IPRA Protocol

Here's the letter outlining how Officer involved shootings will be handled now:




Interesting that IPRA will notify Felony Review as soon as possible, even before they leave the office and arrive on scene. That tells us quite a lot. It ought to tell each and every reader quite a lot, too.

I've always been a worker, and it seems like my heart just breaks a little bit more every day.
They want it, they've got it.

I'll be damned if I chase another dude.
I wish these young kids would understand. And in not even necessarily "old" by any means, but I have respectable time on. I've worked in districts, on teams, and units. I've learned from, and worked with some of the finest officers to serve this city. I have taken gunfire in these neighborhoods, and returned fire. Have always had the best interest of this great city, and more importantly the best interests of that silent majority held captive in their own neighborhoods at heart.

Most people go to jobs they hate every day, just collecting a paycheck. I always considered myself fortunate because I had a job where I felt I was actually making a difference, and I had a job that I actually BELIEVED in. Somewhere along the way we became the villain. Up became down. Left became right. And everything is just backwards now. Suddenly everything I believed in, is everything supposedly "wrong" with this city, and I'm realized I've dedicated in excess of a decade for service that apparently isn't wanted.

Young kids- if he runs, let him go. If the car takes off, let it go. Unless it's an exceptional/extraordinary situation, you are worth to much to your friends and family.

The UPSIDE of you chasing is maybe making a good pinch, some court time, maybe an award.
The DOWNSIDE is a heavy suspension, termination, public embarrassment, and possibly prison.
On a scale, I know which side carries more weight. It's a no-brainer.

NOTHING GOOD WILL COME OF DOING THIS JOB LIKE IT'S MEANT TO BE DONE!
I just don't want to see any more of our brothers and sisters take on the stres of being right, but being crucified like you're wrong.

In a OIS, prior to making any statements to anyone request an attorney, period. They meaning IPRA and CCSAO are not conducting an investigation in what happened, they are so nvestigating if you were right or wrong to pull the trigger. Anybody requesting a statement inform them that you are not refusing to make a statement but since I may be charged criminally I will not do so without my attorney present.

SCC where were these "ipra" investigators trained at and/or are they certified by the state as lead homicide investigators like we have to adhere to? Are they going to required to submit gpr's that are "supposed" to become part of the file to be left in the areas? Will we even have access to their notes? Sorry just asking

Sounds like the street officers need some training and professional advice. Has the FOP thought of getting some use of force professionals to provide training to street officers? You should look into getting someone like Massad Ayoob, who has been defending LEO nationwide for years. I do not think you want to wait for the city to provide the training.

If the City or FOP doesn't do it, he has classes for concealed carriers. I have not taken one of his courses, but it is on my to-do list.

Contract News - 2012-2013 Overtime Retro Pay

The Lodge would like to report that we were recently contacted by the City attorneys and advised that a lawsuit involving retroactive payments for FLSA overtime hours worked during the first year of the current Contract was filed. As you might recall, due to the prior administration, their Lodge attorneys and several individuals who admitted to having knowledge of the failure to timely submit the "re-opener" letter; the City adamantly maintained the position that they were going to withhold "any and all" retroactive payments worked in 2012-2013.
In April of 2014, a meeting took place where we were successful in getting the "clock reset" as it were that resulted in getting retroactive pay back on the table. However, as negotiations progressed the City's position only offered retroactive pay for straight time earned in 2012-2013 and overtime was excluded. The Lodge persistently argued for the full payout of "all" retroactive pay during multiple negotiation session but was unable to move the City off of its stance. After exhausting every possible option, it was suggested by counsel representing the Lodge that we move forward and accept the $25 million payout for straight time retroactive pay and not run the risk of losing everything due to the City's unwillingness to include overtime earnings.
The lawsuit that the City is presently dealing with cites an obscure regulation within the United States Department of Labor (USDOL) regulation that appears to override the agreement related to retroactive overtime payments. If this regulation had been raised during negotiations, it is thought by counsel that the City would have never offered a final deal to approve "any" retroactive payments for "any and all" hours worked in 2012-2013.
Once the Lodge was contacted by the City regarding the lawsuit, our labor attorneys were directed to review the matter and determine the feasibility of the claim. It is their opinion that because the 2012-2013 payment was structured as "retroactive payment" on hours worked, the USDOL regulation could possibly require the City to now include retroactivity on 2012-2013 overtime hours. The attorneys noted, however, that there is little, if any, guidance or direction on the relevance of this regulation to the unique circumstances in this case. The City lawyers informed our attorneys that they are reviewing the lawsuit and will keep us advised on how they intend to proceed. As more information becomes available to the Lodge, we will continue to update the Membership. Currently there is no timeline, nor is there anything further or substantial to report.
Let us be 100% clear on the two critical elements that preceded these events. The first critical element was the success in getting retroactivity placed back on table after the April 2014 meeting. The second critical element was the October 2014 ratification of the Contract by our Membership. These two critical elements opened the door for this litigation to be possible in the first place. Remove either element and this specific case could never have been filed. Finally, even though the Lodge was not approached by the Member(s) that took it upon themselves to move this suit forward, if successful in securing the retroactive pay for overtime worked during that "lost year"; on behalf of the potentially affected Officers, thank you.

