Chicago to Return $$$?

  • Chicago violated the “fundamental principles of justice, equity and good conscience” by denying due process to motorists issued red-light camera and speed-camera tickets, a judge has ruled, declaring those tickets “void.”

    In a harshly worded ruling handed down late Friday, Circuit Court Judge Kathleen Kennedy kept alive a lawsuit seeking hundreds of millions dollars in refunds for motorists ticketed since 2003 after City Hall “skipped a step” mandated by the city’s own municipal code.

    The lawsuit filed nearly a year ago accused the Emanuel administration of violating the requirement to issue a second notice of violation before issuing a determination of liability against motorists issued speed-camera and red-light camera tickets.
Wait, what? The City doesn't follow the rules it puts in place and expects everyone else to follow? Who would've thunk it? So all those hundreds of millions of dollars, all of it spent already, might have to be refunded.

And what does this mean going forward, seeing as how these things were put into place with a crooked City Council vote, greased by bribes of up to $2,000 per camera installed, and are currently being sued to the tune of hundreds of millions?

Arizona is planning on banning them. "The only tickets that will be issued in Arizona will be issued by sworn peace officer, and that's the way we like it, not by a private foreign company in a foreign land," he said.

According to Dow, research shows that red light cameras can increase accidents at intersections. However, a 2007 study by ASU on red light camera intersections shows mixed results. The study states:

Think about it--the damages not include the fines illegally levied and paid. In some cases those 'moving violations', fraudulently created, probably increased insurance rates for some drivers. (ka-CHING!) In some cases, may have led to revocation of licenses (ka-Ching, ka Ching!!), with subsequent loss of employment.

All that money has been spent already and MORE than it took in was borrowed against future fine income that not only will NOT materialze but is now leveraged and owed in periodic payments to bond holders. If we spent money like this it would be over quickly. The city will now suffer a long and painful process that further pushes it to bankruptcy and the in ability to pay for the social programs that matter and help people. The church taught us funding government with gambling money is poor social policy and common sense tells us that funding government with fines and penalties against citizens is equally bad social policy. But 50 aldermen and an incompetent man for a mayor cannot figure that out.

OT: It's that time of the year. I got my first 'sample' ballot in the mail yesterday from the 11th Ward Dem party and noticed the Machine supports Alvarez instead of Foxx for SA. IS this a sign there's a falling out with Preckwinkle?

They also support Shirley Madigan as a Clinton delegate. Any relationship to Mike?

I take the 'sample' ballot into the booth every primary election and always vote for a non-Machine candidate and vote straight Republican in the general election.

If the City loses this case, coupled with the other incompetence demonstrated by "Rhambalina", it is going to cost the citizens of Chicago hundreds of millions of dollars! If Judge Kennedy's decision, which was wise and logical is upheld on appeal, the City will have to fork out Hundreds of Millions of Dollars! Rham's policies have destroyed the Police Department, left CPS in chaos and in conflict over his desire to put the corrupt Charter School System run by his "friends" in place (UNO, Arnie Duncan, Bill Ayers). Heard recently about a well known west side bar that has been on the radar and under investigation and some former coppers may be jammed up along with a current disabled officer or two as well as some organized crime figures. Off topic but I spoke with an lawyer friend who told me in reguards to been bounced from ur car and changing ur start times etc etc for not "DOING ISR REPORTS" document Names and Badge # time and dates , conversation that took place . Most of his press coverage involved Eddie trying to intimidate city employees (threatening to have a streets & San tow driver fired for hooking his POV) or even a nightclub doorman in Miami(who wouldn't let his underage nephew in the club). On that occasion the Miami PD intervened and filed a CR in lieu of prosecution.
Eddie's only function in Springfield was to support the Midget in Chief, Mike Madigam.
He has a lot of nerve asking for that Pension sweetener. And Hauser&Lappe have even more nerve to grease the skids for little "Eddie Munster."

Please check out Ms. Mitchell sun times piece of journalism this morning about how her sister received a ticket violation on 95th Ryan. Ms. Mitchell this is the kind of stuff and reasons the community and the police will always be divided...Individuals like yourself trying to make it National news about a ticket violation and bash on the police as if they were the enemy of the state. Instead go around and write about the violence and the deaths of folks of all ages and how gang violence is out of control and how drugs have infested these communities, Instead your attention has come to the aid of your sister on how she received a parking violation. There is due process if she chooses to contest the citation and she will be able to plea her side of the story, however for you to come out and bash on the police for writing her a citation is just plain stu@id! Lack of accountability seems more like it here especially if shes been guilty of doing it multiple times, well you just can't get away with it for ever. Also if you feel that shes been treated unfairly then I ask you instead of being part of the problem, then be part of the solution. Go around with your camera, note pad and pen and record or write about not only the police but stand or sit there and watch the crime as it unfolds in front of your face. I beg you stand on 79th Cottage Grove, 63rd Ashland, Madison and Pulaski or pick a so called hot spot and conduct a Year long investigation an lets see what the results will be. I can almost guarantee you the Alderman or your own bosses will tell you to get out because its bad publicity!!! So I will end with this, STOP being biased and write something that is meant for all the community not just your sister and the benefit of a few, you should be embarrassed to consider yourself a journalist, writer, or voice to the people or whatever you want to call yourself....u should try to be open minded and biased free it works better!!!

