$16 Million - Move On

  • City of Chicago lawyers have reached a proposed $16 million settlement with the family of the innocent bystander shot dead by an officer who fired at a teenager carrying a baseball bat in December 2015, according to multiple sources with knowledge of the agreement.

    The tentative settlement with the family of 55-year-old Bettie Jones emerged late last week with the lawsuit’s trial date looming at the Daley Center courthouse. The city is still scheduled to go to trial this week with the survivors of 19-year-old Quintonio LeGrier, who approached officers with a baseball bat as they responded to a domestic disturbance. Officer Robert Rialmo fired, hitting LeGrier and accidentally striking Jones, killing both.

    The settlement is among the largest ever for a shooting by Chicago police, though the circumstances — a churchgoing grandmother killed by a bullet intended for another — have little comparison in city history. The proposed deal, which will require City Council approval, is the latest in a string of multimillion-dollar payouts by the city in lawsuits alleging police misconduct or excessive force.
Not comparable assholes. There has been no finding of misconduct or excessive force in the death of Jones - it was a tragic outcome. Wrong place, wrong time, and while that does not diminish the loss suffered, neither should it be license to slander the police due to the accidental nature of her death. No one intended for Jones to be injured or killed, but she was placed in that doorway by a family unable to deal with the hellspawn they created via years of abuse, neglect, apathy and indifference.

We can disagree about the payout - high, low, correct, whatever. But removing Jones from the equation should allow the City to better defend the legal and proper actions of the Officer when confronted by a bat wielding assailant.

As tragic as this may be, the officer did nothing wrong and Quintonio was the cause of her death. I can stomach a payout of a couple million if need be, but this is beyond excessive. Taxpayers are once again on the hook for one's criminal actions. This is nothing more than campaign financing paid by taxpayers in order to gain the votes of the black voting block. Once again, a tragic occurrence, however, taxpayers should not be held accountable for Quintonio's actions.

This is a tragic circumstance the mayor should make a payout out of his campaign funds. The mayor closed multiple mental health centers it is totally his negligence that is causing all these mentals to lose their minds without proper care. He does whatever he wants he closed over 54 public schools, now he is spending billions building brand new public schools in many areas, where the capacity has diminished due to people fleeing the city.

Then we have the sexual assault scandals throughout the Chicago public school system, why are some of the predators allowed to retire get their pensions and not be prosecuted? Unreal settlement. I have a friend who's grandson was electrocuted by accident while working for a power company. 25yrs old, 2 kids under age 3, and was making about 80K a year. Total combined payout from various entities held responsible along with SS for the kids,and workmans comp. until 18 was around 5 million. How many pols and connected ones are gonna stuff some cash in their pockets after this setlement?

Where do they come up with these outrageous lawsuit payouts? It was always explained to me (by lawyers) in a wrongful death lawsuit, they take your worth. So if you made 500k per year, your family gets more. They're paying millions and millions to families who had family members killed and I highly doubt made tons of money. It's insanity.

$16,000,000 / 25 years of work is the same as making $640,000 each year. That is way more than any top surgeons make.

So now her family gets to live large because she made the mistake of being at the wrong place at the wrong time. If it was up to me, the family would get my sympathy and a lesson to stay out of the way and let the police handle the situation and that's all.

$16 Million is the number Rahm arrived at adjusting for inflation in the three years since he awarded $5 Million to the family of McDonald, under the cover of night and with the election safely in the rear view mirror back in 2015.

The Mayor followed a forward trajectory using this simple premise: McDonald was young and still could have fucked up even more than he had, so his estate was awarded a lower dollar amount. Bettie Jones, by all accounts, had lived 55 years as an upstanding citizen. Therefore, subtracting 17 from 55, and multiplying it by X, the Emanuel administration arrived at the number, based on that number, then further multiplying in on the rising cost of market forces surmounting against the Mayor from the black community, with the multiplier being .3677.

It's Rahm math. It doesn't have to make sense. It just has to be paid by you and me.

As far as the innocent grandmother who was so precious only 16 million could begin to compensate for her loss, I would like to see how many crimes her spawn and their spawn have committed, and how much taxes they've all paid compared to the benefits they've received. Hate to say it but she would never make this in a lifetime and neither will any one on this job. This is just way too much. 2-5 million would have been more appropriate. Quite the timing, the settlement that is, though tentative, how many council members are going to object? Two, three?
If anything needs reform it’s Tort.
Besides Term Limits for Elected City Office, Tort Reform comes in a very close second.

Where’s their “justice” for being unintended victims of the unchallenged to this day, Chicago Cook County deliberate and intentional gun violence and restorative justice handouts?
Oh, there were “laws” passed.
Laws that effect only the law abiding citizens.

If anything, monetary compensation should come from the campaign pockets of the elected, appointed and the responsible catalyst not the taxpayer general fund. Make it the police fault. It’s these political hacks giving away money that they only control and are not necessarily wholly entitled to.
Leave these compensation settlement pacts to voter referendum and not politician whim.

