Due Process?

  • Fraternal Order of Police President Dean Angelo on Monday accused the Chicago Police Department of violating the due process of seven officers who stand to lose their jobs for allegedly covering up the police shooting of Laquan McDonald.

    In his long-awaited response to a scathing report by Inspector General Joe Ferguson, Police Supt. Eddie Johnson has moved to fire the seven officers for allegedly violating Rule 14.

    That’s the “If you lie, you die” rule that prohibits officers from filing false reports or lying under oath during the course of an investigation.

    Angelo complained that none of the seven officers have been told how they lied. That, he said, is a violation of due process.

    “They committed a Rule 14 violation based on what? What specifically did they do? What did they say? What did they write that puts them in that category? I don’t know. They don’t know,” Angelo said.
Did you know that you can't even put a prisoner in lockup without telling him what he's charged with? It used to irritate us a long time ago when the lockup keepers would ask jagoff, "Do you know what you're charged with?" It's like they didn't trust us. And the fact was, they didn't trust us, because they had been burned before. So now, their routine was to ask everyone. Once we worked lockup a few times, we developed the same habits...and tried not to work the lockup - it made us cynical.

To be hammered with 15 or 20 Department charges and not even be able to adequately prepare a rebuttal or assist your lawyer in mounting a proper defense is unconscionable. But then again, so is having a shooting ruled "justified" by eight or ten exempts who haven't even seen the inside of a beat car in decades, and then get dragged into a political maelstrom where the same guy who said "justified" months ago is suddenly driving a bus over your back.

Hey SCC and FOP 7

Why don't you ask some experienced members who have been stripped, transfered and sat in call back?

Beside myself I know about 7 officers and 2 Sergeants that went through this while they waited for the first
allegations to be served them. Mine took 6 weeks to be served by IAD. Then it took a good 2 months to be
interviewed by IAD. I complained to FOP 7 and was told that as long as I was being paid there was no harm.

IAD then did a second interview after 9 months. All the time I was stripped and sat waiting. Then one day
almost one year later. I am told to report to IAD where I was reinstated and walked down to Personnel and issued my ID and star. I was then sent back to my unit.

No Harm No Foul and no Due Process. I never was informed as to status or findings of allegations.
it was punishment with no responsibility.

I remember once they hit a copper with 30 charges... The copper answered all the questions they way guys answered questions during Iran-Contra, you know--- I can't recalled that, I can't remember... So they ended up nailing him with a charge of refusing to cooperate when ordered to answer a question given by a white shirts i.e. Sgt, Lt, Cpt--- and shit canned him.

I gotta say, I can always drive uber or lift... Don't have to deal with bs or CR garbage--- plus it's a pain in the ass to do a city complaint against one of those guys or a cab driver, call 311 and find out.. You gotta get that crap mailed to you and notarized

These lawyers employed by the city are the worst of the worst. They probably graduated at or near the bottom of their class and couldn't find employment with any respectable law firm or for that matter the county. The city looks at the quality of their lawyers and then decides they're all losers and pays out every claim. Look for these officers to be vindicated and get their jobs back with back pay. When that happens they should go after Rahm for millions, ala Mosby from Baltimore. And you can take that to the bank. Retired CPD.

Find out why Steve Patton the same one who orchestrated the 5 million dollar payoff by perjuring himself in front of the city council was involved in dictating who would be fired and who would be spared. Start asking questions. What was his role in the process. This was all an attempt to serve these coppers up on silver platter so no one would look at the mayor for withholding the video. No coppers lied. Joe Ferguson unfortunately will also be shown to be a biased partial investigator. See he had already conducted an "investigation" into this and without interviewing one person determined that everyone was lying. He publicly stated these opinions in the task force report so who does Rahm task with the investigation. Not Ipra, not IAd but the Oig the same person who already publicly stated his opinion in a readily available report. Conflict of interest maybe? Do you think the coppers got a fair and impartial investigation. It was a complete hose job designed to protect the Mayor and Patton. Next in line they get to appeal to Lori Lightfoot the chairwoman of the same task force that without interviewing one single person deemed the shooting unjustified and determined everyone was lying. Think the police board will be fair or impartial I think not. These coppers are getting railroaded.

