Special Ed's Memo

  • The Chicago Police Department, pressured by a U.S. Justice Department investigation and public outrage over police misconduct, has unveiled proposed policy changes aimed at cutting down on the kinds of controversial uses of force that have plagued the city.

    The draft policies released Friday would further limit when officers can shoot fleeing people, restrict the number of times officers can Taser arrestees and compel officers to use the lightest force possible in any situation. The draft rules would expand on guidelines now in effect, some of which are comparatively vague.
  • The Chicago Police Department for the first time will seek the public’s input on proposed changes to how officers use force — proposals that already are worrying some cops, such as restrictions on when to draw a weapon.

    “We’re going to use less-lethal alternatives as much as we can,” police Supt. Eddie Johnson said at a news conference Friday.
All on a Friday afternoon....of a holiday weekend. Is this Department completely predictable or what?

Then you had Special Ed's "memo" outlining what was to come:
  • Let me be very clear, I understand the concerns you may have regarding use of force encounters. I have worked the very same streets as you. I understand the challenges and the scrutiny under which we operate. These policies were drafted to clarify response options that can be used while making split second decisions and contain information, most of which should already be familiar to you.
Really Ed? When was the last time you actually worked these streets? Three years ago? Five years ago? Ten years ago? Let's face reality here - you haven't worked these streets. It's changed Ed. We know what we did decades ago and we're pretty sure we know what you did decades ago, and it ain't happening now. So you haven't worked diddly-squat Ed. You're a politician now.

What worries us is that last sentence:
  • These policies were drafted to clarify response options that can be used while making split second decisions....
So you're going to take a relatively simple Order....and complicate it? You admit that these are "split second decisions" but your brain trust is going to add more information. Golly, won't that result in more hesitation? More second guessing? More coppers getting hurt and (God forbid) possibly killed?

Some other highlights from Special Ed:
  • Sanctity of life – In all aspects of their conduct, Department members will act with the foremost regard for human life and safety of all persons involved. This includes the requirement that officers comport themselves in a manner that conveys the gravity of any use of force, offering medical aid to those injured in use of force incidents, and intervening and reporting on a subject’s behalf when observing force being used in violation of Department policy.
Sanctity of life? What, the "preservation of life" policy was too godless? "Comport themselves"? So no high-fives and touchdown dances? Already there. Summoning medical help? We do that. "...intervening...on a subject's behalf when observing force being used in violation of Department policy." So....officers have to tackle another officer using what they determine to be inappropriate force? Or shooting other coppers now? What two-bit lawyer wrote this crap?
  • Ethical behavior - The Department remains committed to prohibiting and preventing the use of unwarranted or excessive physical force and expects its members to demonstrate the highest degree of ethical behavior and professional conduct at all times. Officers will engage the public with professionalism and respect the dignity of every person in carrying out their law enforcement duties, while ensuring that gender, race, ethnicity, or any other protected characteristic does not influence any decision on the use of force.
More about that pesky "ethics" from a guy who covered up a cheating scandal involving his betrothed and the wives/girlfriends/side pieces of how many bosses? And has anyone asked that copper in 015 if "race" played any role in her decision to take a beating rather than shooting the felon beating her unconscious?
  • Use of Force – While the legal standard remains that an officer's use of force must be objectively reasonable, necessary, and proportional to the threat faced by the officer, the new Department policy is more demanding than the law requires. Department members will now be expected to use the least amount of force necessary based on the totality of the circumstances and will only resort to physical force when no reasonably effective alternative appears to exist
So forget existing law and court decisions. You will be fired for a policy violation committed in a "split second" decision that you have almost no control over - the actions of another person. You know what a "reasonably effective alternative" would seem to be? Roll slow and/or retreat from confrontation. Brilliant.
  • Deadly Force – The use of deadly force (which now also includes striking a subject's head with an impact weapon or into a hard, fixed object) is only authorized to prevent an immediate threat of death or great bodily harm posed to officers or another person. The draft policy generally prohibits officers from firing into crowds, into buildings or through doors and windows, and at or into a moving vehicle, except in extraordinary circumstances. Additionally, officers may only draw and display their firearms when there is reasonable belief that such action is necessary for the officer’s safety or the safety of others.
You mean like if an officer is being strangled (threat of death or GBH), head stunning is authorized? We know of an officer who'd like to hear that one again. As for the firing into crowds, unseen targets, etc, no shit there Ed. As for the "draw and display," it seems someone has forgotten the "act, react" scenarios. Tactically, you act far faster than an opponent can react. Having your weapon handy cuts down on the reaction time and enables officers to more easily save their life, their partner's life and an innocent bystander's life.

