Well Lookie Here

  • The Pennsylvania Supreme Court ruled Monday that Pittsburgh Police officers don't have to live inside city limits.

    The decision overturns a long-standing city residency requirement upheld in January by a 4-3 ruling in the State Commonwealth Court.

    Attorneys representing local police argued now and in the past that officers should be allowed to live outside the city for their own safety. KDKA reports that included the freedom to be more selective when considering area school districts.

    Pittsburgh Mayor Bill Peduto said in a statement Monday that he disagrees with the high court's decision.

    "We want our police officers to continue to live in the neighborhoods and communities that they serve," he said. "We defended the will of the residents of Pittsburgh, all the way to the Supreme Court, believing that the law that allowed Pittsburgh to become a Home Rule Charter city should have taken precedence."
And they beat it over Home Rule?

This comeback from the local communists is hilarious:
  • Brandi Fisher, director of the Alliance for Police Accountability, echoed Peduto. She said having officers live in the city creates a sense of community.

    "Building real relationships happens when you can see people at the store, when you live in the same neighborhoods, in the same communities," Fisher said.

    It's ironic, she said, that officers would choose to live outside of the city to access better schools and housing.

    “It just goes to show a mentality towards the people in the city," Fisher said. "If your feeling is that its poor housing, poor communities, poor schooling, then you already have ... some sort of disdain in the way that you’re looking at these communities.”
So, "We've done everything in our power to neuter the police, make your job as dangerous as possible, demonized you from the elderly all the way down to the children. We've ruined the schools, taxed you to the eyeballs and celebrate when you get shot, maimed or killed. Now you cops have the audacity to want a better life? You better sit right here in Shits-burgh and be miserable with all the rest of us!"

Aldercreatures are selling out the formerly "quiet" neighborhoods favored by cops, firemen and other city workers.

This is a non-starter in Springfield, but we've said it before - everywhere a local FOP has sued, they've eventually won.

I have an idea on overturning the residency issue. There are a lot of us that hate being trapped living in the city and who feel we are punishing our children and spouses. Why wait for the FOP to say that it can not be challenged?

I am for setting up a collective legal fund ourselves and retaining a competent attorney to file a lawsuit. Based on the legal precedents nationwide we will win. Talk is cheap, let's get it done! If we all contributed $500 to the fund, setup an organization and retained counsel we can win!

I know that a lot of officers want to move out of 016 as fast as possible to escape the public housing projects and their devastating effects on our property values, safety and quality of life. Six Alderman want to destroy our lives, our neighborhood and our families. It is time to move out of Chicago and the only way to do this is to hire our own attorney.

I am betting that Fire will jump on this too.

Just think of the joy of living in Glenview, Morton Grove, Park Ridge or Niles.

Why not sue over residency? A simple google search shows Calumet City FOP Lodge 1 won in court despite the city being home rule. Pittsburgh FOP just won despite home rule. Numerous departments have won the residency battle via court. Is there some Illinois law preventing CPD from negotiating residency, and then suing when the city refuses to negotiate residency as part of collective bargaining?

Milwaukee is another city that lost its ability to shackle its officers. Just a means to stabilize neighborhoods, increase property taxes each year and ultimately recoup wages through a variety of taxes. Even more so when the spouse works.

Think how much Chicago will lose in property taxes for all the taxing bodies, the City Stickers, the fines, the fees, the sales taxes, the entertainment taxes, etc etc if the city workers were allowed to legally live elsewhere?

If Chicago loses the fight, which it won't because all the judges owe their souls to the Machine, it will hasten the downward spiral to the level of Detroit.

Yeah i had no problem staying in the city when i did, but now since i got on the job i got to see how fucked up the city is with its corruption and how its being run ! I just can't wait to leave. The South Side of Chicago has changed so much in the last 30 years. Areas that were once nice and quite are now crime ridden.

I really don't see the City of Chicago getting better. Seven more years for me. When I leave I'm going somewhere that doesn't tax the crap out of you.

When I get there they will be happy that a person who doesn't ask for any government services and keeps up his property. They are going to welcome us with open arms.

I just can't wait. It will be going, going and I'm gone too!!!

