Trib Steals TASER Story

The Tribune is going to owe the Chaplains a crap-load of money this month, stealing numerous stories from the blog, like this one:
  • The Chicago Police Department has tightened its policy on Taser use, rewriting the rules to discourage officers from shocking people who are running away or otherwise vulnerable to injury.

    The change drew little public notice when the department enacted new use-of-force policies in October.

    The revised order was issued a month and a half after a Chicago Tribune investigation detailing the department’s reliance on the weapon pointed out that the rule changes the department had announced did not specifically ban shocking people who simply run away and pose no serious threat. That prohibition has been adopted by other large police departments and endorsed by reform advocates and use-of-force experts who note that Taser shocks can cause people to fall and sustain devastating head injuries.
Here's an idea - don't run away from the police. Obey the lawful orders to stop and cease resisting.
  • There's a 73% chance that Foxxx won't charge you
  • and another 78% chance you'll make bail, even on murder and hate crime charges
  • and another 82% chance you beat the charge at court.
The Trib gets this part correct:
  • But five months after the new rules were unveiled, the department issued a Taser policy containing a lengthy revision. The order now includes a section that advises officers not to shock people who run away, are intoxicated or could fall and suffer a head injury, among other things.The new language stops short of firmly banning Taser uses under those circumstances but says that “when practicable, department members should avoid” those uses.

    The department’s force policies are significant not just as guidelines but because they dictate conduct that can lead to discipline for an officer.
But they draw the wrong conclusion. The order doesn't "dictate conduct." It pretty much puts an officer in the trick bag for any bad outcome arising from the conduct of the criminal. If we understand Newton's Law of Motion and his Law of Universal Gravitation, a TASER doesn't negate these realities when muscular paralysis is introduced into the equation, so why carry or use a TASER that will only lead you to Federal Court? They even cite this example:
  • The rule change is a step in the right direction, said Dominique Franklin Sr., whose 23-year-old son died after an officer deployed a Taser while trying to arrest him for allegedly stealing a bottle of vodka from a downtown convenience store in 2014. Dominique Franklin Jr. fell and hit his head on a pole, suffering a fatal head injury.

    His father called the rule revision “bittersweet,” because it comes more than three years after his son died. He said he suspects little will change unless the department’s culture also changes and discipline grows more reliable.

    “Too many cops do stuff because they feel they can get away with it,” he said.
Leaving aside the dark humor this episode provided, dear old dad's quote provides an eerie insight into today's troubles:
  • "Too many shitheads do this stuff because they feel they can get away with it,"
No chases? Car jackings skyrocket. No bail restrictions? Recidivism explodes. No serious jail/prison time for theft, robbery, UUW? Guess what's popping up all over the "quiet" and "safe" neighborhoods?

But if they take away yet another tool that prevented cops from having to go "hands on" all the time and suffer injury after injury after lawsuit for "beating" someone instead of "subduing" a resisting criminal, well - we're seeing the results of that now, aren't we?

With all the non-learning at CPS you think they could cobble together a cheap presentation on STOP and DROP:

STOP if a police officer tells you to stop and
DROP the gun, if you have a gun in your hand.

If all the AMISH would be taught this, there would be a LOT more lives saved than any other program or non-lethal weapon used.

Maybe with all the FREE handouts - breakfast, lunch, and dinner programs that go on, maybe before they get their food - they need to repeat that mantra before they get handed their snacks and treats?

Three Now-Former Deputies Indicted For Murder In Taser Death

"Former Deputies Rhett Scott, Michael Howell, and Lee Copeland have now been charged with felony murder, involuntary manslaughter, false imprisonment, aggravated assault, simple assault, and reckless conduct, according to WMAZ. Warrants have been issued for their arrest.

The charges stem from a Jul. 7 incident when a homeowner called 911 to report Martin, who suffered from schizophrenia, as a suspicious person after he asked the homeowner for water."

The video is very poor quality with no audio. The video seems to be the only evidence.

Apparently, the officers intended to take the subject into custody as an arrest or a psychological patient. Every time an officer puts his hand on the subject pulls away.

The Grand Jury (States Att/prosecutor) thinks the subject should not have been tased.

Haven't we been trained to use the taser in this situation? Note, he was zapped on grass, not the street.

What should the officers have done?

If you let the schizophrenia walk away, anything the mental does after the POs let him go is on the officers.

He was tased because of his actions (resisting arrest) to avoid being arrested for stealing the bottle of vodka. The criminal escalated the incident from a simple arrest to a situation requiring a taser. Engaging in a fair fight is not part of the job of a police officer. They are allowed to use tools to avoid the possibility of being injured or battered. That includes using a taser on someone who decides to fight to avoid an arrest. They habitually convolute the facts to put a negative spin on any situation and give the illusion that the police are the bad guys and overreact to any situation. Libtard bastards make it harder and harder to do this job every day. The message seems to be that for everyone that does not voluntarily put there hands behind there back and submit to arrest we should allow them to make good there escape. Well, you got it shitcago. There have been many detailed examples on this blog over the years that should cause officers to come to the conclusion that nothing good comes from being proactive.

Even IF being proactive results in a quality arrest...video, cooperating witnesses, admission of guilt on ERI, and a guilty plea, there offender WILL STILL receive a short sentence, if one at all.

Unfortunately, far too many coppers choose to ignore what is right in front of them.

In the unlikely event you arrest someone the court is just going to let them go. The same goes for jails, why bother other than to give them pizza. The good thing is, the vast majority of people who post here who are active (and some retired) are not, and have never been "proactive" or what used to be considered the real police. So litigation from police actions should likely be lower in 2018.

