- In a rare move, a Cook County judge has ordered Mayor Rahm Emanuel to sit for a sworn deposition in lawsuits stemming from the controversial police shooting of a baseball bat-clutching teen and an innocent bystander.
Lawyers for the city had waged a sustained battle to prevent Emanuel or police Superintendent Eddie Johnson from having to give statements under oath, but Cook County Circuit Judge James O’Hara ordered Wednesday that both must give depositions in the coming weeks.
The ruling comes more than two months after the city’s police oversight agency determined that Officer Robert Rialmo unjustifiably shot and killed Quintonio LeGrier, 19, and his 55-year-old neighbor, Bettie Jones, while responding to a domestic disturbance on the West Side in 2015. Johnson has yet to determine whether he will adopt the disciplinary agency’s recommendation and seek Rialmo’s firing by the police board, and volumes of litigation over the shooting are still pending.
As veterans of numerous lawsuits will recall, anything and everything is fair game in a sworn deposition. It doesn't matter what the questions are - your lawyer can object - but you WILL answer the question and a judge will determine its relevancy at a later date. Rahm's own Corp Counsel showed this last week when they asked if LeGrier's mom conceived him as part of a financial transaction. Insulting? Sure. Out of line? That's for a judge to decide.
So now we'd like to see a list of questions that Rahm (and Special Ed) should be asked. We'll start with a few:

- Special Ed, in your roll as part of the "exempt review" process, why did you along with Garry McCarthy rule the shooting as justified? You were the Chief of Patrol, correct?
- Special Ed, who else reviewed and justified the shooting? To whom did you report your findings? Via phone call or e-mail? Was the mayor of his office part of this notification process?
- Mr. Mayor, when did you become aware of the existence of a video? When did you see it? Who notified you of its existence? Via what means?
- Mr. Mayor, who told you about this alleged "Code of Silence" and what proof did they offer to its existence? You are the only member of the chain-of-command to admit it exists and it seems to start and stop on the 5th floor of two different buildings - Police HQ and City Hall. Why is that?
- Mr. Mayor, why did you apologize then and why do you continue to apologize for an incident your handpicked exempt staff ruled justified? Does this not undermine not only the staff you put in place, but the taxpayers of the City of Chicago?
- Mr. Mayor, in regard to the officer's lawsuit allegations that training is and continues to be an issue with the CPD, along with a DOJ finding of the same, why is it that your Department has undertaken a massive new "training regimen" that will culminate in 40 or more hours of mandatory annual training in the next few years? Isn't this a tacit admission that the officer's lawsuit is completely true? How will you be paying the officer - cash or check?

One of the most dangerous bills I have ever read, HB1664, has been passed by Illinois House of Representatives and is in the Illinois Senate. I have dubbed HB1664 the ‘Snitch Act’. The bill establishes a dangerous person’s hotline with which anyone can turn in another person they think is dangerous. The Illinois State Police are then supposed take a person’s FOID card and firearms, shades of the KGB and Gestapo. Heinrich Himmler is gone, but Vladimir Putin is still with us. The Russians are really good at this type of clandestine operation. Who knows, we might see Vladimir Putin picking up a few extra bucks moonlighting for the State of Illinois.

HB 1465 (MUSSMAN) – Creates confusing tiered ban on sale/purchase/transfer/delivery/possession of rifles and magazine clips that fire more than 10 rounds to persons under 21.
Sec. 24-1.9 broadly defines “assault weapon” as any rifle that can accept more than 10 rounds of ammunition or is a .50 caliber rifle, but also includes handguns. Includes many firearms used by junior shooters at gun clubs and competitive shooting matches.
Sec. 24-1.9(c) states anyone under 21 that currently owns or possess an “assault weapon” must relinquish it within 90 days.
Section 24-1.10(b-5) states all large capacity magazines owned by a person under 21 must be relinquished immediately.
HB 1465 would make persons under 21 felons unless they relinquish their legally purchased and owned guns and magazines…a possible violation of the 4th Amendment to the US Constitution.
Silent as to where or how to properly relinquish prohibited firearms and magazines.
Out-of-state gun owners (regardless of age) who bring any legal firearms into IL could be found in violation if visiting IL longer than 24 hours (subsection d-4).
Creates a 4-tiered standard for firearm transportation: one for 18-21 year olds; one for hunting/shooting competitions; one for non-residents (which could be in conflict with current IL conceal carry law); and the current standard for IL residents according to the Unlawful Use of a Weapon statute.
Appears to limit where persons under 21 may shoot a rifle to Sparta shooting complex, or similar competitive shooting events, due to transportation restrictions (but no exemption for recreational shooting by those under 21 at gun clubs or gun ranges).