There isn't a municipality that has lost this challenge in the past 7 yrs. The prescedent has been made by multiple supreme courts. If our union actually grew a set of nuts we'd all be able to gtfo out of this tax ridden hell hole.

It's not a Springfield issue. Home rule cities in Illinois can choose wether to have residency or not. If Rahm was on board it could change very quick. New mayor in 2019 is the best chance to this happening.

Was for residency and believed the city will be ruined if lifted.... boy was i wrong after the zoning passed yesterday for the large section 8 building in 016 im done. The city is ruined not because of lifting residency but politicians. How dumb do i feel arguing with young cops about how "we knew we have to live here when got hired". Im willing to admit i was wrong i have less then 7 years and instead of carring about property values all i care is that my family survives this narco state known as chicago. Fuck it! Id rather loose a few thousand than lose a loved one .

The case won in Michigan was won along party lines. Ruling was 5 to 2 and this will surprise you the Michigan Supreme Court is made up of 5 republicans and 2 democrats

When Rahm first ran, he implied that he would not be adverse to removing this restrictive policy, which is an archaic form of indentured servitude. Now I realize there are people out there who will say: "If you don't like it leave.", and there are also coppers who are concerned, that their concrete patios on the northwest and southwest sides of the city will suddenly be worth less, if City workers are allowed to leave. Yet, there are other issues at play here. Many of us have seen our "work" as a calling, I dare say a vocation, so we tolerate and have tolerated conditions that would not be acceptable to most citizens. So the "just leave" or quit argument is weak. As for property values, we are seeing dynamics today, that did not exist in past White Flights. Automobile ownership is in decline and "snowflakes" who in some cases will not even apply for a driver's license are going to be tied to the cities. Yet, all of this ignores the other issue, and that is our families. Are we selfish to have careers that put our families, especially children in a situation that denies them the innocence of childhood in a safe environment? It first hit me many years ago, when I went to the wake for an Irish copper's son. The son had been in a Latin Gang and was shot to death at 17. So I am at the wake, and see this White kid in the coffin, dressed like a gangbanger, and the grieving female Latina gangbangers crying; and it seemed odd for a White copper's family, but this is the fate of a kid growing up in Da Hood. Would this kid have been in that coffin if he had grown-up in say Naperville? In recent years, how many copper's kids have we seen killed, basically because they lived, worked and grew up in Shitcaga? Then, I went to a high school graduation for an in-law's kid, in a small town in Michigan. The kids were polite, the school was great and she had a full scholarship to a good college. Now this relative makes less than half of what I made, but his family had a great life and his kids were wonderful. I see coppers working three jobs and paying over $30,000 a year for parochial school tuition! My in-law makes $40,000 a year and his wife works part-time jobs, THEIR GREAT SCHOOLS ARE FREE! Which family is better off? Many people, do not realize that Catholic high school tuition is in the area of $14 to $16,000 per year! Two kids; do the math. Unless your kid is a nerd or you have clout, the average copper's kid is not getting into Northside College Prep. And here is the irony; the issue of Race always come up in any topic related to Shitcaga; yet on this one the Worst Impact is upon minority coppers! When they knocked down the "Jets", (Housing Projects) many of those residents took their vouchers and moved into what used to be Middle Class Black and Latino neighborhoods. The Residential bungalow villages in Mt. Greenwood and the Northwest side do not have a density of vacant apartments. So the impact and danger that those Urban Refugees produced impacted most on minorities in Black and Latino Middle Class and Working Class neighborhoods. So here are some of the issues to take into account, before rushing to judgement on the issue of Residency. Also note, several years ago an IAD Sgt., who was primarily tasked with catching coppers living outside of the city, was caught himself, living in the burbs! Now repeat the mantra: "Its on da Legit!" Be prepated to pay double or triple your property taxes. Crack the checkbook open for even higher water and garbage collection fees. Oh dont forget the code violation cars, so next time you decide to do a "small" remodel job make sure you hide any evidence or you'll be fined. We should be taking this all the way to the US Supreme Court. No one in any capacity should be forced to live in certain places. It's totally antiquated. At the very least residency should be lifted after 10, 15, or even 20 years of service.

Just a citizen. I don't understand why CPD is shackled by a residency requirement. In addition to Calumet City Police, I know Lynwood, Lansing, Homewood, Dolton officers do not have residency and all with the exception of Lynwood are home rule communities.