FunFact:
$16,000,000 is approximately the annual real estate tax revenue generated by just 2,300 single family homes on the far NW side.
Approximately 8,000 Rahm TinyHomes could be built (on the far NW side) to house almost all of Rahm’s growing unwashed homeless voter contingent.

Blaming the police is easy.
Stay Fetal, arrive safe enough to take reports, advise warrants and refer community members to seek legal outlets for resolutions to their many problems.

The answer is simple, but you won't like it. The credibility of the Chicago PD is at an all time low. Does not matter whether it is deserved or not.

It would be different if there was video showing the guy with the bat actually attacking the cop who fired the shot, but without such video, it is just the word of people the average citizen has lost faith in.

The city probably figures that they get into federal court that there is serious potential for an even bigger award by the jury just to make a point.

There is also the problem of a whole series of wrongful conviction cases that are about to hit. The sheer number is going to make CPD look even worse. And juries are composed of human beings. They may well feel the need to punish CPD today for things that happened 20 or 30 years ago. you want to be the lawyer defending this case after 20 or 30 or more people have their convictions overturned?

It's based on previous settlements for wrongful death by this and other Police Departments. I would guess that many top plaintiff's attorney's would rather take it to trial also. Potential for a larger settlement.

The only one who will get their money here in one lump sum is the attorney. The family will get what's left of the $16 million in the form of an annuity over 20 years or more. They don't publish that but that's the way it is.

In May 2018, we gave $41,000 in assistance to Chicago Police families in need, including:

$20,500 in education assistance for sons and daughters of Chicago Police Officers who were killed or catastrophically injured in the line of duty

$2,200 in financial assistance to Widows of CPD Officers killed in line of duty

$4,600 in financial assistance to Police Officers in need

$1,000 in financial assistance to Police Officers on disability

$1,100 in Police Memorial assistance

In addition, the Chicago Police Memorial Foundation provided assistance to the Gold Star Families, the Chicago Police Survivors & for Gold Star Families Memorial and Park Maintenance.

Total assistance given in 2018: $368,000

Family or spouse receives one year of deceased officer's full salary. Then it goes to 75% widow's pension, tax free, for life.

Kids get a free ride in school.

No, they don't become millionaires. Neither do they scrape by for groceries. Still bitter? Stay safe. Maybe you would rather get a job in the steel or aluminum industry.

I got through the career more or less safely. Retired 5 years. Over $300,000 paid to me so far, for not working. Plus the part time job I do, wearing a smile. I have no complaints, but that is just me. The further I get from the job, the better I feel.

I check out SCC to catch up on all the whining and complaining I don't fucking miss one bit.

Take it easy boys and girls. There's a good life out there. If you can't enjoy it while on the job, sorry for that. If you can return to the human race after retirement, after about a year you'll see what I mean.

Nitwit, no one gets a check for $16 million. It is an annuity. After lawyer's fee, expenses etc, the family gets the rest over 20 or 30 years. That's how the City pays these large awards. Lawyer gets his in one lump, no one else.

Rarely does anyone suing the city get their dough in a lump sum, one check.

Rahm is getting the money now being paid into the pension fund, per state law, from the money that formerly was used to pay for retirees health insurance. All you still on the job will suddenly say upon retirement, "What the fuck, I get no retiree health insurance?" That's right. The City put the FOP in the health insurance business. You choose between the blue Cross plan they put together or the Aetna. But you pay. And if you are not on Medicare, you will pay more.

Haven't people been reading that Trump wants to cut Medicare? Yup. Ot just leave it to run out of money. Then retirees can go back to the cat food diet. Better make plans on insuring yourself upon retirement.

The lawsuit against the City by Krislov is just about in the tank. The latest big decisions have all gone against the retirees. And coppers being coppers, few were sending any money to Krislov to fund the lawsuit.

Didn’t the Illinois Supreme Court rule in 2014 in favor of the state employees lawsuit saying their retiree health insurance was protected by the state constitution? Then when ours comes before them, they refuse to hear it. What does that tell you?

Not sure except that our retiree health insurance was never in the contract. It was "an understanding," that everyone took to be a "Promise." Both Daley's stuck to it. This jagoff Rahm had to come up with pension money on that yearly catch up shit enacted into state law. He got the money from canceling the retiree insurance.

He found out he could cancel the retiree insurance so he did and said "sue me." We did, but all we had was sort of a "past practice" thing and it was heard in the Daley Center courts, not Federal Court. Contact Clinton Krislov's office and get on the email list to stay informed. The last email I got was a "this isn't looking good" sort of thing. You can send a check for $50 or $25 because there was nothing else paying the bills. We paid the bills by voluntary donations. I sent him $300 since he filed the case.

Wait till you retire and find yourself without retiree health insurance. Probably you'll complain about democrats again and wonder why "someone doesn't do sumpthin'". I try to get people interested but most are like you. Can't be bothered and think you're being cheated if you are asked to send $10 or $20 or $50. But hey, if some drunken cop wrecks and get's suspended, "he's a good guy." Right? Just don't spend any of your martini money on something like a law firm that's been the only one's fighting for restoration of our retiree health insurance.