In one of the LA surburbs a deputy sheriff was chasing a 17 yr old on a ATV vehicle and pulled along side him and tasted the idiot while both were doing 15 or 20 miles per hour and the goof srruck a parked car and was killed. The deputy (who is a licensed attorney) has plead not guilty to murder and related charges.

This department should have welcomed a non compliance policy just as other agencies have. If a person does not comply after being ordered to stop, use the tool the same way you would use a night stick, just from a safer distance. Case closed.

Come on now, the taser is a good tool---with a downside. Been to a "guns drawn" situation lately?, I have and the taser was used to subdue the individual- no shots fired. However, my sense is that it has fostered a "hands off " culture--where some police are neglecting to use physical control tactics---instead they enter into prolonged bartering exchanges- never taking command.

The perversity of this nonsense begs the question: Why do we even have Tasers? If you deploy it, the onus is on YOU to justify its use. If the suspect gets injured (he most likely WILL!), YOU will have to prove there were no other options available (ie, this was a last resort). And if this was a last resort, then YOU should have been able to use your sidearm, and the outcome would almost certainly be better! Tasers usually do not produce the desired outcome, much like the failure rate of OC spray, which are simply "fillers" added to the Use of Force Continuum, introduced to obfuscate and confuse officers and issues involved in real life use of force situations, so administrators (do-nothings) that haven't done any police work in this millenium (if ever), will have some method to criticize (Monday morning quarterback) what YOU did on the street. It makes absolutely NO SENSE to use a Taser in a deadly force situation (ie, against a knife or gun), so what's the point in adding more weight to your duty belt? Why offer a suspect yet another weapon to try to take away from you when he fights you to avoid apprehension? If he tries to use your Taser on YOU, and YOU shoot him, YOU will go to prison, like that officer they made an example of in SC last week. And the media won't even mention the part about the Taser, just that YOU shot an unarmed man for a traffic violation. The admins could make it clearer, but they won't! Instead of just getting rid of these useless doorstops, they insist on keeping them available for YOU (face it: THEY NEVER used one nor will they ever!). Since you are pretty much forbidden to use them (by the trick language they employ in their written policies), you might as well not even have them with you.

Bottom line: You can't use a Taser!

The Trib story only focuses on a few of the new guidelines and ignores the rest which are the problematic ones. The guidelines are written in classic vague weasel words designed to make ANY use of the taser problematic if the reviewing authority decide to make it so (ban without banning) or as remarked elsewhere outcome based as decided by the political winds of the time. This was not written to benefit the PO but provide cover for the management to arbitrarily declare “good” or “bad” use of force no matter what actually occurred.

**WARNING** This is what the mayor, politicians, revs, democratic, and leftist public want:

They want you as a police officer to risk your life even further by second guessing yourself about using a taser and only use it in the most dangerous situations when there is an immediate threat of death or great bodily harm. You know, the situations that you should NOT be using a taser for and using your firearm instead. But yeah, they would rather you stop using that altogether and replace anytime you think about using your gun with a taser. In other words, they want you to use it only when you would be justified in using lethal force because of a very small % chance that the offender might die or be injured. That way, there is less of a chance of a successful lawsuit if you were authorized to shoot him and you tried to taser him. To all of those groups, police lives do not matter. They will not be marching in the streets against the offender that took the life of a police officer. But some career criminal, well, how dare you not give him every chance in the world to escape or kill you instead. They will flood the streets to protest you not allowing him to kill you if you end up shooting him.

Hillard was a trip.

On his last day as Superintendent, he approved and signed off
on every recommendation for suspension time that had piled up
in his in basket.

Several sources confirmed this.

Yeah... Discipline has to be meted out but what he did
and how he did it raised a lot of eyebrows.

Word was he had put a brick on a few sharp black
Sergeants and Lieutenants because they were sharp.

But he promoted a whole bunch of dunces.
Then again, which Superintendent DIDN'T do this?

Sharp bosses might fuck up an agenda.

And absolutely nobody actually sharp and savvy
will be allowed to outshine any clout-beast/
merit mook Superintendent.

When Hillard stepped down, there were a few
who Shortshanks wanted to be Superintendent
but they very wisely opted for retirement
instead of being the face associated with
the ruination of CPD.

As an aside, counsel for the defense made a fool of him
on the witness stand during testimony regarding the
Ryan Harris murder investigation so your assessment
of "Intellectually Disinterested" is on the money.

Everyone that got taser qualified took 2 tests! One from city one frome taser! That was to cover citys ass cause taser says u cant tase peeps city claimed u can! They had you take that test on purpose to cover them for city lawsuits! Now they put it in writing! Fop should have boycotted tasers then!

Just let your taser certification lapse. It's way too confusing to carry anymore. No tool on our belt should require multiple pages of legal caveats.

2 years ago at 51st street range for firearms qualification, the range instructor gave us a 10-minute Taser "re-certification". She told us then that we were better off just throwing the thing at an arrestee. It used to be that smart officers could work within the restrictions our GOs placed on us; find ways to nail offenders while still playing by the rules of law and the GOs. I lost interest in that challenge years ago. Copa, under rahm's orders, wants your head. They will not get mine.

I hope the city lawyers really don’t believe that like you do. Taking the tests don’t protect the city at all. The city has deep pockets and will always be sued. Police have been 100% wrong and the city gets sued. That’s were the moneys at. No matter what the city does it’s alsays improper trading, code of silence not taking action against the officer for previous incidents
Look at the latest. Detective is intixicated, kills to guys and the city just lost a big lawsuit.