I live in Indiana and have many of these fine officers as neighbors living in my subdivision. Some have take home cars or are K-9 officers. Two of the officers who live in my community are African-/American. They have told me they must live within a 1 hour drive of the community in which they are employed.

They are seeking safe neighborhoods, good schools and all have expressed to me being anonymous.

I grew up in Calumet City during the 1970's and my family moved to Indiana in 1983. At that time Calumet City was a great community with residents of Polish, Italian, German descent living there and as a kid, I rode my bike all over town with no worries.

Calumet City is now a shithole destroyed by Section 8 housing, foreclosures, poor schools, bloated City Government and terribly high property taxes. I had two small rental buildings which I had for sale for over 4 years which I could not sell after lowering the price six times. The cost of compliance with ridiculous City rental inspections, fees, water bills, tenant damage made them a nightmare.

Since I was unable to sell the buildings, I ended up donating them to an African-American Church from Chicago that uses them for apartments for members of their congregation. I took the loss on my taxes and moved on.

This past December, about 1 year after I completed the donation, I drove past the buildings. They were both vacant, boarded up with plywood and one had fire damage in the back. There is no pride of ownership left over there. The Democratic City Government exists to squeeze the last dollars out of citizens unable to escape it. This is the future of Chicago.

Do you seriously think that Rahm would just allow us to live where we choose without getting something in return?

Just what are you willing to give up to live in the suburbs? Future pay raises? Less vacation time? He will want concessions. And do you seriously think that we will all band together? Fight the good fight? HA! If past contract negotiations are any indication, the city will drag it's feet, knowing that all they have to do is wait. Wait until enough time has passed and then bring up the subject of RETRO PAY and then they'll have us, simply because there will be too many coppers drooling over the aspect of that retro check to look at what we could have had if we held out or what we will lose if we sign on to it.

The only way to get this done, is to go to the Federal Supreme Court and please say out of the State Courts that are packed with these Dem's who don't give a shit about the Police and their families. The Dem's know we for the most part do not vote for them and will stick it to us in the State Courts. Do a Federal Law Suit for discrimination in the pursuit for happiness.

The FOP could easily fight this. File a lawsuit, every other department in the country has lost when trying to keep officers in their cities. Sadly it's probably going to have to come down to an officer or a few officers filing a lawsuit, because the corrupt FOP wants residency too. If an officer want to stay in Chicago, then so be it; however, if an officer wants to live in Indiana and drive 2 hours a day to work, then that is his or her right as an American!

I agree and believe forced residency is antiquated and unconstitutional. However, our shaddy Illinois Supreme Court is comprised of mostly Chicago "machine" democrats. Hard to believe right? For instance, Alderman Burke's wife is one of them along with another female judge that Rahm campaigned heavily for. So it's a long shot

Ahh residency sounds good, but don't spend much if any on it just look at supreme court in Springfield all controlled by Madigan rahm and crew! Take an internet journey look at some of bastions of former peace and safety who have allowed the illegal criminals and section 8 menace to invade and after paying $1015 thousand a year in taxes having the menace next door in your schools!

Friend bought a new home in Naperville all set, paid over $475,000, directly next door who moved in? Bunch of middle easterners, dirty, 3 families he put house up for sale had open house watched as people drove by did not even visit after looking at next door which will ruin this area!Talk to Naperville coppers for example, look at shootings and crime stats all the drugs coming in heavy crime rising again troll the internet!

Take a look at Woodfield mall Schaumburg area how is that bastion? Oh look over here mall is shit section 8 apartments everywhere the element fleeing Chicago relocating!

Bottom line the old adage applies "be careful what you wish for you just might get it!"

Now if your destined to move best way to look at area drive around all hours, drive around business area all hours, drive by schools and parks frequently and most important the Blue line is the best gauge of areas talk to local beat coppers, as we know our areas they know theirs and best of luck to all mostly God bless the police officers everywhere!