How can you not only trust -- but mandate -- that an agency to whom you are implacably hostile pick up all the teeth, brains, and empty shells, and then turn the whole scene over to you for "investigation?"

Hire your own min-wage janitors to clean up the mess -- and then take it from there as it's obvious you intend to anyway.

I'd suggest "de-funding the police," as has been suggested, and hiring Aramark to do the prelims.

Can't believe we gave up our contractual rights just like that. We gave a sworn investigative position to a private entity. Ipra are now deputised police detectives...byassing dept. Procedures and contractual obligations. Once more, stay fetal or you will get a asa approve felony case against you.

So if an officer shoots and kills an armed offender who has an accomplice who is arrested, will the IPRA investigator interview this subject? Will the investigator advise the accomplice of his rights per Miranda? Will s/he take notes on a GPR and will s/he complete a Supplementary Report, all of which wil become part of the file? Will s/he sit with an ASA during statements, and will s/he appear and testify in court or the grand jury?

Or will s/he run away from this part of the investigation as fast as possible?

My question is this are IPRA investigators trained to actually do a investigation? if so who trained them? and how many hours of training did they receive? If these people are just political hacks who were sponsored by a aldercreature, reverends or county board hacks, does a P.O. have a right to sue the investigator and IPRA because he or she failed to do a proper investigation and tried to railroad the P.O. this after further investigation it was discovered that IPRA failed to do their job properly. This job is so f@ck no wonder they can't get enough people to sign up for the exam

So if IPRA investigators are in bed sleeping they will not be available!

Then we run into the problem of keeping witnesses around.

Beat officer on scene should just do that lovely contact cards on the witness and walk away. Don't even attempt to touch or look at any video. You will be accused of erasing it!
The exempt they send out is likely to never have been a Detective of shootings and will say things like keep the witness in custody but will never say that out loud or signs anything.

You will have 3- 5 white shirts watching you but none will transport a prisoner or watch any evidence for lack of manpower. you are best served on standing in front of a police camera when the exempt starts acting like the know anything to record all those order they love to give.

caution as soon as a white shirt ask if your camera is on, be very worried they will not have anything good to say specially if you are the paper car .

if you are extremely wary complete a SUPP report as soon as possible documenting all the action you were ordered to do per IPRA and put their names for GODs sake your are the police.
Check the identification of all personal thinking they can talk to you take a pic of the IPRA investigator remember you are helping them investigate but will never see the report.

READ the state law regarding police shootings!

If you read the ilcs law that was passed 01Jan16 you would know this letter is a complete pile of crap and a total violation of the State Law! In our area many of the Detectives have already called the union (who was waitin for the official letter to be presented). I'm sure the union will be addressing the CLEAR violations of the State Law that are being broken.

Remind me again, is it legal to brea the law because of a general order/ special order/ any bullshit written by the dept? If we knowingly break the new state law does that put us in the trick bag?