Then it goes into "de-escalation," the new buzz-word that is going to get officers maimed and killed. It's a pile of crap and pretty much an order to avoid contact with the public, an end to proactive police work, slow roll to jobs, and retreat in the face of resistance. Dumb dumb dumb.

I've seen this crap affect a street stop after shots fired and the bad guy stopped was not cuffed or patted down....then he flees with the gun, ditches it and gets tazered.....charges: reckless and resisting......wtf. If I quit and get a ccl, am I tarnished for life if I shoot an offender because I was a police officer? Is ten years enough to receive a retird star and be able to carry nationwide?

How much more "Done" can this job be? We've all said numerous times over the last year "the job is done" Just when you think it's totally done and buried they bury it even more. Except now they dug it up and buried it at sea where it will never be found. Cops are going to get hurt. The politicians want the police to go out there and stop all the violence but if they make any mistakes they will hang the poor cop. It will always be the lowly street cop that gets hurt the worst and blamed for everything. No one should ever go to an award ceremony again with these people that will throw you under the bus while they sit inside physically and financially safe.

Someone with legal knowledge please chime in, but...

Federal consent decrees are basically (coerced) agreements between the US executive and other entities.

Does the President have the power to simply vacate these agreements, and free the hands of state and local police agencies?

That would make all the Communist front groups have to go through the legal wrangling all over again, with a much lower chance of success with a hostile public and Congress.  It would be glorious.

Evidently, Deputy Chief Steve Caluris is one of the authors. I remember when he was a UIC officer just waiting to get hired by the CPD. This person was a hard charging officer who frequently rolled on hot calls in the old 12th Dist & when ISP would need an assist. Sorry to see that he's now part of Eddie's gold star Buffon Brigade after his adapting mccompost to the CPD.
And SCC, you're absolutely correct to ask how Eddie can use the word "ethics" in any official document or statement while the stench of the Lie-tenants exam permeates 35th & Michigan.

Anyone pushing a beat car who takes out a loan of any kind and doesn't have employable skills beyond law enforcement is nuts . I predict that it will soon be difficult to find a beat officer with more than 5 years on the job and when you do they will in no way resemble a good policeman of even five years ago .

I am a former CPD guy who works as a LEO on the federal side... On the federal side, you have to document everytime you draw any type of weapon as well as document in depth what led you to do so... I seen a couple of guys lose their jobs for doing dumb shit and draw their weapon for no reason necessary. Oh by the way, the weapon you carry as a fed, is a government weapon--- you do not own it. I give it 10 years and CPD will be the same. More control over your actions if it's their weapon.

Upon arrival stay close to the truck/ladder while the white shirts (LT, Capt, or Chief) determine a course of action. Obey orders. Go back to house (hole).

WE all drive to and from work thru various neighborhoods of the city, some of which are similar or worse than roads in Baghdad. From time to time officers are victims of crimes while driving and it ahs been occurring more often these days.
May I suggest that officers purchase Dash Cams for their personal vehicle with sound to capture any assaults or incidents that they are victims of. Should you become a victim of road rage or a an armed robbery, this may be your ace in the hole to save you and your paycheck. The department and media will look to throw you under the bus and run over you, then back up over you to make sure they flatten you out.

Take a moment while on your route to work and imagine the possibilities that can happen. Now imagine if you had a video of any event to prove you were in the right and were a legitimate victim.

Nothing better than a video of a crime.

Stay safe and remain fetal.

Seems to me with each passing news conference regarding the Chicago Police Department, the media and the citizens have forgotten to ask 1 question. Superintendent is it true that you have members under your command and a significant other, that conspired with a former high ranking official in the department, to cheat on a test to gain access to a higher rank within the Chicago Police Department. If that did in fact occur, did you know that it was going on and what did you do about it when you found out? Do these cheaters/liars still maintain the rank that they did not rightfully gain?

So, if you and your partner stop a carload of "suspicious", (Reasonable Suspicion) young gangbangers, for say a blatant traffic offense, you and your partner should NOT have your weapons drawn? Since to believe that these fine young men, wearing color coordinated Gang Colors, cruising Da Hood, are probably searching for potential Good Deeds to perform. And to think of them as anything else is Racial Profiling.In addition to the traditional Life or Death, Shoot or Don't Shoot, the officer must now make a Purely Political Decision as well, all in a split second. So walk up to the vehicle smile, be polite and if they have their weapons drawn and shoot you as you approach the vehicle, you should take the shots with your weapon in its holster. When you think of it this way, it makes sense; the only people who would be upset are the family and colleagues of the deceased officers. No rioting, nobody's feelings hurt and it is much cheaper than shooting one of them. Remember, in a Democrat Party world, Perception is more important than Reality. A Cop's life has a set price, what the Feds give the survivors. Mookie or Flacko's life is priceless, the sky is the limit on what that is worth. This paragraph alone seems to clear the officer who gave a stun kick to the offender who was choking his partner while simultaneously attempting to hold back the hostile crowd. Has he been cleared...2,3,4, crickets.