Chicago is one of the last cities to uphold this residency requirement, yet we still have the highest crime rates of anyone in the United States! If the Chicago police are in need of new officers and struggling to recruit enough, abolishing this ridiculous requirement would surely fix that. Nobody wants to live in Chicago anymore with the bad schools, high taxes, an rising crime rates - and what officers would want to live near, and often in the same neighborhoods, as the dangerous criminals they arrest? It isn't safe, IRRESPONSIBLE of the city to require this of their officers, and things will NOT change until they allow the CPD to live outside city limits. I don't believe there has ever been a case where enforcing residency has won. It is Unconstitutional to make someone live somewhere they don't want to live. However, municipalities can require first responders to live within a certain distance of their job i case of emergency. Our problem is it is in the CONTRACT. So, we technically give up our right to live outside the city because we agree to live in the city via the contract. Now, the FOP could make lifting residency a demand, but these are negotiations, and the city would come back and say sure, we will lift residency, give up your raise, all of your protections if you get in trouble, pay for your insurance, etc. The question is what are YOU willing to give up to get rid of residency? It is not about hiring lawyers, it is about changing the contract and all most coppers stupidly care about is the retro check.

I have an idea on overturning the residency issue. There are a lot of us that hate being trapped living in the city and who feel we are punishing our children and spouses. Why wait for the FOP to say that it can not be challenged?

I am for setting up a collective legal fund ourselves and retaining a competent attorney to file a lawsuit. Based on the legal precedents nationwide we will win. Talk is cheap, let's get it done! If we all contributed $500 to the fund, setup an organization and retained counsel we can win!

I know that a lot of officers want to move out of 016 as fast as possible to escape the public housing projects and their devastating effects on our property values, safety and quality of life. Six Alderman want to destroy our lives, our neighborhood and our families. It is time to move out of Chicago and the only way to do this is to hire our own attorney.

I am betting that Fire will jump on this too.

Just think of the joy of living in Glenview, Morton Grove, Park Ridge or Niles.

I live in a community adjacent to the City of Pittsburgh and we absolutely welcome any Pgh Police Officers interested in living in our safer,cleaner, healthier community. It's not perfect, but we're friendly and not snobs. Housing is very reasonably priced and the commute to work is easy. Peduto is an idiot, who has driven people away from the city. Companies relocate to the suburbs, and adjacent counties.

Anyway, congrats to Pgh Police and you Zone 5 guys, move a couple miles into PH and it's 1000% better. Take a drive around, it's 20 sq miles and we have farms and all sorts of stuff you never see on tv. We'd love to have you as neighbors!

as a retired CPD who moved out the year after I retired, it is a decision that I have never regretted. It is nicer out here, more open, nicer homes, although taxes and fees are a burden at times. My kids are long grown so no need to worry about schools. But, my grandkids are out here and go to public schools and they seem very good, and, for the
most part, tuition free . If you have a large family it would be cheaper out here then paying 12 grand for private schools. But, don't fool yourself. Drugs are also a big problem in all of the burbs. And, gangs are out here also, although not as bad as in the city. There are tradeoffs. i was happy in the city when I was younger, but when I retired i wanted a condo with a little more room and they were not to be found in the city. I really do not think that there would be a mass exodus if residency was lifted and i don't think there would be a large loss in property values. That has not happened in other cities where residency was lifted.

Lets make this happen. So many benefits outside the city. You can acutally walk without a fear of getting hit by a stray bullet. You dont have to pay 12k for private hs. It doesnt take you 30 mins to drive 5 miles. My friends that moved from the city to the burbs never complained. Its a different world out there. I would drive an hour to work to live in will county. It takes an hour to drive from northside to the southside of chicago to go to work.

I know of several officers and supervisors who have their families living outside of the city limits now, yet the officers reside in the city. The only person obligated to live in the city is the one employed by the city. What can the city do if the family lives elsewhere yet you, the city employee, rest your head inside the city limits on your work days? What laws or department rules prevent you from visiting them on your time off? Here's something else. Aren't the spouses and children of city employees harmed by the residency requirement?

Most suburbs are safer and quieter with better schools. Indiana and Wisconsin are cheaper and safer. But, do you want to spend 3-4 hours a day traveling? I'm saying residency cuts both ways. Bottom line. YOU should live wherever you choose.