Hmmm, Where do I start. The new law effective Jan 1 2016, clearly states we cannot be involved in the investigation in a fatal police shooting. As the first on scene, if you are marking evidence that means you are looking for evidence. That is investigating. Forensic services personnel are investigators and their job involves looking for evidence, marking the evidence, photographing the evidence, measuring, and collecting the evidence. Forensic services job is to investigate along with detectives. Next, this is not two investigations, it is one. You are involving detectives in this single investigation which is violating state law. You cannot transport witnesses to the area. What if they begin to talk about the investigation. Then you have to document and you are involved. Ipra needs to say when the body is removed and they have to make the arrangements. They are the investigators. The law also states that we are to have a written order by Jan , 2016. The police do not and that is violating the state law.

So much for trained, experienced investigators, (the police detectives) conducting thorough, competent investigation. Now we will have an agency with an agenda (and maybe a quota) in charge leading the investigation toward their agenda (which is the police are always wrong) good luck. So police with years and years of experience and expertise will have to stand by and watch civilians with a whole week of training. Does anyone else see something drastically wrong here. The police are now on trial for every action taken. Do nothing to stay safe. Civilians go get a Concealed carry permit and learn how to handle a gun. Felony review with states attorney...I will invoke my right to not say shit until my FOP union lawyer shows up due to a traumatic episode I have just encountered with the shooting and until I feel comfortable. I will also go out on psych leave in spite of the bullshit I will have to endure to make things more transparent in favor of the officer. Where is the due process in this? Simultaneous investigations alongside IPRA? WTF is this shit? Those lackeys aren't detectives nor do they have the qualifications to do such. This is our future shit to deal with just because Rahm had to hide some bullshit to get reelected another term along with Anita Alvarez. Knife vs. gun=dead offender, bat vs. gun=dead offender.....That's the matrix!

This is going to be interesting considering the rights of public employee's regarding the Constitutional rights pertaining to the Supreme Court's ruling in the Garrity Supreme Court Case. In the Garrity Court ruling, the Court stated that the Constitution protects citizens from the actions of governments. When a public employee is being questioned by their employer, they are being questioned by the government. Therefore, the 5th Amendment applies to their interrogation, if it is related to potentially criminal conduct. The 14th Amendment make this applicable to state and local governments also. In the Gardner v Broderick supreme court ruling, public employers cannot use a a threat of termination to force employees to waive their constitutional rights. This law also applies to outside agencies investigation public employee's. (IPRA) Does this mean that employer can never ask question regarding a particular incident. No, a police officer must answer questions regarding a shooting but that statement CANNOT BE USED AGAINST HIM/HER IN A COURT OF LAW AND/OR DISCIPLINARY HEARING. In addition, any evidence gained or learned by this questioning can not be used also. What does all this mean: A person can still be question and be prosecuted for the offence under investigation, as long as the prosecution relies solely on evidence other that of the protected statements and other evidence learned as a results of such statements. In other words, a PO can be questioned however, any statements given can not be against him/her. What is going to be interesting is if a PO gets involved in a shooting and is questioned by IPRA with a States Attorney present. If there is ever a time when FOP also comes out with a policy this is it. If you saw the above letter that was written by the current head of IPRA, FOP WAS NOT INCLUDED INFORMED. WHY?

The new State Law is very clear. CPD should not be involved (i.e. Detectives and FIs/ETs)in CPD personnel fatalities period. You cannot separate the investigation into two different parts (criminal act by the offender and then the shooting of the offender). It is one investigation. This agreement between the CPD, IPRA, and the CCSAO is in violation of the law. I hate to be the first set of officers, detectives, and FIs that get the first police fatality of the year. The civil lawsuit will be for Wrongful Death (like always) and for Knowingly Violating the State Law. Chief of Detectives Gene Roy will be long retired when this goes to federal court so who will be left holding the bag of shit? Detectives and FIs/ETs should refuse to work on police fatalities.

The city new of this law in the summer of 2015 and there is no Special Order on it that has been published. And when it is published, it will reflect the same nonsense written by IPRA that is in violation of the law (I saw a draft).

Where are you FOP? The city is putting us all in a very bad predicament and we have heard NOTHING from you.

It doesn't matter what they do in the name of "fixing" something that wasn't broken in the first place. If the race baiting politicians and reverends, the ghetto lottery ticket lawsuit seeking family, or the blind bleeding heart libtards do not get the results that they want following a police shooting (the police officer sent to prison for life), they are still going to complain that the system is corrupt.