I don't know if this is off topic but there's something that's never been mentioned (to my knowledge) in the whole Laquan McDonald brouhaha, and it involves the Knife McDonald refused to drop, to wit; ........

Has anyone thought, or brought up, the fact that a knife doesn't have to be within arm's reach, or have to stay in someone's hand to use as a weapon -- Knives Get Thrown, and can kill someone as easily as a bullet. Granted, a folding knife might not penetrate a cop's vest, but that just protects the chest. There's plenty of other vital areas that a knife wound will prove fatal if hit.

'Back in the day' we all carried a knife and we all practiced throwing them into trees as target practice, I used to be pretty proficient and continued practice with larger 'Hunting' knives as I got older. I know this isn't like it used to be 'back then', today it's all guns, but who knows what McDonald could do. If he was good that 12'-15' separation was/is meaningless.

Do you stake your life on it??? I wouldn't.

Please reach out to the coppers that have been stripped. They will not have the benefit of the doubt by being at call back until this is resolved. Every one of them is a solid officer and good person. They have been told they will be in NO PAY status as soon as this week. Regardless if you know them or not, this could have been any one of us. The department and the mayor are making them scapegoats. There are not not many of us that could survive very long losing our income and health insurance with one week's notice.

On another note, this department does not offer ongoing or scenario-based training that could help not only officers who find themselves in such situations, but would also help the City because then we might have fewer lawsuits..... Don't tell me that a computer-based video program constitutes adequate training.

In a word, our training regimen is ABYSMAL.

Fly oh the Wall: I have said repeatedly that this is coming from the Mayor. The superintendent is just following the direction from the 5th Floor of City Hall. I have also stated that there were mistakes in the Investigation itself and how it was handled. What you, SSC, have stated is 100% accurate. The Mayor's Office, the Superintendent Office, and Legal Affairs does not know how to handled this situation. It showed as SSC and Angelo stated, "Where is the Due Process in this matter?" What about following the contract between the City of Chicago and the FOP, how about following State Law regarding the Disciplinary Process in regards to Police Officers, and how about following the results of Arbitration? These are major errors the City is committing. Again, to the Attorney representing Jason Vandyke: Review the conduct of IG Investigators on how they conducted the investigation. They violated the contract, the law and procedures.

To set the record straight:
Today, I saw a video of 7 or 8 Black women fighting, kicking, scratching, beating each other in the front of a Wal-Mart Store. The video titled the Wal-Mart as being in Crestwood, Illinois.
So I phoned there and spoke to the head guy to see what Wal-Mart did about the situation (they best have filed charges on all of them for disturbances and for the bare feet--to stick with the charges and thru the courts--and to forbid those criminals access to that particular store for the future. Also, planned to mention my shopping experiences will be somewhere other than Crestwood-Wal-Mart. Turns out I didn't get that far. Manager said fight and video did not occur in Crestwood-Wal-Mart---that Crestwood does not have a Money Center incorporated into the Wal-Mart (see ads on wall). So, I searched for all Wal-Mart's in the Chicagoland area with Money Centers in them. There are 2. One in Lombard and one on US-6, Gary, Ind.

Your time as a Police Officer can end at any time always have a backup job in mind. I'm an ASE certified mechanic fix cars on the side in my garage, I also have a CDL and friends in sales auto/insurance business keep your options open. Always save money for rainy day try to save a years salary within a decade many in Chicago live on half of what we make. Retainer for good attorney is 10 to 20 thousand hopefully you will never need bail money anything can happen.

Fly oh the Wall: I have said repeatedly that this is coming from the Mayor. The superintendent is just following the direction from the 5th Floor of City Hall. I have also stated that there were mistakes in the Investigation itself and how it was handled. What you, SSC, have stated is 100% accurate. The Mayor's Office, the Superintendent Office, and Legal Affairs does not know how to handled this situation. It showed as SSC and Angelo stated, "Where is the Due Process in this matter?" What about following the contract between the City of Chicago and the FOP, how about following State Law regarding the Disciplinary Process in regards to Police Officers, and how about following the results of Arbitration? These are major errors the City is committing. Again, to the Attorney representing Jason Vandyke: Review the conduct of IG Investigators on how they conducted the investigation. They violated the contract, the law and procedures.