No, police work is not dead. There are plenty of young officers in busy districts like 011, 010, 015, 025, 007, etc. who are still out there making street stops, traffic stops, etc. I can not even tell you how many times these kids get into foot chases and vehicle pursuits. They think this is a game while us older veterans know it is not. Yet, when you counsel some of them, they act like they are superstars and you are a dog.

If the use of force changes in the ways they are proposing, which I'm sure it will, if not even worse after the public's input, we should all adopt a new tactic of retreating from every situation until it's safe or everyone is dead. Why should we put our lives and careers and freedom on the line to protect anyone from a violent offender if every action we take beyond saying "pretty please be nice and don't hurt me" will be considered excessive force? Are there people armed with guns who will drop that gun at the very sight of a police officer? Yes. Are there people who would drop it if asked nicely? Sure. Are there people who would drop it if you point a gun at them and demand that they drop it? Yep. Are there people who will drop it if you use a taser or pepper spray? Maybe. But then there are those who won't drop that gun no matter what you say or do. There are those who want to shoot the police or other innocent people. What happens when we say pretty please to that person? How are we to know which type of person we're dealing with on any particular day in any particular situation? WE DON'T AND WE CAN'T! THAT is why the use of force policy allows us to use deadly force when presented with deadly force. THAT is why we can't use the least amount of force and gradually work our way up to whatever ends up being effective. We don't have the time or the luxury of waiting to see if that particular guy feels like shooting on that day in that situation. Using a taser on a guy with a knife could get you stabbed. Using an asp on a guy with a baseball bat can get your skull bashed in. We can't realistically use less force than is legally allowed without unnecessarily endangering ourselves and others. This won't end policing as we know it for everyone. There will still be those poor bastards who do what's right and legal, but get fired, indicted, and imprisoned due to stupid policies. Then there will be those injured and killed trying to follow these new policies. We already have that. It will only get worse. This is absolutely ridiculous and completely unsafe for the police and law-abiding citizens who we're supposed to protect. Get your concealed carry permits and shoot your attackers yourselves. We aren't allowed to help you as we once were. You have more power to use deadly force than we do now. FUCK YOU EDDIE!

I've had to sit at the defendants table in the Dirksen Building and the punitive requests had already been dismissed....I can't imagine the pucker factor if the punitive damages were still on the table.

At this point, stay safe and go home to your family. Until we get a mayor who will stand up for us, do nothing proactive. respond to your calls, write your paper and stay out of the trick bag Rham has made for us.

I am a former CPD guy who works as a LEO on the federal side... On the federal side, you have to document everytime you draw any type of weapon as well as document in depth what led you to do so... I seen a couple of guys lose their jobs for doing dumb shit and draw their weapon for no reason necessary. Oh by the way, the weapon you carry as a fed, is a government weapon--- you do not own it. There is a big difference between duties of a special agent and a street officer but I appreciate your insight. I assume you were fully trained in the use of force policy by your agency. This is a new policy and the department's training for officers on the street is horrible and somewhat non-existent. They rely on a 5 minute roll call video or a training bulletin. Legal affairs never includes the academy staff in training so recruits receive the bare minimum with any policy changes. The training for the ISR consisted of 50 officers in a room and could not ask questions. Look at the results; stops are down by 80%. The current de-escalation class will take years before they reach all officers. Yet I assume the new use of force policy will start in January without advanced training. Like I said, there is a big difference between a federal agency and the CPD.

Those rules only worked in GB because if someone did beat a cop they went away to a harsh jail for a very long time. Firearms were scares and British cops were not fetal about using their truncheons if it became necessary. Old Retired Guy Here Again !!! Please Indulge Me A Moment, With A "Good Old Day's Story. At one time, it was considered a very common practice to have your "Revolver" at the "Ready" position. Thank God, I never had to shoot anyone, in my 33yr. career. Certainly I was, as most of us,confronted with the situation where, Use Of Deadly Force, would have fit into the State Statute, and CPD use of Deadly Force. Having My Revolver at the "Ready" position, and God's Grace brought me through.
PS: Maybe the new motto of the CPD should be: "Oh No, We Are No Longer Expected To Be The "Police", We are just a "Police Monitor" ! We only let you know, when you need the Police.

I have read the entire 41 page report, and there is nothing really new in it, except for minimizing the number of times you can taze a subject. it should also be noted that the chokehold (long forbidden) is included as a deadly force option (meaning, if you're in fear of being killed, beaten unconscious or disarmed, which could directly lead to your death). You just have to be able to adequately explain whatever force you use
to gain control of a combative subject or an assailant. Stop the hysterics.

