Again, Repeat Offender

Anita's people decide "not enough evidence," even though that's the job of a jury to determine:
  • A 23-year-old man charged in a Sept. 11 shooting in Rogers Park that hospitalized two, including one in critical condition, had been arrested less than two weeks earlier in a separate shooting that the Cook County State’s Attorney’s Office declined to prosecute for lack of evidence.
And what exactly was the "lack of evidence?"
  • On Aug. 31, twelve days before the latest incident, Richardson had been arrested by police responding to a report of shots being fired, according to both police and the Cook County State’s Attorney’s Office.

In the Aug. 31 case, officers arrived in the 7700 block of N. Sheridan Road around 8:45 p.m. and were told by witnesses of a man in a white shirt and blue jeans running from Rogers Beach after the shots were heard in the area.

Officers quickly stopped Richardson in the 7700 block of Eastlake for questioning and recovered a loaded .45 caliber semi-automatic handgun nearby, police said. Eyewitnesses ;said Richardson looked like the man they had seen running from the beach, according to a Chicago Police report.

At the time Richardson told officers the gunshots came from an unidentified rival gang member who fled south on Rogers Ave. in a grey Range Rover with tinted windows.

Richardson denied the handgun police found was his but later, at the 24th District station, he told officers he had seen the gun before, police said. Richardson told officers his fingerprints might be on the weapon but could not explain why they would be there, according to the report.
Gee, fits the description, gun found nearby, admits he's "seen" the gun before and his fingerprints "might be on the weapon." Can you imagine the incompetence of a States Attorney who couldn't get some, if not all of this, admitted into the record?

Nothing to see here! We'd never win at trial! Guns are bad! We need more laws! Black Lives Matter! Move along folks.

Sorry but you have no actual witness identification to the shooting, he wasn't found in possession of the weapon, he stated that his prints "might" be on the weapon and that he's seen it before but he never admits to possessing it or firing it, and there's no indication that an E.T was able to or did actually lift prints from the weapon. Also no indication of a GSR being performed either. When you examine the narrative offered up here, the officers really didn't even have probable cause for an arrest in the first place. "Witnesses" saying shit like "he looked like the guy running from the beach" or saying someone was wearing the same clothes was seen running from the area is not a positive ID of an offender. I can never figure out why so many patrol officers can't understand this stuff. I get that the ASA'S are often a pain in the ass but in this case from the information available "you got nothin kid" comes to mind.

I agree. As was said above, sometimes the ASA's can be a pain in the ass, but would you like a sustained CR# for 5,10, 30 pending, because someone said, "He looks like the cop that hit me," or "I think he's the guy that pointed a gun at me in a bar." Or worse yet, having charges approved against you because some guy "thinks" you're the cop that gave him a crack in the head in an alley, and your GPS on your car showed you were "close by" when it happened? Sorry, have to agree with above poster, and I'm a retired Dic. Don't worry, every dog has his day, and someone will either get him dirty, or he'll become an ME#. Believe it or not, there are some really good ASA's out there that do like the Police, maybe not as many as there once was, but they are there.

Step one very fucken simple, if he admitted to fingerprints being in the weapon and he has no FOID card and a Felony which I'm pretty share he does just with that you can get 10 years in jail. But Stupid Anita said there's no evidence. WHAT!!!!

The reason people used N. Sheridan was because the city wisely designated Kenmore and Winthrop as the bike routes in that area. Often not safe -- get jumped, beaten, etc.

N. Sheridan was a nice ride. I always take it easy, and stop for people walking. Never had a problem. There are some weekend bicycle idiots who really zoom along there, though, who deserve a freaking ticket. Last time I was over there, a couple of them almost crashed me while I was standing on the sidewalk, off the bike, waiting for the light to change so I could get off that stretch like the signs say.

So the A/Os did not see him in possession of the gun- Strike 1

Witnesses see him running from the scene, but not firing the weapon "I ran cause I heard shots" Strike 2

No mention of victim cooperation level, meaning "heard shots felt pain" Whether that is true or a lie it doesn't matter Strike 3

No more GSR kits til Jan 1, prints hard to lift off gun, Strike 4, 5

Its mot always the dics or the states fault you know

Days of being the police are over. All you young guys can say what you want but this case fell apart and fell apart fast. Caller was prob anonymous gun wasn't found on him and you really don't have shit. Now that's in crook county. In Texas or Arizona this guy would be in jail. If his prints were on the gun that's good enough. But in crook county if the gun isn't in his person YOU AINT GOT SHIT. Welcome to liberal crook county boys and girls.