Unlikely Emanual will ever testify. Most likely a significant monitory offer will be made and settle the case at the very last minute. A move that will sell everyone out, but keep him off the stand under oath. Most politicians cannot tell the truth, ever, so putting them under oath with criminal consequeaces is rare;if ever. They are snakes, spineless snakes and charlatans. That's all, so if he's not allowed to tell tales, and speak half-truths and understatements then he cant speak. Johnson will most likely testify, he's expendable, but h ell use the Mayors attorneys, and will have advanced memory failures speak of uncertinity to the facts, and be unaware of a lot. Who actually decides who will release video footage of police incidents? Who is directly responsible for starting that process? Who controls it? Who oversees it? When there is chicanery, much less obvious delay and obvious covering up of video existing, who has the authoroty to cause delay, outright hiding of this evidence and so far destruction of it?

Here's a question what do you mayor have on trump? He was all boisterous when running fir president about the illegals here and the crime and has done nothing at all! Many find it strange in California ICE is taking out many, sessions was there yesterday and suing the state officials as it is a sanctuary state just like Illinois has become!

Court Rules that Shooting by Romeoville Police Officer Was Reasonable
Judge Rebecca R. Pallmeyer of the U.S. District Court for the Northern District of Illinois granted summary judgment in favor of a Romeoville police officer in Hinch v. O’Connor, No. 15-C-9316 (Feb. 15, 2018). Plaintiff Charles Hinch claimed that his Fourth Amendment rights were violated when Officer Michael O’Connor shot Plaintiff while he was operating a motor vehicle and drafting another officer, Officer Scott Stutler, through a crowded parking lot.
The events started in the evening of November 28, 2013, when Plaintiff dropped his neighbor, Robert Russell, off at department store knowing that Russell “does a little shoplifting” and that it was possible that he would steal merchandise. As Plaintiff waited in the store parking lot for his neighbor to exit, the police received a 911 call that Russell was observed Russell concealing merchandise.
The two officers responded to the call of a retail theft in progress at the store dressed in fully visible police uniforms. A police dispatcher advised the officers that one of the two offenders (later identified as Russell) was headed towards the store’s south entrance. Officer Stutler observed Russell exit the store, look in his direction, and start running, and the officer gave chase on foot yelling, “Stop, police.” Russell continued to run and entered the front seat of Plaintiff’s vehicle. Officer Stutler reached into the vehicle and grabbed Russell in the chest area, ordering Russell to stop.
Plaintiff knew that Officer Stutler was a police officer and that he was trying to arrest Russell. Nevertheless, at Russell's urging, Plaintiff drove the vehicle while Stutler's arm was trapped in the vehicle's door dragging Stutler through the parking lot. Meanwhile, Officer O’Connor, who was in his squad car in the parking lot, observed Officer Stutler chasing Russell. When O’Connor exited his squad car, he observed Stutler struggling with Russell, Stutler’s arm trapped in the vehicle, and Plaintiff driving away, dragging Stutler.
Officer O’Connor yelled, “stop, police,” but Plaintiff kept driving. O’Connor believed that Stutler would be sucked underneath the vehicle, run over, and killed. Thus, Officer O’Connor concluded that the only way to save Officer Stutler’s life was to discharge his fiream at the driver’s side of the moving vehicle. Plaintiff was shot in the elbow, the vehicle came to a stop, and Stutler was able to free his arm from the vehicle. As a result of being dragged, Stutler suffered injuries to his right shoulder.
The Court held that Officer O’Connor’s use of force was reasonable in light of the circumstances. The Court reasoned that O’Connor’s use of force was authorized because he reasonably believed that Officer Stutler was in imminent danger of death or serious bodily injury and that Plaintiff’s conduct posed an active and ongoing threat to Officer Stutler’s safety which did not stop until he was shot. The Court also held that Officer O’Connor was entitled to qualified immunity because it was not clearly established in 2013 that a police officer could not use deadly force to prevent a fellow officer from being dragged by a vehicle from the scene of a crime. The Court granted summary judgment in favor of the officers on Plaintiff’s claims. Mike Bersani and Tara Grimm represented the police officers.

Today at an exempt training FatHead Ed came in and and berated the district commanders for putting 2 and 3 Ppo's with a single FTO. He told the commanders that "they" should have never allowed that practice to start and it's a stupid idea. He then said that an AMFN message will be coming out mandating that each commander use their leadership to "convince" officers to sign up to be acting-up FTO's. He chided them and said if they send a negative report then THEY will be the acting FTO. He also said "don't send me the name of the copper nobody wants to work with, because he will know"
They asked for volunteers from the Sgt list, the Det list and then those who weren't on any list. When they couldn't get anyone to do it now they are threatening the commanders to get names or else!!

Last Tuesday in Berwyn a young mother driving to work was killed in a head-on traffic accident that was not her fault. She was killed by a drunk driver named Jose Zamada Gaugin. If Jose is an illegal, which is most likely, the sanctuary state of Illinois will not turn him over to ICE. He will be allowed to make bond and he will flee to wherever he has citizenship. A similar circumstance recently occurred in the sanctuary city/state of Denver, Colorado. This nonsense has to stop. Durbin, duckworth, Rauner and 9.5 are all sanctuary advocates. We must defeat them all at the polls to regain some sanity in our state of Illinois.
