- Chicago police said they found a loaded handgun lying in the grass along Recreation Drive near the car where two gangbangers were hanging out late Friday night. But prosecutors refused to file weapons charges in the case because the gun couldn't be tested for fingerprints on the weekend, police said.
Instead, Alfonso Fierro and two friends are charged with being on park property after hours and other minor offenses.
Fierro, known as “Little A,” is currently awaiting trial for allegedly possessing a loaded handgun in a car this winter. And one of his other arrestees is a felony gun offender.
What are the chances this wasn't actually his gun? Zero? Next-to-zero? So Kim is using either CPD non-staffing or ISP Crime Lab hours to not charge these goofs.
Wait a minute - where was the ATF NIBIN van? That super van that's supposed to be available weekends to print guns, shell casings, recovered evidence in order to charge gun offenders promptly? Or is that just another reelection ploy that doesn't really mean holding gu offenders accountable?

Ease up, SCC. This sort of thing has happened to police officers well before Foxx ever was elected. If you didn't see the gun in the creep's hand, all you have is found property/handgun. We don't always nail the bad guys we run up against. Karma will catch up with this subject soon enough, and it's even better when they are taken out of the game permanently by one of their own.
What goes around, usually comes around.
Has anybody reading actually encountered that ATF van? If so, has the van had any success stories? Probably a NO to both questions.

I know forensic's is short but they had no one to throw some powder on the gun. It might have taken six hours to get an ET but they would have done it.
This was always a big problem when a gun was recovered and you wanted to link it up with a suspect or offender. No matter how many times you told officers not to handle or unload the gun they did. Don't know what the protocol is now but before you called for an ET. The ET did not process the gun for you as dusting for prints on the scene would not reveal prints. They would give you a special gun recovery box, you put the gun in it hand carried it to Homan (E&RPS) and requested it would be laser printed by the ISP lab which was a five step process. We would write a request with the box for this to be done. When we would check up on it we found out the guns never made to the ISP lab as the people in the CPD crime lab would test fire the guns therefore destroying any prints on the gun. And even if CPD officers see a gun in an offenders hand and recover it and think their eyewitness testimony in court is good enough they are mistaken. We had a few like this where the judges and jurors don't believe their testimony. The want a lot more according to a few ASAs. So why even bother when the deck is stacked against you. Keep driving, waving and smiling!

I'm sure the investigating officers left the weapon undisturbed and requested an ET to recover it. That way, the pistol would've been swabbed for the presence of DNA and then forwarded to Latent Prints, perhaps resulting in ridge impressions suitable to make an identification resulting in the double whammy of possession.
Oh, what's that you say? The investigating officers contaminated the evidence by handling the pistol because they thought the glory that accompanies Boxes #1 and #2 on the inventory would elude them by following protocol?

And we all know the NIBIN van was nothing more than an act in the CPD Dog & Pony Show thanks to some extra federal money procured out of thin air. CPD's firearms lab has the exact same capabilities. What it doesn't have is a lack of prima donnas unwilling to work weekends - my area's evidence coordinator has been protesting this fact for years.
And herein lies the rub: at the end of the day, what does it really matter? An airtight case would probably still result in a finding of not guilty here in Crook County.

Not charging offenders encourages continued violation of existing criminal statutes and possession of firearms with a required FOID. Made the mistake of turning on NPR this morning 4-5 . Got to listen to some really disturbing liberal bullshit about what is happening in Cali at the moment and how there is no "rioting" like if Ferguson and Baltimore and how there was a really "tense" moment when the protesters were chanting and yelling in the Police Officer's faces but the Police "deescalated" the situation by retreating down an alley while the blm asswipes were chanting " whose streets our streets" and of course pointing out that the "protesters" broke off a group to enter an intersection but were called back by "others" in the group. Trust me, I get your point about the termination. I've been on 31 yrs and this department has gone south in MANY ways!!
But in regards to the shooting, I'm gonna guess that this was not a completely innocent "victim" and her companion may be a little on the shady side himself. 2:30am?
Playing devils advocate, I'd be fuming if the jagoff being chased by the police t-bones my daughters car with my granddaughter inside and kills either or both.
I get the thrill of the chase and the pussification of this department, but the death or catastrophic injury to innocent people in the name of making an arrest just isn't worth it.

I heard the whole chase lead car were idiots didn't even no how to call out the pursuit. If you are on i55 call out the exits as you pass them. It was embarrassing to listen to the idiot call it out as he was calling out mile markers! I kid you not! But then again why are you chasing or doing any type of police work at all. Stay fetal!
Thought guns in city were illegal? Going to start carrying mine when I visit from Indiana. Better to be judged by 12 than caries by 6. Willing to work weekends? I didn’t realize we had that choice. I’m going to see the district commander in the morning and inform him I’m not will to work the weekends. I thought that was only the front office people that had that choice

Exactly! I had a similar situation a couple of years ago w/some gang members. My suggestion was a couple of contact cards and a found property report. My partner wasn't happy but we did just that. I know in his heart of hearts he knows I made the right decision.

This is becoming the norm. POs in 010 tonight get a call of person with a gun, given a description including hat, jacket and pants. POs see offender and go to investigate when he bends down and they hear a metal object hitting and scraping concrete like a handgun sliding on the street. The detain the bad guy and go to location of him bending down and discover a handgun. They have the caller come and give a posture ID as the guy they saw with the gun. ASA rejects charges at this time and tells the POs to call back when the gun is tested for prints because the felon said it wasn’t his gun. This will continue to happen and will lead to blood on the hands of Kim Foxx and her minions of ASAs.

Yes sir, I agree. I tell all my civilian friends or people/acquaintance the truth if they ask. I tell them we are not allowed to chase, even if I see a person shoot someone in the head. If the person takes off and even taps another vehicle, I have to terminate. People are shocked and don’t believe me. People are so brainwashed by the media they believe coppers are out running and gunning, brutalizing innocent minorities. Truth is, the job is dead but a some coppers and most citizens don’t know it yet.
this kind of thing has been litigated previously all the way to the illinois supreme court. if the best you can come up with is physical proximity to the gun, it just does not fly. the prosecutors were correct not to charge.

Really? If any officer with a shred of experience thinks this is a chargeable and provable case you're an idiot. Two guys are in a van and there is one gun in the grass outside the van? I'm also guessing no statements and no other evidence? You gotta prove knowledge and possession....this case has neither. Even the best Judges at 26th street would direct this piece of shit out. You did your job of getting the gun off the street, and were stuck with the facts that were there. Nothing wrong with that. You'll get them next time.