For the michael brown shooting, they tried EVERYTHING they could to find fault with officer wilsons actions. When they could not, and the evidence showed that brown was attacking the officer who only responded in self defense, the response was sickening. NOT ONE of the media bastards who crucified the officer before any investigation was done, nor any of the politicians who sided with the mob, nor any "men of god" who fanned the racial flames spoke up and apologized to officer wilson and his family or vindicated him publicly. In fact, when they speak of the incident to this day, they insinuate that it was still a racially motivated incident by a corrupt biased system geared towards the continued oppression of minorities rather than what it was..... a police officer who was attacked by a criminal. And this criminals actions forced the officer to defend himself.

They will keep pushing and pushing and the panderers will change whatever they can without thought of the risk to police officers. The blood of any police officer injured or killed due to even a fraction of a second hesitation because of the inevitable shit storm of litigation and witch hunt that follows every shooting, is on their hands. The problem is, they dont care. We are the hated, we are the hunted. Watch yourselves and dont be easy prey.

I ask this since my prior employment was outside of Chicago as a police officer.
During this employment I was involved in several officer involved shootings.
And must tell you that when the State Police step in they control it all
from evidence collection to witness statements.

And that is the way it should be. Do you really think this department has the ability to perform any investigation now without influence or leaks from the administration
or mayor?

If you think otherwise, just look at McDonald shooting and see who is being stripped, and reassigned during investigation. One year after original investigation
and it is being reinvestigated and blaming CPD members. While IPRA is not mentioned.......

We need an outside independent shooting investigator. Former law enforcement
former states attorney teams that come out for officer involved shootings.
No connection or influence from City or employer.
What do you want the truth or what city wants to be released?

Yes it tells me the deck is stacked against us even before they leave there office and with all the heat on CPD and clear incompetence from IPRA in the past, IPRA has an agenda, to charge as many officers as it can to appease the black community and the revnones , a IPRA investigator should not be able to interview a witness or offender alone due to its clear bias and orders from the mayor to charge officers, CPD detectives should sit in to make sure this non law enforcement agency has a clue. All IPRA investigators should wear body cameras to ensure accountability and fairness and transparency .

Despite all of this, we still have some officers stopping cars and getting into foot chases. They won't outwardly admit it, but they want to examine officer involved shootings under a microscope. To see if there is any small deviations of policy. And if there is, you will have to exchange your blue uniform for an orange jump suit. Who wants to be made out to be the first example? I don't.

Everyone understand this. Under the law that went into effect 01 Jan 2016, Police and Community Relations Improvement Act under 50 ILCS 727/1-10 (b) bottom of paragraph. No investigator involved in the investigation may be employed by the same agency as the officer involved in the officer involved death unless the investigator is employed by the department of State Police AND not assigned to the same division or unit as the officer involved. For short CPD dics can't be involved in the investigation of a CPD officer involved death unless employed by the State Police "AND" notice it says "AND" not "OR" (not assigned to the same division or unit as the officer involved. CPD and IPRA defining policy in clear violation of the state law.

Any dics going out on these you are in violation of the state statute which will be addressed by the civil attorneys at the lawsuit depositions Make no mistake
Also under section (d), the investigators will submit a report to the Attorneys Office for review. Any copper that shoots someone now should
invoke their right to counsel and to remian silent.

Your FOP needs to get on the ball and ensure that officers make no voluntary statements to IPRA. Do what you must to ensure CPD command need to order officers to make a statement. That more clearly protects the officer under Garrity. In my west coast agency, we have this any time we talk to our civilian "investigators".

I understand that IPRA can conduct an investigation and find a use of force /shooting unjustified. That in and of itself does not make it a criminal matter. Now if they determine the action is a criminal act, do they do the full investigation? Do they prepar the case for court? Who arrests the officer involved? Who goes to court? Will they end up in federal court in the civil proceedings? How will conflicting investigations between the detectives and IPRA or with any other agency involved be resolved? More questions then answers. For an officer involved it is lawyer up.

