Where is the Interest?

We posted a few days ago about the FOP finally putting together an informational session regarding the latest legislative actions that pretty much gives Rahm political cover for not funding the pensions in a timely manner as written into state law based on a fantasy casino that isn't even approved yet.

According to the comments, under 20 people showed up on Tuesday evening.

The next one is Thursday morning at 0900.

While we would hope that everyone is saving their "venting of the spleens" for the General Meeting on 16 June, we would have expected a little better showing, especially among the retirees - unless they were out sampling the cat food their going to be buying in bulk at Sam's.

Shouldn't FOP board members maybe make their way to roll calls? When was the last time any of them showed up with some answers about pension questions. If they're legit at all at least it would show a little good faith.

OT - Talk about "Where is the interest?"

After hearing more about that Prosecutor Mosby in Baltimore and her request for the police to patrol more in the "bad neighborhoods", she should NOT be anywhere near that trial of the six police officers.

Talk about a person not knowing their job (or who they should support). There should be a concentrated and very vocal effort to get her to step down.

If I Was a taxpayer in Baltimore, I would be asking why are we paying for such incompetence?

I was there at the meeting. I thought Dean and his advisers did an exceptional job explaining the complexities surrounding the pension issue. Granted, SB 777, is not Utopian, but it is the best police, and fire are going to get. We must have a clear vision as to what reality is.

Let's keep one thing in mind; the union works for the membership, and should be accommodating them, not the other way around. The lodge should be sending reps out to roll calls to fill everyone in to help prevent the spread of misinformation throughout the department. Most active members barely have enough time between balancing work, kids and their home life to sit and relax for a few hours, let alone find time to head to one of these informational meetings. Considering how major this issue is, their actions only make me think the union would prefer to keep everyone in the dark. Get these reps off their asses and into roll calls letting everyone know what's up.

I love that the start times of the informational meetings are 5:00 pm and 9:00 am. They can start these things whenever they want, but some genius says "as a convenience to the officers, let's start the meetings at the peak hours of rush hour traffic." It really makes me wonder what those people on Washington are really up to all day.

Last time.

The FOP has no power to control how the city funds the pensions. The court has no power to make the legislature fund the pension.

THE CITY AND STATE HAVE TO PAY THE PENSIONS WHEN THEY COME DO. How they do that is their problem, not ours.

If there is going to be a bankruptcy, it's better for us to have it sooner rather than later.

Seems the membership has once again lost their interest after the contract and mayoral election. The FOP PAC mindset is and always been " we don't want to piss them off, we might need a favor" (both Madigan endorsements and the decision to go '"no choice" for mayor because there wasn't a unanimous Rahm endorsement) ...oh my.
So here we are, about to be bamboozled with another pension i.o.u. and the ineffectual FOP PAC still exists.
After a very good showing at the polls, by the FOP taxpaying membership, Rahm remains at the helm of our sinking pension ship.
Thanks for nothing, four more years of taking away your benefits, the FOP is powerless, even more so now.
So the favor we been long awaiting from those Lisa Madigan endorsements comes in the form of Mike Madigan allowing Rahm to forego a bit of the pension obligations until the fund is almost exhausted?
Sorry, in this day and age a police organization political endorsement doesn't have any worth... but an angry mob does.

To the angry mob, please attend an FOP meeting.

SCC: Looks much like folks are weary...retirees no exception....we are All being knocked with the planted idea that every area is broken by Billions of Dollars...there seems no way out....the Media plants that in our heads...the city, the state, the county. Now, I'm not saying we are not truly broke but then we get hit over the head with the zillions and millions of dollars being poured into unnecessary projects...like Maggie, like DePaul, like the only 15 foot wide River Walk, the Fly-Over, the perfectly stupid wood burning of the Simulated Great Chicago Fire apparently honoring where thousands were killed, and a million into Humboldt Park just cause a few hundred are yelling about missing a beach when they have a HUGE Lake not far from them or paying Paul McCartney to sing in Grant Park..how much is that action? NO one seems to have ideas to properly generate the funds needed for our dismal pensions...no one from the famous Univ. of Cgo. with its Noble Prize winning Economic Dept. have stepped forward..NO Bankers have stepped out with a plan of action. No One has answers. My only conclusion is for the US government to print more money and give it to our pension....we are the only country in the world that can do that....its our best chance. Other than that, we are weary and scared about losing our benefits and pension but don't know where to turn to keep them. It in the hands of a few too many who make all the decisions...no democracy here. Wished to have had a better response...but the problem is too deep.

Agree. Also, there is no trust from those of us that didn't vote for these guys or their contract. Let's face it, the retirees voted in Dean and these same guys - plus the "give me my check" twits - gave us this shitty contract. The union has become self serving. 1. Question why weren't you there? Were you going today? Today maybe 7 or 8 retirees and those were all of those on the pension committee but maybe one. Very poor showing again today. If your looking to find something to yell about on Tuesday this isn't it. The heads of the unions (fop, local 2. capts, Lt's and the sellout Sgt's) did this on their own. But it sounded to me as a very good start. Look for Tuesday to be a long night of idiotic questions.

