Alvarez Folds
- In a stunning reversal, Cook County State’s Attorney Anita Alvarez on Thursday recused herself from prosecuting Chicago Police Officer Jason Van Dyke and asked a Cook County judge to appoint a special prosecutor to handle the high-profile murder of teenager Laquan McDonald.
Alvarez held firm in her motion filed Thursday that her office did not have a conflict of interest in the case as critics have charged. But she noted that she would still recuse herself and ask for a special prosecutor “to obtain justice for Laquan McDonald, and to ensure continuity in the handling of this important and complicated case . . . ”
During the Democratic primary election, Alvarez repeatedly rejected calls for a special prosecutor in the Van Dyke case, a key issue during the campaign that ended in her getting trounced.
Anyone else think this is a political move to protect Foxx? As the first-degree murder charge falls apart, Foxx is going to need cover for herself and Prickwrinkle's County machine. Better to blame an outsider.

Alvarez didn't need to dirty her hands with this case; it won't end before she's out of office. There's no point in starting what you can't finish. She knows she's damned if she does and damned if she doesn't, where this case is concerned.
Her issue is now finding future employment. Surrounding herself with more controversy won't help her in her job search.
I look at this move totally differently.
I look at it as, "Hey, this is a BIG CASE and that means a LOT of work." Why put any effort into it when I am on the way out? Just coast until I am out.
That's the way I see it.
Next case.
I thought the opposite. Anita basically saying not my job anymore. It's a shit case and she knows it, now let foxx explain the acquittal , or blame anita, but either way, foxx is inheriting an office plus staff plus investigators who all know her game plan , her agenda, and her blm bullshit and known it's nonsense.
It's a pure and simple sellout.
It also is intended to pander to the "community" and the BLM crowd.

Oh how I wish that were the case.
Looking at this case with some legal training (Police Academy) I agree that this case has problems hampering conviction.
But that doesn't matter. The trial is not about legality or justice. It is about blood revenge. The PO will be sacrificed to appease the underclass horde.
So what's in it for Anita? Did Prickwrinkle promise that the black politicos would acquiesce to a judicial post? A trip to the Maybrook Square Courthouse is an easy commute from River Forest.
And if this will really be an independent prosecutor, will that legal giant have the courage to drop the 1st degree murder charge to manslaughter or negligent homicide? Watch all the #blm crowd start their own lynch mob if the charges are reduced since they cannot comprehend anything longer than a 30 second hate the police diatribe from Carol Marin who seeks to extend the "laquan legacy" so she can garner more journalism awards. Last month's Peabody award was only the first lie built on other lies.

The vary premise, that Alvarez could prosecute this case is absurd from the start, because she may well be forced to testify as a "Hostile Witness". The callous way this entire incident was handled is the hallmark of Corrupt Cook County Politics. Just think about this for a moment: Jason Van Dyke, the vicious Murderer; when did Anita see the video? Did she wait 410 plus days before she realized that Van Dyke was a crazed Murderer? At which point, she immediately had him arrested, charged, shackled and Perp Walked for the Media and masses of angry welfare recipients, and of course their angry Suburban White Liberal attorneys. If Anita was dumb enough to let a hardened Murderer to roam free for more than a year, then she really is stupid. Or, she was doing what Rahm told her to do to protect her political ass. Now maybe Rahm will keep her on the payroll like he did for Zopp, another Democrat Loser in the last Primary. Fu%k Rahm; Stay Fetal, Stay Fetal! Anita was Chicago Values! Baby"G"
Isn't the term "murder" a legal definition for an unlawful killing to be used after a conviction, and calling someone not convicted of such libel?
This was a terrible move. Anita could have left this mess for Fox. So when he beats the case it's all on her. They must have promised something for Anita.
Anita is not the only States Attorney who is recusing herself. Word at 26th Street that there more than a few Assistant's who have submitted resumes to various law firms through out the Chicago Land Area. There are several Assistants who are exploring the idea of forming their own firm. My question is why? With the low number of clear ups in murders and other part one felonies arrest, is there going to be enough work to go around?
Now when Jason is found properly "not guilty" of the trumped up charges what next? Jasons attorney is looking forward to this case, he knows as well as anyone with any sense knows not guilty! All the coppers thrown u8nder the bus, Eddie opening up old cases,a crazy judge looking to charge coppers with perjury, and you keep on working pro-actively in the ghetto black lies matter areas! Think your family,your pension,your home,your freedom all gone for what a ghetto felon animal just not worth it.
Don't forget also rahm criticism of police for a chase involving possible homicide offender!