They meaning IPRA and CCSAO are not conducting an investigation in what happened, they are so nvestigating if you were right or wrong to pull the trigger. Anybody requesting a statement inform them that you are not refusing to make a statement but since I may be charged criminally I will not do so without my attorney present.

Felony Review was always notified of a police shooting. They always came out and sat in on the round table. There is a lot of information that develops during the investigation that the ASA should be privy to since they will also be looking at the charges on the offender. Yes, I know everyone is thinking that they're looking to charge the copper, but we all know, very few coppers are wrong in the shootings so normally, no one will be criminally charged. The ASA will not be involved in the matters relating to procedural violations, i.e. unauthorized ammo or duty weapon, camera/microphone infractions etc., just law matters. When it comes to the law, there will be few, if any coppers being looked at, unless it's clear they set out with unjustified intent. Officer Vandyke wouldn't have been criminally charged in the IPRA review with an ASA present, since he did not commit any crime. He may have been looked at harshly during an excessive force investigation, but that's not a criminal investigation; it's civil. The only reason he is facing criminal charges is a bow to pressure so politicians can respond to public and media critics and save their political handouts.

SCC-Maybe you can help with getting information since our unit reps, watch reps, and fop has no answer. This is new information regarding the squad scheduling.
This week the 12 district was informed that the squad scheduling was going to be terminated in the 3rd period. Everyone has to re- pick day off groups and have to now find a 3rd person for each car. What is upsetting is they wait until the year begins to tell us that its ending. No one for 2 years ever bothered to even ask us our opinion on this. I am not a fan of squad scheduling at all. But like most of us we have family and other obligations in our current day off groups. Its very simple to just up and say everyone has to re-pick day off groups. Instead of waiting until the end of 2016 to fix this issue and have new d.o.g for 2017 they chose to do this now. At least this commander was able to get this stopped, but why now? Any help?

As far as I remember from detective training CCSAO ASAs are NOT to conduct investigations at the area. CPD conducts the investigation and then presents the evidence to the ASA, at which point they determine if charges should be levied. Once ASAs start interviewing witnesses, especially when there is video of the CPD interviews that they can watch, then they become liable. Also, from a few lawsuits ago, transporting witnesses into an area was supposed to be a big NO NO. Maybe IPRA can transport them so they can defend themselves again kidnapping and malfeasance lawsuits.

Your a little LATE on the up take. FOP has investigators on call every day in addition to a field rep. The field reps always went out on shootings. The investigators were hired THREE YEARS AGO. A professional police officer would know this. Talk to your unit representative. He or she should address your roll call once a month after he or she attends the general meeting. Or YOU could watch the meeting in it's entirety on the FOP web site.

Secure and preserve the scene. Set up a check in stop and have all investigators signs in. Don't canvass for witnesses or evidence. Asked to be advised your administrative and or Miranda rights. Insist that a FOP representative and lawyer be present for all questioning. Let them figure out what their supposed to do, eventually they' ll shoot themselves in the foot.

Worked in 008 with those coppers very aggressive actually work extremely hard as this is their neighborhood also, the scum invades and they do their jobs to keep crime down all legally and honestly! I sure hope that these IPRA investigators are State certified in the various certifications needed to conduct a proper criminal investigation.

And I hope that Dean (a man who can't pay for his own dogs medical bills cause he doesn't have enough money) and crew hire a law firm to represent officers.
A law firm that will be able to send an attorney out at any hour of the day or night to represent an officer that is doing his/her job and protecting themselves from the criminals of this city.

If you are ordered to do otherwise, get it on paper that you are being ordered to do something without your attorney. Get all the minutes of the interview on paper and get a copy.

The OCIC or Street Deputy have been meritoriously promoted at every opportunity of their careers. What do they know how to do? Walk a runway, give weightlifting tips, teach someone how to wash a tender age minor's mouth out with industrial soap. That child was not hers. That act was and is criminal. Can someone explain what they were promoted for. I don't recall any of them doing anything that merited a single promotion much less five or more. Oh yeah they are all politically connected and each is a wealth of tics off of a specific social groups. Yet their lacking in passing the examinations and being promoted in highest score order. Remember if you get in a shooting it's very stressful. I would advise all members who get involved in a fatal shooting to address the chest pains they have and the shortness of breath they are experiencing and get examined by a Doctor at a qualified hospital. Also it would not hurt to stay overnight at the hospital for observation. Remember your health is the most important issue. The investigation will take place but it's very important that you get the medical attention you require. Stay safe.....

