have come to loght.

1. The utter silence of the FOP on just about everything. Most notably: the forced 10.5hour shift and the confirmation of a retro check date and especially the mayoral endorsement. This is starting to add up and its not pretty. They want to endorse Rahm, but doing so will confirm that they are bed buddies. They won't endorse anyone else because it will piss Rahm off.
2. The contract laid the tracks for the 10.5 hour day. First the furlo by watch. Then the time due. Then the vehicles. I haven't heard ANYONE say furlo by district was bad. So why is it contract issue?
3. Sorry people but this 10.5 is not about us. I think the goal is probably to wipe another 1000 to 1500 vacancies from the books for a force that is now "full strength". And by virtually eliminating anc combining watches that is very possible.
4. Im SURE the FOP could confirm or deny all of this but they are being silent as to not rock the boat.. BTW what ever happened to them coming to the district roll calls? I guess that would be easier once an entire watch is eliminated.

It all adds up. It's obvious that the Superintendent has a few select recently promoted Sergeants that he wants to make Lieutenants and possibly exempts. What he's saying is that the 700+ Sergeaants that signed up to take the test already ain't worth shit. IIt must be nice to know that all you have to do is show up for the first part of the test to get made. iT'S THE CHICAGO WAY!!!

A little tidbit. Look at scc archive February 2013 for confirmation. Sergeant union agrees to pension changes. Two days later merit applications are being asked for. 15 months later all 175 vacant positions are filled. Secret promotional deals.

One only had to go to the human resource website on the intranet and look up the minimum qualifications for lieutenant and that's to have obtained the rank of sergeant. That is it.

Don't want to sound petty, but I made Sgt. 8 years ago and at that time I wasn't able to take the last Lt. exam. I have waited a long time for this test and feel I am ready to be a Lt. If I do score well. There is no way in hell I would have been ready to be a Lt. After only 2 or 3 years as a Sgt. Being a Sgt. Is a lot if responsibility and takes a while to learn how to deal with the different personalities. It has been this way forever. If all thes e new Sgts would have scored better on the previous test they would be Sgts already and qualify to take the test. So the Sup told you you can take the exam while in Sgt school. BFD. Wait your turn and quit crying.

Now the Sgts need to release the side letter showing what Rahm didn't want others to see. More than just promising to hold a promotional exam he made some other promises. He probably doesn't want to negotiate with the other unions. I wonder if side letters can be subject to FOI

Furlough by district was horrendous. People with 8+ years on stuck with a full 2. I know, i know. Wait your turn. But 8 years is enough to get out of a 2 furlough. I'm not complaining for myself. I've been able to split since having 6 years on getting April-September. But my partner who only has 2 less years than me couldn't get shit. After a while I felt bad. It's better for man power too.

I completely agree with you. I've heard of officers calling the union regarding their concern about the talk of the 10.5 hour days being forced on everyone next year...... Union's response is " that's just a rumor ".
If in fact it has no basis in fact don't you think the union should say that it's a completely false rumor with no truth to it?
The fact that they're not adamantly denying it leads me to believe that we were further hosed by our Union than first though. Bastards!

As a sgt. for almost 17 yrs I can say that this court action is a waste of time. No promotion test is ever agreed upon by the union, and the city. The city , unfortunately can do and give a test for promotion whenever they want. If it's not in the contract your wasting your time.

I really don't know why anyone would not want the 10 hour days. it is a great deal, most people working a beat car don't do a lot out there and the days off are great, 4 day weekends every 4th,5th.6th weekends. in reality you will work 1 extra hour each day, by the time you all hide in the lot or locker room, I worked 10 hr dqys for 7 yrs. GREAT!!!!!!

Then posing with 9 1/2 for the camera's after you settled the sergeant contract on your own. That did not go so well either. Settling for paying 2 percent of the sergeant's pension amount after the arbitrator ruling stated you President Ade opened the door. Now this. Glad I spent my time and money studying for a promotional test I will never see. I hope I can retire in 5 years with some type of pension before the sergeant's ASSociation sells us down the river again based upon promises from the mayor. Hey sergeants wake up and get rid of that goof you have as president. Every bad decision he makes effect's all of us. I believe that our former president is available for consultation. Just saying.

SCC, how about a post about Commander Don O'neill retiring from his six figure job on the police department to collect his six figure pension from the broke ass pension fund. Then, the minute he retires, the Department hires him back to a six-figure "civilian" job in the Department. Does he really get a six figure pension and a six figure salary? At the same time? Is this possible? And we wonder why everyone seems to be in favor of pension reform. Rahm and the gold stars!

The sad truth is that Ade and Bilotta spend an inordinate amount of time shmoozing with the likes of Don O'Neill and the higher-ups at headquarters when they should be FIGHTING for their members. After all, if they get voted out they want to go to good units, right? Ade has NEVER been a "go-getter," and I am still shocked that he was able to fool enough members into voting for him for union president. Ade is out for himself, and Bilotta just follows in his wake.

750 Sergeants signed up for the test. We don't need many Lt's at all since every order has been poorly rewritten to state the DSS does everything. This means that they will probably not even promote 100 Lt's off of this list. When you factor in merit you will absolutely need to score in the top 5-10 percent. Good luck with that. Competing for Sgt is one thing. Paying money for study groups and taking time away from family and friends for Lt is for the VAST majority a losing proposition. Then you get to start over with seniority (for the third time). I will enjoy my life and family instead.

From the outside looking in I am having a hard time understanding how an informal 2 years as sgt requirement before becoming a lt can be enforced by a court.

If the city actually put this in writing as a unilateral thing they can unilaterally undo it.