If I was Jason Van Dyke I'd have my attorneys screaming for a change of venue. There's no way in hell he gets something even close to a fair trial by a Crook County Jury.
Expect chaos and anarchy now that Preckwinkle has control of Cook County. Dart is terrible. Kim Foxx will be even worse. And soon she'll have Rahm out and she'll control the whole city and county. Do your best to fight against it. Vote against Kim Foxx and any Democrat backed by Preckwinkle and the Democratic establishment.
Makes perfect sense for her to hand it over to a special prosecutor. She's done as SA, so why would she bother to star in another shit-show circus event that will end up in disaster? Let Foxy Brown handle it since she's so damn qualified when she gets the big chair. Gonna be real interesting when they realize JVD will not be getting murder charges approved.
If an officer is able to use 'deadly force' under Illinois Law, is there such a thing as 'excessive' deadly force?
Hope the verdict is announced on a cold,cold January night next year with a blizzard blowing.

Fox won't need any cover. Here is how it will play out. If Van Dyke gets nothing to very little her & Preckwinkle will blame it on Alverez dropping the ball originally. If he gets hammered Fox will take all the credit and tell the "Sheeple" that it was all her. And if Alverez was still in office that it would of never happened. Either way Fox will be shown how to make herself look like she was the right person.
JVD would have been remiss in allowing this drugged armed felon to continue to create mayhem and possibly murdee. Did the first shot kill him or the last. No reputable judge could possibly find him guilty of first degree murder. But on the other hand, the courts found TD to be a resident of Chicago while he lived far far away.
Not a lawyer, but she overcharged him...case is going to get tossed or bargained down. Anita knows this, let Foxx handle the mess coming. And all that nonsense about the other officers reports saying this and that...at that moment in time each officer wrote what he/she believed they saw. If all the officers huddled and wrote the same thing everyone would still be complaining they got together and lied. I hope Herbert is up for the challenge, he should win this case.

A special prosecutor is the worst thing that could happen for JVD. A Dan Webb type special prosecutor will have no allegiance to anyone except maybe the Loevy & Loevy types. Dan Herbert is no match for this type of prosecution, but the only real loser is JVD and his family. This is not gonna be good!

The video from this case is ugly. Police work often is. Way too ugly for the oh-so-soft millenial generation to handle.
Anita probably discussed this case with the subordinates in her office. Looked at the State statutes and case law and realized that this probably is not a 95% probably conviction. And wanted to bury it.
Would have been able to had not some judge ordered the video release.
Whoever the State's Attorney is will not directly prosecute this case. Leave it in the hands of experienced trial lawyers on your staff.
Which seems that a lot are bailing out. Either they don't want to work this case (its no-win for an attorney. If you get a conviction, you are anti-law-and order. If you don't you are part of the racist conspiracy). Or they don't want to work for Foxx. Or both.
While Foxx won the primary is virtually in, she won't take office until early 2017. Case won't start until late 2017 or early 2018.
Would JVD be better off pushing for a quick trial date? How much leverage does he have as he is out on bail? Or is the FOP lawyer dragging it out to run up the bill?

Is it too much to hope that this gets delayed long enough that President Trump can have the National Guard on scene and let them do what needs to be done when the dindus attack?

She had whose backs?!?!? She tried to FRY the Park Forest officer who shot the old man with bean bags. By all accounts he followed the department SOPs to a T. The officer was called to the scene from the station after all other attempts to defuse the situation had been unsuccessful. She went for that guy's throat. How do you even fix your lips to say she had our backs? Just because you have two candidates you don't want doesn't make one any better than they are...you just have one you can tolerate a little more than the other.

Anita Alvarez is an embarrassment
You sound like one of Alvarez’s ex cpd / current CCSAO investigators -flunkies getting ready to lose your job.
Alvarez has been nothing but an embarrassment since she assumed the reins of the states attorneys office
A few officers may have embarrassed their departments , but Alvarez embarrassed the entire county.
Need I remind of the other high profile criminal cases her office lost, especially against po’s? The railroading of innocent po’s, who at most should have been charged with misdemeanors or forced to resign?
Do I have to point out the prosecutorial overkill of the few convicted officers who got slammed with overreaching sanctions, while her office looks the other way and allow gangbangers, repeated convicted felons, to stay out on the streets and wreak havoc in every Chicago neighborhood?
She allowed charges to be drop against a politically heavy police hating black anarchist who was filmed punching out a uniformed po.
Let’s look at her shop
She has a high ranking states attorney being looked at for major ethics violation
One CCSAO investigator is charged with child porn offenses
Another was forced to resign after goofing off in a cigar store instead of investigating felony and misconduct cases.
Then her office botched that Nato 3 terrorism case
She loses five criminal cases against PO’s that her office cherry picks . Read between the lines
She has never prosecuted a politician. Chicago and Cook County must have some overwhelmingly honest ones.
She cuts and runs on the JVD case, and flip flops on a special prosecutor, in hopes she gets a judgeship or other special consideration done the road.
And that’s just the tip of the iceberg.
Alvarez should have been launched for no other reason besides her screw-ups, and the fact that she is a poster child for term limits.
I detest Kim Foxx, I think she will be a disaster. I’m supporting that republican Pfannucke or whatever in the fall. But keeping Alvarez in that office was a huge mistake.