6/11/2015 06:38:00 AM

Nice insight. This is exactly what the city has attempted to do with this legislation. Put in writing, hence state law, that bondholders are paid first. What this does is create a situation where PENSIONERS are put in the position of having to fight in bankruptcy court for what is owed to them, not the bondholders.

But this legislation attempts to con the stupid into thinking the City has a right to actually file a bankruptcy. At this time they don't. And, this law attempts to con the stupid into thinking that IF state law lets them file bankruptcy that they will WIN a bankruptcy ruling.

It's the stupid who believe all this bullshit posturing.

In Detroit, the books were laid bare, as the law requires. In Detroit, the city had to show THEY DIDN'T HAVE THE REVENUE TO PAY WHAT WAS OWED. In bankruptcy court, you have to PROVE you can't pay y our debts not just lie about not being able to pay them.

THIS is the primary difference between Chicago and Detroit. Detroit had no revenue to pay it's debts, that was made plainly clear.

In Chicago, the City HAS the revenue to pay it's debts, it simply chooses not to and claim they're broke instead.

That won't work in bankruptcy court. A Federal BK judge does not possess the authority to GRANT a bankruptcy to any municipality if that municipalities revenue stream can pay it's debt.

NOR can a Federal judge grant a BK petition to proceed if RESTRUCTURING OF CURRENT PROGRAMS can balance that debt.

What this means for those who choose to believe the city will win something over pensioners is, THE BOOKS ARE OPEN FOR DISSECTION IN BK COURT. That means INCOME and REVENUE are laid bare against ALL DEBT and the time required to pay that debt.

The City will never get a BK judge to allow them a BK. The City has the revenue to pay it's debt and no BK judge will grant cutting payments to creditors before forcing adjustments to revenue streams to pay for that debt.

In short, TIF is what is killing Chicago. TIF will be included as INCOME and THAT program will die first before a bankruptcy will ever be allowed.

ALL "moneylending" programs by this city will be forced to die off before any bankruptcy can proceed. The City has no legal authority protected in federal law to act as a free moneylender to the rich, state laws or not.

Stop listening to the bullshit. It's what he wants you do to so you shit yourselves and give it all away for the rich.

What most likely will have to happen on our behalf, is that we choose our own representation in bankruptcy court, because the FOP is telegraphing that they have no intention of fighting a fucking thing when this event happens.

We will need to choose representation who already knows what has happened and what has been made precedent in other MBK filings, because the FOP will not secure representation that looks after OUR interests, that much is clear.

Look at the financial lessons learned in Detroit. Pensioners took the LEAST cuts because of their status and because no plan can proceed that gives complete cover to any creditor.

As a single reference:
http://www.law360.com/articles/604145/9-lessons-for-creditors-from-detroit-s-bankruptcy

Specifically note lesson 5. Unencumbered City assets can be creatively monetized in Chapter 9.

This means the city is REQUIRED to deploy ALL assets it has at it's disposal before a plan can be allowed to proceed.

TIF is REVENUE. The funds in the bank and the annual income stream are ASSETS and REVENUE. In no way can the city keep this money or hide this income or attempt to protect it under any circumstances in a bankruptcy.

Currently, the city pulls in close to 500 million per year in TIF money, then stashing it away for pet projects.

Tax increases in the face of this protected income for the rich don't help Emanuel's case for bankruptcy, it hurts it.

The City is required to prove it's revenue collected doesn't cover it's liabilities. Liabilities do NOT include slush funds, pet projects or claimed "future projects". Liabilities include labor costs (et al), bond debt and in general lawfully required city services required to grant the city it's legal status AS a city.

A city is stripped bare of it's political spending in a BK. This means a BK court forces the city to return to it's lawfully defined purpose: providing lawfully mandated services to it's constituents.

If Chicago ever attempted to go to BK, they wouldn't last a year before being thrown the fuck out of court.

The city can't hide it's revenue from a BK judge or it's creditors. THAT is where the city will fail. All this shit they do now is to program the stupid into thinking they will lose in a BK filing so they eat shit on their own before a judge gets hold of them.

Go look at Detroit. Had pensioners eaten the shit the city tried to continue foisting on them they would have been FAR worse off than the 3 to 5 % they took.

With expert representation, we will all be fine even if the City tries to file a BK.

Let the thieving come to an end. It will be a BK court that ends it, not us. Don't let the rich keep stealing from us because you believe the lies told to you by proven liars.

Please, I've been on the job 12 years. I have only seen anybody from FOP come to the districts at election time. I've seen that dick head Sgt from the in car camera unit at roll call more times than anyone from the FOP.