You are not thinking clearly. You might get away with this attitude and be able to retire, but the odds will be against you. The writing is on the wall, my friend. The department will not back you and will fire you if the fallout from your actions is great enough. They will fire you for violating department rules, not state law. It is coming . Be carefull. If you think that the union will save you or an appeal to the courts will reverse the decision, you might be in an uphill battle. I have seen cops who were wrongly accused of acts get fired and the decision upheld by the circuit courts. If they want your head they will get it.

Evidently, Deputy Chief Steve Caluris is one of the authors. I remember when he was a UIC officer just waiting to get hired by the CPD. This person was a hard charging officer who frequently rolled on hot calls in the old 12th Dist & when ISP would need an assist. Sorry to see that he's now part of Eddie's gold star Buffon Brigade after his adapting mccompost to the CPD.

I don't know anyone who has ever seen Caluris run out on any hot calls in more than 20 years. Whatever proactive actions you've 'witnessed' Steve do must have occurred many decades ago...All he's known for now is taking up space in the exempt food chain.

Is there any way for you to appeal directly to homeowners and biz owners with this? You'll get nowhere with the politicians, obviously, and the media doesn't give a damn because it is so leftist, but I really cannot imagine that people paying exhorbitant amounts in taxes will be pleased that the protection they think they are paying for is getting its hands tied behind its back. These moronic policies are leaving decent, law abiding people all over Chicago wide open to being preyed upon by thugs. I don't think they are getting the full story on it either or understand the scope of how bad it is because the venues that SHOULD be exposing it (the media) are in total collusion with the lousy politicians and "community."

I doubt the FOP will do much (it seems to pretty much roll over and take whatever is dished to it), but is there any way that enough concerned LEOs could pool resources and buy some ad time, something, ANYTHING, to get word out about this nonsense and get people enraged about it? How about volunteering to speak abotu the problems at biz organization meetings, the VFW, the Am. Legion, etc. You need a direct appeal to the public. Pitchforks need to come out, and soon, before the city slides any further into the abyss.

I worked until the day I retired at age 60. That was 9 years ago and things were different then including Special Ed. He had been a sergeant then in Area 4 and was a good boss. Things change, the job and obviously Special Ed. The was this job is now, get out when you have 20 years and 50 years of age. The city don't care about you or us retired guys. They took away our health insurance by the end of the year, even though when I came on they said they would pay it for life. The job was always political but now it's past that. Pandering to the people we all had problems with to the point of "Having your back" now means with a knife in it. Stay safe and wear blinders until you can retire guys and gals.

Is it not absolutely mind blowing that the streets are borderline out of control with gun toting hoodlums at a time when the cities homicide rate is spinning out of control and the department wants us out on the street using butterfly kisses and unicorn piss to aid us in taking active resisters into custody. In the rare instance that I've gotta wrestle somebody into handcuffs, I will continue to do what I need to do in order to get home safely at the end of my tour. Or maybe if I'm challenged by a potential arrestee I'll just throw up my hands and " de escalate " the situation by walking away and going to lunch.

How can we take the department of justice (or injustice) seriously when they cannot adequately investigate a certain political candidate who has committed so many obvious criminal acts and illegal violations regarding national security? Think about this; would you give it your all in a game such as baseball, football, any other competition, if you were made aware before the contest that you have already lost the game? Didn't think so. You would play the game in a manner that ensured your safety and move on. Do the same here at work.

I am a former CPD guy who works as a LEO on the federal side... On the federal side, you have to document everytime you draw any type of weapon as well as document in depth what led you to do so... I seen a couple of guys lose their jobs for doing dumb shit and draw their weapon for no reason necessary. Oh by the way, the weapon you carry as a fed, is a government weapon--- you do not own it. I give it 10 years and CPD will be the same. More control over your actions if it's their weapon.

It should be on recording what is said at roll call , how desk officers treat citizens and outside units .
In 6 outside units are required to write ibonds for traffic violates while desk crew eat , play on computer or watch tv

Please tell me you're not this fucking dumb. That's not how the use of force model works. If you're justified in using a taser, and it doesn't work, you use force at that same level. You don't go up a level because one option didn't work. An active resister who doesn't stop resisting after a taser zaps him a few times is still just an active resister. You're still only allowed to use the level of force authorized for an active resister. You don't get to use deadly force on an active resister. You have no idea how the use of force model works. You have no idea how to use logic. You have no business putting yourself in a position to use force. Please hide behind a desk somewhere or ask to go back to the academy to be properly trained. You're a liability and a moron. You and others like you are the reason cops end up on the news and on trial.