Regarding the revamped ISR / PAX 501 - Unfortunately I do not see this changing anything. You still have to complete a report documenting why you thought a crime was, is, or was about to be committed. When there is no arrest for the most part you are then documenting that you were wrong. Policing at the district level is about volume, sometimes it only took one stop - other days it took 30, however now you can't afford to be wrong. Until the department and the community has our backs (even a little bit) and wants the police to police we are stuck in the mud. It's a good job, nobody wants to be fired.

Not a cop here... work for lawyers who do consulting with municipal bond rating agencies... they keep commenting that Chicago is not going to right its financial troubles before avoiding insolvency and bankruptcy. This just adds to the scenario that makes it look as though creditors will not even be allowed to keep funding bad debt with credit that will not be repaid.
The long term looms very grim not only for future retirees but even for current pensioners. We're always wondering why your union sits idly by so calm and quiet when it looks as though your employer is going terribly broke and there will be no rescue for an insolvent fund...
When I ask cops on the street about their pension, I hold back my shock that they mostly say the state constitution guarantees their benefit. The state law has no mechanism to provide funds on your employer's behalf if they stop paying or run dry, it only says benefit shall not be diminished. But there is no way to make them comply. Why do you guys think an already crooked city and broke state will look out for you?
From the posts here it sounds as if you all know full well who you are dealing with and yet you are relying on "good faith" from a city and state that has no such thing. Good luck to you.

I happen to love this city, my family helped build this city. This city is only a "shithole" because of the people that happen to inhabit it.

A lot of suburbs, not willing to just leave it to an outside private company solely driven by profit, required their officers to review all of the violations. Only the ones that were approved by them were sent violation notices. This eliminated a bunch of borderline and rolling right turn violations. Made the citations more legit.

Something has to be done with Romulus parking meter nonsense in addition to the red light camera crap. Wtf is wrong with these meter maid people-they act as though they get a percentage of those tickets they hand out.
Got my first one in front of the Police uniform store on Roosevelt. Parking fee there is about a quarter for four minutes. Took a little longer for Manny to finish my work although I pumped over 3.00 in quarters and I see those meter readers tagging my car. Does no good to try and reason with them...
Ticket cost: $65.00!

Not a cop here... work for lawyers who do consulting with municipal bond rating agencies... they keep commenting that Chicago is not going to right its financial troubles before avoiding insolvency and bankruptcy. When I ask cops on the street about their pension, I hold back my shock that they mostly say the state constitution guarantees their benefit. The state law has no mechanism to provide funds on your employer's behalf if they stop paying or run dry, it only says benefit shall not be diminished. But there is no way to make them comply. Why do you guys think an already crooked city and broke state will look out for you?
From the posts here it sounds as if you all know full well who you are dealing with and yet you are relying on "good faith" from a city and state that has no such thing. Good luck to you.

If there were Due Process deficiencies in the citation process (and there were), then the entire Law Department of the City of Chicago should be fucking fired. After all, if it wasn't their job to oversee and approve the process, then just exactly whose job was it?

And the head corporation counsel should be forced to liquidate his assets to help satisfy the judgment. Sure, he probably doesn't have $600 Million but I think this is the kind of bitch slapping he needs to wake the fuck up and start paying attention.

I am afraid that the city and all of the pension funds are in serious trouble. In a few short years the city might have to declare bankruptcy and then everything is on the table. And yet many suburban municipalities continue raking in the dough from unsuspecting motorists. Case in point: Fox River Grove, IL (aka: Little Moscow), using their red light camera to send tickets out to people who don't stop long enough before making a right on red. In-fucking-credible. The scam of the century has already raked in millions of dollars to this clout heavy town, whose claim to fame is losing several children in a major school bus fatal crash. Of course, I doubt if any funding went to make this intersection any safer. But hey, who cares? As long as they're making money off the citizens of Illinois, that's all that matters, right? Screw the school kids. Way to go, Fox River Grove and Chicago, too- for running the same bullshit scam against its taxpayers.