Hey boys and girls it's all relative. You can live in the burbs and pay even more in property taxes. But then you don't have to pay for school until college. Your travel time to and from work/court increases, more money your paying out. It's something to definitely try to get next contract. I'm more focused on pay increases, better equipment/training for us, funding our pension etc. Or how about simply the judges and city actually enforce the legal system that is written as law. Before the last FOP president election, I was at a roll call where Dean Angelo was asked about residency. He started chortling, laughing, and turned over his shoulder to look at Kevin Kilmer who was also chuckling. I'm glad they found it so funny. They probably needed a good laugh since they probably knew they were going to lose in a landslide. And deservedly so.

It just goes to show you, that the last FOP regime did not take residency seriously at all. I'm not sure if the current one will. In any case a suggestion from the comments above that we police officers should retain an attorney on our own and push to overturn this rotten Rule and law is the best action. But of course, the biggest Advantage for Rahm is that we coppers are all too cheap to hire an attorney on our own. We expect that FOP to do everything for us.

other comments above that the Illinois Supreme Court may be stacked against our cause are probably accurate. However, if the Supreme Court of the land chose to hear an appeal after the Illinois Supreme Court rejects our case, it may just go our way. Milwaukee is another city that lost its ability to shackle its officers. Just a means to stabilize neighborhoods, increase property taxes each year and ultimately recoup wages through a variety of taxes. Even more so when the spouse works.

Think how much Chicago will lose in property taxes for all the taxing bodies, the City Stickers, the fines, the fees, the sales taxes, the entertainment taxes, etc etc if the city workers were allowed to legally live elsewhere?

If Chicago loses the fight, which it won't because all the judges owe their souls to the Machine, it will hasten the downward spiral to the level of Detroit.

Perhaps in the short term, but this decision indicates that if brought to a higher court the
Illinois supreme court decision would be laughed out of the courtroom

I moved the wife and kids out to the suburbs a few years back and sold the Chicago house.
I rent an apartment for my work week and my residency requirement.
I hope they take away the residency requirement, but I'm sure glad I will not have to try and sell a house in the city worker filled neighborhoods.

However, if the Supreme Court of the land chose to hear an appeal after the Illinois Supreme Court rejects our case, it may just go our way. I believe the US Supreme Court ruled previously that residency is a state issue, not a federal law. That's why all the residency cases are being fought on the state level instead of on the federal level

Legally, a landlord cannot turn down a person with a Section 8 voucher but there's a couple ways to get around it.

Tell the prospective tenant that you (the landlord) are looking for the best qualified tenant based on their credit report and you just started taking applications. Odds are that the Section 8's tenant's credit isn't good and you can move onto the next tenant.

Or

Don't have your apartment meet Section 8 inspection standards. My friend who does rehab work had a landlord tell him that his apartment building failed an inspection due to minor things such as minor peeling paint and torn linoleum tiles on the kitchen floor. HUD can't force a landlord to make repairs unless they're paying a portion of the rent.

I have an idea, if you get on the job you would have to stay in the city for at least 10 years. I would have to say some coppers would stay depending on where they stayed. some would probably love having the option to move after 10 years but might not be able to move because of housing availability. The turn over rate would stabilize to a constant flow of officers coming and going.

In most of them, mine for instance, you cannot buy or sell a house until the city code inspector goes over your house looking for violation or construction work done improperly or without a permit. Everything will then have to be brought up to code. You cannot even install a hot water tank without a permit, or a furnace, or an electrical outlet. Everything costs.No off duty fireman doing construction work out here unless they are licensed, insured and have a city permit.