It seems pretty clear from the "notify the felony unit" and the ....interview to be conducted with the officer involved for "public safety".... shows a thin veil of contempt for law enforcement officers. This document sends a very clear message to those who chose to serve and protect the citizens and visitors of Chicago, if you ever need to use deadly force to save your life or someone else's , you are going to be charged as a criminal. Although the procedures outlined by IPRA and proposed by the department may not affect an officer who his defending his life or another under the law, they absolutely affect the way the incident is to be properly investigated and they violate the State Statute which throws the detectives under the bus because under the statute the CPD dics can't be involved while being employed by same agency as CPD involved officer.

Apart from that IPRA will be submitting a report after investigation to The States Attorneys Office to determine if criminal charges are warranted.

Invoke your right to counsel and to remain silent. If City is claiming that IPRA is truly independent from the police department then you shouldn't have to make any statement to them and only administrative to your supervisors

I understand the fetal thing is a response to the fact that you are videoed, watched and reported on by every civilian, reverand, social activist and the media. Your actions are scrutinized and dissected at every turn. So I get it. But, aren't you in a way empowering the bad guy? If Mr. Jagoff knows that he won't get stopped, if he knows that we are laying down, can't we expect him to take advantage? And trust me, he knows. To go deeper into 22, 16, the west end of 008 and where ever else we live? "They" are not just going to kill themselves, they will be in our yards, busting into our garages and homes, and robbing, at gunpoint, a man out walking his dog as in 022 recently? I know it's not easy but someone has to protect people who need protecting. Please. Figure out a way.

In Lake Co. IL, the Lake Co. Major Crimes Task Force handles all OIS. The task force is comprised of police officers/detectives and evidence technicians from many suburbs. The TF has a formalized set of policies and procedures, so being from a different department means nothing; you follow the TF protocols.

In Lake Co, the TF can have multiple detectives, as well as multiple ETs at a scene fairly quickly. And on the TF, the ETs are not just guys who are given some training, fingerprint powder and a camera. They have a great mobile crime lab. Also, the Lake Co. SAO participates in the investigation. Believe it or not, the facts are what come out of a TF investigation.

If the claim that "public trust" is eroded by having CPD conduct its own investigations of OIS, then the Cook Co. Major Crimes TF should conduct the investigations. The Cook Co. TF is just like the Lake Co. version.

What's obviously missing is the general order or special order addressing this change so nobody really knows what will or should happen on scene of the first ois which results in death in 2016. You can make a statement after the CCSAO grants you Transactional immunity, in writing, to you and your attorney. I'd throw in copy for a witness or two in case your attorney crashes his or her car on the way home. Insist on immunity before any statements. Once its granted, record the interview yourself - advise all parties of such. Don't embellish, stick to the facts and don't lie. If you lie, you can be prosecuted for obstruction of justice, even with immunity, and your lies can be used to impeach you at later court proceedings, such as civil suits.

If the CCSAO won't grant immunity, even after the preliminary parts of the investigation are completed, your attorney will probably have a come-to-Jesus talk with you about your bleak future.

FYI, Administrative Proceedings Rights are a form of immunity. When you get them for a CR#, they are used to compel your cooperation under threat of termination, which is why they state you cannot be prosecuted for statements made after being given the rights. See Garrity V New Jersey; Kastigar V United States, and Kalkines v. United States.

Although these cases refer to federal employees and the employment rights they are given during investigations, CPD's version of Administrative Proceedings Rights are similar in nature.

The mayor ran Ando off and now Fairly is running off anyone else at IPRA who she thinks is not anti-police enough. Those who won't buy into her anti-police bias and see her for the inexperienced and incompetent figure head she is are bailing on her left and right. The 1st Deputy, ex-DEA like Ando, and Chief Counsel have already left. The few others there with law enforcement experience are not going to be there much longer either. Soon all that will be left are the cop haters and hacks who were there before Ando brought in some experienced people. CPD, and IPRA for that matter, are doomed under Fairly.