Somebody PLEASE get this post to VanDyke. This poster's been pretty dead-on in the past and is drawing a blueprint. Yes, the lawyers 'should' know this, but let's try to make sure they cover every base.

From FOP Contract Article 6
M. If, prior to taking an Officer’s statement, the Employer, IPRA or IAD is in possession of video or audio evidence relevant to the matter under investigation, it may, in its discretion, elect to advise or not to advise the Officer of such fact and, further, may allow or not allow the Officer an opportunity to review the video or audio evidence prior to taking the Officer’s statement. An Officer who is not allowed to review the video or audio evidence prior to giving a statement shall not be charged with a Rule 14 violation unless the Officer has been presented with the video or audio evidence and given the opportunity to clarify and amend the Officer’s original statement. In any event, the Employer shall not charge an Officer with a Rule 14 violation unless it has determined that: (1) the Officer willfully made a false statement; and (2) the false statement was made about a fact that was material to the incident under investigation.

That's why you don't pay the taxes when you contribute it. You pay them when you make withdrawals. Unlike you, who is filthy rich, I expect I'll be making somewhat less than I do now, so the tax bit won't be as bad, hopefully. Don't forget, that money is supposed to last many years, so, if you snatch out 100K the first year cause it's your money, you'll be taxed to death and broke, in short order.

The contract means nothing when they go after you. There is no statute of limitations. For Illinois court its 3 years, for the Federal Court system its 5, for CPD, there are no limits. Sure the contract says there are time limits, but look at the police board cases. They go over the limit and then say "no where does it say that if the city goes over the time limits on an investigation or forget to file an extension does it result in charges dropped against the officer. So why have limits in the contract if there are no consequences for the city for not following them. We need to have out unions fight for time restrictions that result in automatic dropping of charges after say 5 years. But the union says the same thing it has always said "your still getting paid" They do not talk about the depression and marital issues that arise by living your life for years in limbo.

Saw a news story about Dallas Police concerning the rule that officers involved in shootings have a 48-hr reprieve before interview/interrogation. According to the story, the officers will now receive Miranda, have the right to refuse the interview and be represented by an attorney. According to the reports, the DPD has said a police officer should have no less rights than a citizen and that the new rules are a just due process.

Guilford has escaped forced mandatory retirement TWICE...the first time for the SOS scandal (he was their commander when their shit hit the fan), and how this. Talk about a charmed life as an exempt, huh?

Don't be to hard on the guy. He does have a point. When you are younger have kids as write off, mortgages,etc you can be in a lower tax bracket. In addition your salary is less. When you retire and get 75% maybe a wife pension and social security along with 2 deferred comps you could be in a higher tax bracket. I'm not rich but paying a lot of taxes. Doesn't happen that often but does happen

The Dallas PD shooting interview rules were a 72 hour wait on questions of officers involved in shooting.

An activist group demanded çhanges. So the Chief changed the rules to just give Miranda rights.

The officers hasn't been presented with any charges or allegations and neither have they received a copy of the IG's mreport, and yet the supe recommended that they be fired. There's a protocol that must be followed EJ, but don't worry you reap what you sow and when Rahm serves you yours after you're done doing his dirty work you are going to need 10 shoulders to cry on.

When Deferred Comp and the other retirement plans were created they had great tax advantages, but back then there were many tax brackets, up to 90 percent. The theory was that when you retired you would be in a lower bracket and that was an advantage of not taxing the money until retirement. Now there are many fewer brackets so that you very likely will pay pretty much the same tax as when you were working. The 15 percent bracket ends at around 65K, but that is taxable income. Most of us will be in that bracket, so it will still be some savings. The 20 percent that they withhold when a withdrawal is made is just that withholding and if you are in a lower bracket that is what you wind up paying.