When Rahm first ran, he implied that he would not be adverse to removing this restrictive policy, which is an archaic form of indentured servitude. Now I realize there are people out there who will say: "If you don't like it leave.", and there are also coppers who are concerned, that their concrete patios on the northwest and southwest sides of the city will suddenly be worth less, if City workers are allowed to leave. So the "just leave" or quit argument is weak. As for property values, we are seeing dynamics today, that did not exist in past White Flights. Automobile ownership is in decline and "snowflakes" who in some cases will not even apply for a driver's license are going to be tied to the cities. Yet, all of this ignores the other issue, and that is our families. Are we selfish to have careers that put our families, especially children in a situation that denies them the innocence of childhood in a safe environment? It first hit me many years ago, when I went to the wake for an Irish copper's son. The son had been in a Latin Gang and was shot to death at 17. So I am at the wake, and see this White kid in the coffin, dressed like a gangbanger, and the grieving female Latina gangbangers crying; and it seemed odd for a White copper's family, but this is the fate of a kid growing up in Da Hood. Would this kid have been in that coffin if he had grown-up in say Naperville? In recent years, how many copper's kids have we seen killed, basically because they lived, worked and grew up in Shitcaga? I see coppers working three jobs and paying over $30,000 a year for parochial school tuition! My in-law makes $40,000 a year and his wife works part-time jobs, THEIR GREAT SCHOOLS ARE FREE! Which family is better off? Many people, do not realize that Catholic high school tuition is in the area of $14 to $16,000 per year! Two kids; do the math. Unless your kid is a nerd or you have clout, the average copper's kid is not getting into Northside College Prep. And here is the irony; the issue of Race always come up in any topic related to Shitcaga; yet on this one the Worst Impact is upon minority coppers! When they knocked down the "Jets", (Housing Projects) many of those residents took their vouchers and moved into what used to be Middle Class Black and Latino neighborhoods. The Residential bungalow villages in Mt. Greenwood and the Northwest side do not have a density of vacant apartments. So the impact and danger that those Urban Refugees produced impacted most on minorities in Black and Latino Middle Class and Working Class neighborhoods. So here are some of the issues to take into account, before rushing to judgement on the issue of Residency. Also note, several years ago an IAD Sgt., who was primarily tasked with catching coppers living outside of the city, was caught himself, living in the burbs! Now repeat the mantra: "Its on da Legit!" This poster makes a good point. The government is spreading out section 8 everywhere, and not just in Cook County. Parts of DuPage and Lake Counties has the same crime problems, all be it on a smaller scale, for now. And the city will not allow you to move to Wisconsin or Indiana

The neighborhood? AUSTIN!
My family lived there until 1967 or so. There was a neighbor on LeClaire who was an Irish cop(from Ireland) in 015. He died many years ago in his early 50's.

Our property taxes keep going up just like in the city but did you know that, where we live the water/sewer fees are cheaper. The W/M garbage pickup is cheaper. Our city stickers are two years for half the cost of the city. Our neighbors are all nice and happy. We had a nice, well kept house in greenwood amongst the once a month grass cutters and decade past proper painters. The city changed since I was hired. My word means something and I agreed to live in the city and expected nothing in return for my unclouted self. If we and the FOP were smart we would go into contract negotiations attempting to get as big of a salary increase as possible. Also limit the discipline procedures as much as possible. Regarding property values dropping if the residency requirement is lifted...there are $13,000 officers out of a population of 2.8 million, so they account for <.5% of the population. Even if every officer sold their home (which they wouldn't, at least not at the same time), it would be statistically insignificant. Also - not every officer owns a home, some rent & some are living with family, so it would be even less than that. Whatever Chicago has been doing has not been working and I firmly believe that Graham is our only hope at fixing what has been broken for so long.

First of all gramps, I'm probably older than you. Secondly, many generations of people successfully researched major life decisions ( choice/location of career) prior to the internet. It's obvious that you took this job solely to brag to your suburban childhood friends that you're a big bad city cop. Probably made them cream their Schamburg HS gym shorts with war stories of your rough nights directing traffic.

Most of us knew that we were accepting a job in a city full of corruption and a department full of the same. If they lift residency, great. If the department stops promoting based on clout and dick sucking, fantastic. But if your dumb ass didn't know these factors were in place prior to making your career move to the big city, you dug your own ditch.

Or maybe you're one of those guys from the far northwest side who never went south of Devon until you were able to carry a gun to protect you from people you didn't grow up with.

005 I lived at 16 W 110str. My dad was a fireman we moved to MGW in 70s. He came hove one morning and told us they burnt our old house down. It's church parking lot now.

Holy shit. You have absolutely no understanding of numbers..5 does not equal 50. .5% is .5%, as in 1/2 of 1%. 50% is 100 times that, as can be seen by multiplying .5 by 100. You're confusing some very basic math concepts here, and it worries me that you may be the police. We're not supposed to be mathematicians by any means, but this is simple shit. How did you even get into high school, let alone graduate from it?