Take your time to a call be safe give a report and go home. It's the safest way for you. If you don't like it than go work at McDonald's. Whole job has gone to shit my fellow brothers.

Yeah! Whammo. Slam-dunk, good deal. A__hole was reported to be mocking and laughing at the widow and motherf__ing the judge. Hardheaded ain't the word.

Prosecutor said "He will kill someone else while he's in prison for the rest of his life." Sorry to differ with Pope Francis on this, who I think is a good man, but this one here needs thirteen steps up to a long drop. Scaffold to be erected in the Daley Center Plaza.

LOVE this story from USA TODAY.
Makes me want to relocate to Houston.

HOUSTON — A 21-year-old who beat up an elderly man and bragged about the crime on Facebook was sentenced to a prison term for longer than he's been alive, the district attorney's office said.

DeAndre Bryant of Houston had been charged with aggravated robbery with a deadly weapon after he and his buddy, Greg Young, used a Taser on a 70-year-old man and his wife last year, prosecutors said. Bryant first attacked the man outside his home, dragged him inside and then held the couple at gunpoint while the men, who had covered their faces and hands to hide their identities, ransacked the victims' home.

The robbers escaped with $12,000 in cash, some guns and the couple's truck — more than $56,000 in valuables. Then they posted photos showing off the cash on Facebook, according to Harris County prosecutors.

They also threw out latex gloves they had been wearing when they committed the crime in a nearby parking lot. A passerby thought it unusual, so he took a picture of the license plate on the car the men were driving, which was traced to Bryant's girlfriend.

When Harris County investigators discovered Bryant's name, they found his Facebook photos, the Harris County District Attorney's Office said in its own Facebook post. The gloves contained DNA that also linked Young to the crime.

The photos helped convict Bryant, who was sentenced Monday to 35 years in prison, and likely will be used again when Young goes on trial in February.

With that opinion, you didn't have to tell us you weren't a cop. "Men and women in Cook County fighting bullshit cases'? Grow up. There is no Richard Kimball, wrongfully accused. It was a 1960's TV series, not real life. The "sitting in County for just weed" cases the liberals are always referring to don't exist either.

Everyone in there really needs to be in there. Some may beat their cases, unfortunately, but they need to be in there. Or, maybe you want them on your block?

So you're having a hard time with officers acting on the best
information they had at the time?

Are you new at this?

Policemen really don't have the luxury of time
to painstakingly pre-try these cases when guns are banging
and lead is flying right now.

Shit happens...
Shots get fired all the time with m/fers
"running from the scene."

Policemen get witnesses all the time
who didn't see what they thought they saw upon
further review.

If the witnesses prove to be not worth a shit then so be it
but don't slam the Coppers for trying to balance protection
of life, protection of rights and the right of the public to be free
from tumult and violence.

...And not always being perfect in doing so.

ONLY IN COOK COUNTY! In Lake County, this is a felony UUW! That's the difference between our State Attorney's Office. ANITA and her minions WONT take a case like this to a jury, because it's NOT a slam-bang conviction which she needs for the next election cycle!

You are delusional if you think that Alvarez could have gotten that conviction. Brian Sexton handled that case for a specific reason. If it was a loser, Anita walks away clean. She personally handled the P/O Alex Valadez murder case, ..... wait for it.... BECAUSE THERE WAS A CONFESSION! That's a real hard one to prosecute (WTF?) Brewer was convicted for two simple reasons. The Dicks from Area One who handled it are excellent and the SA (Sexton) was excellent! "Nuff said"!

I thought the same exact thing upon reading this in SCCs thread header. If the A/O's wrote the paper even close to how it was related here, they potentially have much bigger problems than working New Years Eve or being denied CU or.........

Not to mention the fact that ethically a state's attorney cannot bring charges that he/she doesn't have a good faith basis for. And maybe looks like, maybe prints on. That's not enough. Plain and simple. Move on. Nothing to see here. And writing good paper is different from creating better facts.