If it was done as part of a deal with the sgt's union, it is hard to see how the city could just change it.

Someone must know if this is a real requirement or just a guideline.

I am very glad to see at least one reporter bring this to light. Thank you. My wife keeps asking "when is the test we need to plan the vacation with my family, remember?" I respond in a pissy manner because this shitty city has pushed me to the end with the way they treat employees. I then hand her the EAP magnet. If anybody at HR really thought about the implications for the members I would hope they would give us the date.

Experience cannot be taught. It is essential to being a good leader. The city knew this and as a result established a time in grade requirment. Now to promote the chosen few they are willing to throw that away? There are Sgts who have been waiting 9 years to take there first Lt test. They will make great Lt's because they know the job. Try supervising a Sgt who has 5 plus years as a sgt when you have never truly been a sgt yourself. There are many exempts who will tell you it is easy. We all know how much they collectively bring to the table. Not to mention that they are not respected by anyone.

You should have a minimum of 15 years to be a Lt with at least 5 years as a Sgt. Ask yourself, "would I have been a better supervisor now or ten years ago?" Being a supervisor on this department if done well comes with the large burden of protecting and mentoring your subordinates so that they make the best decisions not only for the department but ALSO for their legal, ethical, and physical well being. When you are a younger supervisor you care more about the numbers than the people. With experience you learn how to accomplish both.

So if they aren't hiring any police officers, we can expect several officers detailed to the academy to be heading back to their unit of assignments right? 9 years as a Sergeant. I feel that only in the last year or two that I would make a good Lt. It takes several years of experience to make a good Lt. No Sgt wants to listen to a Lt that spent 2-3 years as a Sgt. Let the supe make whatever suckass Sgts he wants into Deputy Chiefs. Leave the career service requirement alone and schedule this exam to the original March 7 date and let us all move on.

Thanks to the superintendent for fucking the guys on the current K9 list. HR told us they had the ability to hire new handlers off the old list because of the money set aside by the city finance. The master minds upstairs thought differently and decide to have a new test when there was even 10 people promoted off of the old lists. Hmmm........and you wonder why moral is down. You keep fucking people over and over......now the rules are set so tight for the next test that only those with seniority will probably make the list leaving those who really want it left out in the cold. Thanks for the moral boost Garry......you're not helping anyone.

Every Sgt should be allowed to take the Lt's test. The city dragged with promotions. 8 years? The city is only to blame. I agree with having 3 years in grade to be promoted to Lt...but why not let every current sgt take the test? Doesn't make sense

SCC, how about a post about Commander Don O'neill retiring from his six figure job on the police department to collect his six figure pension from the broke ass pension fund. Then, the minute he retires, the Department hires him back to a six-figure "civilian" job in the Department. Does he really get a six figure pension and a six figure salary? At the same time? Is this possible? And we wonder why everyone seems to be in favor of pension reform. Rahm and the gold stars!

If there is essentially no time in grade required to sit for the lts exam, then being a sgt should not be a prerequisite for becoming a lt. Seriously, what will you have learned in one year as a sgt that will make you qualified over the pos you were among just a year before? If this is the way of the future for CPD command, than just eliminate sgt before lt, let everyone test for both, and just double down on clout openly

Doesn't effect my morale one but. Don't know the guy and don't care. Being jealous doesn't have to crush your morale. Instead, stop stressing yourself out over everyone else's lives. Live your life and worry about that. If your a patrolman your making somewhere between 81-92 thousand dollars base salery. If you do court or Vri now you make near 6 figures. Not bad for a job that only requires 2 years of college. If you wanted a better job then you should have chosen a better job or got a 4 year degree and got a different job in the private sector. Instead you cry like my little son about how your feelings are so hurt about how good someone else has it. Bitter and jealous. Get over it and live your own life. You let too many outside stressors that you have no control over get you worked up. Do your job and go home.. Don't think about work again until you walk back in the building then go home again.. Rinse, lather and repeat with this job.. It will make you much happier

Nice excerpt from Management 101. No supervisors have ever been burdened their subordinates on this dept. The exact opposite has occurred and continues on a daily basis.

They sure are, in fact they briefed everybody at the monthly meeting before they even brought suit. It's a crazy idea but maybe attend a meeting.
The meetings are posted well in advance so you can adjust for your family situation.

Hey smart ass ! Do you work in a district ? You drop a slip or get a slip approved to attend the union meeting or do you go on company time ?

So maybe the reps, you and the union should post so all members that are affected by a suit brought forth can know what is entailed . Is that to much to ask of a union that is supposed to represent the entire membership not just the 30 or so people who can attend the meetings ?

That is why we have a email account a union Facebook page as well as a union website , to keep the members informed !

Missy here again - Kiss my dupa Mister above. I been a sgt for nearly 2 years and was told by many I will be a great Lt come this spring.
My Uncle Tom was a Dep Chief before the mayor asked him to help in running other departments like S.S. He worked gard and I know how to direct my Sgt' when I am called "LU"
People like you should of stayed in patrol becayse you got 8 years and noe knowing how to lead a charge. Dumbo !!

Hey less than 2 year sgt "missy" glad your uncle is TB maybe he made you a merit sgt like how he took care of his daughter in JTTF . This whole job is about seniority . People missed the test in 2006/2007 by weeks and they had to wait another 8 years ! You can wait as well ! All you sgt's that did not make the cut : oh well, sorry ! Here's a tissue! Go call your uncle TB and have him put you in a spot where you will make LT or have him detail you to him at Parks and get paid as a sgt ..... Less than 2 years as a sgt .. I hope your post was a joke !

On a good note , the PBPA sent emails to the affected members about the law suit .