Dean stop giving yourself credit on the blog!!!

I was there at the meeting. I thought Dean and his advisers did an exceptional job explaining the complexities surrounding the pension issue. Granted, SB 777, is not Utopian, but it is the best police, and fire are going to get. We must have a clear vision as to what reality is.

Will there be blood at the meeting on Tuesday?

Well... Maybe some askew collars, bald armpits, stepped-on toes,
skinned shins and ruffled comb-overs?

Democracy be messy.
Imminent Treachery even more so.

The city will never file bankruptcy because they would have to open the books. Unless all of the alderman and past mayors, alderman, and political cronies all died at the same time, they can and will never open the books. Too many people would go to jail....

Worry more about the legislature passing a constitutional amendment diminishing or converting our pension to something else...

Speaking of times are a changing. At least the 5 -10 year guys were smart enough to bail from tact including their sergeants. To those wanna be hair gels that want off midnights and out of a beat car....don't be a fool and be the next guy caught on video tape doing any type of police work. Your bosses the community and the media will throw you under the bus and crucify you. If you need further explanation. ..just look up Ferguson NYC Baltimore and McKinney....

Pension Benefit Guaranty Corporation?

That's for corporate pensions, not public.

What have our ELECTED Pension Bd. trustees been doing about the recent pension bills? How about retiree rep Ken Hauser? There should be info available on either the Pension Bd website or they could write an article and post it on the FOP website since Mr Hauser is also a FOP Tristee. Cmon guys, there are ways to reach the current/retired PO's. This has farther reaching consequences than the new Uniform/appearance standards. Let's see if these Pension Trustees attend next Tuesday's meeting.

Let's also see if FOP realizes this and has special meetings scheduled for the next two months. Vacation is nice but so is a solvent Pension.

The smart retirees couldn't attend because they got the hell out of Chicago ASAP after retiring. I did.

Who gives a fuck anymore? I started my own retirement fund years ago. I'm not depending on my pension for anything. Every year for the past 15 years, I've been hearing about how my pension is in jeopardy.

I'm not going to spend the next 15 years worrying about it. Fuck it. I'll be fine.

If you don't have a back up plan, then get one.

Our union sucks and can't do shit. Don't put your retirement in their hands.

7pm meeting, 16Jun, grilled food to follow for the summer break. There are no meetings in Jul or Aug.

6/11/2015 06:11:00 AM

Why does FOP take the summer off? Who started this yearly haitius? FOP should have 12 meeting per year...

6/11/2015 03:22:00 PM

@@@@@@

Sad to say but only 1% of the membership ever goes to meetings.

Only about 105 to 115 people even meet the 5 meeting a year requirement to run for office. For all the bitching here very few people ever step up to the plate.

I see a shitload of names yet no formal reports present, minutes of meeting, graphs future laws,or anything!

I see a lot of retirees too!

How much is going to these multiple committees? They can't even post a single fact backed by documents! This is not counting the lawyers on staff...

6/11/2015 02:27:00 PM

Please post YOUR NAME so we - the membership of FOP - can demand that Angelo puts YOU on some committees. Get of your ass and out of your mother's basement and step up to the plate.

SCC, for your information, dog food tastes and smells better than cat food. Also you can get more of it for your money. Ask me how I know this.

6/11/2015 12:41:00 AM

Um, your dog turns his nose up at cat food perhaps?

I have a rose tattooed on my arm, one for each ex-wife. I am working on a bouquet. A dozen red roses is my goal. I just can't keep giving them houses. That was so 80's.

Got my answers by reading the law. Don't need fop to translate for me.

6/11/2015 12:35:00 AM

I would call the FOP to get an interpretation of a section of the contract. Frank D. would read the section of the contract to me. I'd say no, please, I too can read, tell me what it means. Then he says he would have to get back to me. WTF. What he's got 12 years in office and doesn't know the contract inside out? The dear deceased Financial Secretary knew the contract. He knew how it was interpreted, he knew the grievances and how they were resolved, he never was at a loss for an answer. None left like him, damnit.

I'm not a dean fan .... But I was there today and he was very informative as well as everyone on stage associated with bill 777 and our lodge.
Nothing is perfect. But the CPD /CPS and the Fireman all have big big pension debts. The casino is suppose to- over a five year period pay off the debt owed to the police.

6/11/2015 05:18:00 PM

It will take a lot longer than 5 years.

I am thinking of getting a tattoo that makes a statement about our pensions. Something like, "Hey, you crook guys, don't steal my pension!"

I was at the Tuesday meeting...me and about 25 other coppers. There was notices up in my district on Friday or Saturday. The experts will be at the stated meeting on Tuesday, I predict the usual 100-125 coppers will be there. I grow tired at the bitching and moaning without action.
